TENTANG

KETENTUAN-KETENTUAN POKOK PERTAMBANGAN

LAW OF THE REPUBLIC OF INDONESIA

NUMBER 11 OF 1967

CONCERNING

BASIC PROVISIONS ON MINING

 

DENGAN RAHMAT TUHAN YANG MAHA ESA.

BY THE GRACE OF GOD ALMIGHTY.

 

KAMI, PEJABAT PRESIDEN REPUBLIK INDONESIA,

WE, THE ACTING PRESIDENT OF THE REPUBLIC OF INDONESIA,

 

Menimbang : a. bahwa guna mempercepat terlaksananya pembangunan ekonomi Nasional dalam menuju masyarakat Indonesia yang adil dan makmur materiil dan spirituil berdasarkan Pancasila maka perlulah dikerahkan semua dana dan daya untuk mengolah dan membina segenap kekuatan ekonomi potensiil di bidang pertambangan menjadi kekuatan ekonomi riil;

b. bahwa berhubungan dengan itu, dengan tetap berpegang pada Undangundang Dasar 1945, dipandang perlu untuk mencabut Undang-undang No. 37 Prp tahun 1960 tentang Pertambangan (Lembaran-Negara tahun 1960 No. 119) serta menggantinya dengan Undang-undang Pokok Pertambangan yang baru yang lebih sesuai dengan kenyataan yang ada, dalam rangka memperkembangkan usaha-usaha pertambangan Indonesia di masa sekarang dan di kemudian hari;

Considering: a. that in order to accelerate the implementation of national economic development toward an Indonesian society that is just and prosperous—both materially and spiritually—based on Pancasila, it is necessary to mobilize all funds and resources to process and cultivate all potential economic strengths in the mining sector into actual economic strengths;

b. that in connection therewith, and while adhering to the 1945 Constitution, it is deemed necessary to revoke Law No. 37 Prp of 1960 concerning Mining (State Gazette of 1960 No. 119) and replace it with a new Basic Mining Law that is more in line with existing realities, with a view to developing Indonesian mining enterprises both at present and in the future;

 

Mengingat : 1. Pasal 5 ayat 1 dan Pasal 33 Undang-undang Dasar 1945;

2. Ketetapan Majelis Permusyawaratan Rakyat Sementara No. XXI/MPRS/1966.

3. Ketetapan Majelis Permusyawaratan Rakyat Sementara No. XXIII/MPRS/1966;

4. Ketetapan Majelis Permusyawaratan Rakyat Sementara No. XXXIII/MPRS/1967;

5. Keputusan Presiden Republik Indonesia No. 163 tahun 1966;

6. Keputusan Presiden Republik Indonesia No. 171 tahun 1967;

Having regard to:   1. Article 5, paragraph (1) and Article 33 of the 1945 Constitution;

2. Decree of the Provisional People's Consultative Assembly No. XXI/MPRS/1966;

3. Decree of the Provisional People's Consultative Assembly No. XXIII/MPRS/1966;

4. Decree of the Provisional People's Consultative Assembly No. XXXIII/MPRS/1967;
