TENTANG

PEDOMAN PENGGUNAAN SUMBER DAYA AIR PADA AIR TANAH DAN TATA CARA PENGENAAN, PENGHITUNGAN, PEMBAYARAN DAN/ATAU PENYETORAN PENERIMAAN NEGARA BUKAN PAJAK BERUPA DENDA ADMINISTRATIF PENATAAN IZIN PENGUSAHAAN AIR TANAH DAN PERSETUJUAN PENGGUNAAN AIR TANAH

REGULATION OF THE MINISTER OF ENERGY AND MINERAL RESOURCES

OF THE REPUBLIC OF INDONESIA

NUMBER 4 OF 2026

CONCERNING

GUIDELINES ON THE UTILIZATION OF GROUNDWATER RESOURCES AND PROCEDURES FOR THE IMPOSITION, CALCULATION, PAYMENT, AND/OR REMITTANCE OF NON-TAX STATE REVENUE IN THE FORM OF ADMINISTRATIVE FINES RELATED TO COMPLIANCE WITH GROUNDWATER UTILIZATION LICENSES AND GROUNDWATER UTILIZATION APPROVALS

MENTERI ENERGI DAN SUMBER DAYA MINERAL REPUBLIK INDONESIA,

BY THE GRACE OF ALMIGHTY GOD

MINISTER OF ENERGY AND MINERAL RESOURCES OF THE REPUBLIC OF INDONESIA,

 

Menimbang : a. bahwa untuk menjaga keberlanjutan air tanah serta meningkatkan efektivitas dan efisiensi dalam pelaksanaan kegiatan penggunaan sumber daya air pada sumber air tanah, diperlukan upaya perlindungan air tanah dari kerusakan baik kuantitas maupun kualitas air tanah;

b. bahwa untuk melaksanakan ketentuan Pasal 120 dan Pasal 147 ayat (1) dan ayat (3) Peraturan Pemerintah Nomor 30 Tahun 2024 tentang Pengelolaan Sumber Daya Air, perlu mengatur mengenai persetujuan penggunaan air tanah;

c. bahwa untuk melaksanakan ketentuan Pasal 8 Peraturan Pemerintah Nomor 19 Tahun 2025 tentang Jenis dan Tarif atas Jenis Penerimaan Negara Bukan Pajak yang Berlaku pada Kementerian Energi dan Sumber Daya Mineral, perlu mengatur tata cara pengenaan, penghitungan, pembayaran dan/atau penyetoran penerimaan negara bukan pajak berupa denda administratif penataan izin pengusahaan air tanah dan persetujuan penggunaan air tanah;

d. bahwa berdasarkan pertimbangan sebagaimana dimaksud dalam huruf a, huruf b, dan huruf c, perlu menetapkan Peraturan Menteri Energi dan Sumber Daya Mineral tentang Pedoman Penggunaan Sumber Daya Air pada Air Tanah dan Tata Cara Pengenaan, Penghitungan, Pembayaran dan/atau Penyetoran Penerimaan Negara Bukan Pajak Berupa Denda Administratif Penataan Izin Pengusahaan Air Tanah dan Persetujuan Penggunaan Air Tanah;

Considering: a. that in order to maintain groundwater sustainability and enhance the effectiveness and efficiency of groundwater resource utilization activities, it is necessary to protect groundwater from degradation regarding both quantity and quality;

b. that to implement the provisions of Article 120 and Article 147 paragraphs (1) and (3) of Government Regulation Number 30 of 2024 concerning Water Resource Management, it is necessary to regulate groundwater usage approvals;

c. that to implement the provisions of Article 8 of Government Regulation Number 19 of 2025 concerning Types and Tariffs of Non-Tax State Revenue Applicable to the Ministry of Energy and Mineral Resources, it is necessary to regulate the procedures for the imposition, calculation, payment, and/or remittance of non-tax state revenue in the form of administrative fines related to compliance with groundwater exploitation permits and groundwater usage approvals;

d. that based on the considerations referred to in letters a, b, and c, it is necessary to establish a Regulation of the Minister of Energy and Mineral Resources concerning Guidelines for Groundwater Resource Utilization and Procedures for the Imposition, Calculation, Payment, and/or Remittance of Non-Tax State Revenue in the Form of Administrative Fines Related to Compliance with Groundwater Exploitation Permits and Groundwater Usage Approvals;
