PRESIDENT OF THE REPUBLIC OF INDONESIA,

Pasal 1
Dalam Undang-Undang ini yang dimaksud dengan :
Article 1
In this Law what is meant by :

15. Ketentuan Pasal 15 dihapus.

16. Ketentuan Pasal 17 diubah sehingga berbunyi sebagai berikut:

Pasal 17

(1) Luas dan batas WIUP Mineral logam dan WIUP Batubara ditetapkan oleh Menteri setelah ditentukan oleh gubernur.

(2) Luas dan batas WIUP Mineral logam dan WIUP Batubara yang berada pada wilayah laut ditetapkan oleh Menteri setelah berkoordinasi dengan instansi terkait.

(3) Penetapan luas dan batas WIUP Mineral logam dan WIUP Batubara sebagaimana dimaksud pada ayat (1) dan ayat (2), harus memenuhi kriteria:

a. terdapat data sumber daya Mineral logam atau Batubara; dan/atau

b. terdapat data cadangan Mineral logam atau Batubara.

(4) Selain kriteria sebagaimana dimaksud pada ayat (3) Menteri menetapkan WIUP Mineral logam dan WIUP Batubara berdasarkan pertimbangan:

a. ketahanan cadangan;

b. kemampuan produksi nasional; danlatau

c. pemenuhan kebutuhan dalam negeri.

(5) Dalam hal WIUP Mineral logam dan WIUP Batubara telah ditetapkan oleh Menteri, pemanfaatan potensi sumber daya alam yang terdapat di dalamnya diprioritaskan untuk kegiatan Usaha Pertambangan.

15. The provisions of Article 15 are deleted.

16. The provisions of Article 17 are amended to read as follows:

Article 17

(1) The area and boundaries of Metal Mineral WIUP (in Bahasa) and Coal WIUP (in Bahasa) are determined by the Minister after being determined by the governor.

(2) The area and boundaries of metallic mineral WIUP (in Bahasa) and Coal WIUP (in Bahasa) located in marine areas are determined by the Minister after coordinating with the relevant agencies.

(3) Determination of the area and boundaries of metal mineral WIUP (in Bahasa) and Coal WIUP (in Bahasa) as intended in paragraph (1) and paragraph (2), must meet the following criteria:

a. there is data on metallic mineral or coal resources; and/or

b. there is data on reserves of metallic minerals or coal.

(4) In addition to the criteria as intended in paragraph (3), the Minister shall determine the Metal Mineral WIUP (in Bahasa) and Coal WIUP (in Bahasa) based on considerations:

a. reserve resilience;

b. national production capabilities; and or

c. meeting domestic needs.

(5) In the event that the Metal Mineral WIUP (in Bahasa) and Coal WIUP (in Bahasa) have been determined by the Minister, the utilization of the natural resource potential contained therein is prioritized for Mining Business activities.
