Rangka Lelang Dini di Kementerian Pekerjaan Umum dan Perumahan Rakyat untuk
Tahun Anggaran 2019 yaitu 1. Penyiapan Dokumen Penawaran yaitu, Jaminan
Penawaran Asli, 1.1. Dalam hal HPS (Harga Perkiraan Sendiri) di atas Rp.
10.000.000.000 (sepuluh miliar rupiah), Jaminan Penawaran asli disampaikan
sebagai bagian dari dokumen administrasi, 1.2. Besaran nilai nominal, masa berlaku, dan pencairan
Jaminan Penawaran sebagaimana tercantum dalam Lembar Data Pemilihan (LDP), 1.3.
Peserta harus menyampaikan Jaminan penawaran asli secara langsung atau melalui
pos/jasa pengiriman diterima Kelompok Kerja (Pokja) Pemilihan paling lambat
sebelum batas akhir penyampaian penawaran, 1.4. Dalam hal Jaminan Penawaran
asli tidak diterima Kelompok Kerja (Pokja) Pemilihan sampai dengan batas waktu
yang ditentukan, maka penawaran dinyatakan gugur, 1.5. Segala risiko
keterlambatan dan kerusakan pengiriman Jaminan Penawaran asli menjadi risiko
peserta, dan 1.6. Penerbit Jaminan Penawaran: 1.6.1. Untuk Pekerjaan Konstruksi

Perusahaan Asuransi; 1.6.1.4. Lembaga khusus yang menjalankan usaha di bidang
pembiayaan, penjaminan, dan asuransi untuk mendorong ekspor Indonesia sesuai
dengan ketentuan peraturan perundangundangan di bidang Lembaga pembiayaan
ekspor Indonesia; atau 1.6.1.5. Konsorsium perusahaan asuransi umum/Lembaga
penjaminan/ perusahaan penjaminan yang mempunyai program asuransi kerugian (suretyship), huruf a.2 sampai dengan a.5
telah ditetapkan/mendapatkan rekomendasi dari Otoritas Jasa Keuangan (OJK),
1.6.2. Untuk Pekerjaan Konstruksi dengan nilai HPS (Harga Perkiraan Sendiri) di
atas Rp100.000.000.000,00 (seratus miliar rupiah), diterbitkan oleh: 1.6.2.1.
Bank Umum; atau 1.6.2.2. Konsorsium perusahaan asuransi umum/Lembaga
penjaminan/ perusahaan penjaminan yang mempunyai program asuransi kerugian (suretyship),
huruf b.2 telah ditetapkan/ mendapatkan rekomendasi dari Otoritas Jasa Keuangan
(OJK); dan 2. Pemasukan Dokumen

melalui formulir isian elektronik data kualifikasi pada aplikasi Sistem
Pengadaan Secara Elektronik (SPSE); b. Peserta mengunggah Dokumen Penawaran
terenkripsi hanya melalui aplikasi Sistem Pengadaan Secara Elektronik (SPSE)
sesuai jadwal yang ditetapkan; c. Peserta dapat mengirimkan data kualifikasi
secara berulang sebelum batas akhir waktu pemasukan Dokumen Penawaran. Data
kualifikasi yang dikirimkan terakhir akan menggantikan data kualifikasi yang
telah terkirim sebelumnya; d. Jika formulir isian elektronik kualifikasi yang
tersedia pada aplikasi Sistem Pengadaan Secara Elektronik (SPSE) belum
mengakomodir data kualifikasi yang disyaratkan Kelompok Kerja (Pokja) Pemilihan
(misalnya untuk data kualifikasi anggota Kerja Sama Operasi, KSO), maka
data kualifikasi tersebut diunggah (upload)
oleh yang mewakili/leadfirm Kerja Sama Operasi (KSO)
pada fasilitas yang tersedia pada Sistem Pengadaan Secara Elektronik (SPSE); e.
dengan mengirimkan data kualifikasi secara elektronik, peserta telah menyetujui
pernyataan sebagai berikut: 1) badan usaha yang bersangkutan tidak dalam
pengawasan pengadilan, tidak pailit, dan kegiatan usahanya tidak sedang dihentikan;
2) badan usaha tidak masuk dalam daftar hitam; 3) perorangan yang bertindak
untuk dan atas nama badan usaha tidak sedang dalam menjalani sanksi pidana; 4)
data kualifikasi yang diisikan benar dan jika dikemudian hari ditemukan bahwa
data/dokumen yang disampaikan tidak benar dan ada pemalsuan, maka direktur
utama/pimpinan perusahaan, atau kepala cabang, atau pejabat yang menurut
perjanjian kerja sama berhak mewakili badan usaha yang bekerja sama dan badan
usaha yang diwakili bersedia dikenakan sanksi administratif, sanksi pencantuman
dalam daftar hitam, gugatan secara perdata, dan/atau pelaporan secara pidana
kepada pihak berwenang sesuai dengan ketentuan peraturan perundangundangan; daan
5) pimpinan dan pengurus badan usaha bukan sebagai pegawai K/L/PD atau pimpinan
dan pengurus badan usaha sebagai pegawai K/L/PD (Kementerian / Lembaga /
Pemerintah Daerah) yang sedang mengambil cuti diluar tanggungan K/L/PD
(Kementerian / Lembaga / Pemerintah Daerah); 2. Dokumen Penawaran administrasi,
teknis, dan harga dienkripsi menggunakan sistem pengaman dokumen; 3. Peserta
mengunggah (upload) Dokumen Penawaran
administrasi, teknis, dan harga yang telah terenkripsi sesuai jadwal yang
ditetapkan; 4. Peserta dapat mengunggah Dokumen Penawaran secara berulang
sebelum batas akhir waktu pemasukan Dokumen Penawaran. Dokumen Penawaran
terakhir akan menggantikan Dokumen Penawaran yang telah terkirim sebelumnya; 5.
Surat Penawaran dan/atau Dokumen lain sebagai bagian dari Dokumen Penawaran
yang diunggah (uploaded) ke dalam aplikasi
Sistem Pengadaan Secara Elektronik (SPSE) dianggap sah sebagai dokumen
elektronik dan dianggap telah disetujui dan ditandatangani secara elektronik
oleh pemimpin/direktur perusahaan atau kepala cabang perusahaan yang diangkat
oleh kantor pusat yang dibuktikan dengan dokumen autentik atau pejabat yang
menurut perjanjian kerja sama adalah yang berhak mewakili perusahaan yang
bekerja sama atau pihak yang diberi kuasa oleh pemimpin atau direktur
perusahaan yang nama pemberi kuasanya tercantum dalam akta pendirian/perubahan;
6. Peserta tidak perlu mengunggah (upload)
hasil pemindaian dokumen asli yang bertanda tangan basah dan berstempel,
kecuali surat lain yang memerlukan tanda tangan basah dari pihak lain; 7.
Peserta dapat mengunggah (upload)
ulang Dokumen Penawaran untuk mengganti atau menimpa Dokumen Penawaran
sebelumnya, sampai dengan batas akhir pemasukan penawaran; 8. Pengguna Sistem
Pengadaan Secara Elektronik (SPSE) wajib mengetahui dan melaksanakan ketentuan
penggunaan sistem pengaman dokumen yang melekat pada Sistem Pengadaan Secara
Elektronik (SPSE); dan 9. Untuk Peserta yang berbentuk Kerja Sama Operasi (KSO),
pemasukan penawaran dilakukan oleh badan usaha yang ditunjuk mewakili Kerja Sama Operasi (KSO)/leadfirm.

encrypted Bidding Documents only through the Electronic Procurement System
application according to the set schedule; c. Participants can submit
qualification data repeatedly before the deadline for submission of Bid
Documents. Qualification data sent last will replace the qualification data
that has been sent before; d. If the qualification electronic form form in the
Electronic Procurement System application does not yet accommodate the
qualification data required by the Election Working Group (for example the data
on qualifying members of Operation Cooperation), then the qualification data is uploaded by
the representative / leadfirm of the Operational Cooperation at the facilities
available in the Electronic Procurement System; e. by sending electronic
qualification data, participants have agreed to the following statement: 1) the
business entity concerned is not under court supervision, is not bankrupt, and
its business activities are not being stopped; 2) business entities are not
blacklisted; 3) individuals acting for and on behalf of a business entity are
not under criminal sanctions; 4) qualification data that is filled in correctly
and if in the future it is found that the data / documents submitted are
incorrect and there is forgery, then the president director / company leader,
or branch head, or official who according to the cooperation agreement has the
right to represent the business entity that cooperates the business entity
represented is willing to be subject to administrative sanctions, blacklisted
sanctions, civil claims, and / or criminal reporting to the authorities in
accordance with the provisions of the legislation; and 5) leaders and managers
of business entities not as employees of Ministries / Institutions / Regional
Governments who are taking leave outside responsibility of Ministries /
Institutions / Regional Governments; 2. Offer documents of administrative,
technical and price are encrypted using a document security system; 3. Participants upload bid documents of administrative,
technical, and price that have been encrypted according to the set schedule; 4.
Participants can upload the Bid Document repeatedly before the deadline for
submission of Bid Documents. The last Bidding Document will replace the Bidding
Document that has been previously sent; 5. The Bid Letter and / or other
Documents as part of the Bidding Document uploaded into the Electronic
Procurement System application are considered valid as electronic documents and
are deemed approved and electronically signed by the leader / director of the
company or branch head of companies appointed by the head office as evidenced
by authentic documents or officials who according to the cooperation agreement
are entitled to represent the cooperating company or the party authorized by
the leader or director of the company whose name of attorney is stated in the
deed of establishment / change; 6. Participants do
not need to upload the results of the scanning of original documents that are signed
wet and stamped, except for other letters that require a wet signature from
another party; 7. Participants can upload (re-upload) the Bid Document to
replace or overwrite the previous Bid Document, up to the deadline for
submission of bids; 8. Users of the Electronic Procurement System must know and
implement the provisions for the use of document security systems attached to
the Electronic Procurement System; and 9. For Participants in the form of

Edaran Menteri Pekerjaan Umum dan Perumahan Rakyat Nomor 10 / SE / M / 2018
tentang Pemberlakuan Standar Dokumen Pemilihan Pengadaan Jasa Konstruksi dalam
Rangka Lelang Dini di Kementerian Pekerjaan Umum dan Perumahan Rakyat untuk
Tahun Anggaran 2019 yaitu 1. Pemasukan Dokumen Penawaran, 1.1. Batas
Akhir Waktu Pemasukan Penawaran, 1.1.1. Penawaran harus disampaikan secara
elektronik melalui aplikasi Sistem Pengadaan Secara Elektronik (SPSE) kepada
Kelompok Kerja (Pokja) Pemilihan paling lambat pada waktu yang ditentukan oleh
Kelompok Kerja (Pokja) Pemilihan sebagaimana tercantum dalam Lembar Data Pemilihan
(LDP), 1.1.2. Kelompok Kerja (Pokja) Pemilihan tidak diperkenankan
mengubah waktu batas akhir pemasukan penawaran kecuali: a. keadaan kahar; b.
terjadi gangguan teknis; c. perubahan dokumen pemilihan yang mengakibatkan
kebutuhan penambahan waktu penyiapan Dokumen Penawaran; atau d. tidak ada
peserta yang memasukkan penawaran sampai dengan batas akhir penyampaian
penawaran, 1.1.3. Dalam hal Kelompok Kerja (Pokja) Pemilihan mengubah waktu
batas akhir pemasukan penawaran maka harus menyampaikan/menginformasikan pada
Sistem Pengadaan Secara Elektronik (SPSE) alasan yang dapat
dipertanggungjawabkan, 1.1. 4. Dalam hal setelah batas akhir pemasukan penawaran
tidak ada peserta yang memasukkan penawaran, Kelompok Kerja (Pokja) Pemilihan
dapat memperpanjang batas akhir jadwal pemasukan penawaran, 1.1.5. Perpanjangan
jangka waktu sebagaimana dimaksud pada angka 1.1.4 dilakukan pada hari yang
sama dengan batas akhir pemasukan penawaran; 1.2. Dokumen Penawaran Terlambat
Aplikasi Sistem Pengadaan Secara Elektronik (SPSE) menolak setiap Dokumen
Penawaran yang dikirimkan setelah batas akhir waktu pemasukan penawaran; dan 2.
Pembukaan dan Evaluasi Penawaran, Pembukaan Penawaran, 2.1. Jadwal pembukaan
penawaran sebagaimana tercantum dalam Lembar Data Pemilihan (LDP), 2.2. pada
tahap pembukaan penawaran, Kelompok Kerja (Pokja) Pemilihan mengunduh (download) dan melakukan deskripsi
Dokumen Penawaran dengan menggunakan sistem pengaman dokumen sesuai waktu yang
telah ditetapkan, 2.3. terhadap Dokumen Penawaran yang tidak dapat dibuka
(didekripsi), Kelompok Kerja (Pokja) Pemilihan menyampaikan Dokumen Penawaran
tersebut kepada Layanan Pengadaan Secara Elektronik (LPSE) untuk mendapat
keterangan bahwa Dokumen yang bersangkutan tidak dapat dibuka dan bila dianggap
perlu Layanan Pengadaan Secara Elektronik (LPSE) dapat menyampaikan Dokumen
Penawaran tersebut kepada LKPP (Lembaga Kebijakan Pengadaan Barang/Jasa
Pemerintah), 2.4. Berdasarkan keterangan dari Layanan Pengadaan Secara
Elektronik (LPSE), apabila Dokumen Penawaran tidak dapat dibuka/didekripsi maka
Kelompok Kerja (Pokja) Pemilihan dapat menetapkan bahwa Dokumen Penawaran
tersebut tidak memenuhi syarat sebagai penawaran dan penyedia barang/jasa yang
mengirimkan Dokumen Penawaran tersebut dianggap tidak memasukkan penawaran.
Apabila dapat dibuka, maka Kelompok Kerja (Pokja) Pemilihan akan melanjutkan
proses atas penawaran yang bersangkutan, 2.5. dinyatakan sebagai penawaran yang
masuk apabila Dokumen Penawaran sebagaimana dimaksud pada Instruksi Kepada
Peserta (IKP), Dokumen Penawaran paling kurang terdiri atas: a. Penawaran
Administrasi; b. Penawaran Teknis; dan c. Penawaran Harga terpenuhi. Surat
pengunduran diri (misalnya) tidak termasuk sebagai penawaran, 2.6. Apabila
penawaran yang masuk kurang dari 3 (tiga) peserta maka tender dilanjutkan dengan tahap evaluasi penawaran dan kualifikasi,
serta selanjutnya dilakukan:1) dalam hal terdapat 2 (dua) peserta yang memenuhi
persyaratan administrasi, teknis, dan kualifikasi, dapat dilakukan E-Reverse Auction (apabila sudah
didukung oleh Sistem Pengadaan Secara Elektronik, SPSE), dan 2) dalam hal hanya
1 (satu) peserta yang memenuhi persyaratan administrasi, teknis, dan kualifikasi,
dilanjutkan dengan klarifikasi dan negosiasi teknis dan harga, 2.7. apabila
penawaran yang masuk hanya 1 (satu), maka tender
dilanjutkan seperti proses penunjukan langsung, dan 2.8. Kelompok Kerja (Pokja)
Pemilihan tidak boleh menggugurkan penawaran pada waktu pembukaan penawaran,
kecuali untuk Dokumen Penawaran yang sudah dipastikan tidak dapat dibuka

Enactment of the Standared of Selection Document for the Procurement of
Construction Services in the Early Auction Framework at the Ministry of Public
Works and Public Housing for Fiscal Year
2019 namely 1. Entering Bid Documents, 1.1. Deadline for Bid Submission, 1.1.1.
Offers must be submitted electronically through the Electronic Procurement
System application to the Election Working Group at the latest at the time
determined by the Election Working Group as stated in the Election Data Sheet,
1.1.2. Election Working Groups are not permitted to change the deadline for
submission of bids except: a. force state; b. technical problems; c. changes to
the selection document resulting in the need for additional time to prepare the
Bidding Document; or d. no participant enters an offer up to the deadline for
submission of bids, 1.1.3. In the case of the Election Working Group changes
the deadline for submission of bids, it must inform the Electronic Procurement
System of reasons that can be accounted for, 1.1. 4. In the event that after
the deadline for submission of offers no participant enters an offer, the
Election Working Group can extend the deadline for submission of bidding
schedules, 1.1.5. The extension of the period as referred to in number 1.1.4 is
carried out on the same day as the deadline for submission of bids; 1.2. Late
Bidding Documents, Electronic Procurement System Application (SPSE) rejects
every Bidding Document sent after the deadline for submission of bids;and 2. Opening and Evaluating Bid, Opening
Bid, 2.1. Bid opening schedule as stated in the Election Data Sheet, 2.2. at
the bid opening stage, the Election Working Group downloads and decrypts the
Bidding Documents by using the document security system within the stipulated
time, 2.3. with respect to Bidding Documents that cannot be opened (decrypted),
the Election Working Group presents the Bidding Document to Electronic
Procurement Services to obtain information that the relevant Document cannot be
opened and if deemed necessary Electronic Procurement Service may submit the
Bidding Document to The Policy Institution of Goods / Services Procurement of Government,
2.4. Based on information from Electronic Procurement Service, if the Bidding
Document cannot be opened / decrypted, the Election Working Group can determine
that the Bidding Document does not fulfill the requirements as an offer and the
goods / service provider that submits the Bidding Document is deemed not
included offer. If it can be opened,
the Election Working Group will continue the process of the relevant offer,
2.5. declared as an incoming offer if the Bid Document as referred to in Instruction
to Participant, the Bidding Document must consist of at least: a.
Administrative Offer; b. Technical Offer; and c. Price Offer fulfilled.
Resignation letters (for example) are not included as offers, 2.6. If the bids
are less than 3 (three) participants, the tender will be continued with stage
of the bid and qualification evaluation, and then carried out: 1) in the event
there are 2 (two) participants who meet administrative, technical and
qualification requirements, E-Reverse Auction can be carried out (if already supported
by the Electronic Procurement System), and 2) in the event that only 1 (one)
participant meets administrative, technical, and qualification requirements,
followed by clarification and technical negotiations and prices, 2.7. if the
incoming bid is only 1 (one), then the tender is continued as a direct
appointment process, and 2.8. The Election Working Group may not abort the bid
at the time of bid opening, except for the Bid Documents that have been
ascertained that they cannot be opened based on the statement of Electronic
Procurement Services.

terendah; 2. Kelompok Kerja (Pokja) melakukan evaluasi Dokumen Penawaran
berdasarkan data yang diunggah (uploaded)
dalam aplikasi Sistem Pengadaan Secara Elektronik (SPSE), dikecualikan untuk
evaluasi Jaminan Penawaran dilakukan berdasarkan dokumen Jaminan Penawaran asli
yang disampaikan; 3. Data dokumen
elektronik yang rusak (sesudah mendapat klarifikasi dari Layanan Pengadaan
Secara Elektronik, LPSE) akibat kesalahan pengiriman dokumen oleh Penyedia
Jasa, yang mengakibatkan dokumen tersebut tidak dapat dilakukan evaluasi oleh
Kelompok Kerja (Pokja) Pemilihan, maka dokumen elektronik tersebut dinyatakan
tidak memenuhi syarat; 4. Sebelum evaluasi penawaran, dilakukan koreksi
aritmatik dengan ketentuan: a. Bagian Pekerjaan Lumsum: 1) koreksi aritmatik
dilakukan tanpa mengubah nilai total
harga penawaran untuk bagian pekerjaan Lumsum, dengan menyesuaikan keluaran (output) pekerjaan yang tercantum dalam
Daftar Keluaran dan Harga dengan yang tercantum dalam Dokumen Pemilihan; 2) koreksi
aritmatik untuk penawaran yang tidak melampirkan Daftar Keluaran dan Harga,
maka keluaran (output) pekerjaan yang
ditawarkan ditetapkan sama dengan yang tercantum dalam Dokumen Pemilihan tanpa
mengubah nilai total penawaran untuk
bagian pekerjaan Lumsum; 3) perbedaan angka dan huruf harga penawaran: a)
apabila ada perbedaan antara penulisan nilai harga penawaran antara angka dan
huruf maka nilai yang diakui adalah nilai dalam tulisan huruf; b) apabila
penawaran dalam angka tertulis dengan jelas sedangkan dalam huruf tidak jelas
dan/atau tidak bermakna dan/atau salah, maka nilai yang diakui adalah nilai dalam
tulisan angka; atau c) apabila penawaran dalam angka dan huruf tidak jelas
dan/atau tidak bermakna dan/atau salah, maka penawaran dinyatakan gugur, dan b.
Bagian Pekerjaan Harga Satuan: 1) volume
pekerjaan yang tercantum dalam Daftar Kuantitas dan Harga disesuaikan dengan
yang tercantum dalam Dokumen Pemilihan; 2) apabila terjadi kesalahan hasil
perkalian antara volume dengan harga
satuan pekerjaan, dilakukan pembetulan, dengan ketentuan harga satuan pekerjaan
yang ditawarkan tidak boleh diubah; 3) jenis pekerjaan yang tidak diberi harga
satuan dianggap sudah termasuk dalam harga satuan pekerjaan yang lain dan harga
satuan pada Daftar Kuantitas dan Harga tetap dibiarkan kosong; 4) jenis
pekerjaan yang tidak tercantum dalam Daftar Kuantitas dan Harga disesuaikan
dengan jenis pekerjaan yang tercantum dalam dokumen pemilihan dan harga satuan
pekerjaan dimaksud dianggap nol; 5. Hasil koreksi aritmatik dapat mengubah
nilai total harga penawaran sehingga
urutan peringkat dapat menjadi lebih tinggi atau lebih rendah dari urutan
peringkat semula; 6. Penawaran setelah koreksi aritmatik yang melebihi nilai total HPS (Harga Perkiraan Sendiri)
dinyatakan gugur; 7. Apabila semua harga penawaran setelah koreksi aritmatik di
atas nilai total HPS (Harga Perkiraan
Sendiri), tender dinyatakan gagal; 8.
Berdasarkan hasil koreksi aritmatik Kelompok Kerja (Pokja) Pemilihan menyusun
urutan dari penawaran terendah; 9. apabila setelah koreksi aritmatik terdapat
kurang dari 3 (tiga) penawar yang menawar di bawah dari nilai total HPS (Harga Perkiraan Sendiri) maka
proses tender tetap dilanjutkan
dengan melakukan evaluasi penawaran; 10. Setelah melakukan koreksi aritmatik,
Kelompok Kerja (Pokja) Pemilihan memeriksa indikasi persekongkolan sebagaimana Instruksi Kepada
Peserta (IKP) angka 6; 11. Setelah memeriksa indikasi persekongkolan, Kelompok
Kerja (Pokja) Pemilihan melakukan evaluasi penawaran yang meliputi: a. evaluasi
administrasi; b. evaluasi teknis; dan c. evaluasi harga; 12. Ketentuan umum
dalam melakukan evaluasi sebagai berikut: a. kelompok Kerja (Pokja) Pemilihan
dilarang menambah, mengurangi, mengganti, dan/atau mengubah kriteria dan
persyaratan yang telah ditetapkan dalam Dokumen Pemilihan ini; b. kelompok
Kerja (Pokja) Pemilihan dan/atau peserta dilarang menambah, mengurangi,
mengganti, dan/atau mengubah isi Dokumen Penawaran; c. penawaran yang memenuhi
syarat adalah penawaran yang sesuai dengan ketentuan, syarat-syarat, dan
spesifikasi teknis yang ditetapkan dalam Dokumen Pemilihan ini, tanpa ada
penyimpangan yang bersifat penting/pokok atau penawaran bersyarat; d. penyimpangan
yang bersifat penting/pokok atau penawaran bersyarat adalah: 1) penyimpangan
Dokumen Penawaran dari Dokumen Pemilihan yang mempengaruhi lingkup, kualitas
dan hasil/kinerja pekerjaan; dan/atau 2) penawaran dari peserta dengan
persyaratan tambahan diluar ketentuan dan syarat-syarat yang akan menimbulkan
persaingan usaha tidak sehat dan/atau tidak adil, e. kelompok Kerja (Pokja)
Pemilihan dilarang menggugurkan penawaran dengan alasan: 1) Peserta tidak aktif/tidak
membuka Sistem Pengadaan Secara Elektronik (SPSE) dan/atau tidak bertanya pada
saat pemberian penjelasan; dan/atau 2) kesalahan yang tidak substansial, adalah
kesalahan-kesalahan yang tidak mempengaruhi hasil evaluasi, f. para pihak
dilarang mempengaruhi atau melakukan intervensi kepada Kelompok Kerja (Pokja)
Pemilihan selama proses evaluasi; g. apabila dalam evaluasi ditemukan bukti
adanya persaingan usaha yang tidak sehat dan/atau terjadi pengaturan bersama
(indikasi kolusi/persekongkolan) antara peserta, Kelompok Kerja (Pokja)
Pemilihan, Unit Kerja Pengadaan Barang/Jasa (UKPBJ), PPK
(Pejabat Pembuat Komitmen) dan/atau pihak lain yang terlibat, dengan tujuan
untuk memenangkan salah satu peserta, maka: 1) peserta yang ditunjuk sebagai
calon pemenang dan peserta lain yang terlibat dikenakan sanksi dalam Daftar
Hitam; 2) anggota Kelompok Kerja (Pokja) Pemilihan, PPK (Pejabat Pembuat
Komitmen) dan/atau pihak lain yang terlibat persekongkolan dikenakan sanksi
sesuai dengan ketentuan peraturan perundang-undangan; 3) proses evaluasi tetap
dilanjutkan dengan menetapkan peserta lainnya yang tidak terlibat (apabila
ada); dan 4) apabila tidak ada peserta lain sebagaimana dimaksud pada angka 3),
maka tender dinyatakan gagal, dan h.
apabila indikasi persekongkolan terpenuhi, maka peserta digugurkan pada tahap
evaluasi administrasi, teknis, dan/atau kualifikasi; 13. Evaluasi Administrasi:
a. evaluasi terhadap data administrasi dilakukan terhadap hal-hal yang
tidak/belum dinilai pada saat penilaian kualifikasi; b. penawaran dinyatakan
memenuhi persyaratan administrasi, apabila: 1) syarat-syarat substansial yang
diminta berdasarkan Dokumen Pemilihan terpenuhi, yaitu dengan dilampirkannya:
a) Surat Penawaran; b) Jaminan Penawaran Asli (apabila disyaratkan); c) Surat
Perjanjian Kerja Sama Operasi (apabila ber-KSO, Kerja Sama Operasi); d) Dokumen
Penawaran Teknis; e) Dokumen Penawaran Harga, 2) Surat Penawaran memenuhi
ketentuan sebagai berikut: a) bertanggal; b) jangka waktu berlakunya Surat
Penawaran tidak kurang dari waktu sebagaimana tercantum dalam Lembar Data
Pemilihan (LDP), dengan ketentuan: i. apabila ada perbedaan penulisan antara
angka dan huruf maka jangka waktu yang diakui adalah tulisan huruf; ii. apabila
yang tertulis dalam angka jelas sedangkan nilai dalam huruf tidak jelas/tidak
bermakna/salah, maka jangka waktu yang diakui adalah yang tertulis dalam angka;
atau iii. apabila yang tertulis dalam angka dan dalam huruf tidak jelas/tidak
bermakna/salah, maka penawaran dinyatakan gugur, c) dalam hal terdapat
kesalahan pengetikan dalam penulisan nama Kelompok Kerja (Pokja) dan/atau nama
paket, maka tidak dapat dinyatakan gugur; dan d) dalam hal terdapat kesalahan
tanggal, maka apabila kesalahan tersebut tidak menyebabkan masa berlaku surat
penawaran menjadi kurang dari waktu sebagaimana tercantum dalam Lembar Data
Pemilihan (LDP) maka tidak dapat dinyatakan gugur, 3) jaminan Penawaran Asli
(apabila disyaratkan) memenuhi ketentuan sebagai berikut: a) dalam hal
pekerjaan Konstruksi dengan nilai HPS (Harga Perkiraan Sendiri) di atas
Rp10.000.000.000,00 (sepuluh miliar rupiah) sampai dengan Rp100.000.000.000,00
(seratus miliar rupiah), diterbitkan oleh: a).1. Bank Umum; a).2. Perusahaan
Penjaminan; a).3. Perusahaan Asuransi; a).4. Lembaga khusus yang menjalankan usaha
di bidang pembiayaan, penjaminan, dan asuransi untuk mendorong ekspor Indonesia
sesuai dengan ketentuan peraturan perundang-undangan di bidang Lembaga
pembiayaan ekspor Indonesia; atau a).5. Konsorsium perusahaan asuransi umum/
konsorsium Lembaga penjaminan/ konsorsium perusahaan penjaminan yang mempunyai
program asuransi kerugian (suretyship),
huruf a.2 sampai dengan a.5 telah ditetapkan/mendapatkan rekomendasi dari
Otoritas Jasa Keuangan (OJK). b) dalam hal pekerjaan Konstruksi dengan nilai
HPS (Harga Perkiraan Sendiri) di atas Rp100.000.000.000,00 (seratus miliar
rupiah) diterbitkan oleh: a).5.1. Bank Umum; atau a).5.2. Konsorsium perusahaan
asuransi umum/konsorsium Lembaga penjaminan/konsorsium perusahaan penjaminan
yang mempunyai program asuransi kerugian (suretyship);
huruf b.2 telah ditetapkan/ mendapatkan rekomendasi dari Otoritas Jasa Keuangan
(OJK), c) masa berlaku tidak kurang dari yang ditetapkan dalam Dokumen
Pemilihan; d) masa berlaku dicantumkan dalam angka dan huruf, dengan ketentuan:
(1) apabila ada perbedaan penulisan antara angka dan huruf maka masa berlaku
yang diakui adalah tulisan huruf; (2) apabila yang tertulis dalam angka jelas
sedangkan dalam huruf tidak jelas/tidak bermakna/salah, maka yang diakui adalah
masa berlaku yang tertulis dalam angka; atau (3) apabila yang tertulis dalam
angka dan dalam huruf tidak jelas/tidak bermakna/salah, maka dinyatakan gugur,
e) nama yang tercantum dalam surat Jaminan Penawaran sama dengan nama peserta;
f) besaran nilai Jaminan Penawaran tidak kurang dari nilai jaminan yang
ditetapkan dalam Dokumen Pemilihan; g) besaran nilai Jaminan Penawaran
dicantumkan dalam angka dan huruf, dengan ketentuan: (1) apabila ada perbedaan
penulisan antara angka dan huruf maka nilai yang diakui adalah tulisan huruf;
(2) apabila yang tertulis dalam angka jelas sedangkan dalam huruf tidak
jelas/tidak bermakna/salah, maka yang diakui adalah nilai yang tertulis dalam
angka; atau (3) apabila yang tertulis dalam angka dan dalam huruf tidak
jelas/tidak bermakna/salah, maka penawaran dinyatakan gugur. h) nama Kelompok
Kerja (Pokja) Pemilihan yang menerima Jaminan Penawaran sama dengan nama
Kelompok Kerja (Pokja) Pemilihan yang mengadakan Tender; i) Paket pekerjaan yang dijamin sama dengan paket pekerjaan
yang ditenderkan; j) Jaminan
Penawaran harus dapat dicairkan tanpa syarat (unconditional) sebesar nilai Jaminan dalam waktu paling lambat 14
(empat belas) hari kerja, setelah surat pernyataan wanprestasi dari Kelompok
Kerja (Pokja) Pemilihan diterima oleh Penerbit Jaminan; k) Jaminan Penawaran
atas nama KSO (Kerja Sama Operasi) harus ditulis atas nama KSO (Kerja Sama
Operasi); dan l) substansi dan keabsahan/keaslian Jaminan Penawaran telah
dikonfirmasi dan diklarifikasi secara tertulis oleh Kelompok Kerja (Pokja)
Pemilihan kepada penerbit jaminan apabila kurang jelas dan meragukan, 4) Surat
Perjanjian Kerja Sama Operasi memenuhi persyaratan sebagai berikut: a)
mencantumkan nama KSO (Kerja Sama Operasi) sesuai dengan dokumen isian
kualifikasi; b) mencantumkan nama perusahaan leadfirm dan anggota KSO (Kerja Sama Operasi); c) mencantumkan
pembagian modal (sharing) dari setiap
perusahaan; d) mencantumkan nama individu pihak yang mewakili KSO (Kerja Sama
Operasi); dan e) ditandatangani para calon peserta KSO (Kerja Sama Operasi), c.
Kelompok Kerja (Pokja) Pemilihan dapat melakukan klarifikasi/konfirmasi secara
tertulis terhadap hal-hal yang kurang jelas dan meragukan namun tidak boleh
mengubah substansi, d. evaluasi administrasi menghasilkan dua kesimpulan, yaitu
memenuhi syarat administrasi atau tidak memenuhi syarat administrasi; e.
Peserta yang memenuhi persyaratan administrasi dilanjutkan dengan evaluasi
teknis, f. apabila dari 3 (tiga) penawaran terendah ada yang tidak memenuhi
persyaratan administrasi maka Kelompok Kerja (Pokja) Pemilihan melakukan
evaluasi administrasi terhadap penawar terendah berikutnya (apabila ada); g. apabila
hanya ada 1 (satu) atau 2 (dua) peserta yang memenuhi persyaratan administrasi,
maka evaluasi tetap dilanjutkan dengan evaluasi teknis; dan h. apabila tidak
ada peserta yang memenuhi persyaratan administrasi, maka tender dinyatakan gagal; 14. Evaluasi Teknis: a. evaluasi teknis
dilakukan terhadap peserta yang memenuhi persyaratan administrasi; b. unsur-unsur
yang dievaluasi teknis sesuai dengan yang ditetapkan sebagaimana tercantum
dalam Lembar Data Pemilihan (LDP); c. evaluasi teknis dilakukan dengan sistem
gugur dengan ketentuan: 1) Kelompok Kerja (Pokja) Pemilihan menilai persyaratan
teknis minimal yang harus dipenuhi
dengan membandingkan pemenuhan persyaratan teknis sebagaimana tercantum dalam
Lembar Data Pemilihan (LDP); 2) penawaran dinyatakan memenuhi persyaratan
teknis sebagaimana tercantum dalam Lembar Data Pemilihan (LDP) apabila: a) metode
pelaksanaan pekerjaan memenuhi persyaratan substantif yang ditetapkan dalam
Dokumen Pemilihan dan diyakini menggambarkan penguasaan dalam menyelesaikan
pekerjaan, meliputi: (1) tahapan/urutan pekerjaan dari awal sampai akhir secara
garis besar dan uraian/cara kerja dari masing-masing jenis pekerjaan utama; (2)
kesesuaian antara metode kerja dengan peralatan utama yang
ditawarkan/diperlukan dalam pelaksanaan pekerjaan; (3) Kesesuaian antara metode
kerja dengan spesifikasi/volume
pekerjaan yang disyaratkan. Penilaian metode pelaksanaan tidak mengevaluasi jobmix/rincian/ campuran/komposisi material dari jenis pekerjaan. Dalam
melakukan evaluasi terhadap metode pelaksanaan pekerjaan, Kelompok Kerja
(Pokja) Pemilihan membandingkan antara metode kerja yang ditawarkan oleh
peserta dengan metode kerja yang menjadi bagian persyaratan teknis yang telah
ditetapkan oleh PPK (Pejabat Pembuat Komitmen) dengan cara menilai kesesuaian
metode tersebut. Apabila tidak sesuai, Kelompok Kerja (Pokja) melakukan
evaluasi berdasarkan kesesuaian metode kerja yang ditawarkan dengan peralatan utama,
serta personel berdasarkan keahlian yang dapat dipertanggungjawabkan, b) Jangka
waktu pelaksanaan pekerjaan yang ditawarkan tidak melampaui batas waktu
sebagaimana tercantum dalam Lembar Data Pemilihan (LDP), c) peralatan utama
yang ditawarkan sesuai dengan yang ditetapkan dalam Dokumen Pemilihan, dengan
ketentuan: (1) yang dimaksud dengan peralatan utama adalah peralatan yang
mendukung langsung dan sesuai kebutuhan untuk melaksanakan pekerjaan pekerjaan
utama (major item), (2) jenis,
kapasitas, dan jumlah yang disediakan untuk pelaksanaan pekerjaan, (3) kepemilikan
peralatan utama adalah milik sendiri, sewa beli, dan/atau milik pihak lain
dengan perjanjian Sewa bersyarat (bukan surat dukungan), (4) khusus pekerjaan
dengan nilai HPS (Harga Perkiraan Sendiri) di atas Rp200.000.000.000,00 (dua
ratus miliar rupiah), maka peralatan utama wajib milik sendiri atau dalam
status Sewa Beli dengan ketentuan peralatan sudah dalam penguasaan peserta dan
sudah ada bukti perjanjian sewa beli dengan tanggal perjanjian sebelum
pemasukan penawaran, (5) evaluasi terhadap peralatan utama yang bersumber dari:
(a) milik sendiri, dilakukan terhadap bukti kepemilikan peralatan [contoh STNK
(Surat Tanda Nomor Kenderaan), BPKB (Buku Pemilik Kenderaan Bermotor), invoice]; (b) Sewa Beli, dilakukan
terhadap bukti pembayaran Sewa Beli (contoh invoice
uang muka, angsuran), (c) sewa, cukup terhadap kebenaran surat perjanjian sewa,
(6) dalam hal jenis, kapasitas, komposisi dan jumlah peralatan minimal yang ditawarkan berbeda dengan
yang tercantum dalam Dokumen Pemilihan, maka Kelompok Kerja (Pokja) Pemilihan
akan membandingkan produktivitas alat tersebut berdasarkan metode pelaksanaan
pekerjaan yang ditawarkan. Apabila perbedaan peralatan menyebabkan metode tidak
dapat dilaksanakan atau produktivitas yang diinginkan tidak tercapai sesuai
dengan target serta waktu yang dibutuhkan, maka dinyatakan tidak memenuhi
persyaratan dan dapat digugurkan pada tahap evaluasi teknis, d) Personel
manajerial yang ditawarkan sesuai dengan yang diperlukan dalam pelaksanaan
pekerjaan, dengan ketentuan: (1). Personel manajerial yang disyaratkan meliputi
jabatan: Manajer Pelaksanaan/ Proyek, Manajer Teknik, Manajer Keuangan, dan
Ahli/Petugas K3 (Keselamatan dan Kesehatan Kerja), (2). untuk pekerjaan yang
diperuntukkan bagi: (a) Usaha Kecil tidak mensyaratkan Tenaga Ahli; (b) Usaha
Menengah dan Usaha Besar tidak mensyaratkan Tenaga Teknisi atau Analis dan Operator, (3). untuk pekerjaan yang
memiliki tingkat risiko kecil, maka dapat mensyaratkan Petugas K3 (Keselamatan
dan Kesehatan Kerja) atau Ahli K3 (Keselamatan dan Kesehatan Kerja) sedangkan
untuk pekerjaan yang masuk dalam kategori risiko besar maka mensyaratkan Ahli
K3 (Keselamatan dan Kesehatan Kerja), (4). Kompetensi personel manajerial
meliputi tingkat pendidikan dan pengalaman bekerja sesuai jenis pekerjaan yang
di-tender-kan, (5). Sertifikat
Kompetensi Kerja tidak dievaluasi pada saat pemilihan, dibuktikan saat rapat
persiapan penunjukan penyedia, (6). Pengalaman kerja yang dihitung adalah
pengalaman sesuai dengan jenis pekerjaan yang ditenderkan (bukan berdasarkan jabatan yang ditawarkan), (7).
Pengalaman kerja dihitung per tahun tanpa memperhatikan lamanya pelaksanaan
konstruksi (dihitung berdasarkan Tahun Anggaran), e) bagian pekerjaan yang akan
disubkontrakkan memenuhi ketentuan sebagai berikut: (1). Paket pekerjaan dengan
nilai pagu anggaran di atas Rp25.000.000.000,00 (dua puluh lima miliar rupiah)
sampai dengan Rp50.000.000.000,00 (lima puluh miliar rupiah) wajib
mensubkontrakkan sebagian pekerjaan utama kepada penyedia jasa spesialis
(apabila telah tersedia penyedia jasa spesialis), dan sebagian pekerjaan yang
bukan pekerjaan utama kepada sub penyedia jasa Usaha Kecil, dan/atau (2). Paket
pekerjaan dengan nilai pagu anggaran di atas Rp50.000.000.000,00 (lima puluh
miliar rupiah) wajib mensubkontrakkan sebagian pekerjaan utama kepada penyedia
jasa spesialis (apabila telah tersedia penyedia jasa spesialis) dan sebagian
pekerjaan yang bukan pekerjaan utama kepada sub penyedia jasa Usaha Kecil.
Peserta dalam penawarannya sudah menominasikan subpenyedia jasa spesialis
(apabila telah tersedia penyedia jasa spesialis) dan subpenyedia jasa Usaha
Kecil dari lokasi pekerjaan provinsi setempat, kecuali tidak tersedia
subpenyedia jasa dari provinsi setempat yang dimaksud, dengan cara memilih
perkerjaan yang disubkontrakkan sesuai yang tercantum dalam Lembar Data
Pemilihan (LDP); (3). Penyedia tidak mensubkontrakkan seluruh pekerjaan utama, dan
(4). Penyedia Usaha Kecil tidak mensubkontrakkan pekerjaan yang diperoleh, f)
Dokumen Rencana Keselamatan Konstruksi (RKK) memenuhi persyaratan sebagaimana
tercantum dalam Lembar Data Pemilihan (LDP), yang memuat: (1). manajemen risiko
dan rencana tindakan (minimal sesuai
identifikasi bahaya yang ditentukan PPK, Pejabat Pembuat Komitmen), meliputi:
(a) Penjelasan manajemen risiko meliputi mengidentifikasi bahaya, menilai
tingkat risiko, dan mengendalikan tingkat risiko, (b) Penjelasan rencana
tindakan meliputi sasaran umum, sasaran khusus, dan Program K3 (Keselamatan dan
Kesehatan Kerja), (2). tanda tangan wakil sah badan usaha, g) Dokumen lain yang
disyaratkan (apabila ada) sebagaimana tercantum dalam Lembar Data Pemilihan
(LDP), dengan ketentuan: (1) kriteria evaluasi diuraikan secara rinci dan
terukur; (2) Persyaratan harus mempertimbangkan persaingan usaha yang sehat dan
jangka waktu pemenuhan persyaratan, d. Kelompok Kerja (Pokja) Pemilihan dapat
melakukan verifikasi lapangan dan/atau klarifikasi, khususnya kepada
pabrikan/produsen/agen/ distributor material alat untuk menjamin konsistensi
jenis material/alat serta kemampuan
untuk menyediakan material/peralatan
sesuai jadwal yang telah ditetapkan serta kebenaran penyewaan terhadap
pelaksanaan pekerjaan; e. apabila dalam evaluasi teknis terdapat hal - hal yang
tidak jelas atau meragukan, Kelompok Kerja (Pokja) Pemilihan melakukan
klarifikasi dengan peserta. Dalam klarifikasi, peserta tidak diperkenankan
mengubah substansi penawaran. Hasil verifikasi lapangan dan/atau klarifikasi
dapat menggugurkan penawaran, f. Peserta yang dinyatakan lulus evaluasi teknis
dilanjutkan dengan evaluasi harga, g. Apabila hanya ada 1 (satu) atau 2 (dua)
peserta yang lulus evaluasi teknis, maka evaluasi tetap dilanjutkan dengan
evaluasi harga; h. apabila dari 3 (tiga) penawaran terendah setelah koreksi
aritmatik tidak ada yang memenuhi persyaratan teknis maka Kelompok Kerja
(Pokja) Pemilihan dapat melakukan evaluasi penawaran terhadap penawar terendah
berikutnya (apabila ada) dimulai dari evaluasi administrasi, i. apabila tidak
ada peserta yang lulus evaluasi teknis maka tender
dinyatakan gagal, dan j. Kelompok Kerja (Pokja) Pemilihan memasukkan hasil
evaluasi teknis pada aplikasi Sistem Pengadaan Secara Elektronik (SPSE),
termasuk alasan ketidaklulusan peserta dalam evaluasi teknis; 15. Evaluasi
Harga: a. unsur-unsur yang perlu dievaluasi adalah hal-hal yang pokok atau
penting, dengan ketentuan: 1) Total
harga penawaran terkoreksi dibandingkan dengan nilai total HPS (Harga Perkiraan Sendiri): a) apabila total harga penawaran terkoreksi
melebihi nilai total HPS (Harga
Perkiraan Sendiri), dinyatakan gugur; dan b) apabila semua harga penawaran
terkoreksi di atas nilai total HPS
(Harga Perkiraan Sendiri), tender
dinyatakan gagal, 2) apabila tidak menyampaikan perkiraan biaya penyelenggaraan
keamanan dan kesehatan kerja serta Keselamatan Konstruksi maka dinyatakan gugur,
3) dalam hal bagian pekerjaan harga satuan maka harga satuan penawaran yang
nilainya lebih besar dari 110% (seratus sepuluh perseratus) dari harga satuan
yang tercantum dalam HPS (Harga Perkiraan Sendiri), dilakukan klarifikasi
dengan ketentuan: a) apabila setelah dilakukan klarifikasi, ternyata harga
satuan tersebut dinyatakan timpang maka harga satuan timpang hanya berlaku
untuk volume sesuai dengan Daftar
Kuantitas dan Harga. Jika terjadi penambahan volume terhadap pekerjaan yang harga satuannya dinyatakan timpang,
maka pembayaran terhadap volume
tersebut berdasarkan harga satuan hasil negosiasi; b) apabila setelah dilakukan
klarifikasi, ternyata harga satuan tersebut dapat dipertanggungjawabkan/ sesuai
dengan harga pasar maka harga satuan tersebut dinyatakan tidak timpang, 4) apabila
terdapat mata pembayaran yang harganya nol atau tidak ditulis maka dilakukan
klarifikasi, kegiatan tersebut harus tetap dilaksanakan. Harganya dianggap
termasuk dalam harga pekerjaan lainnya, b. dilakukan evaluasi kewajaran harga
dengan ketentuan sebagai berikut: 1) Evaluasi kewajaran harga dilakukan
terhadap bagian pekerjaan lumsum dan bagian pekerjaan harga satuan; 2) klarifikasi
terhadap hasil koreksi aritmatik, apabila ada koreksi/ perubahan; 3)
Klarifikasi dalam hal penawaran Tingkat Komponen Dalam Negeri (TKDN) berbeda
dibandingkan dengan perkiraan Kelompok Kerja (Pokja) Pemilihan (apabila
mensyaratkan Tingkat Komponen Dalam Negeri, TKDN), 4) klarifikasi/evaluasi
kewajaran harga apabila harga penawaran dibawah 80% (delapan puluh perseratus)
HPS (Harga Perkiraan Sendiri) dengan ketentuan: a) Peserta menyampaikan Rincian
Keluaran dan Harga (untuk bagian pekerjaan lumsum) dan Analisa Harga Satuan
Pekerjaan (untuk bagian pekerjaan harga satuan), b) Rincian Keluaran dan Harga
(untuk bagian pekerjaan lumsum) dan Analisa Harga Satuan Pekerjaan (untuk
bagian pekerjaan harga satuan) hanya digunakan untuk evaluasi kewajaran harga
penawaran dan tidak dapat digunakan sebagai dasar pengukuran dan pembayaran
pekerjaan, c) meneliti dan menilai kewajaran harga satuan dasar meliputi harga
upah, bahan, dan peralatan dari harga satuan penawaran sekurang - kurangnya pada
setiap mata pembayaran utama, d) meneliti dan menilai kewajaran
kuantitas/koefisien dari unsur upah, bahan, dan peralatan dalam Analisa Harga
Satuan sekurang-kurangnya pada setiap pekerjaan utama, e) Hasil penelitian
butir c) dan butir d) digunakan untuk menghitung kewajaran harga tanpa memperhitungkan
keuntungan yang ditawarkan; f) Harga dalam Analisa Harga Satuan Pekerjaan dan
Rincian Keluaran dan Harga yang dinilai wajar dan dapat dipertanggungjawabkan
digunakan untuk menghitung total
harga penawaran; g) Total harga
sebagaimana dimaksud pada huruf f) dihitung berdasarkan: (1) volume yang ada dalam Daftar Kuantitas
dan Harga, serta (2) keluaran (outputs)
yang ada dalam Daftar Keluaran dan Harga, h) apabila total harga lebih kecil dari hasil evaluasi sebagaimana huruf g)
tersebut, maka harga penawaran dinyatakan tidak wajar dan gugur harga, i) apabila
total harga penawaran lebih besar
dari hasil evaluasi sebagaimana huruf g) tersebut, maka harga penawaran
dinyatakan wajar; j) apabila peserta tersebut ditunjuk sebagai pemenang tender, harus bersedia untuk menaikkan
Jaminan Pelaksanaan menjadi 5% (lima perseratus) dari nilai total HPS (Harga Perkiraan Sendiri), dan
k) apabila peserta yang bersangkutan tidak bersedia menaikkan nilai Jaminan
Pelaksanaan menjadi sebesar 5% (lima perseratus) HPS (Harga Perkiraan Sendiri),
penawarannya digugurkan serta dikenakan sanksi Daftar Hitam, c. memperhitungkan
preferensi harga atas penggunaan produksi dalam negeri (apabila memenuhi
persyaratan diberlakukannya preferensi harga) dengan ketentuan perhitungan
Tingkat Komponen Dalam Negeri (TKDN) yang disampaikan oleh peserta berdasarkan
penilaian sendiri (self assessment),
dengan ketentuan: 1) Preferensi Harga untuk Barang/Jasa dalam negeri diberlakukan
pada Pengadaan Barang/Jasa yang dibiayai rupiah murni tetapi hanya berlaku
untuk Pengadaan Barang/Jasa bernilai diatas Rp1.000.000.000,00 (satu miliar
rupiah), 2) Preferensi Harga hanya diberikan kepada Barang/Jasa dalam negeri
dengan Tingkat Komponen Dalam Negeri (TKDN) lebih besar atau sama dengan 25%
(dua puluh lima perseratus). Apabila peserta tidak menyampaikan formulir
perhitungan Tingkat Komponen Dalam Negeri (TKDN) maka peserta dianggap tidak
menginginkan diberlakukan preferensi harga bagi penawarannya dan tidak menggugurkan.
Ketentuan dan tata cara penghitungan Tingkat Komponen Dalam Negeri (TKDN)
merujuk pada ketentuan yang ditetapkan oleh Menteri yang membidangi urusan
perindustrian dengan tetap berpedoman pada tata nilai Pengadaan Barang/Jasa, 3)

2019 namely Bid Opening and Evaluation, Bid Document Evaluation, 1. Evaluation
of bids carried out with the lowest price system; 2. The Working Group
evaluates the Bidding Document based on data uploaded in the Electronic
Procurement System application, excluded for evaluation of the Bid Security
carried out based on the original Bid Security document submitted; 3. The
damaged electronic document data (after obtaining clarification from the Electronic
Procurement Service) due to an error in the delivery of documents by the
Service Provider, which resulted in the document being unable to be evaluated

conditions; 4. Before the evaluation of the offer, arithmetic correction is

of the bids for the portion of Lumsum's work; 3) difference in numbers and
letters of the offer price: a) if there is a difference between writing the bid
price value between numbers and letters, the recognized value is the value in
writing letters; b) if the bid in numbers is clearly written while in letters
that are not clear and / or not meaningful and / or wrong, then the recognized
value is the value in numerical writing; or c) if the bid in numbers and letters
is unclear and / or not meaningful and / or wrong, then the offer is declared
null, and b. Work Unit of Price Unit: 1) the volume of work listed in the
Quantity and Price List is adjusted to those listed in the Bidding Document; 2)
if there is an error resulting from the multiplication of the volume with the
price of the work unit, it is corrected, provided that the price of the unit of
work offered cannot be changed; 3) the type of work that is not given a unit
price is considered to be included in the price of another work unit and the

Estimated Price, the tender is declared failed; 8. Based on the results of the
arithmetic correction of the Election Working Group the order of the lowest
bid; 9. if after an arithmetic correction there are less than 3 (three) bidders
bid below the total value of the Self Estimated Price, the tender process will
be continued by evaluating the offer;

indication of conspiracy as the Instruction to Participant number 6; 11. After
checking indications of conspiracy, the Election Working Group will evaluate
the offer which includes: a. administrative evaluation; b. technical
evaluation; and c. price evaluation; 12. General provisions in evaluating are
as follows: a. election Working Groups are prohibited from adding, reducing,
replacing, and / or changing the criteria and requirements set out in this Bidding
Document; b. election Working Groups and / or participants are prohibited from
adding, reducing, changing, and / or changing the contents of the Bid
Documents; c. bid that meets the requirements is an offer that is in accordance
with the technical terms, conditions, and specifications specified in this
Bidding Document, without any important / principal deviations or conditional
offers; d. important / principal deviations or conditional offers are: 1) deviations

number 3), the tender is declared to have failed, and h. if the indication of
conspiracy is fulfilled, then the participant is aborted at the evaluation
stage of administrative, technical, and / or qualification; 13. Administrative Evaluation: a. evaluation
of administrative data is carried out on matters that are not / have not been
assessed at the time of qualification assessment, b. the offer is stated to
have fulfilled administrative requirements, if: 1) the substantial conditions
requested based on the Bidding Document are fulfilled, namely by attaching: a)
Bid Letter; b) Original Offer Guarantee (if required); c) Joint Operation
Agreement (if Operation Cooperation); d) Technical Bidding Documents; e) Price
Bid Documents, 2) Bid Letter fulfills the following conditions: a) dated; b)
the validity period of the Bid Letter is not less than the time as stated in
the Election Data Sheet, provided that: i. if there are differences in writing
between numbers and letters, the period recognized is written letters; ii. if
the written number is clear while the value in letters is not clear /
meaningless / wrong, then the period recognized is written in numbers; or iii.
if what is written in numbers and in letters is not clear / meaningless /
wrong, then the bidder is declared null, typing error in writing the name of
the Working Group and / or package name, then it cannot be declared null and
void; and d) in the event of a date error, if the error does not cause the
validity period of the offer letter to be less than the time stated in the
Election Data Sheet then it cannot be declared null, 3) Original Offer
Guarantee (if required) meets the following conditions : a) in the case of
Construction work with an value of Self Estimated Price above
Rp.10,000,000,000.00 (ten billion rupiahs) up to Rp.100,000,000,000.00 (one
hundred billion rupiahs), issued by: a). 1. Commercial Banks; a) .2. Guarantee
Company; a) .3. Insurance company; a) .4. Special institutions that run
businesses in the fields of financing, guarantees, and insurance to encourage
Indonesian exports in accordance with the provisions of laws and regulations in
the field of Indonesian export financing Institutions; or a) .5. Consortium of
general insurance companies / consortium of guarantee institutions / consortium
of guarantee companies that have suretyship programs, letters a.2 to a.5 has

stated in numbers and letters, with the following provisions: (1) if there is a
writing difference between numbers and letters, the validity period recognized

validity period written in numbers; or (3) if the numbers and letters are not

14. Technical Evaluation: a. technical
evaluation is carried out on participants who meet administrative requirements;
b. technical evaluated elements in accordance with those stipulated as listed in
the Election Data Sheet; c. technical evaluation is carried out with a knockout
system with the following provisions: 1) The Election Working Group assesses
the minimum technical requirements that must be met by comparing the
fulfillment of technical requirements as stated in the Election Data Sheet; 2)
the offer is stated as fulfilling the technical requirements as stated in the
Election Data Sheet if: a) the method of carrying out the work fulfills the
substantive requirements specified in the Bidding Document and is believed to
describe mastery in completing work, including: (1) Stages / sequence of work
from the start to the end in broad outline and description / workings of each
type of main work; (2) conformity between work methods and the main equipment
offered / needed in the execution of work; (3) conformity between work methods
and specifications / volume of work required. Assessment of implementation
methods Assessment of implementation methods does
not evaluate jobmix / details / mix / material composition of the type of work. In evaluating the method of carrying out
work, the Working Group of Election compares the work methods offered by
participants with work methods that are part of the technical requirements set
by The Commitment Making Officials by assessing the suitability of the method.
If it is not appropriate, the Working Group conducts an evaluation based on the
suitability of work methods offered with the main equipment, as well as
personnel based on accountable expertise, b) the period of execution of the
work offered does not exceed the deadline as stated in the Election Data Sheet,
c) the main equipment offered in accordance with those specified in the Bidding
Document, with the following provisions: (1) the meaning of the main equipment
is equipment that supports directly and according to the need to carry out the
major work (major item); (2) type, capacity, and amount provided for the
execution of work; (3) ownership of the main equipment is self-owned, leased
purchase, and / or owned by another party with a conditional Rental agreement
(not a letter of support), (4) specifically for work with value of Self
Estimated Price above Rp. 200,000,000,000 00 (two hundred billion rupiahs),
then the main equipment must be self-owned or in the status of Buy Lease with
the provisions of the equipment already in the mastery of the participant and
there is already proof of the buy lease agreement with the date of the
agreement before the submission of the offer, (5) evaluation of the main equipment sourced from: (a) self-owned,
carried out on proof of ownership of equipment [example, Vehicle Registration
Certificate, Motorized Vehicle Ownership Book, invoice]; (b) Buy Rental, made

Manager, and Expert / Officer of Occupational Safety and Health, (2). for work
intended for: (a) Small Businesses do
not require experts; (b) Medium and Large Businesses do not require Technicians
or Analysts and Operators, (3). for occupations that have a small level of
risk, they can require Officer of Occupational Safety and Health or Experts of Occupational
Safety and Health while work that falls into the large risk category requires
Experts of Occupational Safety and Health, (4 ) The competence of managerial
personnel includes the level of education and experience of working according
to the type of work being tendered, (5). The Work Competency Certificate is not
evaluated at the time of election, evidenced at the provider appointment
preparation meeting, (6). The work experience calculated is experience
according to the type of work tendered (not based on the position offered),
(7). Work experience is calculated per year regardless of the duration of
construction (calculated based on the Budget Year), e) the portion of work to
be subcontracted meets the following conditions: (1). Work packages with a budget ceiling value of more than Rp.
25,000,000,000.00 (twenty five billion rupiahs) up to Rp. 50,000,000,000.00
(fifty billion rupiahs) are required to subcontract a portion of the main work
to specialist service providers (if available specialist service providers),
and a portion of work that is not a main job to a Small Business service sub provider,
and / or (2). Work packages with a budget ceiling value of more than Rp
50,000,000,000 (fifty billion rupiahs) are required to subcontract a portion of
the main work to specialist service providers (if specialist service providers
are available) and part of the work that is not the main job to the Small Business
service sub-provider. The participant in the offer has nominated a sub-provider
of specialist service (if a specialist service provider is available) and a
Small Business service sub-provider from the local provincial work location,
unless there are no service sub-providers available from the local province in
question, by selecting subcontracted work according to the Election Data Sheet;
(3). The Provider does not subcontract
all major works, and (4). The Small Business Provider does not subcontract the
work obtained, f) The Document of Construction Safety Plan meets the
requirements as listed in the Election Data Sheet, which contains: (1). risk
management and action plans (at a minimum according to the identification of
hazards determined by the Commitment Making Officials, include: (a) Explanation
of risk management including identifying hazards, assessing the level of risk,
and controlling the level of risk, specific targets, and Program of Occupational
Safety and Health, (2). signature of the legal representative of the business
entity, g) other Documents required (if any) as listed in the Election Data
Sheet, with the following provisions: (1) evaluation riteria described in
detail and measured; (2) Requirements must consider fair business competition
and the period of fulfillment of requirements, d. The Election Working Group
can carry out field verification and / or clarification, especially to
manufacturers / producers / agents / material distributors / tools to ensure
the consistency of material types / tools and the ability to provide materials
/ equipment according to a predetermined schedule and the correctness of
leasing to work implementation; e. if
there are unclear or dubious matters in the technical evaluation, the Election
Working Group will clarify with the participants. In clarification,
participants may not change the substance of the offer. The results of field
verification and / or clarification can abort the offer, f. Participants who
have passed the technical evaluation are followed by price evaluations, g. if
there is only 1 (one) or 2 (two) participants who pass the technical
evaluation, then the evaluation will continue with price evaluation; h. if of
the 3 (three) lowest bids after arithmetic correction does not meet the
technical requirements, the Election Working Group can conduct bid evaluation
on the next lowest bidder (if any) starting from the administrative evaluation,
i. if no participant has passed the technical evaluation, the tender is
declared to have failed; and J. The Election Working Group includes the results
of technical evaluations in the application of the Electronic Procurement
System, including the reasons for the participants' failure in technical
evaluation; 15. Price Evaluation: a. the elements that need to be evaluated are
the main or important things, provided that: 1) the Total of offer price is
corrected compared to the total value of the Self Estimated Price: a) if the
total of bid price is corrected exceeds the total value of Self Estimated Price,
disqualified; and b) if all the bid prices are corrected above the total value
of the Self Estimated Price, the tender is declared failed, 2) if it does not
submit the cost estimated of carrying out safety and health and Construction
Safety, it is declared null, 3) in terms of parts of work of unit price, offer unit
price of value greater than 110% (one hundred and ten percent) of the unit

evaluate the fairness of the bid price and cannot be used as a basis for measurement
and payment of work, c) researching and assessing the fairness of the base unit
price including the price of wages, materials and equipment from the minimum
unit price of at least each major payment item, d) research and assess the
fairness of the quantity / coefficient of the elements of wages, materials, and
equipment in Unit Price Analysis at least for each main job, e) the results of

the biggest bidder with the Domestic Component Level is the winner, 6) the
giving of the Price Preference does not change the Bid Price and is only used

are potential winners who have the same bid price, the Election Working Group
chooses participants who have greater Basic Capability and this is recorded in
the Minutes of Tender Results, e. if in evaluating found evidence of unreasonable prices due to unfair
business competition and / or joint arrangements (collusion / conspiracy) as
stipulated in regulations and legislation, then the tender is declared failed
and the participants involved are subject to sanctions of the Black List, f. if
in price evaluation there are things that are unclear or doubtful, the Election
Working Group can clarify with the participants. In clarification, participants
