STANDAR KEGIATAN USAHA PADA PENYELENGGARAAN PERIZINAN BERUSAHA BERBASIS RISIKO SEKTOR ENERGI DAN SUMBER DAYA MINERAL

CONCERNING

STANDARDS FOR BUSINESS ACTIVITIES IN THE IMPLEMENTATION OF RISK-BASED BUSINESS LICENSING IN THE ENERGY AND MINERAL RESOURCES SECTOR

BAB III

PENGAWASAN

CHAPTER III

SUPERVISION

 

Pasal 6

Pengawasan terhadap PB dan/atau PB UMKU sektor energi dan sumber daya mineral dilaksanakan sesuai dengan ketentuan peraturan perundang-undangan.

Article 6

Supervision of Business Permits and/or Business Permits to Support Business Activities in the energy and mineral resources sector is carried out in accordance with statutory provisions.

 

BAB IV

SANKSI ADMINISTRATIF

CHAPTER IV

ADMINISTRATIVE SANCTIONS

 

Pasal 7

Pelaku Usaha yang melanggar ketentuan PB dan/atau PB UMKU subsektor minyak dan gas bumi dikenai sanksi administratif berupa:

a. teguran tertulis;

b. penghentian sementara kegiatan usaha;

c. penghentian usaha atau kegiatan;

d. pengenaan denda administratif; dan/atau

e. pencabutan PB dan/atau PB UMKU.

Article 7

Business actors who violate the provisions of Business Licensing and/or Business Licensing to Support Business Activities in the oil and gas subsector will be subject to administrative sanctions in the form of:

a. written warning;

b. temporary suspension of business activities;

c. termination of business or activities;

d. imposition of administrative fines; and/or

e. revocation of Business Licensing and/or Business Licensing to Support Business Activities.

 

Pasal 8

(1) Pelaku Usaha yang melanggar ketentuan PB dan/atau PB UMKU subsektor ketenagalistrikan dikenai sanksi administratif berupa:

a. teguran tertulis;

b. pembekuan kegiatan sementara;

c. denda administratif; dan/atau

d. pencabutan PB dan/atau PB UMKU.

(2) Dalam hal pelanggaran sebagaimana dimaksud pada ayat (1) mengakibatkan timbulnya korban dan/atau kerusakan terhadap:

a. keselamatan;

b. kesehatan;

c. lingkungan;

d. pemanfaatan sumber daya; dan/atau

e. aspek lainnya,

dikenai sanksi administratif berupa pembekuan kegiatan sementara atau pencabutan PB dan/atau PB UMKU.

Article 8

(1) Business actors who violate the provisions of Business Licensing and/or Business Permits to Support Business Activities in the electricity sub-sector shall be subject to administrative sanctions in the form of:

a. written warning;

b. temporary suspension of activities;

c. administrative fines; and/or

d. revocation of Business Licensing and/or Business Permits to Support Business Activities.

(2) If the violation as referred to in paragraph (1) results in casualties and/or damage to:

a. safety;

b. health;

c. the environment;

d. resource utilization; and/or

e. other aspects,

administrative sanctions shall be imposed in the form of temporary suspension of activities or revocation of Business Licensing and/or Business Permits to Support Business Activities.

 

Pasal 9

(1) Pelaku Usaha yang melanggar ketentuan PB dan/atau PB UMKU subsektor mineral dan batubara dikenai sanksi administratif berupa:

a. peringatan tertulis;

b. penghentian sementara sebagian atau seluruh kegiatan PB dan/atau PB UMKU; dan/atau

c. pencabutan PB dan/atau PB UMKU.

(2) Selain sanksi administratif sebagaimana dimaksud pada ayat (1), pemegang PB atau PB UMKU yang melanggar kewajiban pembayaran pendapatan negara dan/atau pendapatan daerah dikenai denda administratif sesuai dengan ketentuan peraturan perundang-undangan.

Article 9

(1) Business actors who violate the provisions of Business Licensing and/or Business Permits to Support Business Activities in the mineral and coal sub-sector shall be subject to administrative sanctions in the form of:

a. a written warning;

b. temporary suspension of some or all Business Licensing and/or Business Permits to Support Business Activities; and/or

c. revocation of Business Licensing and/or Business Permits to Support Business Activities.

(2) In addition to the administrative sanctions referred to in paragraph (1), holders of Business Licensing or Business Permits to Support Business Activities who violate their obligations to pay state revenue and/or regional revenue shall be subject to administrative fines in accordance with statutory provisions.

 

Pasal 10

(1) Pelaku Usaha yang melanggar ketentuan PB dan/atau PB UMKU subsektor energi baru, terbarukan, dan konservasi energi:

a. untuk kegiatan usaha panas bumi untuk pemanfaatan tidak langsung dikenai sanksi administratif sesuai dengan ketentuan peraturan perundang-undangan dibidang panas bumi;

b. untuk kegiatan usaha panas bumi untuk pemanfaatan langsung dikenai sanksi administratif berupa:

1. peringatan tertulis;

2. penghentian sementara seluruh kegiatan usaha pengusahaan panas bumi untuk pemanfaatan langsung; dan/atau

3. pencabutan PB UMKU.

(2) Pelaku Usaha yang melanggar ketentuan PB dan/atau PB UMKU subsektor energi baru, terbarukan, dan konservasi energi untuk kegiatan usaha bahan bakar nabati dan kegiatan usaha bahan bakar biogas dikenai sanksi administratif berupa:

a. peringatan tertulis;

b. penghentian sementara kegiatan usaha bahan bakar nabati dan/atau kegiatan usaha bahan bakar biogas;

c. denda administratif; dan/atau

d. pencabutan PB.

(3) Pelaku Usaha yang melanggar ketentuan PB dan/atau PB UMKU subsektor energi baru, terbarukan, dan konservasi energi untuk kegiatan usaha konservasi energi dikenai sanksi administratif berupa:

a. peringatan tertulis;

b. penghentian sementara seluruh kegiatan usaha; dan/atau

c. pencabutan PB.

Article 10

(1) Business actors who violate the provisions of Business Licensing and/or Business Permits to Support Business Activities in the new, renewable energy, and energy conservation subsector:

a. for geothermal business activities for indirect utilization shall be subject to administrative sanctions in accordance with the provisions of laws and regulations in the geothermal sector;

b. for geothermal business activities for direct utilization shall be subject to administrative sanctions in the form of:

1. written warning;

2. temporary suspension of all geothermal business activities for direct utilization; and/or

3. revocation of Business Permits to Support Business Activities.

(2) Business actors who violate the provisions of Business Licensing and/or Business Permits to Support Business Activities in the new, renewable energy, and energy conservation subsector for biofuel and biogas business activities shall be subject to administrative sanctions in the form of:

a. written warning;

b. temporary suspension of biofuel and/or biogas business activities;

c. administrative fine; and/or

d. Revocation of Business Permits.

(3) Business Actors who violate the provisions of Business Permits and/or Business Permits to Support Business Activities in the new, renewable energy, and energy conservation sub-sector for energy conservation business activities shall be subject to administrative sanctions in the form of:

a. written warning;

b. temporary suspension of all business activities; and/or

c. revocation of Business Permits.

 

 

Pasal 11

Pelaku Usaha yang melanggar ketentuan PB UMKU subsektor geologi dikenai sanksi administratif berupa:

a. peringatan tertulis;

b. penghentian sementara seluruh kegiatan pengusahaan air tanah; dan/atau

c. pencabutan PB UMKU.

Article 11

Business actors who violate the provisions of the Business Permit to Support Business Activities in the geology sub-sector will be subject to administrative sanctions in the form of:

a. a written warning;

b. a temporary suspension of all groundwater exploitation activities; and/or

c. revocation of the Business Permit to Support Business Activities.

 

Pasal 12

Pengenaan sanksi administratif sebagaimana dimaksud dalam Pasal 7 sampai dengan Pasal 11 dilaksanakan sesuai dengan ketentuan peraturan perundang-undangan.

Article 12

The imposition of administrative sanctions as intended in Articles 7 to Article 11 is carried out in accordance with the provisions of statutory regulations.

RISK-BASED BUSINESS LICENSING

 

Bagian Ketiga

PB dan PB UMKU Sektor Energi dan Sumber Daya Mineral

Part Three

Business Licensing and Business Permits to Support Business Activities in the Energy and Mineral Resources Sector

 

Pasal 4

(1) PB sektor energi dan sumber daya mineral meliputi subsektor:

a. minyak dan gas bumi;

b. ketenagalistrikan;

c. mineral dan batubara; dan

d. energi baru, terbarukan, dan konservasi energi.

(2) PB UMKU sektor energi dan sumber daya mineral meliputi penunjang operasional dan/atau komersial kegiatan usaha yang terdiri atas subsektor:

a. minyak dan gas bumi;

b. ketenagalistrikan;

c. mineral dan batubara;

d. energi baru, terbarukan, dan konservasi energi; dan

e. geologi.

Article 4

(1) Business Licensing in the energy and mineral resources sector includes the following subsectors:

a. oil and natural gas;

b. electricity;

c. minerals and coal; and

d. new, renewable energy, and energy conservation.

(2) Business Licensing to Support Business Activities in the energy and mineral resources sector includes operational and/or commercial support for business activities, consisting of the following subsectors:

a. oil and natural gas;

b. electricity;

c. minerals and coal;

d. new, renewable energy, and energy conservation; and

e. geology.

 

Pasal 5

Menteri menetapkan standar kegiatan usaha pada penyelenggaraan PBBR berupa:

a. PB sektor energi dan sumber daya mineral sebagaimana tercantum dalam Lampiran I; dan

b. PB UMKU sektor energi dan sumber daya mineral sebagaimana tercantum dalam Lampiran II, yang merupakan bagian tidak terpisahkan dari Peraturan Menteri ini.

Article 5

The Minister shall establish standards for business activities in the implementation of Risk-Based Business Licensing, including:

a. Business Licensing in the energy and mineral resources sector, as listed in Attachment I; and

b. Business Licensing to Support Business Activities in the energy and mineral resources sector, as listed in Attachment II, which is an integral part of this Ministerial Regulation.

CHAPTER II

RISK-BASED BUSINESS LICENSING

 

Bagian Kedua

Persyaratan Dasar

Part Two

Basic Requirements

 

Pasal 3

Article 3

 

(1) PB sebagaimana dimaksud dalam Pasal 2 ayat (1) diperoleh setelah Pelaku Usaha melakukan pemenuhan persyaratan dasar terlebih dahulu, kecuali diatur lain sesuai dengan ketentuan peraturan perundangundangan.

(2) Terhadap kegiatan survei umum serta wilayah kerja untuk kegiatan usaha hulu minyak dan gas bumi yang sudah ditetapkan oleh Pemerintah, persetujuan Kegiatan Kesesuaian Pemanfaatan Ruang diberikan tanpa dilakukan penilaian dokumen usulan kegiatan pemanfaatan ruang sesuai dengan ketentuan peraturan perundang-undangan.

(3) Pemenuhan persyaratan dasar untuk kegiatan pencampuran hasil produk kilang minyak dan gas bumi dengan biofuel berupa persetujuan Kegiatan Kesesuaian Pemanfaatan Ruang dan Pernyataan Kesanggupan Pengelolaan Lingkungan Hidup telah tercakup dalam pemenuhan persyaratan dasar pemberian Izin Pengolahan Minyak dan Gas Bumi, Izin Penyimpanan Minyak dan Gas Bumi, dan/atau Izin Niaga Minyak dan Gas Bumi.

(4) Terhadap infrastruktur ketenagalistrikan yang dibangun dalam wilayah usaha ketenagalistrikan yang ditetapkan oleh Pemerintah, persetujuan Kesesuaian Kegiatan Pemanfaatan Ruang diberikan tanpa dilakukan penilaian dokumen usulan kegiatan pemanfaatan ruang, dengan ketentuan:

a. lokasi usaha dan/atau kegiatan terletak di lokasi KEK atau kawasan industri yang poligon koordinat lokasinya telah terdaftar dalam Sistem OSS dan terdapat bukti bahwa Pelaku Usaha dapat melakukan kegiatan usaha di KEK atau kawasan industri;

b. lokasi usaha dan/atau kegiatan terletak di kawasan yang dikelola oleh otorita atau badan penyelenggara pengembangan suatu kawasan yang poligon koordinat lokasinya telah terdaftar dalam Sistem OSS dan terdapat bukti bahwa Pelaku Usaha dapat melakukan kegiatan usaha di kawasan tersebut; atau

c. lokasi usaha dan/atau kegiatan terletak di luar lokasi sebagaimana dimaksud pada huruf a dan huruf b, untuk infrastruktur ketenagalistrikan berupa jaringan distribusi tenaga listrik, gardu distribusi, dan/atau penjualan tenaga listrik.

(5) Terhadap infrastruktur ketenagalistrikan berupa pembangkit, jaringan transmisi, dan/atau gardu induk di wilayah usaha PT Perusahaan Listrik Negara (Persero), baik yang berasal dari pembiayaan anggaran pendapatan dan belanja negara maupun pembiayaan PT Perusahaan Listrik Negara (Persero), permohonan penerbitan Kesesuaian Kegiatan Pemanfaatan Ruang diajukan oleh Menteri kepada menteri yang menyelenggarakan urusan pemerintahan di bidang pertanahan dan tata ruang.

(6) Kewajiban pemenuhan persyaratan dasar untuk PB berupa Kegiatan Kesesuaian Pemanfaatan Ruang dikecualikan dalam tahap:

a. survei dan eksplorasi pada subsektor energi baru, terbarukan, dan konservasi energi; dan

b. kegiatan eksplorasi pada subsektor mineral dan batubara.

(7) Pemenuhan persyaratan dasar untuk kegiatan usaha di sektor energi dan sumber daya mineral yang berada pada kawasan hutan atau wilayah perairan laut, sesuai dengan ketentuan peraturan perundang-undangan.

(1) Business Licensing as referred to in Article 2 paragraph (1) is obtained after the Business Actor has first fulfilled the basic requirements, unless otherwise stipulated in accordance with statutory provisions.

(2) For general survey activities and work areas for upstream oil and gas business activities designated by the Government, approval for Spatial Utilization Conformity Activities is granted without an assessment of the proposed spatial utilization activity documents in accordance with statutory provisions.

(3) Fulfillment of the basic requirements for blending oil and gas refinery products with biofuel, in the form of approval for Spatial Utilization Conformity Activities and a Statement of Commitment to Environmental Management, is included in the fulfillment of the basic requirements for granting an Oil and Gas Processing Permit, an Oil and Gas Storage Permit, and/or an Oil and Gas Trading Permit.

(4) For electricity infrastructure constructed within the electricity business area designated by the Government, approval for Spatial Utilization Conformity Activities is granted without an assessment of the proposed spatial utilization activity documents, provided that:

a. The business and/or activity location is located in a Special Economic Zone or industrial area whose location coordinate polygon has been registered in the OSS System and there is evidence that the Business Actor can conduct business activities in the Special Economic Zone or industrial area;

b. The business and/or activity location is located in an area managed by an authority or development agency for an area whose location coordinate polygon has been registered in the OSS System and there is evidence that the Business Actor can conduct business activities in that area; or

c. The business and/or activity location is located outside the location as referred to in letters a and b, for electricity infrastructure in the form of electricity distribution networks, distribution substations, and/or electricity sales.

(5) For electricity infrastructure in the form of generators, transmission networks, and/or substations in the business area of ​​the State Electricity Company (Persero), whether funded by the state budget or by the State Electricity Company (Persero), the application for the issuance of a Conformity of Spatial Utilization Activities shall be submitted by the Minister to the minister in charge of government affairs in the field of land and spatial planning.

(6) The obligation to fulfill basic requirements for Business Licensing in the form of Spatial Utilization Compliance Activities is exempted at the following stages:

a. surveys and exploration in the new, renewable energy, and energy conservation subsectors; and

b. exploration activities in the minerals and coal subsectors.

(7) Fulfillment of basic requirements for business activities in the energy and mineral resources sector located in forest areas or marine waters, in accordance with statutory provisions.
