Pasal 1
Dalam Undang-Undang ini yang dimaksud dengan :
Article 1
In this Law what is meant by :

78. Ketentuan Pasal l04 diubah sehingga berbunyi sebagai berikut :

Pasal 104

(1) Pemegang IUP atau IUPK pada tahap kegiatan Operasi Produksi sebagaimana dimaksud dalam Pasal 103 dapat melakukan Pengolahan dan/atau Pemurnian sendiri secara terintegrasi atau bekerja sama dengan :

a. pemegang IUP atau IUPK lain pada tahap kegiatan Operasi Produksi yang memiliki fasilitas Pengolahan dan/atau Pemurnian secara terintegrasi; atau

b. pihak lain yang melakukan kegiatan usaha Pengolahan dan/atau Pemurnian yang tidak terintegrasi dengan kegiatan Penambangan yang perizinannya diterbitkan berdasarkan ketentuan peraturan perundang-undangan di bidang perindustrian.

(2) Pemegang IUP atau IUPK pada tahap kegiatan Operasi Produksi sebagaimana dimaksud dalam Pasal 103 dapat melakukan kerjasama Pengembangan dan/atau Pemanfaatan Batubara dengan pemegang IUP atau IUPK lain pada tahap kegiatan Operasi Produksi, atau pihak lain yang melakukan kegiatan Pengembangan dan/atau Pemanfaatan Batubara.

78. The provisions of Article l04 are amended to read as follows:

Article 104

(1) Holders of IUP or IUPK at the Production Operation activity stage as intended in Article 103 can carry out Processing and/or Refining themselves in an integrated manner or in collaboration with:

a. holders of IUP or other IUPK at the Production Operation activity stage who have integrated Processing and/or Refining facilities; or

b. other parties carrying out Processing and/or Refining business activities that are not integrated with Mining activities whose permits are issued based on the provisions of laws and regulations in the industrial sector.

(2) Holders of IUP or IUPK at the Production Operation activity stage as intended in Article 103 can collaborate on Coal Development and/or Utilization with other IUP or IUPK holders at the Production Operation activity stage, or other parties carrying out Coal Development and/or Utilization activities.
