BAB VIII

HUBUNGAN KUASA PERTAMBANGAN DENGAN HAK-HAK TANAH

CHAPTER VIII

THE RELATIONSHIP OF MINING POWER AND LAND RIGHTS

 

Pasal 26

Article 26

 

Apabila telah didapat izin pertambangan atas sesuatu daerah, atau wilayah menurut hukum yang berlaku, maka kepada mereka yang berhak atas tanah diwajibkan memperbolehkan pekerjaan pemegang kuasa pertambangan atas tanah yang bersangkutan atas dasar mufakat kepadanya:

a. sebelum pekerjaan dimulai, dengan diperlihatkannya surat kuasa pertambangan atau salinannya yang sah, diberitahukan tentang maksud dan tempat pekerjaan-pekerjaan itu akan dilakukan;

b. diberi ganti kerugian atau jaminan ganti kerugian itu terlebih dahulu.

Once a mining permit has been obtained for a specific area or territory in accordance with applicable law, the party holding rights to the land is required to permit the mining rights holder to conduct operations on said land, subject to the following conditions agreed upon with them:

a. prior to the commencement of operations, and upon presentation of the mining permit or a certified copy thereof, they must be notified of the purpose and location of the intended operations;

b. they must be provided with compensation or a guarantee of such compensation in advance.
