CONTENTS :

Setiap kita (insya Allah) akan menuju suatu perjanjian besar yang merupakan Sunnah Nabi yang tentu kita tidak akan melakukannya dengan main-main, karena hal ini, sebagian besar orang merupakan sesuatu yang hanya ingin dilakukannya sekali seumur hidup, masih banyak alibi yang membuat kita harus menyiapkan segala sesuatunya dengan baik.

Every one of us (God willing) will go to a great agreement which is the Sunnah of the Prophet, which of course we will not do it playfully, because of this, most people are something that he only wants to do once in a lifetime, there are still many alibis that make us prepare everything well.

Sebelum masyarakat di desa mengambil keputusan itu, umumnya muda-mudi yang ada di suatu masyarakat desa harus mempersiapkan 4 (empat) hal,

1.  Kesiapan pemikiran.

1. Readiness for thinking.

Kesiapan pemikiran ini mencakup 3 (tiga) hal,

This readiness of thinking includes 3 (three) things,

1.1.    Orang yang mempunyai kematangan visi Keislaman, berarti memiliki dasar-dasar pemikiran yang jelas tentang identitas idiologinya.

1.1.  People who have the maturity of the Islamic vision mean that they have a clear basis for their ideological identity.

Ketika seorang muslim ingin menikah, ia harus mengetahui dulu bahwa ia muslim, namun di atas itu ia juga harus mengetahui mengapa ia menjadi muslim, sehingga ia mampu dihadapkan kepada berbagai pilihan dalam kehidupan riil.

When a Muslim wants to get married, he must know first that he is Muslim, but above that he must also know why he is Muslim, so he is able to be faced with various choices in real life.

Masalah pernikahan bukan perkara yang sulit (karena Islam sendiri sudah memudahkan masalah ini) tetapi bukan pula masalah yang sembarangan, di sini lah visi kematangan Keislaman. Karena setelah akad nikah terlewati akan ada status qowum (pemimpin) yang menempel pada diri seorang suami dan status bunda pada diri seorang isteri yang di situ memerlukan kematangan visi Keislaman, yang pada nantinya akan terlihat peran qowum dalam pemimpin bahtera rumah tangga, mau dibawa ke mana isteri dan anaknya, dan akan ada peran bunda sebagai ustadzah pertama bagi anak-anaknya. Siapkan seorang qowum dan seorang bunda akan pengetahuan Islam, pengetahuan tentang pernikahan (sebelum dan sesudah akad nikah ditunaikan), pengetahuan tentang tauhid, akhlak, dan sebagainya yang nantinya akan diajarkan kepada jundi-jundi (ksatria-ksatria) kecilnya, pengetahuan akan hukum Islam, etika Islam, dan masih banyak lagi.

The issue of marriage is not a difficult matter (because Islam itself has facilitated this problem) but it is also not an arbitrary problem, here is the vision of Islamic maturity. Because after the marriage contract is over there will be status of a qowum (leader) attached to a husband's self and a mother's status in a wife that requires the maturity of the Islamic vision, which will later see the role of qowum in the leader of the household ark, where to take his wife and children, and there will be the role of mother as the first ustadzah for her children. Prepare a qowum and a mother of Islamic knowledge, knowledge of marriage (before and after the marriage contract is fulfilled), knowledge of monotheism, morals, etc. which will be taught to the small knights, knowledge of Islamic law, Islamic ethics, and still much more.

Akad nikah merupakan lonceng berdirinya sebuah madrasah, akad nikah berlangsung bersamaan dengan pengguntingan pita tanda dibukanya sebuah madrasah baru, bersamaan pula dengan dilantiknya sepasang ustad dan ustadzah yang diwajibkan untuk siap mendidik jundi-jundi (ksatria-ksatria) kecil yang nanti akan meramaikan madrasah itu. Sepasang ustad dan ustadzah yang bersatu dalam ikatan suci ini nanti akan mengajarkan banyak hal kepada jundi-jundi kecilnya dan sekaligus memberikan pelajaran – pembelajaran yang akan mendewasakan keduanya, begitulah waktu bergulir, akankah menjadi sebuah madrasah yang buruk bahkan ambruk tergantung sematang apa visi Keislaman yang ia punya.

The marriage contract constitutes the bell of the establishment of a madrasa, the marriage ceremony takes place in conjunction with the cutting of the ribbon marking the opening of a new madrasa, along with the inauguration of a pair of clerics who are obliged to be ready to educate small knights who will enliven the madrasa. 1.2.    Kematangan visi kepribadian.

2 (dua) hambatan besar dalam hubungan dengan orang lain yaitu bila kita tidak memahami orang lain dengan benar dan bila kita tidak mampu memahami diri kita sendiri dengan benar. Seseorang yang mempunyai konsep diri yang jelas, artinya ia mengetahui kepribadian dirinya sendiri dengan baik, orang seperti ini akan mampu memahami dirinya sendiri dengan baik, sehingga akan melahirkan penerimaan diri yang baik.

2 (two) major obstacles in relationships with other people, that is if we do not understand others properly and if we are not able to understand ourselves correctly. Someone who has a clear self-concept, meaning he knows his own personality well, people like this will be able to understand himself well, so that it will give birth to good self-acceptance.

Ketika seseorang mampu menerima dirinya dengan baik, setelah menikah pada umumnya ia juga akan mampu menerima pasangannya dengan baik.

When someone is able to accept himself well, after marriage in general he will also be able to accept his partner well.

1.3.    Kematangan visi pekerjaan.

Poin ini lebih khusus ditujukan untuk calon suami, seorang ikhwan ketika memutuskan untuk menikah, maka ia harus mempunyai perencanaan yang matang tentang bagaimana ia nanti akan menghidupi anak dan isterinya, artinya ia mempunyai visi yang jelas tentang pekerjaan yang akan dilakoninya kelak.

This point is more specifically intended for prospective husbands, a brother when deciding to get married, then he must have careful planning on how he will support his child and wife, meaning he has a clear vision of the work he will do later.

2.  Kesiapan psikologis.

2. Psychological readiness.

Ketika seseorang berumah tangga, tanggung jawab (sebagai seorang qowum atau seorang bunda) akan memberikan beban sebagai psikologis. Orang yang tidak sanggup menerima beban tidak akan kuat menghadapi berbagai tantangan besar dalam hidup.

When someone is married, the responsibility (as a qowum or a mother) will give a psychological burden. People who are not able to accept the burden will not be strong in facing various major challenges in life.

Kesiapan psikologis adalah kematangan tertentu secara psikis untuk menghadapai berbagai tantangan besar dalam hidup. Orang yang tidak matang secara psikologis akan menyebabkan banyak sekali masalah dalam keluarga ketika memasuki perkawinan.

Psychological readiness is a certain maturity psychologically to face various major challenges in life. People who are not psychologically mature will cause a lot of problems in the family when entering marriage.

3.  Kesiapan fisik.

3. Physical readiness.

Apakah fisiknya sudah siap untuk menikah, kita harus meyakini, bahwa fisik kita sudah siap untuk menikah, itulah sebabnya menikah terlalu dini juga tidak terlalu bagus.

4.  Kesiapan finansial.

Yang ada dalam perkawinan bukan hanya cinta, aspek ekonomi juga sangat terlibat, walaupun tidak berarti ketika seorang ikhwan ingin menikah maka ia harus menjadi ikhwan yang berkpribadian.

L. Bander O. P (1948 : 11), “filsafat-filsafat atau filsafat hukum adalah ilmu yang merupakan bagian dari filsafat (de rechtsphilosophie of wijsbegeerte van het recht is een wetenschap, die deel uitmaakt van de philosophie)”. Purnadi Purbacaraka dan Soerjono Soekanto (1979:11) mengatakan “filsafat hukum adalah perenungan dan perumusan nilai-nilai, kecuali itu filsafat hukum juga mencakup penyerasian nilai-nilai, misalnya penyerasian antara ketertiban dan ketenteraman, antara kebendaan dengan keakhlakan, dan antara kelanggengan/konservatisme dengan pembaharuan”. Menurut Mahadi (1989 : 10), “falsafah hukum ialah falsafah tentang hukum, falsafah tentang segala sesuatu di bidang hukum secara mendalam sampai ke akar-akarnya secara sistematis”. Soedjono Dirdjosisworo mengemukakan (1984 : 48), “falsafah hukum adalah pendirian atau penghayatan  kefilsafatan yang dianut orang atau masyarakat atau negara tentang hakikat ciri-ciri serta landasan berlakunya hukum”. Van Apeldron (1975) menguraikan sebagai berikut, ““filsafat hukum menghendaki jawaban atas pertanyaan, “apakah hukum ?”, ia menghendaki agar kita berpikir masak-masak tentang tanggapan kita dan bertanya pada diri sendiri, apa yang sebenarnya kita tanggap tentang hukum””. (Rasjidi, Uli, Prof., DR., SH, Drs., LLM, (1993), “Dasar-Dasar Filsafat Hukum” hal. 1 s.d. 3).

Soetiksno (1976: 10) formulates "the philosophy of law seeking nature rather than law,  which investigates the rule of law as a consideration of values. L. Bander O. P (1948: 11), " philosophy or philosophy of law is a science that is part of philosophy (de rechtsphilosophie of wijsbegeerte van het recht is een wetenschap, die deel uitmaakt van de philosophie)". Purnadi Purbacaraka and Soerjono Soekanto (1979: 11) say "philosophy of law is contemplation and formulation of values, except that the philosophy of law also includes harmonizing values, for example the harmony between order and tranquility, between materiality and virtue, and between permanence/conservatism with renewal”. According to Mahadi (1989: 10), "the philosophy of law is the philosophy of law, the philosophy of everything in the field of law in depth to the roots systematically". Soedjono Dirdjosisworo argued (1984: 48), "the philosophy of law is the establishment or philosophy of philosophy adopted by a person or society or country about the nature of the characteristics and basis of the application of the law". Van Apeldron (1975) describes as follows, ""the philosophy of law requires an answer to the question, "what is the law?", He wants us to think carefully about our responses and ask ourselves, what we really respond to the law"" . Hal ini maternya terlalu filosofis, abstrak dan hipotesis sehingga kurang dapat digunakan untuk memecahkan masalah praktis yang justru menjadi tujuan pendidikan Starata Satu dalam menghasilkan para pakar hukum profesional. Diberikannya mata kuliah filsafat hukum dengan materi tersebut di atas kurang mendukung sifat profesionalisme itu tadi. Mochtar Kusumaatmadja mengusulkan agar mata kuliah filsafat hukum dipindahkan ke Strata Dua (S-2) dan Strata Tiga (S-3) yang merupakan jenjang pendidikan akademis hukum. Pandangan ini ditentang  oleh beberapa pakar filsafat hukum yang menganggap bahwa mata kuliah filsafat hukum masih perlu diberikan di peringkat  Strata Satu. Landasan teoritis perlu diberikan sebagai bekal bagi para pakar hukum profesional dalam menjalankan pekerjaannya sehari-hari di masyarakat sebab bagaimana pun pengertian semacam keadilan, ketertiban, dan masalah-masalah hukum yang mendasar lainnya sangat penting di dalam memahami masalah-masalah hukum yang dihadapi dalam pekerjaannya tadi. This matter is too philosophical, abstract and hypothetical so that it cannot be used to solve practical problems which actually become the goal of Starata One education in producing professional legal experts. The provision of legal philosophy courses with the material mentioned above does not support the nature of that professionalism. Mochtar Kusumaatmadja proposed that the law philosophy subject be transferred to Strata Dua (S-2) and Strata Tiga (S-3) which are the levels of legal academic education. This view is opposed by several legal philosophers who consider that the law philosophy course still needs to be given a Strata One rank. The theoretical foundation needs to be given as a provision for professional legal experts in carrying out their daily work in the community because no matter what the understanding of justice, order and other fundamental legal issues is very important in understanding the legal problems faced in the work .
