memahami Syarat Umum Surat Perintah Kerja (SPK) yang meliputi 1. lingkup
pekerjaan berupa yang ditunjuk berkewajiban untuk menyelesaikan pekerjaan dalam
jangka waktu yang ditentukan, sesuai dengan volume,
spesifikasi teknis, dan harga yang tercantum dalam Surat Perintah Kerja (SPK);
2. hukum yang berlaku, keabsahan, interpretasi, dan pelaksanaan Surat Perintah
Kerja (SPK) didasarkan kepada hukum Republik Indonesia; 3. Harga Surat Perintah
Kerja (SPK) meliputi 3.1. PPK (Pejabat Pembuat Komitmen) membayar kepada
penyedia atas pelaksanaan pekerjaan dalam Surat Perintah Kerja (SPK) sebesar
harga Surat Perintah Kerja (SPK), 3.2. harga Surat Perintah Kerja (SPK) telah
memperhitungkan keuntungan, beban pajak dan biaya overhead serta harga biaya asuransi, dan 3.3. rincian harga Surat
Perintah Kerja (SPK) sesuai dengan rincian yang tercantum dalam dalam kuantitas
dan harga; 4. hak kepemilikan berupa 4.1. PPK (Pejabat Pembuat Komitmen) berhak
atas semua konstruksi/bahan yang terkait langsung atau disediakan sehubungan
dengan jasa yang diberikan oleh penyedia kepada PPK (Pejabat Pembuat Komitmen).
Jika diminta oleh PPK (Pejabat Pembuat Komitmen) maka penyedia berkewajiban
untuk membantu secara optimal
pengalihan hak kepemilikan tersebut kepada PPK (Pejabat Pembuat Komitmen)
sesuai dengan hukum yang berlaku dan 4.2. hak kepemilikan atas peralatan dan
konstruksi/bahan yang disediakan oleh PPK (Pejabat Pembuat Komitmen) tetap pada
PPK (Pejabat Pembuat Komitmen), dan semua peralatan tersebut harus dikembalikan
kepada PPK (Pejabat Pembuat Komitmen) pada saat SPK (Surat Perintah Kerja)
berakhir atau jika tidak diperlukan lagi oleh penyedia. Semua peralatan
tersebut harus dikembalikan dalam kondisi yang sama pada saat diberikan kepada
penyedia dengan pengecualian keausan akibat pemakaian yang wajar.

Foundation to recommend to the
Department of Library and Information Sciences, The Faculty of Adab and
Humanities, Department of Information and Library Sciences, FIKOM (Faculty of
Communication Sciences); The Department of Civil Engineering, The Faculty of Civil
and Environmental Engineering of MU (Mandailing University) to update by
understanding the General Terms of Work Order which includes 1. the scope of
work in the form of the appointed is obliged to complete the work within the
specified time period, in accordance with the volume, technical specifications,
and prices listed in the Work Order; 2. applicable law, validity,
interpretation and implementation of Work Orders are based on the laws of the
Republic of Indonesia; 3. The price of the Work Order includes 3.1. The
Commitment Maker Official pays to the provider for the execution of work in the
Work Order equal to the price of the Work Order, 3.2. the price of the Work Order
has taken into account profits, tax expenses and overhead costs as well as the
price of insurance costs, and 3.3. details of the price of the Work Order in
accordance with the details listed in the quantity and price; 4. ownership rights
in the form of 4.1. The Commitment Maker Official has the right to all
construction/materials related directly or provided in connection with the
services provided by the provider to the Commitment Maker Officer. If requested
by the Commitment Maker Official the provider is obliged to optimally assist
the transfer of ownership rights to the Commitment Maker Officer in accordance
with applicable law and 4.2. ownership rights to equipment and construction/materials
provided by the Commitment Maker Official remain with the Commitment Maker
Officer, and all equipment must be returned to the Commitment Maker Officer
when the Work Order expires or if no longer needed by the provider. All
equipment must be returned in the same condition when given to the provider
with the exception of wear due to reasonable use.

memahami Syarat Umum Surat Perintah Kerja (SPK) yang meliputi 1. cacat mutu, PPK
(Pejabat Pembuat Komitmen) akan memeriksa setiap hasil pekerjaan penyedia dan
memberitahukan penyedia secara tertulis atau setiap cacat mutu yang ditemukan.
PPK (Pejabat Pembuat Komitmen) dapat memerintahkan penyedia untuk menemukan dan
mengungkapkan cacat mutu, serta menguji pekerjaan yang dianggap oleh PPK
(Pejabat Pembuat Komitmen) mengandung cacat mutu. Penyedia bertanggung jawab
atas cacat mutu selama 6 (enam) bulan setelah serah terima hasil pekerjaan. 2.
Perpajakan, penyedia berkewajiban untuk membayar semua pajak, bea, retribusi,
dan pungutan lain yang dibebankan oleh hukum yang berlaku atas pelaksanaan
Surat Perintah Kerja (SPK). Semua pengeluaran perpajakan ini dianggap telah
termasuk dalam harga Surat Perintah Kerja (SPK). 3. Pengalihan dan/atau
subkontrak, penyedia dilarang mengalihkan dan/atau mensubkontrakkan sebagian
atau seluruh pekerjaan. Pengalihan seluruh pekerjaan hanya diperbolehkan dalam
hal pergantian nama penyedia, baik sebagai akibat peleburan (merger) atau
akibat lainnya. 4. Jadwal meliputi 4.1. Surat Perintah Kerja (SPK) berlaku
efektif pada tanggal penandatanganan oleh para pihak atau pada tanggal yang
ditetapkan oleh SPMK (Surat Perintah Mulai Kerja). 4.2. waktu pelaksanaan Surat
Perintah Kerja (SPK) adalah sejak tanggal mulai kerja yang tercantum dalam SPMK
(Surat Perintah Mulai Kerja). 4.3. penyedia harus menyelesaikan pekerjaan
sesuai jadwal yang ditentukan. Dan, 4.3. apabila penyedia berpendapat tidak
dapat menyelesaikan pekerjaan sesuai jadwal karena keadaan di luar
pengendaliannya dan penyedia telah melaporkan kejadian tersebut kepada PPK
(Pejabat Pembuat Komitmen), maka PPK (Pejabat Pembuat Komitmen) dapat
menjadwalkan kembali pelaksanaan tugas penyedia dengan adendum Surat Perintah
Kerja (SPK).
The Head of The Centre of Development for Policy and
Strategy of The Neighborhood Leadership Assembly of The Great Mandailing
Foundation to recommend to the
Department of Library and Information Sciences, The Faculty of Adab and
Humanities, Department of Information and Library Sciences, FIKOM (Faculty of
Communication Sciences); The Department of Civil Engineering, The Faculty of Civil
and Environmental Engineering of MU (Mandailing University) to update by
understanding the General Terms of Work Order which includes 1. quality
defects, The Commitment Maker Official will check every work of the provider
and notify the provider in writing or any quality defects found. The Commitment
Maker Official can instruct providers to find and disclose quality defects, and
test jobs deemed by the The Commitment Maker Official to contain quality
defects. The Provider is responsible for quality defects for 6 (six) months
after the handover of the work results. 2. Taxation, the provider is obliged to
pay all taxes, duties, levies, and other levies imposed by the applicable law
on the implementation of the Work Order. All of these tax expenditures are
considered to be included in the price of the Work Order. 3. Transfer and/or
subcontracting, the provider is prohibited from transferring and/or
subcontracting part or all of the work. The transfer of all jobs is only permitted
in the event of changing the name of the provider, either as a result of a
merger or other consequence. 4. Schedules include 4.1. The Work Order is
effective on the date of signature by the parties or on the date specified by Starting
Work Order. 4.2. the time for the execution of the Work Order is from the start
date of the work stated in Starting Work Order. 4.3. Providers must complete
the work according to the schedule. And, 4.3. if the provider is of the opinion
that it cannot complete the work according to the schedule due to its
out-of-control circumstances and the provider has reported the incident to The
Commitment Maker Official, The Commitment Maker Official can reschedule the
implementation of the provider's duties with an Addendum to Work Order.

memahami Syarat Umum Surat Perintah Kerja (SPK) yang meliputi 1. Asuransi yaitu
1.1. penyedia wajib menyediakan asuransi sejak SPMK (Surat Perintah Mulai
Kerja) sampai dengan tanggal selesainya pemeliharaan untuk 1.1.1. semua barang
dan peralatan yang mempunyai risiko tinggi terjadinya kecelakaan, pelaksanaan
pekerjaan, serta pekerja untuk pelaksanaan pekerjaan, atas segala risiko
terhadap kecelakaan, kerusakan, kehilangan, serta risiko lain yang tidak dapat
diduga, 1.1.2. pihak ketiga sebagai akibat kecelakaan di tempat kerjanya, dan
1.1.3. perlindungan terhadap kegagalan bangunan. Dan 2. Besarnya asuransi sudah
diperhitungkan dalam penawaraaan dan termasuk dalam Surat Perintah Kerja (SPK).
3. Penanggungan dan risiko meliputi 3.1. penyedia berkewajiban untuk
melindungi, membebaskan, dan menanggung tanpa batas PPK (Pejabat Pembuat
Komitmen) beserta instansinya terhadap semua bentuk tuntutan, tanggung jawab,
kewajiban, kehilangan, kerugian, denda, gugatan atau tuntutan hukum, proses
pemeriksaan hukum, dan biaya yang dikenakan terhadap PPK (Pejabat Pembuat
Komitmen) beserta instansinya {kecuali kerugian yang mendasari tuntutan
tersebut disebabkan kesalahan atau kelalaian berat PPK (Pejabat Pembuat
Komitmen)} sehubungan dengan klaim yang timbul dari hal-hal berikut terhitung
sejak Tanggal Mulai Kerja sampai dengan tanggal penandatanganan berita acara
penyerahan akhir yang meliputi 3.1.1. kehilangan atau kerusakan peralatan dan
harta benda penyedia dan personil, 3.1.2. cidera tubuh, sakit, atau kematian
personil, dan 3.1.3. kehilangan atau kerusakan harta benda, dan cidera tubuh,
sakit atau kematian peihak ketiga; 2. Terhitung sejak Tanggal Mulai Kerja
sampai dengan tanggal penandatanganan berita acara penyerahan awal atau
kerusakan Hasil Pekerjaan, bahan dan perlengkapan merupakan risiko penyedia,
kecuali kerugian atau kerusakan tersebut diakibatkan oleh kesalahan atau
kelalaian PPK (Pejabat Pembuat Komitmen); 3. Pertanggungan asuransi yang
dimiliki oleh penyedia tidak membatasi kewajiban penanggungan dalam syarat ini.
Dan 4. Kehilangan atau kerusakan terhadap hasil pekerjaan atau bahan yang
menyatu dengan hasil pekerjaan selama tanggal mulai kerja dan batas akhir masa
pemeliharaan harus diganti atau diperbaiki oleh penyedia atas tanggungannya
sendiri jika kehilangan atau kerusakan tersebut terjadi akibat tindakan atau
kelalaian penyedia.

namely 1.1. The provider is obliged to provide insurance since Order to Start
Work until the completion date of maintenance for 1.1.1. all goods and
equipment that have a high risk of accidents, execution of work, and workers
for the execution of work, for all risks to accidents, damage, loss, and other
unpredictable risks, 1.1.2. third parties as a result of accidents at work, and
1.1.3. protection against building failure. And 2. The amount of insurance has
been calculated in the offering and included in the Work Order. 3. Coverage and
risk include 3.1. the provider is obliged to protect, free, and bear without
limitation The Commitment Maker Official and its institution against all forms
of claims, responsibilities, obligations, losses, fines, claims or lawsuits,
legal examination process, and fees charged to The Commitment Maker Official
along with its institution {unless the loss underlying the claim is due to an
error or gross negligence of The Commitment Maker Official} in connection with
claims arising from the following matters starting from the Work Start Date
until the signing date of the final submission covering 3.1.1 loss or damage to
equipment and property of providers and personnel, 3.1.2 bodily injury, illness
or death of personnel, and 3.1.3 loss or damage to property, and bodily injury,
illness or death of third parties; 2. Starting from the date of commencement of
work up to the date of signing the minutes of the initial submission or damage
to the Product Work, materials and equipment constitute the risk of the
provider, unless the loss or damage is caused by the mistake or negligence of The
Commitment Maker Official; 3. Insurance coverage owned by the provider does not
limit the liability under this condition. And 4. Loss or damage to the results
of work or materials that merge with the results of the work during the work
start date and the deadline for maintenance must be replaced or repaired by the
provider at its own expense if the loss or damage arises due to the provider's
actions or omissions.

pemeriksaan, PPK (Pejabat Pembuat Komitmen) berwenang melakukan pengawasan dan
pemeriksaan terhadap pelaksanaan pekerjaan yang dilaksanakan oleh penyedia.
Apabila diperlukan, PPK (Pejabat Pembuat Komitmen) dapat memerintahkan kepada
pihak ketiga untuk melakukan pengawasan dan pemeriksaan atas semua pelaksanaan
pekerjaan yang dilaksanakan oleh penyedia. Dan 2. Pengujian, jika PPK (Pejabat
Pembuat Komitmen) atau pengawas pekerjaan memerintahkan penyedia untuk
melakukan pengujian cacat mutu yang tidak tercantum dalam spesifikasi teknis
dan gambar, dan hasil uji coba menunjukkan adanya cacat mutu maka penyedia
berkewajiban untuk menanggung biaya pengujian tersebut. Jika tidak ditemukan
adanya cacat mutu maka uji coba tersebut dianggap sebagai peristiwa kompensasi.
Untuk setiap jenis pengujian yang dipersyaratkan dalam program mutu, penyedia berkewajiban untuk melampirkan hasil uji
dari instansi atau lembaga yang memiliki sertifikasi mengeluarkan hasil
pengujian tersebut.

Department of Library and Information Sciences, The Faculty of Adab and
Humanities, Department of Information and Library Sciences, FIKOM (Faculty of

and Environmental Engineering of MU (Mandailing University) to update by
understanding the General Terms of Work Order which includes 1. Supervision and
examination, The Commitment Maker Official has the authority to supervise and
examine the execution of work implemented by the provider. If necessary, The
Commitment Maker Official can order third parties to conduct supervision and
inspection of all work carried out by the provider. And 2. Testing, if The
Commitment Maker Official or the work supervisor instructs the provider to carry
out a quality defect test that is not listed in the technical specifications
and drawings, and the results of the trial indicate a defect in quality, the
provider is obliged to bear the cost of the test. If there is no quality
defect, the trial is considered a compensation event. For each type of test
required in the quality program, the provider is obliged to attach the test
results from the agency or institution that has the certification to issue the
results of the test.
