BENTUK DAN ORGANISASI
PERUSAHAAN PERTAMBANGAN
CHAPTER III
FORM AND ORGANIZATION OF MINING COMPANIES
Pasal 9
Article 9
(1) Usaha pertambangan bahan galian tersebut dalam pasal 3
ayat (1) huruf b dilaksanakan oleh :
a. Negara atau Daerah.
b. Badan atau Perseorangan Swasta yang memenuhi
syarat- syarat yang dimaksud dalam pasal 12 (1).
(2) Usaha pertambangan yang dimaksud pada ayat (1) huruf a
pasal ini dapat dilaksanakan oleh :
a. Instansi Pemerintah yang ditunjuk oleh Menteri;
b. Perusahaan Negara;
c. Perusahaan Daerah;
d. Perusahaan dengan modal bersama antara
Negara/Perusahaan di satu pihak dengan Daerah Tingkat I dan/atau Daerah Tingkat
II atau Perusahaan Daerah di pihak lain;
e. Perusahaan dengan modal bersama antara
Negara/Perusahaan Negara dan/atau Daerah/Perusahaan Daerah di satu pihak dengan
Badan dan/atau Perseorangan Swasta di pihak lain.
(3) Perusahaan yang dimaksud dalam ayat (2) huruf e pasal ini
harus berbentuk Badan hukum dengan ketentuan bahwa Badan dan/atau Perseorangan
Swasta yang ikut dalam perusahaan itu harus memenuhi syarat-syarat yang
dimaksud dalam pasal 12 ayat (1).
(1) Mining operations
for the minerals referred to in Article 3 paragraph (1) letter b shall be
carried out by:
a. The State or
a Region.
b. Private
entities or private individuals meeting the requirements referred to in Article
12 paragraph (1).
(2) The mining
operations referred to in paragraph (1) letter a of this Article may be carried
out by:
a. Government
agencies appointed by the Minister;
b. State-owned
enterprises;
c.
Regionally-owned enterprises;
d. Joint-venture
enterprises between the State/State-owned enterprises on the one hand and
First-Level Regions and/or Second-Level Regions or Regionally-owned enterprises
on the other;
e. Joint-venture
enterprises between the State/State-owned enterprises and/or
Regions/Regionally-owned enterprises on the one hand and private entities
and/or private individuals on the other.
(3) The enterprises
referred to in paragraph (2) letter e of this Article must take the form of a
legal entity, provided that the private entities and/or private individuals
participating in such enterprises meet the requirements referred to in Article
12 paragraph (1).
