PRESIDENT OF THE REPUBLIC OF INDONESIA,

Pasal 1
Dalam Undang-Undang ini yang dimaksud dengan :
Article 1
In this Law what is meant by :

25. Di antara Pasal 31 dan Pasal 32 disisipkan 1 (satu) pasal, yakni Pasal 31A sehingga berbunyi sebagai berikut :

Pasal 31A

(1) Penetapan WIUPK sebagaimana dimaksud dalam Pasal 31 dilakukan setelah memenuhi kriteria:

a. pemanfaatan ruang dan kawasan untuk kegiatan Usaha Pertambangan sesuai dengan ketentuan peraturan perundang-undangan;

b. ketahanan cadangan;

c. kemampuan produksi nasional; dan/atau

d. pemenuhan kebutuhan dalam negeri.

(2) Pemerintah Pusat dan Pemerintah Daerah menjamin tidak ada perubahan pemanfaatan ruang dan kawasan pada WIUPK yang telah ditetapkan sebagaimana dimaksud pada ayat (1).

(3) Pemerintah Pusat dan Pemerintah Daerah menjamin penerbitan pertzinan lain yang diperlukan dalam rangka pelaksanaan kegiatan Usaha Pertambangan pada WIUPK yang telah ditetapkan sepanjang telah memenuhi persyaratan sesuai dengan ketentuan peraturan perundang-undangan.

25. Between Article 31 and Article 32, 1 (one) article is inserted, namely Article 31A so that it reads as follows:

Article 31A

(1) The determination of WIUPK as intended in Article 31 is carried out after fulfilling the following criteria:

a. utilization of space and areas for Mining Business activities in accordance with statutory provisions;

b. reserve resilience;

c. national production capabilities; and/or

d. meeting domestic needs.

(2) The Central Government and Regional Government guarantee that there will be no changes in the use of space and areas in WIUPK that have been determined as intended in paragraph (1).

(3) The Central Government and Regional Government guarantee the issuance of other permits required for the implementation of Mining Business activities in the designated WIUPK as long as they meet the requirements in accordance with the provisions of statutory regulations.
