Pasal 9

Article 9

 

Menyimpang dari ketentuan-ketentuan dalam pasal 4, maka dengan Undang-undang ditentukan bahan-bahan galian yang harus diusahakan semata-mata oleh Negara dan cara melaksanakan usaha tersebut.

Notwithstanding the provisions of Article 4, the minerals that must be exploited exclusively by the State, and the manner of such exploitation, shall be determined by law.

CHAPTER III

FORM AND ORGANIZATION OF MINING COMPANIES

 

Pasal 8

Article 8

 

(2) Sebelum memberikan kuasa seperti yang dimaksud dalam ayat (1) pasal ini haruslah didengar lebih dahulu pendapat dari suatu Dewan Penasehat Pertambangan yang pembentukan dan penentuan susunannya akan diatur dengan Peraturan Pemerintah.

(3) Dalam memberikan sesuatu kuasa pertambangan tersebut dalam ayat (1) pasal ini, pengutamaan diberikan kepada koperasi.

 (2) Prior to granting the authorization referred to in paragraph (1) of this Article, the opinion of a Mining Advisory Council—the establishment and composition of which shall be regulated by Government Regulation—must first be sought.

(3) In granting any mining authorization referred to in paragraph (1) of this Article, priority shall be given to cooperatives.

Pasal 8

Article 8

 

(1) Pelaksanaan pertambangan bahan-bahan galian yang tersebut dalam pasal 3 ayat (1) huruf b dapat dikuasakan kepada pihak swasta;

A. badan hukum yang:

1. didirikan sesuai dengan peraturan-peraturan Republik Indonesia, bertempat kedudukan di Indonesia dan bertujuan berusaha dalam lapangan pertambangan;

2. pengurusnya mempunyai kewarga-negaraan Indonesia dan bertempat tinggal di Indonesia;

B. perseorangan yang berkewarga-negaraan Indonesia dan bertempat tinggal di Indonesia.

 (1) The conduct of mining operations for the minerals referred to in Article 3, paragraph (1), letter b may be authorized to private parties, namely:

A. legal entities that:

1. are established in accordance with the regulations of the Republic of Indonesia, are domiciled in Indonesia, and have the objective of engaging in mining activities;

2. have management personnel who hold Indonesian citizenship and reside in Indonesia;

B. individuals who hold Indonesian citizenship and reside in Indonesia.
