merekomendasikan kepada Jurusan Teknik Sipil, Fakultas Teknik
Sipil dan Lingkungan (FTSL) UM (Universitas Mandailing) untuk memutakhirkan
dengan memahami contoh, sub bagian pertimbangan yang meliputi 1. Mengingat
bahwa, PPK (Pejabat Pembuat Komitmen) telah meminta penyedia untuk menyediakan
barang/jasa sebagaimana diterangkan dalam SSUK (Syarat-Syarat Umum Kontrak)
yang terlampir dalam kontrak ini (selanjutnya disebut ‘Pekerjaan
Pengadaan...............’) berupa 1.1. Penyedia sebagaimana dinyatakan kepada
PPK (Pejabat Pembuat Komitmen) memiliki keahlian profesional, personil, dan
sumber daya teknis, serta telah menyetujui untuk menyediakan Jasa lainnya
sesuai dengan persyaratan dan ketentuan dalam Kontrak ini, 1.2. PPK (Pejabat
Pembuat Komitmen) dan Penyedia menyatakan memiliki kewenangan untuk
menandatangani Kontrak ini, dan mengikat pihak yang diwakili, 1.3. PPK (Pejabat
Pembuat Komitmen) dan Penyedia mengakui dan menyatakan bahwa sehubungan dengan
Penandatanganan Kontrak ini masing masing pihak; 2. Isu Hukum berupa klausul
sub bagian pertimbangan memiliki isu hukum penting seperti kesepakatan para
pihak dan kapasitas (kecakapan) para pihak untuk mengikatkan diri pada
perjanjian; 3. Implikasi hukum berupa 3.1. ketiadaan klausul sub bagian
pertimbangan tidak berakibat pada sahnya atau tidak sahnya suatu perjanjian dan
3.2. ketiadaan klausul sub bagian pertimbangan dapat memiliki implikasi hukum
ketidakjelasan keterkaitan Kontrak dengan kegiatan pengadaan barang/jasa
berdasarkan Perpres (Peraturan Presiden) 54/2010 jo 70/2012. Keterkaitan
Kontrak dengan Perpres (Peraturan Presiden) 54/2010 jo 70/2012 sangat penting
dalam rangka pengaturan kontrak dan penegasan bahwa penerapan kebebasan
berkontrak (freedom of contract) tidak boleh melanggar Perpres (Peraturan
Presiden) 54/2010 jo 70/2012; dan 4 solusi hukum berupa sub bagian pertimbangan
harus dirumuskan secara lengkap dan jelas khususnya terkait dengan kegiatan
pengadaan barang/jasa Pemerintah. Klausul sub bagian pertimbangan sebaiknya
menggunakan kalimat umum dan bukan berisi kalimat perintah, larangan, dan/atau
kalimat operatif lainnya.
05 (five) of members of The Bureau of Technology, The Centre of
Development for Policy and Strategy of The Neighborhood Leadership Assembly of
The Great Mandailing Foundation to recommend to the Department of Civil
Engineering, the Faculty of Civil and Environmental Engineering of MU
(Mandailing University) by updating by understanding the example, sub section
of consideration which includes 1. Given that, the Commitment Maker Official
has requested the provider to provide goods / services as explained in the
General Contract Conditions attached to this contract (hereinafter referred to
as 'Procurement Work ... ............') in the form of 1.1. Provider as stated
to the Commitment Maker Official has professional expertise, personnel, and
technical resources, and has agreed to provide other services in accordance
with the terms and conditions in this Contract, 1.2. The Commitment Maker
Official and the Provider state that they have the authority to sign this
Contract, and bind the party represented, 1.3. The Commitment Maker Official
and the Provider acknowledges and states that in connection with the Signing of
this Contract each party; 2. Legal issues in the form of clauses of sub-section
of considerations have important legal issues such as the agreement of the
parties and the capacity (ability) of the parties to bind themselves to the
agreement; 3. Legal implications in the form of 3.1. the absence of clauses of sub-section
of consideration does not result in the validity or invalid of an agreement and
3.2. the absence of clause of a sub-section of consideration can have legal
implications for the unclear relationship between the Contract and the
procurement of goods / services based on Presidential Regulation 54/2010 jo
70/2012. The link between the Contract and Presidential Regulation 54/2010 jo
70/2012 is very important in the context of contract regulation and
confirmation that the application of freedom of contract must not violate Presidential
Regulation 54/2010 jo 70/2012; and 4 legal solutions in the form of sub-section
of consideration must be formulated in a complete and clear manner, especially
related to Government procurement of goods / services. Clause of sub section of
consideration should use general sentences and not contain sentences of command,
prohibitions, and/or other operative sentences.

Pajak Pertambahan Nilai (PPN) yang diperoleh berdasarkan rincian biaya satuan
pekerjaan sebagaimana tercantum dalam Berita Acara Hasil Klarifikasi dan
Negosiasi Teknis dan Biaya adalah sebesar Rp__________________ (__________
rupiah); 3. isu hukum berupa klausul nilai kontrak memiliki isu hukum penting seperti
kewajiban harga yang harus dibayarkan oleh PPK (Pejabat Pembuat Komitmen)
kepada Penyedia dan dasar hukum bagi pengeluaran jumlah dana bagi pelaksanaan
pekerjaan; 4. Implikasi hukum berupa 4.1. perumusan klausul nilai kontrak yang
tidak akurat dapat merugikan PPK (Pejabat Pembuat Komitmen) dan menyebabkan
tidak berjalannya kegiatan penyediaan barang/jasa secara baik, 4.2. ketiadaan
klausul nilai kontrak dapat berakibat pada sahnya atau tidaknya suatu
perjanjian karena dapat menyebabkan ketidakjelasan syarat syah mengenai “suatu
hal / obyek tertentu”, 4.3. sebagai tambahan, berdasarkan United Nations Convention on Contracts for the International Sale of
Goods (CISG), Kontrak harus menyebutkan dengan jelas Nilai Kontrak; dan 5.
Solusi hukum, klausul nilai kontrak harus dirumuskan dengan angka dan huruf
secara jelas, lengkap, dan akurat.

Department, the Faculty of Civil and Environmental Engineering of MU
(Mandailing University) to update by understanding 1. The Contract Contents
includes 1.1. contract value clause, 1.2. terminology and expression clauses,
1.3. document unity clause, 1.4. document hierarchy, 1.5. rights &
obligations, and 1.6. after the entry into force of the agreement; 2. For
example, a contract value clause for a unit price contract or a unit price
combined contract and a lump sum is written as the total of Contract Price or
Contract Value including Value Added Tax (VAT) obtained based on the details of
the work unit costs as stated in the Minutes of Results of Clarification and
Negotiation of Technical and Costs are Rp__________________ (__________
rupiah); 3. legal issues in the form of contract value clauses have important
legal issues such as price obligations that must be paid by the Commitment
Maker Official to the Provider and the legal basis for spending the amount of
funds for carrying out the work; 4. Legal implications in the form of 4.1. the
formulation of inaccurate contract value clauses can be detrimental to the
Commitment Maker Official and causes the inability to supply goods / services
properly, 4.2. the absence of a contract value clause can result in the
validity or the invalidity of an agreement because it can cause unclear legal
terms regarding "a certain thing / object", 4.3. in addition, based
on the United Nations Convention on Contracts for the International Sale of
Goods (CISG), the Contract must clearly state the Contract Value; and 5. Legal
solutions, contract value clauses must be formulated with numbers and letters
clearly, completely, and accurately.
