47.    Hak dan Kewajiban Penyedia.

47.    Providers' Rights and Obligations.

Hak-hak yang dimiliki serta kewajiban-kewajiban yang harus dilaksanakan oleh Penyedia dalam melaksanakan Kontrak, meliputi :

Owned rights and obligations that must be carried out by the Provider in implementing the Contract, include:

a.       menerima pembayaran untuk pelaksanaan pekerjaan sesuai dengan harga dan ketentuan yang telah ditetapkan dalam Kontrak;

a.     receive payment for the execution of work in accordance with the price and conditions set out in the Contract;

b.   meminta fasilitas-fasilitas dalam bentuk sarana dan prasarana dari PPK (Pejabat Pembuat Komitmen) untuk kelancaran pelaksanaan pekerjaan sesuai ketentuan Kontrak;

b.   request facilities in the form of facilities and infrastructure from The Commitment Making Officials for the smooth of implementation of work in accordance with the provisions of the Contract;

c.   melaporkan pelaksanaan pekerjaan secara periodik kepada PPK (Pejabat Pembuat Komitmen);

c.   report the implementation of work periodically to The Commitment Making Officer;

d.   melaksanakan, menyelesaikan dan menyerahkan pekerjaan sesuai dengan jadwal pelaksanaan pekerjaan dan ketentuan yang telah ditetapkan dalam Kontrak;

d.  carry out, complete and submit work in accordance with the schedule of implementation of work and the provisions set out in the Contract;

e.   melaksanakan dan menyelesaikan pekerjaan secara cermat, akurat dan penuh tanggung jawab dengan menyediakan tenaga kerja, bahan-bahan, peralatan, angkutan ke atau dari lapangan, dan segala pekerjaan permanen maupun sementara yang diperlukan untuk pelaksanaan, penyelesaian dan perbaikan pekerjaan yang dirinci dalam Kontrak;

e.   carry out and complete work carefully, accurately and responsibly by providing labor, materials, equipment, transportation to or from the field, and all permanent and temporary work needed for the implementation, completion and repair of work specified in the Contract;

f.   memberikan keterangan-keterangan yang diperlukan untuk pemeriksaan pelaksanaan yang dilakukan PPK (Pejabat Pembuat Komitmen);

f.   provide informations needed for inspection of the implementation carried out by The Commitment Making Officer;

g.   mengambil langkah-langkah yang memadai dalam rangka memberi perlindungan kepada setiap orang yang berada di tempat kerja maupun masyarakat dan lingkungan sekitar yang berhubungan dengan pemindahan bahan baku, penggunaan peralatan kerja konstruksi dan proses produksi;

g.   take adequate steps in order to provide protection to everyone who is in the workplace and society and the surrounding environment related to the transfer of raw materials, the use of construction work equipment and the production process;

h.   melaksanakan semua perintah Pengawas Pekerjaan yang sesuai dengan kewenangan Pengawas Pekerjaan dalam Kontrak ini;

h.   carry out all Work Inspector's orders that are in accordance with the authority of the Work Supervisor in this Contract;

i.   hak dan kewajiban lain yang timbul akibat lingkup pekerjaan ditentukan di SSKK (Syarat – Syarat Khusus Kontrak).

i.    Other rights and obligations arising from the scope of work are determined in the CST (Contract Specific Terms).

48.   Penggunaan Dokumen.

48.   Use of Documents.

Dokumen Kontrak dan Informasi Penyedia tidak diperkenankan menggunakan dan menginformasikan dokumen Kontrak atau dokumen lainnya yang berhubungan dengan Kontrak untuk kepentingan pihak lain, misalnya spesifikasi teknis dan/atau gambar-gambar, serta informasi lain yang berkaitan dengan Kontrak, kecuali dengan izin tertulis dari PPK (Pejabat Pembuat Komitmen)  sesuai ketentuan peraturan perundang-undangan.

Contract Documents and Provider Information are not permitted to use and inform Contract documents or other documents relating to Contracts for the benefit of other parties, for example technical specifications and / or drawings, as well as other information relating to Contracts, except with written permission from The Official of Commitment Maker in accordance with the provisions of the legislation.

49.   Hak Kekayaan Intelektual.

49.   Intellectual Property Rights.

Penyedia wajib melindungi PPK (Pejabat Pembuat Komitmen)  dari segala tuntutan atau klaim dari pihak ketiga yang disebabkan penggunaan atau atas pelanggaran Hak Kekayaan Intelektual oleh Penyedia. Providers must protect The Commitment Making Officials from all claims from third parties caused by the use or violation of Intellectual Property Rights by the Provider.

50. Penanggungan Risiko.

50. Risk Management.

50.1.   Penyedia berkewajiban untuk melindungi, membebaskan, dan menanggung tanpa batas PPK (Pejabat Pembuat Komitmen) beserta instansinya terhadap semua bentuk tuntutan, tanggung jawab, kewajiban, kehilangan, kerugian, denda, gugatan atau tuntutan hukum, proses pemeriksaan hukum, dan biaya yang dikenakan terhadap PPK (Pejabat Pembuat Komitmen) beserta instansinya [kecuali kerugian yang mendasari tuntutan tersebut disebabkan kesalahan atau kelalaian berat PPK (Pejabat Pembuat Komitmen)] sehubungan dengan klaim yang timbul dari hal-hal berikut terhitung sejak Tanggal Mulai Kerja sampai dengan Tanggal Penyerahan Akhir Pekerjaan :

50.1.   The Provider is obliged to protect, release, and bear without limitation the Commitment Making Officer and its institutions on all forms of claims, responsibilities, obligations, losses, disadvantage, fines, lawsuits, legal proceedings, and fees imposed on the Commitment Making Officer along with its institutions [except the loss that underlies the claim due to the gross error or negligence of the Commitment Making Officer] in connection with claims arising from the following matters from the Work Commencement Date to the Final Job Delivery Date:

a.   kehilangan atau kerusakan peralatan dan harta benda Penyedia, Subpenyedia (jika ada), dan tenaga kerja konstruksi;

b.   cidera tubuh, sakit atau kematian tenaga kerja konstruksi;

c.   kehilangan atau kerusakan harta benda, dan cidera tubuh, sakit atau kematian pihak ketiga.

a.   loss or damage to equipment and property of Providers, Sub-providers (if any), and construction workers;

b.   bodily injury, illness or death of a construction workforce;

c.   loss or damage to property, bodily injury, illness or death of a third party.

50.2.   Terhitung sejak Tanggal Mulai Kerja sampai dengan Tanggal Penyerahan Akhir Pekerjaan, semua risiko kehilangan atau kerusakan hasil pekerjaan ini, bahan dan perlengkapan merupakan risiko Penyedia, kecuali kerugian atau kerusakan tersebut diakibatkan oleh kesalahan atau kelalaian PPK (Pejabat Pembuat Komitmen).

50.2.   As from the Commencement Date to the End of Work Submission Date, all risks of loss or damage to the results of this work, materials and equipment constitute the risk of the Provider, unless the loss or damage is caused by an error or negligence of the Commitment Making Officer.

50.3.   Pertanggungan asuransi yang dimiliki oleh Penyedia tidak membatasi kewajiban penanggungan dalam pasal ini.

50.3. Insurance coverage held by the Provider does not limit liability under this article.

50.4.   Kehilangan atau kerusakan terhadap hasil pekerjaan atau bahan yang menyatu dengan hasil pekerjaan sejak Tanggal Mulai Kerja sampai dengan Tanggal Penyerahan Akhir Pekerjaan harus diganti atau diperbaiki oleh Penyedia atas tanggungannya sendiri jika kehilangan atau kerusakan tersebut terjadi akibat tindakan atau kelalaian Penyedia.

50.4.   Loss or damage to work products or materials that are integrated with the work results from the Work Commencement Date until the Final Job Submission Date must be replaced or repaired by the Provider at his own expense if the loss or damage occurs due to the Provider's actions or omissions.

51. Perlindungan Tenaga Kerja.

51. Labor Protection.

51.1.   Penyedia dan Subpenyedia berkewajiban atas biaya sendiri untuk mengikutsertakan Tenaga Kerja Konstruksinya pada program Badan Penyelenggara Jaminan Sosial (BPJS) Ketenagakerjaan sebagaimana diatur dalam peraturan perundang-undangan.

51.1.   The Provider and Sub-Provider are obliged at their own expense to include their Construction Workers in the program of the Social Security Organizing Agency of Employment as stipulated in the legislation.

51.2.   Penyedia berkewajiban untuk mematuhi dan memerintahkan Tenaga Kerja Konstruksinya untuk mematuhi peraturan keselamatan kerja. Pada waktu pelaksanaan pekerjaan, Penyedia beserta Tenaga Kerja Konstruksinya dianggap telah membaca dan memahami peraturan keselamatan kerja tersebut.

51.2.   The Provider is obliged to comply with and instruct the Construction Workforce to comply with workplace safety regulations. At the time of execution of the work, the Provider and his Construction Workers are considered to have read and understood the work safety regulations.

51.3.   Penyedia berkewajiban untuk menyediakan kepada setiap Tenaga Kerja Konstruksinya (termasuk Tenaga Kerja Konstruksi Subpenyedia, jika ada) perlengkapan keselamatan kerja yang sesuai dan memadai.

51.3.   The Provider is obliged to provide to each of his Construction Workers (including the Sub-Provider Construction Workers, if any) appropriate and adequate safety equipment.

51.4.   Tanpa mengurangi kewajiban Penyedia untuk melaporkan kecelakaan berdasarkan hukum yang berlaku, Penyedia wajib melaporkan kepada PPK (Pejabat Pembuat Komitmen) mengenai setiap kecelakaan yang timbul sehubungan dengan pelaksanaan Kontrak ini dalam waktu 24 (dua puluh empat) jam setelah kejadian.

51.4.   Without reducing the obligation of the Provider to report an accident based on applicable law, the Provider must report to the Commitment Maker Officer regarding any accidents arising in connection with the implementation of this Contract within 24 (twenty four) hours after the incident.

52. Pemeliharaan Lingkungan.

52. Environmental Maintenance.

Penyedia berkewajiban untuk mengambil langkah - langkah yang memadai untuk melindungi lingkungan baik di dalam maupun di luar tempat kerja dan membatasi gangguan lingkungan terhadap pihak ketiga dan harta bendanya sehubungan dengan pelaksanaan Kontrak ini, sesuai dengan ketentuan peraturan perundang-undangan yang mengatur mengenai pengelolaan lingkungan hidup.

The Provider is obliged to take adequate steps to protect the environment both inside and outside the workplace and limit environmental disturbances to third parties and their assets in connection with the implementation of this Contract, in accordance with the provisions of laws and regulations governing environmental management.

53. Asuransi.

53. Insurance.

53.1.   Penyedia wajib menyediakan asuransi sejak SPMK (Surat Perintah Mulai Kerja) sampai dengan Tanggal Penyerahan Akhir Pekerjaan untuk barang yang mempunyai risiko tinggi terjadinya kecelakaan dalam pelaksanaan pekerjaan atas segala risiko terhadap kecelakaan, kerusakan akibat kecelakaan, kehilangan, serta risiko lain yang tidak dapat diduga.

53.1.   Providers must provide insurance since the Order Commencing to Work until the Final Job Delivery Date for goods that have a high risk of accidents in carrying out work for all risks of accidents, accidental damage, loss, and other risks that cannot be predicted.

53.2.   Penyedia wajib menyediakan asuransi bagi pihak ketiga sebagai akibat kecelakaan di lokasi kerja.

53.2.   Providers must provide insurance for third parties as a result of accidents at work sites.

53.3.   Besarnya asuransi sudah diperhitungkan dalam penawaran dan termasuk dalam Harga Kontrak.

54.   Tindakan Penyedia yang Mensyaratkan Persetujuan PPK (Pejabat Pembuat Komitmen) atau Pengawas Pekerjaan.

54.   Actions of Providers Requiring Approval of The Commitment Making Officials or Occupational Supervisors.

54.1.   Penyedia berkewajiban untuk mendapatkan lebih dahulu persetujuan tertulis PPK (Pejabat Pembuat Komitmen) sebelum melakukan tindakan-tindakan berikut:

54.1.   The Provider is obliged to obtain prior written approval of the Commitment Making Officer before carrying out the following actions:

a.  mensubkontrakkan sebagian pekerjaan dalam Lampiran A SSKK (Syarat – Syarat Khusus Kontrak);

b.  menunjuk Personel Manajerial yang namanya tidak tercantum dalam Lampiran A SSKK (Syarat – Syarat Khusus Kontrak);

c.  mengubah atau memutakhirkan Rencana Mutu Pekerjaan Konstruksi (RMPK) dan RKK (Rencana Keselamatan Konstruksi);

d.  tindakan lain yang diatur dalam SSKK (Syarat – Syarat Khusus Kontrak).

a.  subcontract a portion of work in Annex A of Contract Specific Terms;

b.  appoint Managerial Personnel whose names are not listed in Annex A of Contract Specific Terms;

c.  amend or update the Construction Work Quality Plan and Construction Safety Plan;

d.  other actions stipulated in the Special Conditions for Contracts.

54.2.   Penyedia berkewajiban untuk mendapatkan lebih dahulu persetujuan tertulis Pengawas Pekerjaan sebelum melakukan tindakantindakan berikut:

54.2.   The Provider is obliged to obtain prior written approval from the Work Supervisor before carrying out the following actions:

a.   melaksanakan setiap tahapan pekerjaan berdasarkan rencana kerja dan metode kerja;

b.   mengubah syarat dan ketentuan polis asuransi;

c.   mengubah Personel Manajerial dan/atau Peralatan Utama;

d.   tindakan lain yang diatur dalam SSKK (Syarat – Syarat Khusus Kontrak).

a.   carry out each stage of work based on work plans and work methods;

b.   change terms and conditions of insurance policy;

c.   change Managerial Personnel and / or Main Equipment;

d.   other actions stipulated in the Special Conditions for Contracts.

55.    Laporan Hasil Pekerjaan.

55.    Job Result Reports.

55.1. Pemeriksaan pekerjaan dilakukan selama pelaksanaan kontrak untuk menetapkan volume pekerjaan atau kegiatan yang telah dilaksanakan guna pembayaran hasil pekerjaan. Hasil pemeriksaan pekerjaan dituangkan dalam laporan kemajuan hasil pekerjaan.

55.1. Examination of work is carried out during the implementation of the contract to determine the volume of work or activities that have been carried out for payment of work result. The results of the examination of work outlined in the progress report of works result.

55.2. Untuk kepentingan pengendalian dan pengawasan pelaksanaan pekerjaan, seluruh aktivitas kegiatan pekerjaan dilokasi pekerjaan dicatat dalam buku harian sebagai bahan laporan harian pekerjaan yang berisi rencana dan realisasi pekerjaan harian.

d.   jenis dan kuantitas pekerjaan yang dilaksanakan;

e.   keadaan cuaca termasuk hujan, banjir dan peristiwa alam lainnya yang berpengaruh terhadap kelancaran pekerjaan; dan

f.   catatan-catatan lain yang berkenaan dengan pelaksanaan pekerjaan.

c.   type, quantity and condition of equipment;

d.   the type and quantity of work carried out;

e.   weather conditions including rain, floods and other natural events that affect the smooth running of work; and

f.   other records relating to the execution of work.

55.4. Laporan mingguan terdiri dari rangkuman laporan harian dan berisi hasil kemajuan fisik pekerjaan dalam periode satu minggu, serta hal-hal penting yang perlu ditonjolkan.

55.4. The weekly report consists of a summary of the daily report and contains the results of the physical progress of the work in a one-week period, as well as important things that need to be highlighted.

55.5. Laporan bulanan terdiri dari rangkuman laporan mingguan dan berisi hasil kemajuan fisik pekerjaan dalam periode satu bulan, serta hal-hal penting yang perlu ditonjolkan.

55.5. The monthly report consists of a summary of the weekly report and contains the results of the physical progress of the work within a period of one month, as well as important things that need to be highlighted.

55.6. Untuk merekam kegiatan pelaksanaan pekerjaan konstruksi, PPK (Pejabat Pembuat Komitmen) dan Penyedia membuat foto-foto dokumentasi dan video pelaksanaan pekerjaan di lokasi pekerjaan sesuai kebutuhan.

55.6. To record the activities of carrying out construction work, The Commitment Making Officials and Providers make documentation photographs and  videoof the implementation of work at the work location as needed.

55.7. Laporan hasil pekerjaan dibuat oleh Penyedia, diperiksa oleh Pengawas Pekerjaan, dan disetujui oleh PPK (Pejabat Pembuat Komitmen) / pihak PPK (Pejabat Pembuat Komitmen).

55.7. Reports on the results of work are made by the Provider, inspected by the Work Supervisor, and approved by the Commitment Making Officer / the party of The Commitment Making Officer.

56.    Kepemilikan Dokumen.

56.    Document Ownership.

Semua rancangan, gambar, spesifikasi, desain, laporan, dan dokumen-dokumen lain serta piranti lunak yang dipersiapkan oleh Penyedia berdasarkan Kontrak ini sepenuhnya merupakan hak milik PPK (Pejabat Pembuat Komitmen). Penyedia paling lambat pada waktu pemutusan atau penghentian atau akhir Masa Kontrak berkewajiban untuk menyerahkan semua dokumen dan piranti lunak tersebut beserta daftar rinciannya kepada PPK (Pejabat Pembuat Komitmen). Penyedia dapat menyimpan 1 (satu) buah salinan tiap dokumen dan piranti lunak tersebut. Pembatasan (jika ada) mengenai penggunaan dokumen dan piranti lunak tersebut di atas di kemudian hari diatur dalam SSKK (Syarat – Syarat Khusus Kontrak).

All plan, drawings, specifications, designs, reports, and other documents and software prepared by the Provider under this Contract are entirely the property of The Commitment Making Official. Provider no later than at the time of termination or discontinuation or the end of the Contract Period is obliged to submit all documents and software along with the detailed list to The Commitment Making Officer. The Provider can store 1 (one) copy of each document and software. Restrictions (if any) regarding the use of the documents and software mentioned above are set forth in the CST (Contract Specific Terms).

57. Kerjasama Antara Penyedia dan Subpenyedia.

57. Cooperation between the Provider and the Sub-Provider.

57.1.    Penyedia hanya boleh melakukan subkontrak sebagian pekerjaan utama kepada Penyedia Spesialis dan/atau pekerjaan bukan pekerjaan utama kepada Penyedia Usaha Kecil.

57.1.   The Provider may only subcontract part of the main work to the Specialist Provider and / or work not the main job to the Small Business Provider.

57.2.   Penyedia tetap bertanggung jawab atas bagian pekerjaan yang disubkontrakkan tersebut.

57.2.   The Provider is still responsible for the subcontracted part of the work.

57.3.   Subpenyedia dilarang mengalihkan atau mensubkontrakkan pekerjaan.

57.3.   Sub-providers are prohibited from transferring or subcontracting work.

57.4.   Apabila Penyedia yang ditunjuk merupakan Penyedia Usaha Kecil, maka pekerjaan tersebut harus dilaksanakan sendiri oleh Penyedia yang ditunjuk dan dilarang dialihkan atau disubkontrakkan kepada pihak lain.

57.4.    If the designated Provider is a Small Business Provider, then the work must be carried out by the designated Provider himself and prohibited from being transferred or subcontracted to other parties.

57.5.   Penyedia Usaha Non Kecil yang melakukan kerjasama dengan Subpenyedia hanya boleh melaksanakan sesuai dengan daftar bagian pekerjaan yang disubkontrakkan (apabila ada) yang dituangkan dalam Lampiran A SSKK (Syarat – Syarat Khusus Kontrak).

57.5.   Non-Small Business Providers that collaborate with Sub-Providers may only carry out in accordance with the list of subcontracted parts of the work (if any) as outlined in Appendix A of Contract Specific Terms.

57.6.   Lampiran A SSKK (Daftar Pekerjaan yang Disubkontrakkan dan Subpenyedia) tidak boleh diubah kecuali atas persetujuan tertulis dari PPK (Pejabat Pembuat Komitmen) dan dituangkan dalam adendum Kontrak.

57.6.   Appendix A of List of Job of Sub-contracted and Sub-Providers may not be changed except with written approval from The Commitment Making Officer and set forth in the Contract addendum.

57.7.   Pelaksanaan Kerjasama Antara Penyedia dan Subpenyedia diawasi oleh Pengawas Pekerjaan dan Penyedia melaporkan secara periodik kepada PPK (Pejabat Pembuat Komitmen).

57.7.   The Cooperation between the Provider and the Sub-Provider is supervised by the Work Supervisor and the Provider reports periodically to the Commitment Making Officer.

57.8.   Apabila Penyedia melanggar ketentuan sebagaimana diatur pada pasal 57.4 atau 57.5 maka akan dikenakan denda senilai pekerjaan yang disubkontrakkan tersebut.

57.8.   If the Provider violates the provisions as stipulated in article 57.4 or 57.5, it will be fined in the amount of the subcontracted work.

58. Penyedia Lain.

58. Other Providers.

Penyedia berkewajiban untuk bekerja sama dan menggunakan lokasi kerja termasuk jalan akses bersama-sama dengan Penyedia Lain (jika ada) dan pihak-pihak lainnya yang berkepentingan atas lokasi kerja. Jika dipandang perlu, PPK (Pejabat Pembuat Komitmen) dapat memberikan jadwal kerja Penyedia Lain di lokasi kerja.

The Provider is obliged to work together and use the work location including access roads together with Other Providers (if any) and other parties interested in the work location. If deemed necessary, The Commitment Making Officer can provide another Provider's work schedule at the work location.

59. Alih Pengalaman/Keahlian.

59. Experience / Expertise Transfer.

Dalam hal pelaksanaan paket pekerjaan konstruksi dengan nilai pagu anggaran di atas Rp50.000.000.000,00 (lima puluh miliar rupiah), Penyedia diwajibkan memberikan alih pengalaman/keahlian bidang konstruksi melalui sistem kerja praktik/magang sesuai dengan jumlah yang disepakati pada saat Rapat Persiapan Penunjukan Penyedia.

In the case of implementing a construction work package with a budget ceiling value of more than Rp50,000,000,000 (fifty billions rupiah), the Provider is required to provide construction experience / expertise transfer through a practical work system / internship in accordance with the agreed amount at the Preparation Meeting of Appointment of Providers.

60. Pembayaran Denda.

60. Payment of Fines.

Penyedia berkewajiban untuk membayar sanksi finansial berupa denda sebagai akibat wanprestasi atau cidera janji terhadap kewajiban-kewajiban Penyedia dalam Kontrak ini. PPK (Pejabat Pembuat Komitmen) mengenakan denda dengan memotong angsuran pembayaran prestasi pekerjaan Penyedia. Pembayaran denda tidak mengurangi tanggung jawab kontraktual Penyedia.

The Provider is obliged to pay financial sanctions in the form of fines as a result of default or breach of contract for the obligations of the Provider in this Contract. The Commitment Making Officer imposes a fine by deducting the installment payment of the Provider's work performance. Payment of fines does not reduce the contractual responsibility of the Provider.

61. Jaminan.

61. Guarantee.

61.1.   Jaminan yang digunakan dalam pelaksanaan Kontrak ini dapat berupa bank garansi atau
surety bond. Jaminan bersifat tidak bersyarat, mudah dicairkan, dan harus dicairkan oleh penerbit jaminan paling lambat 14 (empat belas) hari kerja setelah surat perintah pencairan dari PPK (Pejabat Pembuat Komitmen) atau pihak yang diberi kuasa oleh PPK (Pejabat Pembuat Komitmen) diterima.

61.1.   Collateral used in the implementation of this Contract can be a bank of guarantee or surety bond. Guarantees are unconditional, easily liquidated, and must be disbursed by the guarantee issuer no later than 14 (fourteen) working days after the disbursement order from The Commitment Making Officer or the party authorized by The Commitment Making Officer is received.

61.2.   Penerbit jaminan selain Bank Umum harus telah ditetapkan/mendapat rekomendasi dari Otoritas Jasa Keuangan (OJK).

61.2.   Guarantee issuers other than Commercial Banks must have been determined / received a recommendation from the Financial Services Authority.

61.3.   Penggunaan Jaminan Pelaksanaan, Jaminan Uang Muka dan Jaminan Pemeliharaan sebagai berikut:

5) Konsorsium Perusahaan Asuransi Umum / Konsorsium Lembaga Penjaminan / Konsorsium Perusahaan Penjaminan yang mempunyai program asuransi kerugian (suretyship).

a.   Work packages up to Rp 10,000,000,000.00 (ten billion rupiahs) can be issued by:

1) Commercial Banks;

2) Insurance Companies;

3) Guarantee Company;

4) special financial institutions that run businesses in the fields of financing, guarantees and insurance to encourage Indonesian exports in accordance with the provisions of legislation in the field of Indonesian export financing institutions; or

61.4.   Jaminan Pelaksanaan diberikan kepada PPK (Pejabat Pembuat Komitmen) setelah diterbitkannya Surat Penunjukan Penyedia Barang/Jasa (SPPBJ) sebelum dilakukan Penandatanganan Kontrak dengan besar:

a.   5% (lima perseratus) dari Harga Kontrak; atau

b.   5% (lima perseratus) dari nilai total HPS (Harga Perkiraan Sendiri) untuk harga penawaran atau penawaran terkoreksi di bawah 80% (delapan puluh perseratus) nilai total HPS (Harga Perkiraan Sendiri).

61.4.   The Implementation Guarantee is given to The Commitment Making Officer after the issuance of a Letter of Appointment of Goods / Services Provider prior to the Signing of the Contract with a large amount:

a. 5% (five percent) of the Contract Price; or

b. 5% (five percent) of the total value of the Self Estimated Price for the bid price or offer price corrected below 80% (eighty percent) of the total value of the Self Estimated Price.

61.5.   Masa berlakunya Jaminan Pelaksanaan paling kurang sejak tanggal penandatanganan Kontrak sampai dengan Tanggal Penyerahan Pertama Pekerjaan (Provisional Hand Over / PHO).

61.5.   The validity period of the Implementation Guaranteed shall be at least from the date of signing the Contract until the Provisional Hand Over / PHO.

61.6.   Jaminan Pelaksanaan dikembalikan setelah pekerjaan dinyatakan selesai 100% (seratus perseratus) dan diganti dengan Jaminan Pemeliharaan atau menahan uang retensi sebesar 5% (lima perseratus) dari Harga Kontrak;

61.6.   The Implementation Guarantee is returned after the work is declared completed 100% (one hundred percent) and replaced with a Maintenance Guarantee or withholding retention of 5% (five percent) of the Contract Price;

61.7.   Jaminan Uang Muka diberikan kepada PPK (Pejabat Pembuat Komitmen) dalam rangka pengambilan uang muka yang besarannya paling kurang sama dengan besarnya uang muka yang diterima Penyedia.

61.7.   The Advance Payment Guarantee is given to the Commitment Making Officer in the context of taking down advances payment, the amount of which is at least equal to the amount of advances payment received by the Provider.

61.8.   Nilai Jaminan Uang Muka dapat dikurangi secara proporsional sesuai dengan sisa uang muka yang diterima.

61.8.  The Advance Payment Guarantee Value can be reduced proportionally according to the remaining down payment received.

61.9.   Masa berlakunya Jaminan Uang Muka paling kurang sejak tanggal persetujuan pemberian uang muka sampai dengan Tanggal Penyerahan Pertama Pekerjaan (PHO, Provisional Hand Over).

61.9.   The validity period of the Advance Payment Guarantee at least from the date of approval of the advance payment up to the First Submission Date of Work (PHO, Provisional Hand Over).

61.10. Jaminan Pemeliharaan diberikan kepada PPK (Pejabat Pembuat Komitmen) setelah pekerjaan dinyatakan selesai 100% (seratus perseratus).

61.10. The Maintenance Guarantee is given to The Commitment Making Official after the work is declared completed 100% (one hundred percent).

61.11. Pengembalian Jaminan Pemeliharaan dilakukan paling lambat 14 (empat belas) hari kerja setelah Masa Pemeliharaan selesai dan pekerjaan diterima dengan baik sesuai dengan ketentuan Kontrak.

61.11. The return of the Maintenance Guarantee is carried out no later than 14 (fourteen) working days after the Maintenance Period is completed and the work is well received in accordance with the provisions of the Contract.

61.12. Masa berlaku Jaminan Pemeliharaan paling kurang sejak Tanggal Penyerahan Pertama Pekerjaan sampai dengan Tanggal Penyerahan Akhir Pekerjaan (Final Hand Over/FHO).

61.12. The validity period of the Maintenance Guarantee is at least from the First Submission Date of Work to the Final Hand Over / FHO.

Hak-hak yang dimiliki serta kewajiban-kewajiban yang harus dilaksanakan oleh PPK (Pejabat Pembuat Komitmen) dalam melaksanakan Kontrak, meliputi :

a.   mengawasi dan memeriksa pekerjaan yang dilaksanakan oleh Penyedia;

b.   menerima laporan-laporan secara periodik mengenai pelaksanaan pekerjaan yang dilaksanakan oleh Penyedia;

c.   menerima hasil pekerjaan sesuai dengan jadwal penyerahan pekerjaan dan ketentuan yang telah ditetapkan dalam Kontrak.

d.  membayar pekerjaan sesuai dengan harga yang tercantum dalam Kontrak yang telah ditetapkan kepada Penyedia;

e.  memberikan fasilitas berupa sarana dan prasarana yang dibutuhkan oleh Penyedia untuk kelancaran pelaksanaan pekerjaan sesuai ketentuan Kontrak; dan

f.   menilai kinerja Penyedia.

The rights owned and the obligations that must be carried out by the Commitment Making Officer in implementing the Contract, include:

a.   supervise and check the work carried out by the Provider;

b.   receive periodic reports regarding the implementation of work carried out by the Provider;

c.   receive work results in accordance with the schedule of submission of work and the conditions set out in the Contract.

d.   pay for work in accordance with the price stated in the Contract that has been determined to the Provider;

e.   provide facilities in the form of facilities and infrastructure needed by the Provider for the smooth of implementation of work in accordance with the provisions of the Contract; and

f.   assess the performance of the Provider.

63. Fasilitas.

63. Facilities.

PPK (Pejabat Pembuat Komitmen) dapat memberikan fasilitas berupa sarana dan prasarana atau kemudahan lainnya (jika ada) yang tercantum dalam SSKK (Syarat – Syarat Khusus Kontrak) untuk kelancaran pelaksanaan pekerjaan ini.

The Commitment Making Officer can provide facilities in the form of facilities and other facilities or facilities (if any) listed in the Special Conditions of Contract for the smooth of implementation of this work.

64. Peristiwa Kompensasi.

64. Compensation events.

64.1. Peristiwa Kompensasi dapat diberikan kepada Penyedia yaitu:

a.   PPK (Pejabat Pembuat Komitmen) mengubah jadwal pekerjaan yang dapat mempengaruhi pelaksanaan pekerjaan;

b.   keterlambatan pembayaran kepada Penyedia;

c.   PPK (Pejabat Pembuat Komitmen) tidak memberikan gambar-gambar, spesifikasi dan/atau instruksi sesuai jadwal yang dibutuhkan;

d.   Penyedia belum bisa masuk ke lokasi sesuai jadwal dalam kontrak;

e.   PPK (Pejabat Pembuat Komitmen) menginstruksikan kepada pihak Penyedia untuk melakukan pengujian tambahan yang setelah dilaksanakan pengujian ternyata tidak ditemukan kerusakan/kegagalan/penyimpangan;

f.    PPK (Pejabat Pembuat Komitmen) memerintahkan penundaan pelaksanaan pekerjaan;

g.   PPK (Pejabat Pembuat Komitmen) memerintahkan untuk mengatasi kondisi tertentu yang tidak dapat diduga sebelumnya dan disebabkan/tidak disebabkan oleh PPK (Pejabat Pembuat Komitmen); atau

h.   ketentuan lain dalam SSKK (Syarat – Syarat Khusus Kontrak).

64.1. Compensation events can be given to Providers, namely:

a.   The Commitment Making Officer changes work schedules that can affect the execution of work;

b.   late payment to Provider;

c.    The Commitment Making Officer does not provide pictures, specifications and / or instructions as required;

d.   Providers cannot enter the location according to the schedule in the contract;

e.   The Commitment Making Official instructs the Provider to carry out additional testing which after the testing is carried out, there is no damage / failure / irregularity found;

f.    The Commitment Making Officer orders a delay in the execution of work;

g.    The Commitment Making Official orders to overcome certain conditions that cannot be predicted beforehand and is caused / not caused by The Commitment Making Officer; or

h.   other provisions in the CST (Contract Specific Terms).

64.2. Jika Peristiwa Kompensasi mengakibatkan pengeluaran tambahan dan/atau keterlambatan penyelesaian pekerjaan maka PPK (Pejabat Pembuat Komitmen) berkewajiban untuk membayar ganti rugi dan/atau memberikan perpanjangan Masa Pelaksanaan.

64.2. If the Compensation Event results in additional expenditure and / or late completion of work, the Commitment Making Officer is obliged to pay compensation and / or provide an extension of the Period of Implementation.

64.3. Ganti rugi akibat Peristiwa Kompensasi hanya dapat dibayarkan jika berdasarkan data penunjang dan perhitungan kompensasi yang diajukan oleh Penyedia kepada PPK (Pejabat Pembuat Komitmen), dapat dibuktikan kerugian nyata.

64.5. Penyedia tidak berhak atas ganti rugi dan/atau perpanjangan Masa Pelaksanaan jika Penyedia gagal atau lalai untuk memberikan peringatan dini dalam mengantisipasi atau mengatasi dampak Peristiwa Kompensasi.

65.1.   Setiap Tenaga Kerja Konstruksi yang bekerja pada pekerjaan ini wajib memiliki sertifikat kompetensi kerja.

65.1.   Every Construction Worker who works for this job must have a work competency certificate.

65.2.   Tenaga Kerja Konstruksi selain Personel Manajerial yang bekerja/akan bekerja pada pekerjaan ini dan belum memiliki sertifikat kompetensi kerja, maka Penyedia wajib memastikan dipenuhinya persyaratan sertifikat kompetensi kerja sepanjang Masa Pelaksanaan.

65.2.   Construction Workers other than Managerial Personnel who work / will work in this job and do not have a work competency certificate, the Provider must ensure that the work competency certificate is fulfilled throughout the Implementation Period.

66. Personel Manajerial dan/atau Peralatan Utama.

66.1.   Personel Manajerial yang ditempatkan dan diperkerjakan harus sesuai dengan yang tercantum dalam Lampiran A SSKK (Syarat – Syarat Khusus Kontrak).

66.1.   Managerial personnel placed and employed must comply with those listed in Appendix A of the CSC (Contract Specific Conditions).

66.2.   Peralatan Utama yang ditempatkan dan digunakan untuk pelaksanaan pekerjaan adalah peralatan yang laik dan harus sesuai dengan yang tercantum dalam Lampiran A SSKK (Syarat – Syarat Khusus Kontrak).

66.2.   The Main Equipment placed and used for the execution of work is equipment that is feasible and must be in accordance with those listed in Appendix A of The Contract Specific Conditions.

66.3.   Penggantian Personel Manajerial dan/atau Peralatan Utama tidak boleh dilakukan kecuali atas persetujuan tertulis dari PPK (Pejabat Pembuat Komitmen) dan dituangkan dalam adendum Kontrak.

66.3.   Replacement of Managerial Personnel and / or Main Equipment may not be carried out except with written approval from The Commitment Making Officer and set forth in the Contract addendum.

66.4.   Jika penggantian Personel Manajerial dan/atau Peralatan Utama perlu dilakukan, maka Penyedia berkewajiban untuk menyediakan pengganti dengan kualifikasi yang setara atau lebih baik dari tenaga kerja konstruksi dan/atau peralatan yang digantikan tanpa biaya tambahan apapun.

66.4.   If the replacement of Managerial Personnel and / or Main Equipment needs to be done, then the Provider is obliged to provide substitutes with qualifications that are equal or better than the construction workforce and / or equipment that is replaced without any additional costs.

66.5.   PPK (Pejabat Pembuat Komitmen) dapat menyetujui penempatan/penggantian Personel Manajerial dan/atau Peralatan Utama menurut kualifikasi yang dibutuhkan setelah mendapat rekomendasi dari Pengawas Pekerjaan.

66.5.   The Commitment Making Officer can approve the placement / replacement of Managerial Personnel and / or Main Equipment according to the qualifications required after obtaining a recommendation from the Work Supervisor.

66.6.   Jika PPK (Pejabat Pembuat Komitmen) menilai bahwa Personel Manajerial :

1)   tidak mampu atau tidak dapat melakukan pekerjaan dengan baik;

2)   berkelakuan tidak baik; dan/atau

3)   mengabaikan pekerjaan yang menjadi tugasnya; maka Penyedia berkewajiban untuk menyediakan pengganti dan menjamin Personel Manajerial tersebut meninggalkan lokasi kerja dalam waktu 7 (tujuh) hari kalender sejak diminta oleh PPK (Pejabat Pembuat Komitmen).

66.6.   If the Commitment Making Officer assesses that Managerial Personnel:

1) unable to do a good job;

2) bad behavior; and / or

3) ignore the work that is his duty; then the Provider is obliged to provide a replacement and ensure that the Managerial Personnel leave the work location within 7 (seven) calendar days from the time requested by the Commitment Making Officer.

66.7.   Personel Manajerial berkewajiban untuk menjaga kerahasiaan pekerjaannya. Jika diperlukan oleh PPK (Pejabat Pembuat Komitmen), Personel Manajerial dapat sewaktu-waktu disyaratkan untuk menjaga kerahasiaan pekerjaan di bawah sumpah.

66.7.   Managerial personnel are obliged to maintain the confidentiality of their work. If required by the Commitment Making Officer, Managerial Personnel may be required at any time to maintain the confidentiality of work under oath.

66.8.   Apabila ada penambahan Personel Manajerial dan/atau Peralatan Utama maka penambahan tersebut harus mendapat persetujuan terlebih dahulu dari PPK (Pejabat Pembuat Komitmen) dan dituangkan dalam Lampiran A SSKK (Syarat – Syarat Khusus Kontrak).

66.8.   If there are additional of Managerial Personnel and / or Main Equipment, the addition must be approved in advance by the Commitment Making Officer and set forth in Appendix A of The Contract Specific Terms.

67. Harga Kontrak.

67. Contract Prices.

67.1.    SSKK (Syarat – Syarat Khusus Kontrak) membayar kepada Penyedia atas pelaksanaan pekerjaan dalam Kontrak sebesar Harga Kontrak.

67.1.   The Contract Specific Terms pays the Provider for the execution of the work in the Contract in the amount of the Contract Price.

67.2.    Harga Kontrak telah memperhitungkan meliputi :

a.   beban pajak;

b.   keuntungan dan biaya overhead (biaya umum);

c.   biaya pelaksanaan pekerjaan; dan

d.   biaya penyelenggaraan keamanan dan kesehatan kerja serta keselamatan konstruksi.

67.2.   The contract price has taken into account include:

a. tax burden;

b. profits and overhead costs (general costs);

c. the cost of carrying out work; and

d. the cost of implementing work security and health and construction safety.

68. Pembayaran.

68.1.   Uang Muka.

68.1.   Down payment.

a.   Uang muka dibayar untuk membiayai mobilisasi peralatan/tenaga kerja konstruksi, pembayaran uang tanda jadi kepada pemasok bahan/material dan/atau untuk persiapan teknis lain.

b.   Untuk usaha kecil, uang muka dapat diberikan paling tinggi 30% (tiga puluh perseratus) dari Harga Kontrak.

c.   Untuk usaha non kecil, uang muka dapat diberikan paling tinggi 20% (dua puluh perseratus) dari Harga Kontrak.

d.   Untuk Kontrak Tahun Jamak, uang muka dapat diberikan paling tinggi 15% (lima belas perseratus) dari Harga Kontrak.

e.   Besaran uang muka ditentukan dalam SSKK (Syarat – Syarat Khusus Kontrak) dan dibayar setelah Penyedia menyerahkan Jaminan Uang Muka paling sedikit sebesar uang muka yang diterima.

f.   Dalam hal diberikan uang muka, maka Penyedia harus mengajukan permohonan pengambilan uang muka secara tertulis kepada PPK (Pejabat Pembuat Komitmen) disertai dengan rencana penggunaan uang muka untuk melaksanakan pekerjaan sesuai Kontrak dan rencana pengembaliannya.

g.   PPK (Pejabat Pembuat Komitmen) harus mengajukan Surat Permintaan Pembayaran (SPP) kepada Pejabat Penandatanganan Surat Perintah Membayar (PPSPM) untuk permohonan tersebut pada huruf f, paling lambat 7 (tujuh) hari kerja setelah Jaminan Uang Muka diterima.

h.   Pengembalian uang muka harus diperhitungkan berangsur-angsur secara proporsional pada setiap pembayaran prestasi pekerjaan dan paling lambat harus lunas pada saat pekerjaan mencapai prestasi 100% (seratus perseratus).

a.   Advances are paid to finance the mobilization of equipment / construction workforce, payment of signed money to suppliers of materials / materials and / or for other technical preparations.

b.   For small businesses, advances can be given a maximum of 30% (thirty percent) of the Contract Price.

c.   For non-small businesses, advances can be given a maximum of 20% (twenty percent) of the Contract Price.

e.   The amount of the down payment is determined in the Special Conditions of Contract and paid after the Provider submits a Advance Payment Guarantee of at least the amount received.

f.   In the case of a down payment, the Provider must submit a request for withdrawal in writing to the Commitment Making Officer accompanied by a plan to use the down payment to carry out work in accordance with the Contract and the planned return.

g.   The Commitment Making Officer must submit a Payment Request to the Official Signing of the Payment Order for the application in letter f, no later than 7 (seven) working days after the Advance Payment Guarantee is received.

h.   Advance refunds must be calculated in proportion to each payment of work performance and must be paid off at the latest when the work reaches 100% (one hundred percent).

68.2.   Prestasi pekerjaan.

Pembayaran prestasi hasil pekerjaan yang disepakati dilakukan oleh PPK (Pejabat Pembuat Komitmen), dengan ketentuan:

a.   Penyedia telah mengajukan tagihan disertai laporan kemajuan hasil pekerjaan;

a.   The provider has submitted a bill accompanied by a progress report on the results of the work;

b.   pembayaran dilakukan tidak boleh melebihi kemajuan hasil pekerjaan yang telah dicapai dan diterima oleh PPK (Pejabat Pembuat Komitmen);

b.   payments made may not exceed the progress of the work achieved and received by the Commitment Making Officer;

c.   pembayaran dilakukan terhadap pekerjaan yang sudah terpasang;

c.   payment is made to the work already installed;

d.   pembayaran dilakukan dengan sistem termin yang ketentuan lebih lanjut diatur dalam SSKK (Syarat – Syarat Khusus Kontrak);

d.   payments are made by a terminology system, which further stipulates in the CST (Contract Specific Terms);

e.   pembayaran harus memperhitungkan:

1)  angsuran uang muka;

2)  denda (apabila ada);

3)  pajak; dan/atau

4)  uang retensi.

e. payment must take into account:

1) installment payments;

2) fines (if any);

3) tax; and / or

4) retention money.

f.   untuk Kontrak yang mempunyai subkontrak, permintaan pembayaran harus dilengkapi bukti pembayaran kepada seluruh Subpenyedia sesuai dengan prestasi pekerjaan. Pembayaran kepada Subpenyedia dilakukan sesuai prestasi pekerjaan yang selesai dilaksanakan oleh Subpenyedia tanpa harus menunggu pembayaran terlebih dahulu dari PPK (Pejabat Pembuat Komitmen);

f.   for Contracts that have subcontracts, payment requests must be completed with proof of payment to all Sub-providers according to job performance. Payments to the Sub-Provider are made according to the work performance completed by the Sub-provider without having to wait for payment in advance from the Commitment Making Officer;

g.   pembayaran terakhir hanya dilakukan setelah pekerjaan selesai 100% (seratus perseratus) dan Berita Acara Serah Terima Pertama Pekerjaan ditandatangani oleh PPK (Pejabat Pembuat Komitmen) dan Penyedia;

h.   PPK (Pejabat Pembuat Komitmen) dalam kurun waktu 7 (tujuh) hari kerja setelah pengajuan permintaan pembayaran dari Penyedia diterima harus sudah mengajukan Surat Permintaan Pembayaran kepada Pejabat Penandatanganan Surat Perintah Membayar (PPSPM);

h.   The Commitment Making Officer within a period of 7 (seven) working days after the submission of a request for payment from the Provider is received must have submitted a Request for Payment to the Official Signing of the Payment Order;

i.   apabila terdapat ketidaksesuaian dalam perhitungan angsuran, tidak akan menjadi alasan untuk menunda pembayaran. PPK (Pejabat Pembuat Komitmen) dapat meminta Penyedia untuk menyampaikan perhitungan prestasi sementara dengan mengesampingkan hal-hal yang sedang menjadi perselisihan.

68.3.   Denda dan Ganti Rugi.

68.3.   Fines and Compensation.

a.   Denda merupakan sanksi finansial yang dikenakan kepada Penyedia, antara lain: denda keterlambatan dalam penyelesaian pelaksanaan pekerjaan, denda keterlambatan dalam perbaikan Cacat Mutu, denda terkait pelanggaran ketentuan subkontrak.

a.   Fines are financial sanctions imposed on Providers, including: late penalties in the completion of work, late penalties in improving Quality Defects, fines related to violations of subcontracting provisions.

b.   Ganti rugi merupakan sanksi finansial yang dikenakan kepada PPK (Pejabat Pembuat Komitmen) maupun Penyedia karena terjadinya cidera janji/wanprestasi. Besarnya sanksi ganti rugi adalah sebesar nilai kerugian yang ditimbulkan.

b.   Compensation is a financial sanction imposed on The Commitment Making Officials and Providers due to the occurrence of breach of contract / default. The amount of compensation is equal to the value of the loss incurred.

c.   Besarnya denda keterlambatan yang dikenakan kepada Penyedia atas keterlambatan penyelesaian pekerjaan adalah:

1) 1‰ (satu perseribu) dari harga bagian Kontrak yang tercantum dalam Kontrak [sebelum PPN (Pajak Pertambahan Nilai)]; atau

2)  1‰ (satu perseribu) dari Harga Kontrak [sebelum PPN (Pajak Pertambahan Nilai)]; sesuai yang ditetapkan dalam SSKK (Syarat – Syarat Khusus Kontrak).

c. The amount of late fees imposed on the Provider for late completion of work is:

1) 1 ‰ (one thousandth) of the price of the part of the Contract stated in the Contract [before VAT (Value Added Tax)]; or

2) 1 ‰ (one thousandth) of the Contract Price [before Value Added Tax]; as specified in the CSC (Contract Specific Conditions).

d.   Besarnya ganti rugi sebagai akibat Peristiwa Kompensasi yang dibayar oleh PPK (Pejabat Pembuat Komitmen) atas keterlambatan pembayaran adalah sebesar bunga dari nilai tagihan yang terlambat dibayar, berdasarkan tingkat suku bunga yang berlaku pada saat itu menurut ketetapan Bank Indonesia, sepanjang telah diputuskan oleh lembaga yang berwenang;

d.   The amount of compensation as a result of the Compensation Event paid by The Commitment Making Officer for late payments is equal to the interest of the late payment amount, based on the current interest rate according to the provisions of Bank of Indonesia, insofar as it has been decided by the authorized institution;

e.   Pembayaran denda dan/atau ganti rugi diperhitungkan dalam pembayaran prestasi pekerjaan.

e.   Payment of fines and / or compensation is calculated in the payment of work performance.

f.   Ganti rugi kepada Penyedia dapat mengubah Harga Kontrak setelah dituangkan dalam adendum kontrak.

g.   Pembayaran ganti rugi dilakukan oleh PPK (Pejabat Pembuat Komitmen), apabila Penyedia telah mengajukan tagihan disertai perhitungan dan data - data.

g.   Payment of compensation is carried out by The Commitment Making Officer, if the Provider has submitted a bill accompanied by calculations and datas.

69. Hari Kerja.

69. Business Days.

69.1.   Orang hari standar atau satu hari orang bekerja adalah 8 (delapan) jam, terdiri atas 7 (tujuh) jam kerja (efektif) dan 1 (satu) jam istirahat.

69.1. People on a standard day or one day of working person is 8 (eight) hours, consisting of 7 (seven) working hours (effective) and 1 (one) hour of rest.

69.2.   Penyedia tidak diperkenankan melakukan pekerjaan apapun di lokasi kerja pada waktu yang secara ketentuan peraturan perundang-undangan dinyatakan sebagai hari libur atau di luar jam kerja normal, kecuali:

a.   dinyatakan lain di dalam Kontrak;

b.   PPK (Pejabat Pembuat Komitmen) memberikan izin; atau

c.   pekerjaan tidak dapat ditunda, atau untuk keselamatan/perlindungan masyarakat, dimana Penyedia harus segera memberitahukan urgensi pekerjaan tersebut kepada Pengawas Pekerjaan dan PPK (Pejabat Pembuat Komitmen).

69.2.   Providers are not permitted to do any work at the work site at a time when the provisions of the legislation are stated as a holiday or outside normal working hours, except:

a. stated otherwise in the Contract;

b. The Commitment Making Officer gives permission; or

c. work cannot be postponed, or for community safety / protection, where the Provider must immediately notify the urgency of the work to the Work Supervisor and The Commitment Making Officer.

69.3.   Semua pekerja dibayar selama hari kerja dan datanya disimpan oleh Penyedia. Daftar pembayaran masing-masing pekerja dapat diperiksa oleh PPK (Pejabat Pembuat Komitmen).

69.3.   All workers are paid during working days and the data is stored by the Provider. The payment list for each worker can be checked by the Commitment Making Officer.

69.4.   Untuk pekerjaan yang dilakukan di luar hari kerja efektif dan jam kerja normal harus mengikuti ketentuan Menteri yang membidangi ketenagakerjaan.

69.4.   For work carried out outside the effective working day and normal working hours must follow the provisions of the Minister in charge of employment.

69.5.   Pelaksanaan pekerjaan di luar hari kerja efektif dan/atau jam kerja normal harus diawasi oleh Pengawas Pekerjaan.

70. Perhitungan Akhir.

70. Final Calculation.

70.1.   Pembayaran angsuran prestasi pekerjaan terakhir dilakukan setelah pekerjaan selesai 100% (seratus perseratus) dan berita acara serah terima pertama pekerjaan telah ditandatangani oleh kedua pihak.

70.1.   The installment payment of the last job performance is made after the work is completed 100% (one hundred percent) and the minutes of the first handover of the work have been signed by both parties.

70.2.   Sebelum pembayaran terakhir dilakukan, Penyedia berkewajiban untuk menyerahkan kepada Pengawas Pekerjaan perhitungan nilai tagihan terakhir yang jatuh tempo. PPK (Pejabat Pembuat Komitmen)  berdasarkan hasil penelitian tagihan oleh Pengawas Pekerjaan berkewajiban untuk menerbitkan SPP  (Surat Perintah Pembayaran) untuk pembayaran tagihan angsuran terakhir paling lambat 7 (tujuh) hari kerja terhitung sejak tagihan dan dokumen penunjang dinyatakan lengkap dan diterima oleh Pengawas Pekerjaan.

70.2.   Before the last payment is made, the Provider is obliged to submit to the Supervisor the Work of the calculation of the value of the final bill due. The Commitment Making Officer based on the results of the invoice research by the Work Supervisor is obliged to issue The Letter of Payment Order for the payment of the last installment bill no later than 7 (seven) working days as of the invoice and supporting documents declared complete and accepted by the Works Supervisor.

71. Penangguhan.

71. Suspension.

71.1.   PPK (Pejabat Pembuat Komitmen) dapat menangguhkan pembayaran setiap angsuran prestasi pekerjaan Penyedia jika Penyedia gagal atau lalai memenuhi kewajiban kontraktualnya, termasuk penyerahan setiap Hasil Pekerjaan sesuai dengan waktu yang telah ditetapkan.

71.1.   The Commitment Making Officer can suspend payments for each installment of the Provider's work performance if the Provider fails or negligent to fulfill his contractual obligations, including the submission of each Work Result in accordance with the stipulated time.

71.2.   PPK (Pejabat Pembuat Komitmen) secara tertulis memberitahukan kepada Penyedia tentang penangguhan hak pembayaran, disertai alasan-alasan yang jelas mengenai penangguhan tersebut. Penyedia diberi kesempatan untuk memperbaiki dalam jangka waktu tertentu.

71.2.   The Commitment Making Officer in writing notifies the Provider of the suspension of payment rights, along with clear reasons for the suspension. Providers are given the opportunity to improve within a certain period of time.

71.3.   Pembayaran yang ditangguhkan harus disesuaikan dengan proporsi kegagalan atau kelalaian Penyedia.

71.3.   Deferred payments must be adjusted to the proportion of failure or negligence of the Provider.

71.4.   Jika dipandang perlu oleh PPK (Pejabat Pembuat Komitmen), penangguhan pembayaran akibat keterlambatan penyerahan pekerjaan dapat dilakukan bersamaan dengan pengenaan denda kepada Penyedia.

71.4.   If deemed necessary by The Commitment Making Officer, deferral of payment due to late delivery of work can be carried out simultaneously with the imposition of fines on the Provider.
