I. Petunjuk Pengisian Untuk Peserta Bukan KSO (Kerja Sama Operasi) mengikuti petunjuk dan penggunaan aplikasi SPSE (Sistem Pengadaan Secara Elektronik) [User Guide].

A. Administrative Data,

1. To be completed with the name of the participant's business entity,

2. Select the status of the business entity (Center / Branch),

3. Filled with address, telephone number, fax number. and email of the head office that can be contacted, and

4. Fill in the address, telephone number, fax number, and e-mail address of the branch that can be contacted, if the participant has the status of a branch office.

B. Landasan Hukum Pendirian Badan Usaha,

1. Diiisi dengan nomor, tanggal dan nama notaris penerbit Akta Pendirian perusahaan/Anggaran Dasar, serta untuk badan usaha yang berbentuk Perseroan Terbatas diisi nomor pengesahan dari Kementerian Hukum dan HAM (Hak Azasi Manusia), dan

2. Diiisi dengan nomor, tanggal dan nama notaris penerbit akta perubahan terakhir badan usaha, apabila ada. Khusus untuk Perseroan Terbatas, jika terdapat perubahan nama anggota Direksi dan/atau Dewan Komisaris, pada Pembuktian Kualifikasi peserta diminta menunjukkan asli dan memberikan salinan Bukti Pemberitahuan dari Notaris selaku Kuasa Direksi yang telah diajukan melalui Sisminbakum (Sistem Administrasi Badan Hukum) atas Akta Perubahan Terakhir.

B. Legal Basis of Establishment of Business Entities,

1. Diisi dengan nama, nomor identitas KTP (Kartu Tanda Penduduk) / SIM (Surat Izin Mengemudi) / Paspor, alamat pemilik saham/persero dan persentase kepemilikan saham/persero, dan

2. Pajak,

a. Diisi NPWP (Nomor Pokok Wajib Pajak) badan usaha, dan

b. Diisi nomor dan tanggal bukti laporan pajak tahun terakhir berupa SPT (Surat Pemberitahuan Tahunan).

G. Financial Data,

1. Filled with name, identity card number / driver's license / passport, address of shareholders / company and percentage of share / company ownership, and

2. Taxes,

b. Fill in the number and date of the latest year tax report in the form of an Annual Notice.

Data Tenaga Tetap (Tenaga ahli/terampil badan usaha) diisi dengan nama, tingkat pendidikan [SLTP (Sekolah Lanjutan Tingkat Pertama) / SLTA (Sekolah Lanjutan Tingkat Atas) / S1 (Strata-1) / S2 (Strata-2) / S3 (Strata-3)] dan nomor dan tahun penerbitan ijazah, jabatan, lama pengalaman kerja profesional berdasarkan jenis pekerjaan, Sertifikat Kompetensi Kerja dan nomor Bukti Setor Pajak PPH (Pajak Penghasilan) Pasal 1721/1721-I atau nomor keanggotaan (Badan Penyelenggaraan Jaminan Sosial) Ketenagakerjaan.

H. Permanent Power Data (expert / skilled business entity) filled with name, education level [Junior High School / Senior High School / S1 (Strata-1) / S2 (Strata-2) / S3 (Strata-3)] and number and year of diploma issuance, position, length of professional work experience based on type of work, Work Competency Certificate and Proof Number of Tax Return (Income Tax) Article 1721/1721-I or membership number (Social Guarantee Agency) of Employment.

Data Pengalaman Perusahaan diisi dengan nama paket pekerjaan, subklasifikasi pekerjaan yang disyaratkan, ringkasan lingkup pekerjaan, lokasi tempat pelaksanaan pekerjaan, nama dan alamat/telepon dari pemberi tugas/ Pejabat Pembuat Komitmen, nomor/tanggal dan nilai kontrak, tanggal selesai paket pekerjaan/PHO (Provisional Hand Over) berdasarkan kontrak, dan tanggal berita acara serah terima, untuk masing-masing paket pekerjaan selama 10 (sepuluh) tahun terakhir. Data ini digunakan untuk menghitung Kemampuan Dasar (KD) [Usaha Kecil tidak disyaratkan].

Untuk perusahaan yang baru berdiri kurang dari 03 (tiga) tahun tidak wajib mengisi tabel ini.

J. Penyedia menyampaikan Laporan Keuangan/Neraca Tahun Terakhir.

L. 1. Persyaratan Izin Usaha Jasa Konstruksi, Sertifikat Badan Usaha, Sertifikat lainnya (apabila disyaratkan) dengan ketentuan:

a. Pokja (Kelompok Kerja) pemilihan melihat kesesuaian antara persyaratan pada Lembar Data Kualifikasi (LDK) dengan Formulir Isian Kualifikasi yang telah diisi oleh peserta pada SPSE (Sistem Pengadaan Secara Elektronik).

b. Pokja (Kelompok Kerja) memeriksa masa berlaku izin/sertifikat dengan ketentuan:

1) Izin/sertifikat wajib masih berlaku berdasarkan masa berlaku yang tertera/tertulis pada izin/sertifikat tersebut;

2) Izin/sertifikat yang habis masa berlakunya sebelum batas akhir pemasukan Dokumen Penawaran tidak dapat diterima dan penyedia dinyatakan gugur;

3) Dalam hal masa berlaku izin/sertifikat habis setelah batas akhir pemasukan Dokumen Penawaran, maka Peserta harus menyampaikan izin/sertifikat yang sudah diperpanjang kepada Pejabat Pembuat Komitmen sebelum penandatanganan kontrak.

c. Pokja Pemilihan dapat memeriksa kesesuaian izin/sertifikat dengan menghubungi penerbit dokumen, dan/atau mengecek melalui layanan daring (online) milik penerbit dokumen yang tersedia.

1. Construction Services Business License Requirements, Business Entity Certificates, other Certificates (if required) provided:

a. The Working Group selects the suitability between the requirements in the Qualification Data Sheet and the Qualification Form that has been filled out by the participants in the Electronic Procurement System.

b. The Working Group checks the validity period of the permit / certificate provided that:

1) Permit / certificate must still be valid based on the validity period stated / written on the permit / certificate;

2) A permit / certificate that expires before the deadline for submission of Bid Documents cannot be accepted and the provider is declared dead;

c. The Election Working Group can check the suitability of the permit / certificate by contacting the issuer of the document, and / or checking through the daring (online) service owned by the issuer of the available documents.

2. Persyaratan Kemampuan Dasar (KD) (apabila disyaratkan), dengan ketentuan:

a. Perhitungan Kemampuan Dasar (KD).

KD = 3 NPt

NPt = Nilai pengalaman tertinggi pada pekerjaan sesuai yang disyaratkan dalam 10 (sepuluh) tahun terakhir.

b. dalam hal KSO (Kerja Sama Operasi), yang diperhitungkan adalah Kemampuan Dasar (KD) dari perusahaan yang mewakili/leadfirm KSO (Kerja Sama Operasi);

c. Kemampuan Dasar (KD) sekurang-kurangnya sama dengan nilai total Harga Perkiraan Sendiri (HPS);

d. pengalaman perusahaan dinilai dari pengalaman tertinggi pada pekerjaan sesuai yang disyaratkan dalam 10 (sepuluh) tahun terakhir, nilai kontrak dan status peserta pada saat menyelesaikan kontrak pekerjaan tersebut.

e. Nilai pengalaman pekerjaan dapat dikonversi menjadi nilai pekerjaan sekarang (present value) menggunakan perhitungan sebagai berikut:

NPs = Nilai pekerjaan sekarang

Npo = Nilai pekerjaan keseluruhan termasuk eskalasi (apabila ada) saat serah terima pertama

Io = Indeks dari Biro Pusat Statistik (BPS) pada bulan serah terima pertama

Is = Indeks dari Biro Pusat Statistik (BPS) pada bulan penilaian prakualifikasi (apabila belum ada, dapat dihitung dengan regresi linier berdasarkan indeks bulan-bulan sebelumnya).

Indeks Biro Pusat Statistik (BPS)yang dipakai adalah indeks yang merupakan komponen terbesar dari pekerjaan.

2. Basic Capability Requirements (if required), provided that:

a. Basic Ability Calculation.

KD = 3 NPt

NPt = The highest experience value on a job according to the requirements in the last 10 (ten) years.

3. Persyaratan NPWP (Nomor Pokok Wajib Pajak) dan kewajiban perpajakan tahun pajak terakhir SPT (Surat Pemberitahuan Tahunan) dapat dikecualikan untuk peserta yang secara peraturan perpajakan belum diwajibkan memiliki laporan perpajakan tahun terakhir, misalnya baru berdiri sebelum batas waktu laporan pajak tahun terakhir.

6. Experience requirements of at least 1 (one) job within the last 4 (four) years, provided that:

7. Persyaratan Sisa Kemampuan Paket (SKP) (apabila disyaratkan), dengan ketentuan:

a. Rumusan Sisa Kemampuan Paket (SKP),

SKP = KP – jumlah paket yang sedang dikerjakan

KP = Kemampuan menangani paket pekerjaan.

KP = 5 N = Jumlah paket pekerjaan terbanyak yang dapat ditangani pada saat bersamaan selama kurun waktu 5 (lima) tahun terakhir,

b. Peserta wajib mengisi daftar pekerjaan yang sedang dikerjakan;

c. Apabila ditemukan bukti peserta tidak mengisi daftar pekerjaan yang sedang dikerjakan walaupun sebenarnya ada pekerjaan yang sedang dikerjakan, maka apabila pekerjaan tersebut menyebabkan Sisa Kemampuan Paket (SKP) peserta tidak memenuhi, maka dinyatakan gugur, dikenakan sanksi daftar hitam, dan pencairan jaminan penawaran (apabila ada).

7. Package Capability Remaining Requirements (if required), provided that:

a. Formulation of Package Ability Remaining

SKP = KP - number of packages being worked on.

KP = Ability to handle work packages.

KP = 5 N = The highest number of work packages that can be handled at the same time for the past 5 (five) years,

b. Participants must fill in the list of work being worked on;

c. If evidence is found that the participant did not fill in the list of work being carried out even though there is actually work being worked on, then if the work causes Package Capability Remaining of the participant not to fulfill, then it is declared dead, he or she will be subject to blacklist sanctions, and offer guarantee disbursement (if any).

8. Persyaratan Tenaga Tetap, dengan ketentuan pembuktian Tenaga Tetap dilakukan pada tahap pembuktian kualifikasi dengan meminta peserta membawa:

a. Bukti setor pajak PPH (Pajak Penghasilan) Pasal 21 Form 1721 atau Form 1721-I, atau

b. Bukti kepersertaan BPJS (Badan Penyelenggaraan Jaminan Sosial) Ketenagakerjaan yang mencantumkan nama jelas serta nama perusahaan yang sama dengan nama perusahaan peserta tender.

c. SK (Surat Keputusan), Susunan Organisasi, atau Daftar Gaji tidak dapat menjadi bukti tenaga kerja tetap.

8. Requirements for Permanent Personnel, with provisions for proving Permanent Personnel to be carried out at the stage of verification of qualifications by asking participants to bring:

KB = Kekayaan Bersih/total ekuitas yang dilihat dari neraca keuangan tahun terakhir

b. Σnilai kontrak paket pekerjaan diambil dari daftar pekerjaan yang sedang dikerjakan dalam Formulir Isian Kualifikasi.

c. Sisa Kemampuan Nyata (SKN) harus sama atau lebih besar dari 10% (sepuluh perseratus) nilai total HPS (Harga Perkiraan Sendiri).

d. Apabila ditemukan bukti peserta tidak mengisi daftar pekerjaan yang sedang dikerjakan walaupun sebenarnya ada pekerjaan yang sedang dikerjakan, maka apabila pekerjaan tersebut menyebabkan Sisa Kemampuan Nyata (SKN) peserta tidak memenuhi, maka dinyatakan gugur, dikenakan sanksi daftar hitam, dan pencairan jaminan penawaran (apabila ada).

9. Requirements for Real Ability Remaining (if required), provided that:

10. Persyaratan surat keterangan dukungan keuangan (apabila disyaratkan) diterbitkan dari bank pemerintah/swasta dengan nilai paling kurang 10% (sepuluh per seratus) dari nilai total HPS (Harga Perkiraan Sendiri).

(b) PPK (Pejabat Pembuat Komitmen) telah menunjuk Penyedia menjadi pihak dalam Kontrak ini melalui Surat Penunjukan Penyediaan Barang/Jasa (SPPBJ) untuk melaksanakan Pekerjaan Konstruksi ...................... (e) PPK (Pejabat Pembuat Komitmen) dan Penyedia mengakui dan menyatakan bahwa sehubungan dengan penandatanganan Kontrak ini masing-masing pihak :

1) telah dan senantiasa diberikan kesempatan untuk didampingi oleh advokat;

2) menandatangani Kontrak ini setelah meneliti secara patut;

3) telah membaca dan memahami secara penuh ketentuan Kontrak ini;

4) telah mendapatkan kesempatan yang memadai untuk memeriksa dan mengkonfirmasikan semua ketentuan dalam Kontrak ini beserta semua fakta dan kondisi yang terkait.

DOKUMEN KONTRAK

Article 4

CONTRACT DOCUMENTS

(1) Kelengkapan dokumen-dokumen berikut merupakan satu kesatuan dan bagian yang tidak terpisahkan dari Kontrak ini terdiri dari adendum Surat Perjanjian (apabila ada), Surat Perjanjian, Surat Penawaran, Daftar Kuantitas/Keluaran dan Harga, Syarat-Syarat Umum Kontrak, Syarat-Syarat Khusus Kontrak beserta lampirannya berupa lampiran A (daftar harga satuan timpang, subpenyedia, personel manajerial, dan peralatan utama), lampiran B (Rencana Keselamatan Konstruksi), spesifikasi teknis, gambar-gambar, dan dokumen lainnya seperti: Surat Penunjukan Penyedia Barang/Jasa, Jadwal Pelaksanaan Pekerjaan, jaminan-jaminan, Berita Acara Rapat Persiapan Penandatanganan Kontrak, Berita Acara Rapat Persiapan Pelaksanaan Kontrak.

(2) Jika terjadi pertentangan antara ketentuan dalam suatu dokumen dengan ketentuan dalam dokumen yang lain maka yang berlaku adalah ketentuan dalam dokumen yang lebih tinggi berdasarkan urutan hierarki sebagai berikut:

a. adendum Surat Perjanjian (apabila ada);

b. Surat Perjanjian;

c. Surat Penawaran berikut Daftar Kuantitas/Keluaran dan Harga;

d. Syarat-Syarat Khusus Kontrak;

e. Syarat-Syarat Umum Kontrak;

f. spesifikasi teknis; dan

g. gambar-gambar.

(1) Completeness of the following documents constitutes an integral and inseparable part of this Contract consisting of an addendum to the Agreement (if any), Agreement, Bid Letter, Quantity / Output and Price List, Contract General Terms, Conditions of Special of the Contract and their attachments are in the form of attachment A (list of unequal unit prices, sub-providers, managerial personnel, and main equipment), appendix B (Construction Safety Plan), technical specifications, drawings and other documents such as: Letter of Appointment of Goods / Services Providers, Schedule of Job Implementation, guarantees, Minutes of Preparatory Meeting for Signing of Contracts, Minutes of Contract Implementation Preparation Meeting.

(2) If there is a conflict between the provisions in a document and the provisions in another document, then the provisions in the higher document are valid based on the order of the hierarchy as follows:

a. addendum to the Agreement (if any);

b. Agreement letter;

c. The Bid Letter follows the List of Quantities / Outputs and Prices;

d. Contract Specific Terms;

e. General Conditions of Contract;

f. technical specifications; and

g. Images.

Pasal 5

MASA KONTRAK

Article 5

CONTRACT TIME

(1) Masa Kontrak adalah jangka waktu berlakunya Kontrak ini terhitung sejak tanggal penandatanganan Kontrak sampai dengan Tanggal Penyerahan Akhir Pekerjaan;

(2) Masa Pelaksanaan ditentukan dalam Syarat-Syarat Khusus Kontrak, dihitung sejak Tanggal Mulai Kerja yang tercantum dalam SPMK (Surat Perintah Mulai Kerja) sampai dengan Tanggal Penyerahan Pertama Pekerjaan selama ………. (… dalam huruf …) hari kalender;

4. Peraturan Presiden Nomor 16 Tahun 2018 tentang Pengadaan Barang/Jasa
Pemerintah;

And by paying attention to:

1. Law Number 2 of 2017 concerning Construction Services;

2. Civil Code (Book III concerning Engagement);

3. Government Regulation Number 29 of 2000 concerning the Implementation of Construction Services as amended several times in the latest by Government Regulation Number 54 of 2016;

4. Presidential Regulation Number 16 of 2018 concerning Procurement of Goods / Services of Government;

PARA PIHAK MENERANGKAN TERLEBIH DAHULU BAHWA:

THE PARTIES EXPRESSLY FIRST THAT:

(a) telah dilakukan proses pemilihan Penyedia yang telah sesuai dengan Dokumen Pemilihan;

(b) PPK (Pejabat Pembuat Komitmen) telah menunjuk Penyedia menjadi pihak dalam Kontrak ini melalui Surat Penunjukan Penyediaan Barang/ Jasa (SPPBJ) untuk melaksanakan Pekerjaan Konstruksi ......................
