BASIC PROVISIONS ON MINING

 

BAB VIII

HUBUNGAN KUASA PERTAMBANGAN DENGAN HAK-HAK TANAH

CHAPTER VIII

THE RELATIONSHIP OF MINING POWER AND LAND RIGHTS

 

Pasal 27

Article 27

 

(1) Apakah telah ada hak tanah atas sebidang tanah yang bersangkutan dengan wilayah kuasa pertambangan, maka kepada yang berhak diberikan ganti rugi yang jumlahnya ditentukan bersama antara pemegang kuasa pertambangan dan yang mempunyai hak atas tanah tersebut atas dasar musyawarah dan mufakat, untuk pengantian sekali atau selama hak itu tidak dapat dipergunakan.

(2) Jika yang bersangkutan tidak dapat mencapai kata mufakat tentang ganti rugi sebagaimana dimaksud pada ayat (1) pasal ini, maka penentuannya diserahkan kepada Menteri.

(3) Jika yang bersangkutan tidak dapat menerima penentuan Menteri tentang ganti rugi sebagaimana dimaksud pada ayat (2) pasal ini, maka penentuannya diserahkan kepada Pengadilan Negeri yang daerah hukumnya meliputi daerah/wilayah yang bersangkutan.

(4) Ganti rugi yang dimaksud pada ayat (1), (2) dan (3) pasal ini beserta segala biaya yang berhubungan dengan itu dibebankan kepada pemegang kuasa pertambangan yang bersangkutan.

(5) Apabila telah diberikan kuasa pertambangan pada sebidang tanah yang di atasnya tidak terdapat hak tanah, maka atas sebidang tanah tersebut atau bagian-bagiannya tidak dapat diberi hak tanah kecuali dengan persetujuan Menteri.

(1) Where land rights already exist over a parcel of land associated with a mining authorization area, compensation shall be provided to the rights holder; the amount thereof shall be determined jointly by the mining authorization holder and the land rights holder based on deliberation and consensus, covering either a one-time payment or compensation for the period during which the rights cannot be exercised.

(2) If the parties concerned fail to reach a consensus regarding the compensation referred to in paragraph (1) of this Article, the determination thereof shall be referred to the Minister.

(3) If the parties concerned cannot accept the Minister's determination regarding the compensation referred to in paragraph (2) of this Article, the determination thereof shall be referred to the District Court having jurisdiction over the area concerned.

(4) The compensation referred to in paragraphs (1), (2), and (3) of this Article, along with all associated costs, shall be borne by the relevant mining authorization holder.

(5) Where a mining authorization has been granted for a parcel of land over which no land rights exist, no land rights may be granted over said parcel of land—or any part thereof—except with the approval of the Minister.
