PRESIDEN REPUBLIK INDONESIA,
BY THE GRACE OF GOD ALMIGHTY
PRESIDENT OF THE REPUBLIC OF INDONESIA,

Pasal 1
Dalam Undang-Undang ini yang dimaksud dengan :
Article 1
In this Law what is meant by :

59. Ketentuan Pasal 81 dihapus.

60. Ketentuan Pasal 82 dihapus.

61. Ketentuan Pasal 83 diubah sehingga berbunyi sebagai berikut :

Pasal 83

Persyaratan luas wilayah dan jangka waktu sesuai dengan kelompok Usaha Pertambangan yang berlaku bagi pemegang IUPK meliputi:

a. luas 1 (satu) WIUPK untuk tahap kegiatan Eksplorasi Pertambangan Mineral logam diberikan paling iuas 100.000 (seratus ribu) hektare;

b. luas 1 (satu) WIUPK untuk tahap kegiatan Eksplorasi Pertambangan Batubara diberikan paling luas 50.000 (lima puluh ribu) hektare;

c. luas 1 (satu) WIUPK untuk tahap kegiatan Operasi Produksi Pertambangan Mineral logam atau Batubara diberikan berdasarkan hasil evaluasi Menteri terhadap rencana pengembangan seluruh wilayah yang diusulkan oleh pemegang IUPK;

d. jangka waktu kegiatan Eksplorasi Pertambangan Mineral logam dapat diberikan selama 8 (delapan) tahun;

e. jangka waktu kegiatan Eksplorasi Pertambangan Batubara dapat diberikan selama 7 (tujuh) tahun;

f. jangka waktu kegiatan Operasi Produksi Mineral logam atau Batubara dapat diberikan paling lama 20 (dua puluh) tahun dan dijamin memperoleh perpanjangan 2 (dua) kali masing-masing 10 (sepuluh) tahun setelah memenuhi persyaratan sesuai dengan ketentuan peraturan perundang-undangan;

g. jangka waktu kegiatan Operasi Produksi Mineral logam yang terintegrasi dengan fasilitas pengolahan dan/atau pemurnian diberikan jangka waktu selama 30 (tiga puluh) tahun dan dijamin memperoleh perpanjangan selama 10 (sepuluh) tahun setiap kali perpanjangan setelah memenuhi persyaratan sesuai dengan ketentuan peraturan perundang-undangan; dan

h. jangka waktu kegiatan Operasi Produksi Batubara yang terintegrasi dengan kegiatan Pengembangan dan/atau Pemanfaatan Batubara diberikan jangka waktu selama 30 (tiga puluh) tahun dan dijamin memperoleh perpanjangan selama 10 (sepuluh) tahun setiap kali perpanjangan setelah memenuhi persyaratan sesuai dengan ketentuan peraturan perundang-undangan.

59. The provisions of Article 81 are deleted.

60. The provisions of Article 82 are deleted.

61. The provisions of Article 83 are amended to read as follows:

Article 83

Requirements for area area and time period according to the Mining Business group that apply to IUPK (in Bahasa) holders include:

a. the area of 1 (one) WIUPK (in Bahasa) for the Metal Mineral Mining Exploration activity stage is given a maximum area of 100,000 (one hundred thousand) hectares;

b. the area of 1 (one) WIUPK (in Bahasa) for the Coal Mining Exploration activity phase is given a maximum area of 50,000 (fifty thousand) hectares;

c. the area of 1 (one) WIUPK (in Bahasa) for the Metal Mineral or Coal Mining Production Operation activity stage is granted based on the results of the Minister's evaluation of the development plan for the entire area proposed by the IUPK (in Bahasa) holder;

d. the period for Metal Mineral Mining Exploration activities can be given for 8 (eight) years;

e. the period for Coal Mining Exploration activities can be given for 7 (seven) years;

f. The term for Metal Mineral or Coal Production Operation activities can be granted for a maximum of 20 (twenty) years and is guaranteed to be extended 2 (two) times of 10 (ten) years each after fulfilling the requirements in accordance with the provisions of statutory regulations;

g. The term of Metal Mineral Production Operation activities integrated with processing and/or refining facilities is given a period of 30 (thirty) years and is guaranteed to obtain an extension of 10 (ten) years for each extension after fulfilling the requirements in accordance with the provisions of statutory regulations; And

h. The term for Coal Production Operation activities that are integrated with Coal Development and/or Utilization activities is given a period of 30 (thirty) years and is guaranteed to obtain an extension of 10 (ten) years for each extension after fulfilling the requirements in accordance with the provisions of statutory regulations.
