barang adalah setiap benda baik berwujud maupun tidak berwujud, bergerak maupun
tidak bergerak, yang dapat diperdagangkan, dipergunakan, atau dimanfaatkan oleh
pengguna barang, pengadaan barang meliputi, namun tidak terbatas pada 3.1.1.
bahan baku, 3.1.2. barang setengah jadi, 3.1.3. barang jadi/peralatan, dan
3.1.4. makhluk hidup dan 3.2. pekerjaan konstruksi yaitu seluruh pekerjaan yang
berhubungan dengan pelaksanaan konstruksi bangunan dan pembuatan wujud fisik
lainnya, yang dimaksud dengan pelaksanaan konstruksi bangunan, meliputi
keseluruhan atau sebahagian rangkaian kegiatan pelaksanaan yang mencakup
pekerjaan arsitektural, sipil, mekanikal, elektrikal, dan tata lingkungan,
masing-masing beserta kelengkapannya untuk mewujudkan suatu bangunan, yang

menteri dengan pelimpahan wewenang berupa pengawasan kepada pemegang IUP (Izin
Usaha Pertambangan), IPR (Izin Pertambangan Rakyat) atau IUPK (Izin Usaha Pertambangan
Khusus), dimana Menteri, Gubernur, dan Bupati/Walikota sesuai dengan
kewenangannya melakukan pengawasan atas pelaksanaan kegiatan usaha pertambangan
yang dilakukan oleh pemegang IUP (Izin Usaha Pertambangan), IPR (Izin
Pertambangan Rakyat) atau IUPK (Izin Usaha Pertambangan Khusus), pengawasan
meliputi pengawasan administratif dan pengawasan operasional; 2. (ayat 1)
pengawasan sebagaimana dimaksud dalam Pasal 140 UU (Undang – Undang) Nomor 04
Tahun 2009 antara lain berupa 2.1. teknis pertambangan, 2.2. pemasaran, 2.3.
keuangan, 2.4. pengolahan data mineral dan batubara, 2.5. keselamatan dan
kesehatan kerja pertambangan, 2.6. keselamatan operasi pertambangan, 2.7.
pengelolaan lingkungan hidup, reklamasi, dan pascatambang, 2.8. pemanfaatan
barang, jasa, teknologi, dan kemampuan rekayasa dan rancang bangun dalam
negeri, 2.9. pengembangan tenaga teknis pertambangan, 2.10. pengembangan dan
pemberdayaan masyarakat setempat, 2.11. penguasaan, pengembangan, dan penerapan
teknologi pertambangan, 2.12. kegiatan-kegiatan lain di bidang kegiatan usaha
pertambangan yang menyangkut kepentingan umum, 2.13. pengelolaan IUP (Izin
Usaha Pertambangan) dan IUPK (Izin Usaha Pertambangan Khusus), dan 2.14.
jumlah, jenis, dan mutu hasil usaha pertambangan; dan 3. (ayat 2) sebagaimana
dimaksud dalam Pasal 140 UU (Undang – Undang) Nomor 04 Tahun 2009 pengawasan
sebagaimana dimaksud pada ayat (1) huruf a, huruf e, huruf f, huruf g, huruf h,
dan huruf l dilakukan oleh Inspektur Tambang sesuai dengan ketentuan peraturan
perundang-undangan.

University) to update by understanding the Occupational Health Inspection which
includes 1. Mining Supervision based on Law Number 04 of 2009 Article 140 and Government
Regulation Number 55 of 2010 in the form of ministerial supervision with
delegation of authority in the form of supervision to holders of Mining Business
Permits, People's Mining Permit or Special Mining Business License, where the
Minister, Governor, and Regent / Mayor in accordance with their authority to
supervise the implementation of mining business activities carried out by holders
of Mining Business Permits, People's Mining Permit or Special Mining Business
License, monitoring includes administrative supervision and operational
supervision; 2. (paragraph 1) supervision as referred to in Article 140 of Law
(Law) Number 04 of 2009 includes 2.1. technical mining, 2.2. marketing, 2.3.
finance, 2.4. processing of mineral and coal data, 2.5. mining work safety and
health, 2.6. mining operation safety, 2.7. environmental management,
reclamation and post-mining, 2.8. utilization of domestic goods, services,
technology and engineering and design capabilities, 2.9. development of mining
technical personnel, 2.10. development and empowerment of local communities,
2.11. mastery, development and application of mining technology, 2.12. other
activities in the field of mining business activities that concern the public
interest, 2.13. management of Mining Business Permit and Special Mining
Business Permit, and 2.14. the amount, type and quality of mining business
results; and 3. (paragraph 2) as referred to in Article 140 of the Act (Law)
Number 04 of 2009 supervision as referred to in paragraph (1) letter a, letter
e, letter f, letter g, letter h, and letter l is carried out by Mining
Inspectors in accordance with the provisions of the legislation.

lain-lain {Organisasi Buruh Internasional, OBI (ILO, International Labour Organization) Tahun 1999}; 3. fenomena ‘gunung
es’ penyakit akibat kerja dilaporkan dan tidak dilaporkan {PAK (Penyakit Akibat
Kerja), berobat tidak dilaporkan, ada gejala tidak berobat, dan terkena tanpa
gejala}; dan 3. Kepmen (Keputusan Menteri) Pertambangan dan Energi Republik Indonesia
Nomor 555.K/26/M.PE/1995 tanggal 22 Mei 1995 tentang Keselamatan dan Kesehatan
Kerja pada Pertambangan Umum meliputi Bagian Kesebelas, Kesehatan meliputi 3.1.
Pasal 48 Ruang Ganti Pakaian yaitu 3.1.1. ayat (1) pada bagian pekerjaan
tertentu, berdasarkan pertimbangan kesehatan, pekerja tambang harus mengganti
pakaian kerjanya dan membersihkan badan sebelum meninggalkan tempat kerjanya
dan 3.1.2. sebagai pelaksanaan dari ketentuan sebagaimana dimaksud dalam ayat
(1) pengusaha / KTT (Kepala Teknik Tambang) harus menyediakan ruang ganti
pakaian dan tempat membersihkan badan yang selalu dijaga kebersihannya, 3.2.
pasal 49 penyediaan air yaitu 3.2.1. ayat (1) air yang disediakan untuk mencuci
dan membersihkan badan harus dalam keadaan bersih dan air bekas dipakai
disalurkan/dibuang ke sarana pembuangan, 3.2.2. ayat (2) air minum yang
memenuhi persyaratan kesehatan harus selalu tersedia secara cuma-cuma dalam
jumlah yang cukup bagi pekerja tambang selama jam kerja, dan 3.2.3. ayat (3)
tempat air minum harus selalu bersih dan dilengkapi dengan penutup yang baik
dan dapat menutup secara otomatis, 3.3. pasal 50 jamban yaitu sarana jamban
harus disediakan di tambang yang dibuat sedemikian rupa sehingga memenuhi
persyaratan kesehatan, dan 3.4. pasal 51 minuman beralkohol berisi 3.4.1. ayat
(1) dilarang meminum minuman beralkohol atau yang memabukkan selama bekerja dan
3.4.2. ayat (2) pekerja tambang yang berada di bawah pengaruh alkohol dilarang
bekerja.

certain parts of work, based on health considerations, mine workers must change
their work clothes and clean the body before leaving their workplace and 3.1.2.
as the implementation of the provisions referred to in paragraph (1) the
entrepreneur / The Head of Mining Engineering must provide a dressing room and
a place to clean the body which is always kept clean, 3.2. article 49 water
supply, namely 3.2.1. paragraph (1) the water provided for washing and cleaning
the body must be clean and used water is discharged into disposal facilities, 3.2.2.
paragraph (2) drinking water that meets health requirements must always be
available free of charge in sufficient quantities for mine workers during
working hours, and 3.2.3. paragraph (3) the place of drinking water must always
be clean and equipped with a good cover and can close automatically, 3.3. article
50 latrines, namely latrine facilities must be provided in mines that are made
in such a way that they meet health requirements, and 3.4. article 51 drinks
contain alcoholic 3.4.1. paragraph (1) is prohibited from drinking alcoholic or
intoxicating drinks during work and 3.4.2. paragraph (2) mine workers who are
under the influence of alcohol are prohibited from working.
