Evaluasi Kualifikasi, 1.1. Kelompok Kerja (Pokja) Pemilihan melakukan evaluasi kualifikasi terhadap dokumen kualifikasi yang disampaikan (diunggah) oleh peserta melalui form elektronik isian kualifikasi dalam aplikasi Sistem Pengadaan Secara Elektronik (SPSE) atau pada fasilitas upload data kualifikasi lainnya, 1.2. Data kualifikasi pada form elektronik isian kualifikasi dalam aplikasi Sistem Pengadaan Secara Elektronik (SPSE) atau pada fasilitas upload data kualifikasi lainnya merupakan bagian yang saling melengkapi, 1.3. dalam hal dijumpai perbedaan mengenai isian data kualifikasi dengan data yang diunggah (upload), maka data yang dianggap benar adalah data yang terdapat dalam isian kualifikasi form elektronik Sistem Pengadaan Secara Elektronik (SPSE), 1.4. Evaluasi kualifikasi dapat dilakukan bersamaan dengan tahapan Evaluasi Penawaran, 1.5. Evaluasi kualifikasi menggunakan sistem gugur, 1.6. Evaluasi terhadap Sertifikat Badan Usaha (SBU) memperhatikan ketentuan sebagai berikut: a) masa berlaku Sertifikat Badan Usaha (SBU) berdasarkan masa berlaku yang tertera/tertulis pada sertifikat tersebut dengan tidak memperhatikan ketentuan registrasi tahunan, b) Sertifikat Badan Usaha (SBU) yang habis masa berlakunya sebelum batas akhir pemasukan Dokumen Penawaran tidak dapat diterima dan penyedia dinyatakan gugur, dan c) dalam hal masa berlaku Sertifikat Badan Usaha (SBU) habis setelah batas akhir pemasukan Dokumen Penawaran, maka Peserta harus menyampaikan Sertifikat Badan Usaha (SBU) yang sudah diperpanjang kepada Pejabat Pembuat Komitmen pada saat rapat persiapan penunjukan penyedia, 1.7. dalam hal peserta ber- KSO (Kerja Sama Operasi), dokumen kualifikasi dilengkapi dengan Pakta Integritas dari anggota KSO (Kerja Sama Operasi)-nya. Apabila tidak ada, maka tidak dievaluasi lebih lanjut dan dinyatakan gugur kualifikasi, 1.8. apabila ditemukan hal-hal dan/atau data yang kurang jelas maka dilakukan klarifikasi secara tertulis namun tidak boleh mengubah substansi formulir isian kualifikasi, 1.9. evaluasi kualifikasi dalam proses pascakualifikasi sudah merupakan ajang kompetisi, maka data yang kurang tidak dapat dilengkapi, 1.10. Selain ketentuan di atas, Peserta dinyatakan lulus kualifikasi apabila memenuhi ketentuan pada Lembar Data Kualifikasi (LDK); 2. Pembuktian Kualifikasi, 2.1. Pembuktian kualifikasi dilakukan terhadap peserta yang memenuhi persyaratan kualifikasi, 2.2. Undangan pembuktian kualifikasi harus disampaikan tertulis secara elektronik dan/atau non elektronik, 2.3. dalam undangan pembuktian kualifikasi sudah menyebutkan dokumen yang wajib dibawa oleh peserta pada saat pembuktian kualifikasi, 2.4. Pembuktian kualifikasi tidak dilakukan jika peserta telah terkualifikasi melalui Sistem Informasi Kinerja Penyedia (SIKaP), 2.5. Pembuktian kualifikasi dilakukan di luar aplikasi Sistem Pengadaan Secara Elektronik (SPSE) [offline] dengan memperhitungkan waktu yang dibutuhkan untuk kehadiran penyedia dan penyiapan dokumen yang akan dibuktikan, 2.6. apabila peserta tidak dapat menghadiri pembuktian kualifikasi dengan alasan yang dapat diterima, maka Kelompok Kerja (Pokja) Pemilihan memperpanjang waktu pembuktian kualifikasi sekurang - kurangnya 1 (satu) hari kerja, 2.7. dalam hal peserta tidak hadir karena tidak dapat mengakses data kontak (misal akun email atau no telepon) tidak dapat dibuka/dihubungi, tidak sempat mengakses atau alasan teknis apapun dari sisi peserta, maka risiko sepenuhnya ada pada peserta, 2.8. Wakil peserta yang hadir pada saat pembuktian kualifikasi adalah: a. Direksi yang namanya ada dalam akta pendirian/perubahan atau pihak yang sah menurut akta pendirian/perubahan, b. Penerima kuasa dari direksi yang nama penerima kuasanya tercantum dalam akta pendirian/perubahan, c. Pihak lain yang bukan direksi dapat menghadiri pembuktian kualifikasi selama berstatus sebagai tenaga kerja tetap (yang dibuktikan dengan bukti setor pajak PPH (Pajak Penghasilan) Pasal 21 Form 1721 atau Form 1721-I atau kepesertaan BPJS (Badan Penyelenggara Jaminan Sosial)-Ketenagakerjaan dan memperoleh kuasa dari Direksi yang namanya ada dalam akta pendirian/perubahan atau pihak yang sah menurut akta pendirian/perubahan, d. Kepala Cabang perusahaan yang diangkat oleh kantor pusat yang dibuktikan dengan dokumen otentik, atau e. Pejabat yang menurut Perjanjian Kerja Sama Operasi (KSO) berhak mewakili KSO (Kerja Sama Operasi), 2.9. pembuktian kualifikasi dilakukan dengan memverifikasi kesesuaian data pada informasi Formulir elektonik isian kualifikasi pada Sistem Pengadaan Secara Elektronik (SPSE) atau fasilitas lain yang disediakan dengan dokumen asli, salinan dokumen yang sudah dilegalisir oleh pejabat yang berwenang dan meminta salinan dokumen tersebut, dan/atau melalui fasilitas elektronik yang disediakan oleh penerbit dokumen. Pembuktian kualifikasi terhadap alamat penyedia, peralatan, dan/atau sumber daya manusia serta persyaratan kualifikasi lainnya dapat dilakukan dengan klarifikasi/verifikasi lapangan apabila dibutuhkan, 2.10. Pembuktian kualifikasi untuk memeriksa/ meneliti keabsahan pengalaman pekerjaan sejenis, dievaluasi dengan cara melihat dokumen kontrak asli dan Berita Acara Serah Terima Pekerjaan dari pekerjaan yang telah diselesaikan sebelumnya, 2.11. apabila peserta tidak hadir dalam pembuktian kualifikasi dan/atau telah diberikan kesempatan namun tetap tidak dapat menghadiri pembuktian kualifikasi sesuai dengan 2.6, maka peserta dinyatakan gugur dan Jaminan Penawaran (apabila disyaratkan) dicairkan ke Kas Negara/Daerah, 2.12. apabila hasil pembuktian kualifikasi ditemukan pemalsuan data, maka peserta digugurkan, dikenakan sanksi Daftar Hitam, Jaminan Penawaran (apabila disyaratkan) dicairkan ke Kas Negara/Daerah, 2.13. dalam hal tidak ada peserta yang lulus pembuktian kualifikasi, maka tender dinyatakan gagal; 3. penawaran Harga Secara Berulang (e-reverse auction), 3.1. dalam hal hanya terdapat 2 (dua) penawar yang dinyatakan lulus administrasi, teknis, dan kualifikasi, peserta dapat diberikan kesempatan untuk berkompetisi kembali dengan cara menyampaikan penawaran harga lebih dari 1 (satu) kali dan bersifat lebih rendah dari penawaran sebelumnya, 3.2. Kelompok Kerja (Pokja) pemilihan mengundang peserta melakukan e-reverse auction dengan mencantumkan waktu pelaksanaan untuk peserta menyampaikan penawaran berulang dalam kurun waktu yang telah ditetapkan, dan 3.3. Peserta menyampaikan penawaran harga melalui fitur pada aplikasi Sistem Pengadaan Secara Elektronik (SPSE) atau sistem pengaman dokumen berdasarkan alokasi waktu (batch) atau secara real-time, 32.4. setelah masa penyampaian penawaran berulang berakhir maka sistem akan menginformasikan peringkat berdasarkan urutan posisi penawar (positional bidding) secara real-time; dan 4. Klarifikasi dan Negosiasi Teknis dan Harga, 4.1. dalam hal hanya 1 (satu) peserta yang memenuhi persyaratan administrasi, teknis, dan kualifikasi, dilakukan klarifikasi dan negosiasi teknis dan harga, 4.2. hal yang diklarifikasi adalah metode pelaksanaan pekerjaan yang dapat mempengaruhi harga untuk dilakukan negosiasi, dan 4.3. hasil klarifikasi dan negosiasi teknis dan harga dituangkan dalam berita acara klarifikasi dan negosiasi teknis dan harga.

Penetapan Pemenang, 1.1. Kelompok Kerja (Pokja) Pemilihan menetapkan pemenang apabila isian yang disampaikan peserta pada formulir isian kualifikasi benar dan masih berlaku/valid, 1.2. dalam hal peserta diketahui mengikuti beberapa paket pekerjaan yang di-tender-kan oleh beberapa Kelompok Kerja (Pokja) Pemilihan dalam waktu yang bersamaan dan telah ditetapkan menjadi pemenang pada beberapa paket tersebut, dilakukan perhitungan ulang Sisa Kemampuan menangani Paket (SKP) (untuk usaha kecil)/Sisa Kemampuan Nyata (SKN) [untuk usaha menengah dan besar], 1.3. dalam hal peserta mengikuti tender beberapa paket pekerjaan konstruksi dalam waktu penetapan pemenang bersamaan: a. menawarkan peralatan yang sama untuk beberapa paket yang diikuti dan dalam evaluasi memenuhi persyaratan pada masing-masing paket pekerjaan, maka hanya dapat ditetapkan sebagai pemenang pada 1 (satu) paket pekerjaan dengan cara melakukan klarifikasi untuk menentukan peralatan tersebut akan ditempatkan, sedangkan untuk paket pekerjaan lainnya dinyatakan peralatan tidak ada dan dinyatakan gugur, b. apabila peserta menawarkan peralatan yang sama pada paket pekerjaan lain/yang sedang berjalan, maka hanya dapat ditetapkan sebagai pemenang, apabila setelah dilakukan klarifikasi peralatan tersebut tidak terikat pada paket lain, c. ketentuan hanya dapat ditetapkan sebagai pemenang pada 1 (satu) paket pekerjaan sebagaimana dimaksud pada huruf a dan b, dapat dikecualikan dengan syarat waktu penggunaan alat tidak tumpang tindih (overlap), ada peralatan cadangan yang diusulkan dalam Dokumen Penawaran yang memenuhi syarat, lokasi peralatan yang berdekatan dalam pelaksanaan pekerjaan sehingga dapat digunakan sesuai dengan jadwal pelaksanaan pekerjaan, dan/atau kapasitas dan produktivitas peralatan secara teknis dapat menyelesaikan lebih dari 1 (satu) paket pekerjaan, d. menawarkan personel yang sama pada lebih dari 1 (satu) paket pekerjaan, maka hanya dapat ditetapkan sebagai pemenang pada 1 (satu) paket pekerjaan setelah dilakukan klarifikasi untuk menentukan personil tersebut akan ditempatkan, sedangkan untuk paket pekerjaan lainnya dinyatakan personel tidak ada dan dinyatakan gugur, e. ketentuan pada huruf d hanya dapat ditetapkan sebagai pemenang pada 1 (satu) paket pekerjaan konstruksi, kecuali: 1) Personel yang diusulkan penugasannya sebagai Kepala Proyek/ General Superintendent (GS), 2) jadwal penugasan personel tidak tumpang tindih (overlap) dengan kegiatan lain berdasarkan jadwal pelaksanaan pekerjaan atau jadwal penugasan, 3) terdapat personel cadangan yang diusulkan dalam Dokumen Penawaran yang memenuhi syarat, dan f. menawarkan personel yang sedang bekerja di paket lain, maka pada saat akan ditetapkan sebagai pemenang dipastikan sudah tidak terikat pada paket lain, 1.4. Kelompok Kerja (Pokja) Pemilihan membuat dan menandatangani Berita Acara Hasil Pemilihan (BAHP) yang paling sedikit memuat: a. Nama seluruh peserta, b. Harga penawaran atau harga penawaran terkoreksi dari masing-masing peserta, c. Metode evaluasi yang digunakan, d. Unsur-unsur yang dievaluasi, e. Rumus yang dipergunakan, f. Keterangan-keterangan lain yang dianggap perlu hal Ikhwal pelaksanaan tender, g. jumlah peserta yang lulus dan tidak lulus pada setiap tahapan evaluasi, h. tanggal dibuatnya Berita Acara, dan i. Pernyataan bahwa tender gagal apabila tidak ada penawaran yang memenuhi syarat, 1.5. dalam hal nilai pagu anggaran paling banyak Rp100.000.000.000,00 (seratus miliar rupiah) maka penetapan pemenang dilakukan oleh Kelompok Kerja (Pokja) Pemilihan, 1.6. dalam hal nilai pagu anggaran paling sedikit di atas Rp100.000.000.000,00 (seratus miliar rupiah) maka penetapan pemenang dilakukan oleh Pengguna Anggaran (PA), 1.7. apabila terjadi keterlambatan dalam menetapkan pemenang dan akan mengakibatkan Surat Penawaran dan/atau Jaminan Penawaran (apabila disyaratkan) habis masa berlakunya, maka dilakukan konfirmasi kepada semua peserta yang lulus evaluasi penawaran dan evaluasi kualifikasi untuk memperpanjang masa berlaku surat penawaran dan/atau Jaminan Penawaran (apabila disyaratkan) secara tertulis sampai dengan perkiraan jadwal penandatanganan kontrak, dan 1.8. dalam hal peserta yang lulus evaluasi penawaran dan evaluasi kualifikasi tidak bersedia memperpanjang surat penawaran dan/atau Jaminan Penawaran (apabila disyaratkan) dianggap mengundurkan diri dan tidak dikenakan sanksi; 2. Sanggah dari Peserta Tender, 3.1. Sanggahan dari Peserta yang memasukkan penawaran yang namanya tertera dalam surat penawaran dan/atau tertera dalam akta pendirian perusahaan, 3.2. Sanggahan disampaikan secara elektronik melalui aplikasi Sistem Pengadaan Secara Elektronik (SPSE) disertai bukti terjadinya penyimpangan, 3.3. Sanggahan diajukan oleh peserta apabila terjadi penyimpangan prosedur meliputi: a. kesalahan dalam melakukan evaluasi, b. penyimpangan terhadap ketentuan dan prosedur yang telah ditetapkan dalam Dokumen Pemilihan, c. rekayasa/persekongkolan tertentu sehingga menghalangi terjadinya persaingan usaha yang sehat, dan/atau d. penyalahgunaan wewenang oleh Kelompok Kerja (Pokja) Pemilihan, pimpinan Unit Kerja Pengadaan Barang/Jasa (UKPBJ), PPK (Pejabat Pembuat Komitmen) dan/atau pejabat yang berwenang lainnya, 3.4. Sanggahan disampaikan dalam waktu 5 (lima) hari kerja setelah pengumuman pemenang, 3.5. Kelompok Kerja (Pokja) Pemilihan wajib memberikan jawaban secara elektronik atas semua sanggahan paling lambat 3 (tiga) hari kerja setelah akhir masa sanggah, 3.6. apabila sanggahan dinyatakan benar maka Kelompok Kerja (Pokja) Pemilihan menyatakan tender gagal, 3.7. sanggahan dianggap sebagai pengaduan, dalam hal: a. sanggahan disampaikan tidak melalui aplikasi Sistem Pengadaan Secara Elektronik (SPSE) [offline], kecuali keadaan kahar atau gangguan teknis, b. sanggahan ditujukan bukan kepada Kelompok Kerja (Pokja) Pemilihan, atau c. sanggahan disampaikan di luar masa sanggah, dan 3.8. Sanggahan yang dianggap sebagai pengaduan tetap harus diproses sebagaimana penanganan pengaduan; 4. Sanggah Banding dari Peserta Tender, 4.1. Peserta dapat mengajukan sanggah banding apabila tidak setuju atas jawaban sanggah, 4.2. Penyanggah menyampaikan sanggah banding secara tertulis kepada KPA (Kuasa Pengguna Anggaran) selambat-lambatnya 05 (lima) hari kerja setelah jawaban sanggah dimuat dalam aplikasi SPSE (Sistem Pengadaan Secara Elektronik). Tembusan sanggah banding disampaikan kepada Aparat Pengawasan Intern Pemerintah (APIP) sesuai Lembar Data Pemilihan (LDP), 4.3. Penyanggah banding harus menyerahkan Jaminan Sanggah Banding yang ditujukan kepada Kelompok Kerja (Pokja) Pemilihan sebesar 1% (satu persen) dari nilai total HPS (Harga Perkiraan Sendiri) dengan masa berlaku 30 (tiga puluh) hari kalender sejak tanggal pengajuan sanggah banding, 4.4. Kelompok Kerja (Pokja) pemilihan mengklarifikasi atas kebenaran Jaminan Sanggah Banding kepada penerbit jaminan dan KPA (Kuasa Pengguna Anggaran) tidak akan menindaklanjuti Sanggah Banding sebelum mendapatkan hasil klarifikasi Kelompok Kerja (Pokja) Pemilihan, 4.5. KPA (Kuasa Pengguna Anggaran) menyampaikan jawaban Sanggah Banding, dengan tembusan kepada Unit Kerja Pengadaan Barang/Jasa (UKPBJ) paling lambat 14 (empat belas) hari kerja setelah menerima klarifikasi dari Kelompok Kerja (Pokja) Pemilihan. Dalam hal KPA (Kuasa Pengguna Anggaran) tidak memberikan jawaban Sanggah Banding, maka KPA (Kuasa Pengguna Anggaran) dianggap menerima Sanggah Banding, 4.6. apabila Sanggah Banding dinyatakan benar/diterima, Unit Kerja Pengadaan Barang/Jasa (UKPBJ) memerintahkan Kelompok Kerja (Pokja) Pemilihan melakukan evaluasi ulang atau pemilihan penyedia ulang, 4.7. apabila Sanggah Banding dinyatakan salah/tidak diterima, maka: a. Kelompok Kerja (Pokja) Pemilihan melanjutkan proses pemilihan dengan menyampaikan hasil pemilihan kepada PPK (Pejabat Pembuat Komitmen), b. Unit Kerja Pengadaan Barang/Jasa (UKPBJ) mencairkan Jaminan Sanggah Banding dan disetorkan ke Kas Negara/Daerah, 4.8. Sanggah Banding menghentikan proses Tender, dan 4.9. Sanggah Banding yang disampaikan bukan kepada KPA (Kuasa Pengguna Anggaran), atau disampaikan diluar masa sanggah banding, dianggap sebagai pengaduan dan diproses sebagaimana penanganan pengaduan.

Kelompok Kerja (Pokja) Pemilihan menyampaikan Berita Acara Hasil Pemilihan (BAHP) kepada PPK (Pejabat Pembuat Komitmen) dengan tembusan kepada Kepala Unit Kerja Pengadaan Barang/Jasa (UKPBJ) sebagai dasar untuk menerbitkan Surat Penunjukan Penyedia Barang/Jasa (SPPBJ); 2. Sebelum menerbitkan Surat Penunjukan Penyedia Barang/Jasa (SPPBJ), Pejabat Pembuat Komitmen, Kelompok Kerja (Pokja) Pemilihan dan pemenang melaksanakan Rapat Persiapan Penunjukan Penyedia; 3. PPK (Pejabat Pembuat Komitmen), Kelompok Kerja (Pokja) Pemilihan dan Pemenang wajib melaksanakan Rapat Persiapan Penunjukan Penyedia dengan ketentuan paling lambat 3 (tiga) hari kerja setelah: a. masa sanggah berakhir (apabila tidak ada sanggahan), b. Kelompok Kerja (Pokja) pemilihan menjawab semua sanggahan dari peserta dan masa sanggah banding telah berakhir (apabila tidak ada sanggah banding), atau c. KPA (Kuasa Pengguna Anggaran) menyatakan sanggah banding salah/tidak diterima (apabila ada sanggah banding); 4. Rapat persiapan penunjukan Penyedia dilaksanakan untuk memastikan pemenang memenuhi ketentuan sebagai berikut: a. keberlakuan data isian kualifikasi, b. bukti sertifikat kompetensi personel manajerial, c. kewajiban melakukan sertifikasi bagi operator, teknisi atau analis yang belum bersertifikat pada saat pelaksanaan pekerjaan, dan d. pelaksanaan alih pengalaman/keahlian bidang konstruksi melalui sistem kerja praktik/magang, paling sedikit pembahasan terkait jumlah peserta, durasi pelaksanaan, dan jenis keahlian; 5. dalam hal Pemenang tidak memenuhi ketentuan sebagaimana dimaksud pada 4 di atas, maka PPK (Pejabat Pembuat Komitmen) bersama Kelompok Kerja (Pokja) Pemilihan melaksanakan rapat persiapan penunjukan penyedia bersama Pemenang Cadangan ke-1 (ke-satu) [apabila ada]; 6. dalam hal pemenang cadangan ke-1 (ke-satu) tidak memenuhi, maka PPK (Pejabat Pembuat Komitmen) bersama Kelompok Kerja (Pokja) Pemilihan melaksanakan rapat persiapan penunjukan penyedia bersama pemenang cadangan ke-2 (ke-dua) [apabila ada], 7. dalam hal pemenang cadangan ke-2 (kedua) tidak memenuhi, maka PPK (Pejabat Pembuat Komitmen) bersama Kelompok Kerja (Pokja) Pemilihan melaksanakan rapat persiapan penunjukan penyedia bersama peserta yang memenuhi persyaratan penawaran dan kualifikasi (apabila ada), 8. PPK (Pejabat Pembuat Komitmen) menerbitkan Surat Penunjukan Penyedia Barang/Jasa (SPPBJ) apabila pernyataan peserta pada formulir isian kualifikasi masih berlaku, dengan ketentuan: a. berdasarkan hasil rapat persiapan penunjukan penyedia, peserta mampu memenuhi semua persyaratan pekerjaan, b. tidak ada sanggah/sanggah banding dari peserta; c. sanggah/sanggah banding terbukti tidak benar, atau d. masa sanggah berakhir; 9. Proses Surat Penunjukan Penyedia Barang/Jasa (SPPBJ) pada angka 8 dilakukan dengan ketentuan: a. dilakukan terhadap pemenang, b. dalam hal pemenang tidak memenuhi, maka proses Surat Penunjukan Penyedia Barang/Jasa (SPPBJ) dilakukan kepada pemenang cadangan ke-1 (ke-satu) [apabila ada], c. dalam hal pemenang cadangan ke-1 (ke-satu) tidak memenuhi, maka proses Surat Penunjukan Penyedia Barang/Jasa (SPPBJ) dilakukan kepada pemenang cadangan ke-2 (ke-dua) [apabila ada], selama masa surat penawaran dan jaminan penawaran (apabila disyaratkan) masih berlaku atau sudah diperpanjang masa berlakunya; 10. Proses sebagaimana tercantum pada angka 9 dengan persetujuan KPA (Kuasa Pengguna Anggaran), kecuali angka 9 huruf a.11. Dalam hal tidak ada pemenang, pemenang cadangan ke1 (ke-satu), dan pemenang cadangan ke-2 (kedua) yang memenuhi maka Surat Penunjukan Penyedia Barang/Jasa (SPPBJ) tidak dapat diterbitkan; 12. Pejabat Pembuat Komitmen menginputkan data Surat Penunjukan Penyedia Barang/Jasa (SPPBJ) dan mengunggah hasil pemindaian Surat Penunjukan Penyedia Barang/Jasa (SPPBJ) yang telah diterbitkan pada aplikasi Sistem Pengadaan Secara Elektronik (SPSE) dan mengirimkan Surat Penunjukan Penyedia Barang/Jasa (SPPBJ) tersebut melalui aplikasi Sistem Pengadaan Secara Elektronik (SPSE) kepada Penyedia yang ditunjuk; 13. Surat Penunjukan Penyedia Barang/Jasa (SPPBJ) diterbitkan paling lambat 6 (enam) hari kerja setelah pengumuman penetapan pemenang apabila tidak ada sanggahan atau 2 (dua) hari kerja setelah semua sanggahan dijawab; 14. Dalam hal DIPA/DPA (Daftar Isian Pelaksanaan Anggaran / Dokumen Pelaksanaan Anggaran) belum terbit, Surat Penunjukan Penyedia Barang/Jasa (SPPBJ) dapat ditunda diterbitkan sampai batas waktu penerbitan oleh otoritas yang berwenang; 15. dalam Surat Penunjukan Penyedia Barang/Jasa (SPPBJ) dicantumkan bahwa penyedia harus menyiapkan Jaminan Pelaksanaan sebelum penandatanganan Kontrak; 16. Surat Penunjukan Penyedia Barang/Jasa (SPPBJ) ditembuskan kepada Aparat Pengawasan Intern Pemerintah (APIP); 17. dalam hal Pejabat Pembuat Komitmen tidak bersedia menerbitkan Surat Penunjukan Penyedia Barang/Jasa (SPPBJ) karena tidak sependapat atas penetapan pemenang, maka: a. Pejabat Pembuat Komitmen menyampaikan penolakan tersebut kepada Kelompok Kerja (Pokja) Pemilihan diserta alasan dan bukti, b. PPK (Pejabat Pembuat Komitmen) melakukan pembahasan bersama terkait perbedaan pendapat atas hasil pemilihan penyedia, c. dalam hal tidak tercapai kesepakatan, maka pengambilan keputusan diserahkan kepada PA / KPA (Pengguna Anggaran / Kuasa Pengguna Anggaran) paling lambat 6 (enam) hari kerja setelah tidak tercapai kesepakatan; d. PA / KPA (Pengguna Anggaran / Kuasa Pengguna Anggaran) dapat memutuskan: i. menyetujui penolakan Pejabat Pembuat Komitmen, PA / KPA (Pengguna Anggaran / Kuasa Pengguna Anggaran) memerintahkan Kelompok Kerja (Pokja) Pemilihan untuk melakukan evaluasi ulang, pemasukan penawaran ulang atau tender ulang; atau ii. menyetujui hasil pemilihan penyedia, PA / KPA (Pengguna Anggaran / Kuasa Pengguna Anggaran) memerintahkan Pejabat Pembuat Komitmen untuk menerbitkan Surat Penunjukan Penyedia Barang/Jasa (SPPBJ) paling lambat 5 (lima) hari kerja, iii. Putusan PA / KPA (Pengguna Anggaran / Kuasa Pengguna Anggaran) bersifat final, e. dalam hal PA / KPA (Pengguna Anggaran / Kuasa Pengguna Anggaran) yang bertindak sebagai Pejabat Pembuat Komitmen tidak menyetujui hasil pemilihan penyedia, PA / KPA (Pengguna Anggaran / Kuasa Pengguna Anggaran) menyampaikan penolakan tersebut kepada Kelompok Kerja (Pokja) Pemilihan diserta alasan dan bukti dan memerintahkan Kelompok Kerja (Pokja) Pemilihan untuk melakukan evaluasi ulang, pemasukan penawaran ulang atau tender ulang paling lambat 6 (enam) hari kerja setelah hasil pemilihan penyedia diterima; 18. Kontrak ditandatangani paling lambat 14 (empat belas) hari kerja setelah diterbitkannya Surat Penunjukan Penyedia Barang/Jasa (SPPBJ); 19. PPK (Pejabat Pembuat Komitmen) dan Penyedia wajib melaksanakan Rapat Persiapan Penandatanganan Kontrak setelah diterbitkan Surat Penunjukan Penyedia Barang/Jasa (SPPBJ); 20. dalam Rapat Persiapan Penandatanganan Kontrak, paling sedikit dibahas hal-hal sebagai berikut: a. Dokumen Kontrak dan kelengkapan, b. kelengkapan Rencana Keselamatan Konstruksi, c. Rencana penandatanganan Kontrak, d. Jaminan Uang Muka (ketentuan, bentuk, isi, waktu penyerahan), e. Jaminan Pelaksanaan (ketentuan, bentuk, isi, waktu penyerahan), f. Asuransi, dan/atau g. hal yang telah diklarifikasi dan dikonfirmasi pada saat evaluasi penawaran; 21. Pejabat Pembuat Komitmen meng-input-kan data kontrak dan mengunggah hasil pemindaian dokumen kontrak yang telah ditandatangani pada aplikasi Sistem Pengadaan Secara Elektronik (SPSE); 22. Penyedia yang ditunjuk wajib menerima keputusan tersebut, dengan ketentuan: a. apabila yang bersangkutan mengundurkan diri dan masa penawarannya masih berlaku dengan alasan yang dapat diterima secara obyektif oleh Kelompok Kerja (Pokja) Pemilihan, maka peserta yang bersangkutan tidak dikenakan sanksi apapun; b. apabila yang bersangkutan mengundurkan diri dan masa penawarannya masih berlaku dengan alasan yang tidak dapat diterima secara obyektif oleh Kelompok Kerja (Pokja) Pemilihan, maka peserta dikenakan sanksi Daftar Hitam dan Jaminan Penawaran (apabila disyaratkan) dicairkan dan disetorkan ke Kas Negara/Daerah; atau c. apabila yang bersangkutan tidak bersedia ditunjuk karena masa penawarannya sudah tidak berlaku, maka peserta yang bersangkutan tidak dikenakan sanksi apapun; 23. apabila pemenang yang ditunjuk mengundurkan diri, maka penunjukan pemenang dapat dilakukan kepada pemenang cadangan sesuai dengan urutan peringkat (apabila ada), selama masa surat penawaran dan jaminan penawaran (apabila disyaratkan) pemenang cadangan masih berlaku atau sudah diperpanjang masa berlakunya; dan 24. apabila semua pemenang yang ditunjuk mengundurkan diri, maka tender dinyatakan gagal oleh PA / KPA (Pengguna Anggaran / Kuasa Pengguna Anggaran) setelah mendapat laporan dari PPK (Pejabat Pembuat Komitmen).

The contract is signed no later than 14 (fourteen) working days after the issuance of the Letter of Appointment for the Supplier of Goods / Services; 19. The Commitment Making Officials and Providers must carry out Preparatory Meetings for Signing Contracts after the Letter of Appointment of Goods / Services Providers is issued; 20. in the Contract Signing Preparatory Meeting, at least the following are discussed: a. Jaminan Pelaksanaan; Jaminan Pelaksanaan; 1.1. Jaminan Pelaksanaan diberikan Penyedia sebelum penandatanganan Kontrak, 1.2. Jaminan Pelaksanaan dikembalikan kepada Penyedia setelah: a. penyerahan seluruh pekerjaan, b. penyerahan Jaminan Pemeliharaan sebesar 5% (lima per seratus) dari nilai Kontrak, atau c. pembayaran termin terakhir/bulan terakhir/sekaligus telah dikurangi uang retensi sebesar 5% (lima perseratus) dari nilai Kontrak (apabila diperlukan), 1.3. Paket pekerjaan dengan nilai HPS (Harga Perkiraan Sendiri) di atas Rp10.000.000.000,00 (sepuluh miliar rupiah) diterbitkan oleh: 1) Bank Umum, atau 2) Konsorsium perusahaan asuransi umum/Lembaga penjaminan/perusahaan penjaminan yang mempunyai program asuransi kerugian (suretyship), huruf b.2 telah ditetapkan/mendapatkan rekomendasi dari Otoritas Jasa Keuangan (OJK), c. masa berlaku Jaminan Pelaksanaan sejak tanggal penandatanganan Kontrak sampai dengan serah terima pertama pekerjaan berdasarkan Kontrak (PHO, Provisional Hand Over) sebagaimana tercantum dalam Lembar Data Pemilihan (LDP), d. Nama Penyedia sama dengan nama yang tercantum dalam surat Jaminan Pelaksanaan, e. besaran nilai Jaminan Pelaksanaan tidak kurang dari nilai jaminan yang ditetapkan, f. Besaran nilai Jaminan Pelaksanaan dicantumkan dalam angka dan huruf, g. Nama PPK (Pejabat Pembuat Komitmen) yang menerima Jaminan Pelaksanaan sama dengan nama PPK (Pejabat Pembuat Komitmen) yang menandatangan kontrak, h. Paket pekerjaan yang dijamin sama dengan paket pekerjaan yang tercantum dalam Surat Penunjukan Penyedia Barang/Jasa (SPPBJ), i. Jaminan Pelaksanaan harus dapat dicairkan tanpa syarat (unconditional) sebesar nilai jaminan dalam jangka waktu paling lambat 14 (empat belas) hari kerja setelah surat pernyataan wanprestasi dari Pejabat Pembuat Komitmen diterima oleh penerbit Jaminan, j. Jaminan Pelaksanaan atas nama KSO (Kerja Sama Operasi) ditulis atas nama KSO (Kerja Sama Operasi) atau masing-masing anggota KSO (Kerja Sama Operasi) [apabila masing-masing mengajukan Jaminan Pelaksanaan secara terpisah], dan k. Memuat nama, alamat dan tanda tangan pihak penjamin, 1.4. PPK (Pejabat Pembuat Komitmen) mengkonfirmasi dan mengklarifikasi secara tertulis substansi dan keabsahan/keaslian Jaminan Pelaksanaan kepada penerbit jaminan apabila ada hal yang meragukan, 1.5. Kegagalan penyedia yang ditunjuk untuk menyerahkan Surat Jaminan Pelaksanaan dipersamakan dengan penolakan untuk menandatangani Kontrak, dan 1.6. Ketentuan lebih lanjut mengenai pencairan Jaminan Pelaksanaan diatur dalam Syarat-Syarat Umum Kontrak; dan 2. Penandatanganan Kontrak; Penandatanganan; 2.1. Penandatanganan Kontrak dilakukan setelah penandatanganan Kontrak DIPA/DPA (Daftar Isian Pelaksanaan Anggaran / Dokumen Pelaksanaan Anggaran) ditetapkan, 2.2. sebelum penandatanganan kontrak Pejabat Pembuat Komitmen wajib memeriksa apakah pernyataan dalam Data Isian Kualifikasi masih berlaku. Apabila salah satu pernyataan tersebut sudah tidak terpenuhi, maka penandatanganan kontrak tidak dapat dilakukan, 2.3. Penandatanganan kontrak dilakukan setelah diterbitkan Surat Penunjukan Penyedia Barang/Jasa (SPPBJ), dan setelah penyedia menyerahkan Jaminan Pelaksanaan, dengan ketentuan: a. nilai Jaminan Pelaksanaan untuk harga penawaran terkoreksi antara 80% (delapan puluh perseratus) sampai dengan 100% (seratus perseratus) nilai total HPS (Harga Perkiraan Sendiri) adalah sebesar 5% (lima perseratus) dari nilai Kontrak, atau b. nilai Jaminan Pelaksanaan untuk harga penawaran atau penawaran terkoreksi dibawah 80% (delapan puluh perseratus) nilai total HPS (Harga Perkiraan Sendiri) adalah sebesar 5% (lima perseratus) dari nilai total HPS (Harga Perkiraan Sendiri), 2.4. PPK (Pejabat Pembuat Komitmen) dan penyedia tidak diperkenankan mengubah substansi Dokumen Pemilihan sampai dengan penandatanganan Kontrak, kecuali mempersingkat waktu pelaksanaan pekerjaan dikarenakan jadwal pelaksanaan pekerjaan yang ditetapkan sebelumnya akan melewati batas tahun anggaran, 2.5. dalam hal perubahan waktu pelaksanaan pekerjaan melewati batas tahun anggaran, maka penandatanganan kontrak dilakukan setelah mendapat persetujuan kontrak tahun jamak, 2.6. PPK (Pejabat Pembuat Komitmen) dan Penyedia wajib memeriksa konsep Kontrak meliputi substansi, bahasa, redaksional, angka dan huruf serta membubuhkan paraf pada setiap lembar Dokumen Kontrak, 2.7. menetapkan urutan hierarki kontrak sebagai berikut: a. adendum Surat Perjanjian (apabila ada), b. Surat Perjanjian, c. Surat Penawaran berikut Daftar Kuantitas dan Harga/ Daftar Keluaran dan Harga, d. Syarat-Syarat Khusus Kontrak, e. Syarat-Syarat Umum Kontrak, f. spesifikasi teknis, dan g. gambar-gambar, dengan maksud apabila terjadi pertentangan ketentuan antara bagian satu dengan bagian yang lain, maka berlaku urutan hierarki hukum, 2.8. banyaknya rangkap kontrak dibuat sesuai kebutuhan, yaitu: a. sekurang-kurangnya 2 (dua) Kontrak asli, terdiri atas: 1) kontrak asli pertama untuk PPK (Pejabat Pembuat Komitmen) dibubuhi materai pada bagian yang ditandatangani oleh penyedia, dan 2) kontrak asli kedua untuk penyedia dibubuhi materai pada bagian yang ditandatangani oleh Pejabat Pembuat Komitmen; b. rangkap kontrak lainnya (apabila diperlukan) tanpa dibubuhi meterai, 2.9. Pihak yang berwenang menandatangani kontrak atas nama penyedia adalah direktur utama/pimpinan perusahaan atau yang namanya tercantum dalam Akta Pendirian/Anggaran Dasar, yang telah didaftarkan sesuai dengan peraturan perundangundangan, 2.10. Pihak lain yang bukan direktur utama/pimpinan perusahaan atau yang namanya tidak disebutkan dalam Akta Pendirian/Anggaran Dasar, dapat menandatangani Kontrak, sepanjang pihak tersebut adalah pengurus/karyawan perusahaan yang berstatus sebagai tenaga kerja tetap dan mendapat kuasa atau pendelegasian wewenang yang sah dari direktur utama/pimpinan perusahaan/ pengurus atau pihak yang sah berdasarkan Akta Pendirian/Anggaran Dasar untuk menandatangani Kontrak, dan 2.11. PPK (Pejabat Pembuat Komitmen) meng-input-kan data kontrak dan mengunggah hasil pemindaian dokumen kontrak yang telah ditandatangani pada aplikasi Sistem Pengadaan Secara Elektronik (SPSE).
