Pemeriksaan.
72. Supervision and Inspection.
PPK (Pejabat Pembuat Komitmen) berwenang melakukan pengawasan dan
pemeriksaan terhadap pelaksanaan pekerjaan yang dilaksanakan oleh Penyedia. PPK
(Pejabat Pembuat Komitmen) dapat memerintahkan kepada pihak ketiga untuk
melakukan pengawasan dan pemeriksaan atas semua pelaksanaan pekerjaan yang
dilaksanakan oleh Penyedia.
The
Commitment Making Officer has the authority to supervise and check the
implementation of work carried out by the Provider. The Commitment Making
Official can order third parties to supervise and inspect all implementation of
work carried out by the Provider.
73. Penilaian Pekerjaan Sementara oleh PPK (Pejabat Pembuat
Komitmen).
73. Temporary Job
Assessment by The Commitment Making Officer.
73.1. PPK (Pejabat Pembuat Komitmen) dalam Masa
Pelaksanaan pekerjaan dapat melakukan penilaian sementara atas hasil pekerjaan
yang dilakukan oleh Penyedia.
73.1. The Commitment
Making Officials in the Period of Execution of the work can make a temporary
assessment of the results of work carried out by the Provider.
73.2. Penilaian atas hasil pekerjaan dilakukan
terhadap mutu dan kemajuan fisik pekerjaan.
73.2. An assessment of the
results of work is carried out on the physical quality and progress of the work.
74. Pemeriksaan dan
Pengujian Cacat Mutu.
74. Examination and Testing of Quality Defects.
74.1. PPK (Pejabat Pembuat Komitmen) atau
Pengawas Pekerjaan akan memeriksa setiap hasil pekerjaan dan memberitahukan
Penyedia secara tertulis atas setiap Cacat Mutu yang ditemukan. PPK (Pejabat
Pembuat Komitmen) atau Pengawas Pekerjaan dapat memerintahkan Penyedia untuk
menemukan dan mengungkapkan Cacat Mutu, serta menguji hasil pekerjaan yang
dianggap oleh PPK (Pejabat Pembuat Komitmen) atau Pengawas Pekerjaan mengandung
Cacat Mutu . Penyedia bertanggung jawab atas perbaikan Cacat Mutu selama Masa
Kontrak.
74.1. The Commitment
Making Officer or the Work Supervisor will examine each work result and notify
the Provider in writing of any Quality Defects found. The Commitment Making Officer
or Job Supervisor can order the Provider to find and disclose Quality Defects,
as well as test the work results that are considered by the Commitment Making
Officer or Work Supervisor to contain Quality Defects. The Provider is
responsible for the improvement of Quality Defects during the Contract Period.
74.2. Jika PPK (Pejabat Pembuat Komitmen) atau
Pengawas Pekerjaan memerintahkan Penyedia untuk melakukan pengujian Cacat Mutu
yang tidak tercantum dalam Spesifikasi Teknis dan Gambar, dan hasil uji coba
menunjukkan adanya cacat mutu maka Penyedia berkewajiban untuk menanggung biaya
pengujian tersebut. Jika tidak ditemukan adanya Cacat Mutu maka uji coba
tersebut dianggap sebagai Peristiwa Kompensasi.
74.2. If the Commitment
Making Officer or Occupation Supervisor instructs the Provider to carry out a
Quality Defect test that is not listed in the Technical Specifications and
Image, and the results of the trial indicate a quality defect, the Provider is
obliged to bear the testing costs. If there is no quality defect, the trial is
considered a compensation event.
75. Perbaikan Cacat
Mutu.
75. Improvement of Quality Defects.
75.1. PPK (Pejabat Pembuat Komitmen) atau Pengawas
Pekerjaan akan menyampaikan pemberitahuan Cacat Mutu kepada Penyedia segera
setelah ditemukan Cacat Mutu tersebut. Penyedia bertanggung jawab atas Cacat
Mutu selama Masa Kontrak.
75.1. The Commitment
Making Officer or Work Supervisor will notify Quality Defects to the Provider
immediately after the Quality Defect is found. The Provider is responsible for
Quality Defects during the Contract Period.
75.2. Terhadap pemberitahuan Cacat Mutu tersebut,
Penyedia berkewajiban untuk memperbaiki Cacat Mutu dalam jangka waktu yang
ditetapkan dalam pemberitahuan.
75.2. Regarding the
notification of Quality Defects, the Provider is obliged to correct the Quality
Defects within the period specified in the notification.
75.3. Jika Penyedia tidak memperbaiki Cacat Mutu
dalam jangka waktu yang ditentukan maka PPK (Pejabat Pembuat Komitmen),
berdasarkan pertimbangan Pengawas Pekerjaan, berhak untuk secara langsung atau
melalui pihak ketiga yang ditunjuk oleh PPK (Pejabat Pembuat Komitmen)
melakukan perbaikan tersebut. Penyedia segera setelah menerima klaim PPK
(Pejabat Pembuat Komitmen) secara tertulis berkewajiban untuk mengganti biaya
perbaikan tersebut. PPK (Pejabat Pembuat Komitmen) dapat memperoleh penggantian
biaya dengan memotong pembayaran atas tagihan Penyedia yang jatuh tempo (jika
ada) atau uang retensi atau pencairan Jaminan Pemeliharaan atau jika tidak ada
maka biaya penggantian akan diperhitungkan sebagai utang Penyedia kepada PPK
(Pejabat Pembuat Komitmen) yang telah jatuh tempo.
75.3. If the Provider does
not correct Quality Defects within the stipulated period, the Commitment Making
Officer, based on the consideration of the Work Supervisor, has the right to
directly or through a third party appointed by the Commitment Making Officer to
make such repairs. The provider immediately after receiving the claim of The Commitment
Making Officer in writing is obliged to reimburse the repair costs. The
Commitment Making Officer can get reimbursement by deducting payment for
Provider bills that are due (if any) or retention money or disbursement of
Maintenance Guarantee or if there is no replacement fee will be calculated as
Provider's debt to The Commitment Making Officer has matured.
75.4. PPK (Pejabat Pembuat Komitmen) mengenakan
denda keterlambatan untuk setiap keterlambatan perbaikan Cacat Mutu dan
mengenakan Sanksi Daftar Hitam kepada Penyedia jika tidak melaksanakan
perbaikan cacat mutu. Besaran denda keterlambatan dan jangka waktu perbaikan
akibat Cacat Mutu ini ditentukan dalam SSKK (Syarat – Syarat Khusus Kontrak).
75.4. The Commitment
Making Officials imposes a late fine for any delay in repairing Quality Defects
and imposes Black List Sanctions on the Provider if it does not carry out
quality defect repairs. The amount of the late fine and the duration of repairs
due to this Quality Defect is determined in the CST (Contract Specific Terms).
76. Kegagalan
Bangunan.
76. Building Failures.
76.1. Apabila terjadi Kegagalan Bangunan maka PPK
(Pejabat Pembuat Komitmen) dan/atau Penyedia terhitung sejak Tanggal Penyerahan
Akhir Pekerjaan bertanggung jawab atas Kegagalan Bangunan sesuai dengan
kesalahan masing - masing selama Umur Konstruksi yang tercantum dalam SSKK
(Syarat – Syarat Khusus Kontrak) tetapi tidak lebih dari 10 (sepuluh) tahun,
dan dalam SSKK (Syarat – Syarat Khusus Kontrak) agar dicantumkan lama pertanggungan
terhadap Kegagalan Bangunan yang ditetapkan apabila rencana Umur Konstruksi
kurang dari 10 (sepuluh) tahun.
76.1. In the event of a
Building Failure, the Commitment Making Officer and / or Provider from the End
of Work Submission Date shall be responsible for Building Failure in accordance
with the respective errors during the Construction Age listed in the SCT
(Special Contract Terms) but not more than 10 ( ten) years, and in the SCC
(Special Conditions of Contract) so that the duration of coverage for Building
Failure is specified if the Construction Age plan is less than 10 (ten) years.
76.2. Penyedia berkewajiban untuk melindungi,
membebaskan, dan menanggung tanpa batas PPK (Pejabat Pembuat Komitmen) beserta
instansinya terhadap semua bentuk tuntutan, tanggung jawab, kewajiban,
kehilangan, kerugian, denda, gugatan atau tuntutan hukum, proses pemeriksaan
hukum, dan biaya yang dikenakan terhadap PPK (Pejabat Pembuat Komitmen) beserta
instansinya [kecuali kerugian yang mendasari tuntutan tersebut disebabkan
kesalahan atau kelalaian PPK (Pejabat Pembuat Komitmen)] sehubungan dengan
klaim kehilangan atau kerusakan harta benda, dan cidera tubuh, sakit atau
kematian pihak ketiga yang timbul dari kegagalan bangunan.
76.2. The Provider is obliged to protect, release,
and bear without limitation the Commitment Making Officer and its institutions
on all forms of claims, responsibilities, obligations, losses, disadvantage, fines,
lawsuits, legal proceedings, and fees imposed on The Commitment Making Officers
and their institutions [except for the losses underlying the claim due to
errors or omissions of The Commitment Making Officials] in connection with
claims of loss or damage to property, bodily injury, illness or death of third
parties arising from building failures.
76.3. PPK (Pejabat Pembuat Komitmen) maupun
Penyedia berkewajiban untuk menyimpan dan memelihara semua dokumen yang
digunakan dan terkait dengan pelaksanaan ini selama Umur Konstruksi yang
tercantum dalam SSKK (Syarat – Syarat Khusus Kontrak) tetapi tidak lebih dari
10 (sepuluh) tahun.
76.3. The Commitment
Making Official and the Provider are obliged to keep and maintain all documents
used and related to this implementation as long as the Construction Age listed
in the Special Conditions for Contracts but not more than 10 (ten) years.

sungguh-sungguh menyelesaikan secara damai semua perselisihan yang timbul dari
atau berhubungan dengan Kontrak ini atau interpretasinya selama atau setelah
pelaksanaan pekerjaan ini dengan prinsip dasar musyawarah untuk mencapai
kemufakatan.
77.1. The Parties are
obliged to endeavor to resolve peacefully all disputes arising from or relating
to this Contract or their interpretation during or after the execution of this
work with the basic principles of deliberation to achieve consensus.
77.2. Dalam hal musyawarah para pihak sebagaimana
dimaksud pada pasal 77.1 tidak dapat mencapai suatu kemufakatan, maka
penyelesaian perselisihan atau sengketa antara para pihak dalam Kontrak dapat
dilakukan melalui, alternatif penyelesaian sengketa, dewan sengketa
(menggantikan mediasi/konsiliasi), dan/atau arbitrase.
77.2. In the event that
the parties' deliberations referred to in article 77.1 cannot reach a
consensus, then the resolution of a discord or dispute between the parties in
the Contract can be done through, alternative of dispute resolution, dispute
council (replacing mediation / conciliation), and / or arbitration.
77.3. Penyelesaian perselisihan/sengketa yang
dipilih ditetapkan dalam SSKK (Syarat – Syarat Khusus Kontrak).
77.3. Settlement of
selected discord / disputes is specified in the CST (Contract Specific Terms).
78. Itikad Baik.
78. Good faith.
78.1. Para pihak bertindak berdasarkan asas saling
percaya yang disesuaikan dengan hak-hak yang terdapat dalam Kontrak.
78.1. The parties act on
the principle of mutual trust in accordance with the rights contained in the
Contract.
78.2. Para pihak setuju untuk melaksanakan
perjanjian dengan jujur tanpa menonjolkan kepentingan masing-masing pihak.
Apabila selama Kontrak, salah satu pihak merasa dirugikan, maka diupayakan tindakan
yang terbaik untuk mengatasi keadaan tersebut.
78.2. The parties agree to
carry out agreements honestly without highlighting the interests of each party.
If during the Contract, one of the parties feels disadvantaged, then the best
action is taken to overcome the situation.
