Peserta Pemilihan/ Penyedia Yang Dikenakan Sanksi Daftar Hitam Sanksi daftar hitam dikenakan kepada peserta pemilihan/Penyedia apabila : a. peserta pemilihan menyampaikan dokumen atau keterangan palsu/tidak benar untuk memenuhi persyaratan yang ditentukan dalam Dokumen Pemilihan; b. peserta pemilihan terindikasi melakukan persekongkolan dengan peserta lain untuk mengatur harga penawaran. Indikasi persekongkolan antar peserta memenuhi sekurang-kurangnya 2 (dua) indikasi di bawah ini : 1) kesamaan dalam Dokumen Penawaran, antara lain pada : metode kerja, bahan, alat, analisa pendekatan teknis, koefisien, harga satuan dasar upah, bahan dan alat, harga satuan pekerjaan, dan/atau spesifikasi teknis/barang yang ditawarkan (merk/tipe/jenis) dan/atau dukungan teknis; 2) para peserta yang terindikasi persekongkolan memasukkan penawaran dengan nilai penawaran mendekati HPS (Harga Perkiraan Sendiri) dan/atau hampir sama; 3) adanya keikutsertaan beberapa Penyedia Barang/Jasa yang berada dalam 1 (satu) kendali; 4) adanya kesamaan/kesalahan isi Dokumen Penawaran, antara lain kesamaan/kesalahan pengetikan, susunan, dan format penulisan; dan/atau 5) jaminan penawaran diterbitkan dari penerbit penjaminan yang sama dan nomornya berurutan; c. peserta pemilihan terindikasi melakukan Korupsi, Kolusi, dan/atau Nepotisme (KKN) dalam pemilihan Penyedia; d. peserta pemilihan yang mengundurkan diri dengan alasan yang tidak dapat diterima Pokja Pemilihan; e. pemenang Pemilihan yang telah menerima Surat Penunjukan Penyedia Barang Jasa (SPPBJ) mengundurkan diri sebelum penandatanganan Kontrak dengan alasan yang tidak dapat diterima oleh PPK (Pejabat Pembuat Komitmen); f. Election Participants / Providers Subject to Black List Sanctions are imposed on election participants / Providers if : a. election participants submit false / incorrect documents or information to fulfill the requirements specified in the Bidding Document; b. Election participants indicated conspiracy with other participants to arrange bid prices. Umum dan Perumahan Rakyat untuk Tahun Anggaran 2019 yaitu Lampiran I Surat
Edaran Menteri Pekerjaan Umum dan Perumahan Rakyat Nomor 10 / SE / M / 2018
tentang Pemberlakuan Standar Dokumen Pemilihan Pengadaan Jasa Konstruksi dalam
Rangka Lelang Dini di Kementerian Pekerjaan Umum dan Perumahan Rakyat untuk
Tahun Anggaran 2019 yaitu Umum yaitu Alih Pengalaman dan
Pendayagunaan Produksi Dalam Negeri, 1. Dalam hal pelaksanaan paket pekerjaan
konstruksi dengan nilai pagu anggaran di atas Rp50.000.000.000,00 (lima puluh
miliar rupiah), penyedia jasa pelaksana konstruksi diwajibkan memberikan alih
pengalaman/ keahlian melalui sistem kerja praktik/magang; 2. Peserta
berkewajiban menyampaikan penawaran yang mengutamakan material/bahan produksi dalam negeri dan tenaga kerja Indonesia
untuk pekerjaan konstruksi yang dilaksanakan di Indonesia; 3. Dalam pelaksanaan
pekerjaan konstruksi dimungkinkan menggunakan bahan baku, tenaga ahli, dan perangkat
lunak yang berasal dari luar negeri (impor) dengan ketentuan: a. pemilahan atau
pembagian komponen harus benar-benar mencerminkan bagian atau komponen yang
telah dapat diproduksi di dalam negeri dan bagian atau komponen yang masih
harus diimpor; b. komponen berupa bahan baku belum diproduksi di dalam negeri
dan/atau spesifikasi teknis bahan baku yang diproduksi di dalam negeri belum
memenuhi persyaratan; c. pekerjaan pemasangan, pabrikasi, pengujian dan lainnya
sedapat mungkin dilakukan di dalam negeri; d. semaksimal mungkin menggunakan
jasa pelayanan yang ada di dalam negeri, seperti jasa asuransi, angkutan,
ekspedisi, perbankan, dan pemeliharaan; e. penggunaan tenaga ahli asing
dilakukan semata-mata untuk mencukupi kebutuhan jenis keahlian yang belum dapat
diperoleh di Indonesia, disusun berdasarkan keperluan yang nyata, dan
diusahakan secara terencana untuk semaksimal mungkin terjadinya alih
pengalaman/keahlian dari tenaga ahli asing tersebut ke tenaga Indonesia; dan f.
peserta diwajibkan membuat daftar Barang yang diimpor yang dilengkapi dengan
spesifikasi teknis, jumlah dan harga yang dilampirkan pada Dokumen Penawaran; 4.
Pengadaan barang/jasa impor dimungkinkan dalam hal: a. barang/jasa tersebut
belum dapat diproduksi/dihasilkan di dalam negeri; b. spesifikasi teknis barang
yang diproduksi dan/atau kualifikasi teknis tenaga ahli dalam negeri belum
memenuhi persyaratan; dan/atau c. volume produksi dalam negeri tidak mampu
memenuhi kebutuhan; dan 5. Pemberian preferensi harga terhadap penawaran peserta
atas penggunaan produksi dalam negeri ditetapkan dalam Lembar Data Pemilihan
(LDP).

2019,, namely General namely Experience Transfer and Utilization
of Domestic Production, 1. In terms of implementing construction work packages
with a budget ceiling value of more than Rp 50,000,000,000 (fifty billion
rupiah), construction service providers are required to provide experience /
expertise transfer through a practical work system / internship; 2.
Participants are obliged to submit offers that prioritize domestic production of
materials / substance and Indonesian labor for construction work carried out in
Indonesia; 3. In the implementation of construction work it is possible to use
raw materials, experts, and software originating from abroad (import) provided
that : a. sorting or division of components must truly reflect parts or
components that can be produced domestically and parts or components that still
need to be imported; b. components in the form of raw materials not yet
produced domestically and / or technical specifications of domestically
produced raw materials do not meet the requirements; c. the work of installing,
manufacturing, testing and others wherever possible is carried out in the
country; d. as much as possible using existing services in the country, such as
insurance services, transportation, expedition, banking, and maintenance; e.
the use of foreign experts is carried out solely to meet the needs of the types
of expertise that cannot yet be obtained in Indonesia, prepared based on real
needs, and planned in a manner that maximizes the transfer of experience /
expertise of these foreign experts to Indonesian personnel as much as possible;
and f. participants are required to make a list of imported goods equipped with
technical specifications, quantities and prices attached to the Bid Documents;4. The procurement of imported goods / services is
possible in terms of: a. the goods / services cannot be produced; b. technical
specifications of goods produced and / or technical qualifications of domestic
experts have not met the requirements; and / or c. domestic production volume
is not able to meet the needs; and 5. Giving price preference for participant

of the Standared of Selection Document for the Procurement of Construction
Services in the Early Auction Framework at the Ministry of Public Works and
Public Housing for Fiscal Year 2019, namely General that is Transfer of Domestic Production Experience
and Utilization, Bidding Document, Fill in the Bidding Document, 1. The Bidding
Document consists of Tender Documents and Qualification Documents, and 2. The
Bidding Document consists of: a. General; b. Announcement; c. Instructions to
Participants; d. Election Data Sheet; e. Form of Bidding Documents: 1)
Administrative Documents: a) Bid Letter; b) Original Offer Guarantee (if
required); c) Agreement on Operation Cooperation (if the participant is in the
form of Joint operation); 2) Technical Bidding Documents: a) Method of carrying
out work; b) The period of execution of work; c) List of Main Equipment; d)
List of Managerial Personnel and accompanied by a statement of ownership of the
work competency certificate; e) Construction Safety Plan Form; and f) List of
Subcontracted Parts of Work (if required); and 3) Price Bid Documents: a) In
accordance with the Bid Letter in the Administrative Document; b) List of
Quantities and Prices (for the work part of the Unit Price) as well as List of the
Output and Price (for the Lumsum work section); and c) Specifically if there is
an evaluation of the fairness of prices below 80% of Self Estimated Price: (1)
Work Unit Price Analysis Form (for unit price work); and (2) Output and Price
Details Form (for lump sum jobs); Election participants will fulfill the Price
Bid Documents in letters c) (1), and c) (2), at the time of clarification of
the fairness of the price. Job Unit Price Analysis (for part of unit price
work) and Output and Price Details (for lump sum jobs) are not part of the
Contract Document; f. Draft Contract (already completed by the Commitment
Making Officer: 1) Letter of Agreement; 2) General Conditions of Contract; 3)
Special Conditions for Contracts; g. Technical Specifications and / or Images;
h. Examples of other forms of documents: 1) Letter
of Appointment for Goods / Services Providers; 2) Warrant
Starts Work; 3) Guarantee of Implementation; 4) Advance
Payment Guarantee (if given a down payment); 5) Maintenance Guarantee; 6)
Recapitulation Form for Calculating Domestic Component (if given price
preference); and 7) List of imported goods (if there are imported goods); 3.
The form of the Qualification Document includes: a. Qualification Data Sheet, b.
Integrity Pact; (Regulated in Electronic Procurement System. In the case of Joint
Operation, the Qualification Document is completed with the Integrity Pact of Joint
Operation member submitted by leadfirm), c. Qualification Form; (Arranged in Electronic
Procurement System). In the case of Joint Operation, the Qualification Document
is completed with the Qualification Form of Joint Operation member submitted by
leadfirm), d. Instructions for Completing the Qualification Form for Joint Operation
participants; and e. Procedure for Qualification Evaluation; and 4.
Participants are obliged to examine the entire contents of the Bidding
Document. Failure to submit Bid Documents and Qualification Documents that do
not meet the requirements in the Bidding Document is the risk of the

beserta seluruh korespondensi tertulis dalam proses pemilihan menggunakan
Bahasa Indonesia; dan 2. Pemberian Penjelasan, 2.1. Pemberian penjelasan dilakukan secara online melalui aplikasi Sistem Pengadaan
Secara Elektronik (SPSE) sesuai jadwal dalam aplikasi Sistem Pengadaan Secara
Elektronik (SPSE), 2.2. Peserta yang tidak aktif/membuka Sistem Pengadaan
Secara Elektronik (SPSE) dan/atau tidak bertanya pada saat pemberian
penjelasan, tidak dapat dijadikan dasar untuk menolak/menggugurkan penawaran, 2.3.
Apabila diperlukan, Pokja Pemilihan dapat memberikan informasi yang dianggap
penting terkait dengan Dokumen Pemilihan, 2.4. Apabila diperlukan, Pokja
Pemilihan dapat memberikan penjelasan lanjutan dengan cara melakukan peninjauan
lapangan. Biaya yang diperlukan peserta dalam rangka peninjauan lapangan

Procurement System and / or do not ask when giving an
explanation cannot be used as a basis for rejecting / aborting the offer, 2.3.
If needed, the Election Working Group can provide information that is
