KETENTUAN PERALIHAN DAN PENUTUP

CHAPTER XII

TRANSITIONAL AND CLOSING PROVISIONS

 

Pasal 35

Article 35

 

(1) Semua hak pertambangan dan kuasa pertambangan perusahaan Negara, perusahaan swasta, badan lain atau perseorangan yang diperoleh berdasarkan peraturan yang ada sebelum saat berlakunya Undang-undang ini, tetap dapat dijalankan sampai sejauh masa berlakunya, kecuali ada penetapan lain menurut Peraturan Pemerintah yang dikeluarkan berdasarkan kepada Undang-undang ini.

(2) Sebelum penetapan menurut Peraturan Pemerintah yang dimaksud dalam ayat (1) di atas dikeluarkan, pemegang-pemegang hak dan kuasa pertambangan tersebut harus menyesuaikan diri dengan ketentuan-ketentuan yang ada dalam Undang-undang ini.

(1) All mining rights and mining authorizations held by state-owned enterprises, private companies, other entities, or individuals—acquired under regulations in force prior to the enactment of this Law—shall remain valid for the duration of their respective terms, unless otherwise stipulated by a Government Regulation issued pursuant to this Law.

(2) Prior to the issuance of the Government Regulation referred to in paragraph (1) above, the holders of such mining rights and mining authorizations must align their operations with the provisions of this Law.
