CONCERNING

BASIC PROVISIONS ON MINING

 

BAB III

BENTUK DAN ORGANISASI PERUSAHAAN PERTAMBANGAN

CHAPTER III

FORM AND ORGANIZATION OF MINING COMPANIES

 

Pasal 5

Article 5

 

Usaha pertambangan dapat dilaksanakan oleh :

a. Instansi Pemerintah yang ditunjuk oleh Menteri;

b. Perusahaan Negara;

c. Perusahaan Daerah;

d. Perusahaan dengan modal bersama antara Negara dan Daerah.

e. Koperasi;

f. Badan atau perseorangan swasta yang memenuhi syarat-syarat yang dimaksud dalam pasal 12 ayat (1);

g. Perusahaan dengan modal bersama antara Negara dan/atau Daerah dengan Koperasi dan/atau Badan/Perseorangan Swasta yang memenuhi syarat-syarat yang dimaksud dalam pasal 12 ayat (1);

h. Pertambangan Rakyat.

Mining operations may be conducted by:

a. Government agencies appointed by the Minister;

b. State-owned enterprises;

c. Regionally-owned enterprises;

d. Enterprises with joint capital between the State and the Region;

e. Cooperatives;

f. Private entities or individuals meeting the requirements referred to in Article 12 paragraph (1);

g. Enterprises with joint capital between the State and/or the Region and Cooperatives and/or private entities/individuals meeting the requirements referred to in Article 12 paragraph (1);

h. People's mining operations.

BAB II

PENGGOLONGAN DAN PELAKSANAAN PENGUSAHAAN BAHAN GALIAN

CHAPTER II

CLASSIFICATION AND IMPLEMENTATION OF MINERAL RESOURCE EXPLOITATION

 

Pasal 4

Article 4

 

(1) Pelaksanaan Penguasaan Negara dan pengaturan usaha pertambangan bahan galian tersebut dalam pasal 3 ayat (1) huruf a dan b dilakukan oleh Menteri;

(2) Pelaksanaan Penguasaan Negara dan pengaturan usaha pertambangan bahan galian tersebut dalam pasal 3 ayat (1) huruf c dilakukan oleh Pemerintah Daerah Tingkat I tempat terdapatnya bahan galian itu.

(3) Dengan memperhatikan kepentingan pembangunan Daerah khususnya dan Negara umumnya Menteri dapat menyerahkan pengaturan usaha pertambangan bahan galian tertentu dari antara bahan-bahan galian tersebut dalam pasal 3 ayat (1) huruf b kepada Pemerintah Daerah Tingkat I tempat terdapatnya bahan galian itu.

(1) The exercise of State control and the regulation of mining operations for the mineral materials referred to in Article 3, paragraph (1), letters a and b, shall be carried out by the Minister;

(2) The exercise of State control and the regulation of mining operations for the mineral materials referred to in Article 3, paragraph (1), letter c, shall be carried out by the Level I Regional Government where said mineral materials are located.

(3) With due regard for the interests of regional development in particular and the State in general, the Minister may delegate the regulation of mining operations for specific mineral materials—from among those referred to in Article 3, paragraph (1), letter b—to the Level I Regional Government where said mineral materials are located.

CHAPTER II

CLASSIFICATION AND IMPLEMENTATION OF MINERAL RESOURCE EXPLOITATION

 

Pasal 3

Article 3

 

(1) Bahan-bahan galian dibagi atas tiga golongan:

a. golongan bahan galian strategis;

b. golongan bahan galian vital;

c. golongan bahan galian yang tidak termasuk dalam golongan a atau b.

(2) Penunjukan sesuatu bahan galian ke dalam sesuatu golongan tersebut pada ayat (1) pasal ini diatur dengan Peraturan Pemerintah.

(1) Mineral materials are classified into three categories:

a. the category of strategic mineral materials;

b. the category of vital mineral materials;

c. the category of mineral materials not included in category a or b.

(2) The designation of a specific mineral material into one of the categories referred to in paragraph (1) of this Article shall be regulated by Government Regulation.
