KETENTUAN PENUTUP

CHAPTER VI

CLOSING PROVISIONS

 

Pasal 18

Pada saat Peraturan Menteri ini mulai berlaku:

a. ketentuan pelaksanaan PB atau PB UMKU yang diatur dalam Peraturan Menteri ini dikecualikan bagi Pelaku Usaha yang PB atau PB UMKU-nya telah diterbitkan dan masih berlaku sebelum berlakunya Peraturan Menteri ini, kecuali ketentuan dalam Peraturan Menteri ini lebih menguntungkan bagi Pelaku Usaha; dan

b. ketentuan PB atau PB UMKU yang memiliki nomenklatur berbeda sebelum berlakunya Peraturan Menteri ini, harus dibaca dan dimaknai sesuai dengan nomenklatur yang diatur dalam Peraturan Menteri ini.

Article 18

Upon the enactment of this Ministerial Regulation:

a. the provisions for implementing Business Licensing or Business Licensing to Support Business Activities as regulated in this Ministerial Regulation shall be exempted for Business Actors whose Business Licensing or Business Permits have been issued and are still valid before the enactment of this Ministerial Regulation, unless the provisions in this Ministerial Regulation are more advantageous to Business Actors; and

b. provisions for Business Licensing or Business Licensing that have a different nomenclature before the enactment of this Ministerial Regulation must be read and interpreted in accordance with the nomenclature regulated in this Ministerial Regulation.

 

Pasal 19

Pada saat Peraturan Menteri ini mulai berlaku, semua Peraturan Menteri yang mengatur mengenai ketentuan standar kegiatan usaha dalam penyelenggaraan perizinan berusaha berbasis risiko sektor energi dan sumber daya mineral, dinyatakan masih tetap berlaku sepanjang tidak bertentangan dengan ketentuan dalam Peraturan Menteri ini.

Article 19

Upon the enactment of this Ministerial Regulation, all Ministerial Regulations governing standard business activity provisions for the implementation of risk-based business licensing in the energy and mineral resources sector shall remain in effect to the extent they do not conflict with the provisions of this Ministerial Regulation.

 

Pasal 20

Pada saat Peraturan Menteri ini mulai berlaku, Peraturan Menteri Energi dan Sumber Daya Mineral Nomor 5 Tahun 2021 tentang Standar Kegiatan Usaha dan Produk pada Penyelenggaraan Perizinan Berusaha Berbasis Risiko Sektor Energi dan Sumber Daya Mineral (Berita Negara Republik Indonesia Tahun 2021 Nomor 318), dicabut dan dinyatakan tidak berlaku.

Article 20

Upon the enactment of this Ministerial Regulation, Regulation of the Minister of Energy and Mineral Resources Number 5 of 2021 concerning Standards for Business Activities and Products in the Implementation of Risk-Based Business Licensing in the Energy and Mineral Resources Sector (State Gazette of the Republic of Indonesia 2021 Number 318) is revoked and declared null and void.

 

Pasal 21

Peraturan Menteri ini mulai berlaku pada tanggal diundangkan.

Article 21

This Ministerial Regulation shall come into force on the date of its promulgation.

 

Agar setiap orang mengetahuinya, memerintahkan pengundangan Peraturan Menteri ini dengan penempatannya dalam Berita Negara Republik Indonesia.

So that everyone knows, it is ordered that this Ministerial Regulation be promulgated by placing it in the State Gazette of the Republic of Indonesia.

KETENTUAN LAIN-LAIN

CHAPTER V

MISCELLANEOUS PROVISIONS

 

Pasal 13

PB UMKU untuk kegiatan usaha pengangkutan yang meliputi kegiatan pemindahan minyak bumi, gas bumi, bahan bakar minyak, bahan bakar gas, dan/atau hasil olahan yang menggunakan alat transportasi selain moda pipa dari suatu tempat ke tempat lain untuk tujuan komersial dilaksanakan sesuai dengan norma, standar, prosedur, dan kriteria pada sektor transportasi berdasarkan Peraturan Pemerintah Nomor 28 Tahun 2025 tentang Penyelenggaraan Perizinan Berusaha Berbasis Risiko.

Article 13

Business Licensing for Business Activities Supporting Business Activities for transportation business activities, including the transfer of petroleum, natural gas, fuel oil, gas fuel, and/or processed products using transportation modes other than pipelines from one location to another for commercial purposes, shall be carried out in accordance with norms, standards, procedures, and criteria in the transportation sector based on Government Regulation Number 28 of 2025 concerning the Implementation of Risk-Based Business Licensing.

 

Pasal 14

Dalam hal terdapat perubahan Klasifikasi Baku Lapangan Usaha Indonesia sesuai dengan ketentuan peraturan perundang-undangan, Klasifikasi Baku Lapangan Usaha Indonesia dalam Peraturan Menteri ini dibaca dan dimaknai sesuai dengan perubahan Klasifikasi Baku Lapangan Usaha Indonesia.

Article 14

In the event of changes to the Indonesian Standard Industrial Classification in accordance with statutory provisions, the Indonesian Standard Industrial Classification in this Ministerial Regulation shall be read and interpreted in accordance with the changes to the Indonesian Standard Industrial Classification.

 

BAB VI

KETENTUAN PERALIHAN

CHAPTER VI

TRANSITIONAL PROVISIONS

 

Pasal 15

Pada saat Peraturan Menteri ini mulai berlaku, permohonan PB dan/atau PB UMKU yang masih dalam proses penerbitan sampai dengan Sistem OSS yang telah disesuaikan dengan Peraturan Pemerintah Nomor 28 Tahun 2025 tentang Penyelenggaraan Perizinan Berusaha Berbasis Risiko beroperasi, tetap diproses berdasarkan:

1. Peraturan Pemerintah Nomor 5 Tahun 2021 tentang Penyelenggaraan Perizinan Berusaha Berbasis Risiko dan Peraturan Menteri Energi dan Sumber Daya Mineral Nomor 5 Tahun 2021 tentang Standar Kegiatan Usaha dan Produk pada Penyelenggaraan Perizinan Berusaha Berbasis Risiko Sektor Energi dan Sumber Daya Mineral; atau

2. Peraturan Menteri Energi dan Sumber Daya Mineral Nomor 14 Tahun 2024 tentang Penyelenggaraan Izin Pengusahaan Air Tanah dan Persetujuan Penggunaan Air Tanah.

Article 15

Upon the enactment of this Ministerial Regulation, applications for Business Licenses and/or Business Licenses to Support Business Activities that are still in the issuance process until the Online System Submission System, which has been adjusted to the implementation of Risk-Based Business Licensing, is operational, will continue to be processed based on:

1. Government Regulation Number 5 of 2021 concerning the Implementation of Risk-Based Business Licensing and Regulation of the Minister of Energy and Mineral Resources Number 5 of 2021 concerning Standards for Business Activities and Products in the Implementation of Risk-Based Business Licensing in the Energy and Mineral Resources Sector; or

2. Regulation of the Minister of Energy and Mineral Resources Number 14 of 2024 concerning the Implementation of Groundwater Business Permits and Groundwater Use Approvals.

 

Pasal 16

Pada saat Peraturan Menteri ini mulai berlaku, PB dan/atau PB UMKU yang telah diterbitkan dan masih berlaku sebelum berlakunya Peraturan Menteri ini, dinyatakan tetap berlaku sampai dengan jangka waktu berakhirnya PB dan/atau PB UMKU.

Article 16

Upon the enactment of this Ministerial Regulation, Business Permits and/or Business Permits to Support Business Activities that have been issued and are still valid prior to the enactment of this Ministerial Regulation shall remain valid until the expiry of the Business Permits and/or Business Permits to Support Business Activities.

 

Pasal 17

Pada saat Peraturan Menteri ini mulai berlaku, terhadap kegiatan pencampuran produk hasil pengolahan minyak dan gas bumi dengan biofuel, Badan Usaha yang telah memiliki Izin Pengolahan Minyak dan Gas Bumi, Izin Penyimpanan Minyak dan Gas Bumi, dan/atau Izin Niaga Minyak dan Gas Bumi tetap dapat melakukan kegiatan pencampuran (blending) dan harus menyesuaikan dengan Peraturan Menteri ini paling lambat 12 (dua belas) bulan terhitung sejak Peraturan Menteri ini diundangkan.

Article 17

Upon the enactment of this Ministerial Regulation, Business Entities that already hold an Oil and Gas Processing Permit, an Oil and Gas Storage Permit, and/or an Oil and Gas Trading Permit may continue to engage in blending activities with biofuels, and must comply with this Ministerial Regulation no later than 12 (twelve) months after the enactment of this Ministerial Regulation.

PENGAWASAN

CHAPTER III

SUPERVISION

 

Pasal 6

Pengawasan terhadap PB dan/atau PB UMKU sektor energi dan sumber daya mineral dilaksanakan sesuai dengan ketentuan peraturan perundang-undangan.

Article 6

Supervision of Business Permits and/or Business Permits to Support Business Activities in the energy and mineral resources sector is carried out in accordance with statutory provisions.

Pasal 7

Pelaku Usaha yang melanggar ketentuan PB dan/atau PB UMKU subsektor minyak dan gas bumi dikenai sanksi administratif berupa:

a. teguran tertulis;

b. penghentian sementara kegiatan usaha;

c. penghentian usaha atau kegiatan;

d. pengenaan denda administratif; dan/atau

e. pencabutan PB dan/atau PB UMKU.

Article 7

Business actors who violate the provisions of Business Licensing and/or Business Licensing to Support Business Activities in the oil and gas subsector will be subject to administrative sanctions in the form of:

a. written warning;

b. temporary suspension of business activities;

c. termination of business or activities;

d. imposition of administrative fines; and/or

e. revocation of Business Licensing and/or Business Licensing to Support Business Activities.

 

Pasal 8

(1) Pelaku Usaha yang melanggar ketentuan PB dan/atau PB UMKU subsektor ketenagalistrikan dikenai sanksi administratif berupa:

a. teguran tertulis;

b. pembekuan kegiatan sementara;

c. denda administratif; dan/atau

d. pencabutan PB dan/atau PB UMKU.

(2) Dalam hal pelanggaran sebagaimana dimaksud pada ayat (1) mengakibatkan timbulnya korban dan/atau kerusakan terhadap:

a. keselamatan;

b. kesehatan;

c. lingkungan;

d. pemanfaatan sumber daya; dan/atau

e. aspek lainnya,

dikenai sanksi administratif berupa pembekuan kegiatan sementara atau pencabutan PB dan/atau PB UMKU.

Article 8

(1) Business actors who violate the provisions of Business Licensing and/or Business Permits to Support Business Activities in the electricity sub-sector shall be subject to administrative sanctions in the form of:

a. written warning;

b. temporary suspension of activities;

c. administrative fines; and/or

d. revocation of Business Licensing and/or Business Permits to Support Business Activities.

(2) If the violation as referred to in paragraph (1) results in casualties and/or damage to:

a. safety;

b. health;

c. the environment;

d. resource utilization; and/or

e. other aspects,

administrative sanctions shall be imposed in the form of temporary suspension of activities or revocation of Business Licensing and/or Business Permits to Support Business Activities.

 

Pasal 9

(1) Pelaku Usaha yang melanggar ketentuan PB dan/atau PB UMKU subsektor mineral dan batubara dikenai sanksi administratif berupa:

a. peringatan tertulis;

b. penghentian sementara sebagian atau seluruh kegiatan PB dan/atau PB UMKU; dan/atau

c. pencabutan PB dan/atau PB UMKU.

(2) Selain sanksi administratif sebagaimana dimaksud pada ayat (1), pemegang PB atau PB UMKU yang melanggar kewajiban pembayaran pendapatan negara dan/atau pendapatan daerah dikenai denda administratif sesuai dengan ketentuan peraturan perundang-undangan.

Article 9

(1) Business actors who violate the provisions of Business Licensing and/or Business Permits to Support Business Activities in the mineral and coal sub-sector shall be subject to administrative sanctions in the form of:

a. a written warning;

b. temporary suspension of some or all Business Licensing and/or Business Permits to Support Business Activities; and/or

c. revocation of Business Licensing and/or Business Permits to Support Business Activities.

(2) In addition to the administrative sanctions referred to in paragraph (1), holders of Business Licensing or Business Permits to Support Business Activities who violate their obligations to pay state revenue and/or regional revenue shall be subject to administrative fines in accordance with statutory provisions.

 

Pasal 10

(1) Pelaku Usaha yang melanggar ketentuan PB dan/atau PB UMKU subsektor energi baru, terbarukan, dan konservasi energi:

a. untuk kegiatan usaha panas bumi untuk pemanfaatan tidak langsung dikenai sanksi administratif sesuai dengan ketentuan peraturan perundang-undangan dibidang panas bumi;

b. untuk kegiatan usaha panas bumi untuk pemanfaatan langsung dikenai sanksi administratif berupa:

1. peringatan tertulis;

2. penghentian sementara seluruh kegiatan usaha pengusahaan panas bumi untuk pemanfaatan langsung; dan/atau

3. pencabutan PB UMKU.

(2) Pelaku Usaha yang melanggar ketentuan PB dan/atau PB UMKU subsektor energi baru, terbarukan, dan konservasi energi untuk kegiatan usaha bahan bakar nabati dan kegiatan usaha bahan bakar biogas dikenai sanksi administratif berupa:

a. peringatan tertulis;

b. penghentian sementara kegiatan usaha bahan bakar nabati dan/atau kegiatan usaha bahan bakar biogas;

c. denda administratif; dan/atau

d. pencabutan PB.

(3) Pelaku Usaha yang melanggar ketentuan PB dan/atau PB UMKU subsektor energi baru, terbarukan, dan konservasi energi untuk kegiatan usaha konservasi energi dikenai sanksi administratif berupa:

a. peringatan tertulis;

b. penghentian sementara seluruh kegiatan usaha; dan/atau

c. pencabutan PB.

Article 10

(1) Business actors who violate the provisions of Business Licensing and/or Business Permits to Support Business Activities in the new, renewable energy, and energy conservation subsector:

a. for geothermal business activities for indirect utilization shall be subject to administrative sanctions in accordance with the provisions of laws and regulations in the geothermal sector;

b. for geothermal business activities for direct utilization shall be subject to administrative sanctions in the form of:

1. written warning;

2. temporary suspension of all geothermal business activities for direct utilization; and/or

3. revocation of Business Permits to Support Business Activities.

(2) Business actors who violate the provisions of Business Licensing and/or Business Permits to Support Business Activities in the new, renewable energy, and energy conservation subsector for biofuel and biogas business activities shall be subject to administrative sanctions in the form of:

a. written warning;

b. temporary suspension of biofuel and/or biogas business activities;

c. administrative fine; and/or

d. Revocation of Business Permits.

(3) Business Actors who violate the provisions of Business Permits and/or Business Permits to Support Business Activities in the new, renewable energy, and energy conservation sub-sector for energy conservation business activities shall be subject to administrative sanctions in the form of:

a. written warning;

b. temporary suspension of all business activities; and/or

c. revocation of Business Permits.

 

 

Pasal 11

Pelaku Usaha yang melanggar ketentuan PB UMKU subsektor geologi dikenai sanksi administratif berupa:

a. peringatan tertulis;

b. penghentian sementara seluruh kegiatan pengusahaan air tanah; dan/atau

c. pencabutan PB UMKU.

Article 11

Business actors who violate the provisions of the Business Permit to Support Business Activities in the geology sub-sector will be subject to administrative sanctions in the form of:

a. a written warning;

b. a temporary suspension of all groundwater exploitation activities; and/or

c. revocation of the Business Permit to Support Business Activities.

 

Pasal 12

Pengenaan sanksi administratif sebagaimana dimaksud dalam Pasal 7 sampai dengan Pasal 11 dilaksanakan sesuai dengan ketentuan peraturan perundang-undangan.

Article 12

The imposition of administrative sanctions as intended in Articles 7 to Article 11 is carried out in accordance with the provisions of statutory regulations.
