Article 66

 
(1) IUP Operasi Produksi & IUPK Operasi Produksi yang telah berakhir masa berlakunya, tidak menghilangkan kewajiban pemegang IUP Operasi Produksi & IUPK Operasi Produksi untuk melaksanakan Pascatambang.
(1) The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation which has expired, does not eliminate the obligation of holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation to implement the Mine Closure.
 
(2) Dalam rangka pelaksanaan Pascatambang sebagaimana dimaksud pada ayat (1), direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya menerbitkan surat mengenai pelaksanaan Pascatambang kepada pemegang IUP Operasi Produksi & IUPK Operasi Produksi.
(2) In the framework of the implementation of the Post-Mining referred to in paragraph (1), the director-general on behalf of the minister, governor or Regent/mayor in accordance with their authority issuing The Letter on the implementation of the Post-Mining to holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation.

CHAPTER X
ADMINISTRATIVE SANCTIONS
 
Pasal 67
Article 67
 
(1) Pemegang IUP Eksplorasi atau IUPK Eksplorasi yang melakukan pelanggaran ketentuan sebagaimana dimaksud dalam Pasal 2 ayat (1), ayat (3), atau ayat (4), Pasal 3 ayat (1), Pasal 4, Pasal 6, Pasal 10, Pasal 11, Pasal 12, Pasal 13, Pasal 14, Pasal 16, Pasal 17, Pasal 18, Pasal 19 ayat (3), Pasal 20 ayat (1), ayat (2), atau ayat (5), Pasal 28, Pasal 29, Pasal 41 ayat (1) atau ayat (3), Pasal 42, Pasal 46, atau Pasal 61 ayat (4) dikenakan sanksi administratif.
(1) Holders of The Mining Permit of Exploration & The Especially Mining Permit of Exploration who violate the provisions referred to in Article 2 paragraph (1), paragraph (3), or paragraph (4), Article 3, paragraph (1), Article 4, Article 6, Article 10, Article 11, Article 12, Article 13, Article 14, Article 16, Article 17, Article 18, Article 19 paragraph (3), Article 20 paragraph (1), paragraph (2), or paragraph (5), Article 28, Article 29, Article 41 paragraph (1) or subsection (3), Article 42, Article 46, or Article 61 paragraph (4) shall be subject to administrative sanctions.
 
(2) Pemegang IUP Operasi Produksi atau IUPK Operasi Produksi yang melakukan pelanggaran ketentuan sebagaimana dimaksud dalam Pasal 2 ayat (2), ayat (3), ayat (4), atau ayat (5), Pasal 3 ayat (2), Pasal 15, Pasal 22 ayat (3), Pasal 23 ayat (1), ayat (2), atau ayat (5), Pasal 25 ayat (3), Pasal 26 ayat (1), ayat (2), atau ayat (5), Pasal 31,Pasal 32, Pasal 33, Pasal 34, Pasal 37, Pasal 38 ayat (1), ayat (3), atau ayat (5), Pasal 39, Pasal 40, Pasal 41 ayat (1), ayat (2), atau ayat (3), Pasal 43 ayat (1), ayat (5), atau ayat (6), Pasal 44, Pasal 45, Pasal 50, Pasal 56, Pasal 61 ayat (4), Pasal 62 ayat (2), Pasal 63, Pasal 64, atau Pasal 65 dikenakan sanksi administratif.
(2) Holders of The Mining Permit of Production Operation or The Especially Mining Permit of Production Operation who violate the provisions referred to in Article 2 paragraph (2), paragraph (3), (4), or paragraph (5), Article 3 paragraph (2), Article 15, Article 22 paragraph (3), Article 23 paragraph (1), paragraph (2), or paragraph (5), Article 25 paragraph (3), Article 26 paragraph (1), paragraph (2), or paragraph (5), Article 31, Article 32, Article 33, Article 34, Article 37, Article 38 paragraph (1), paragraph (3), or paragraph (5), Article 39, Article 40, Article 41 paragraph (1), paragraph (2 ), or paragraph (3), Article 43 paragraph (1), paragraph (5), or paragraph (6), Article 44, Article 45, Article 50, Article 56, Article 61 paragraph (4), Article 62 paragraph (2 ), Article 63, Article 64, or Article 65 shall be subject to administrative sanctions.
 
Pasal 68
Article 68
 
(1) Sanksi administratif sebagaimana dimaksud dalam Pasal 67 dapat berupa :
(1) The administrative sanctions as referred to in Article 67 may be :
 
a. Peringatan tertulis;
a. Written warning;
 
b. Penghentian sementara sebagian atau seluruh kegiatan pertambangan; dan/atau
b. Temporary suspension of part or all of mining activities; and/or
 
c. Pencabutan IUP Eksplorasi, IUP Operasi Produksi, IUPK Eksplorasi, atau IUPK Operasi Produksi.
c. Revocation of The Mining Permit of Exploration, The Mining Permit of Production Operation, The Especially Mining Permit of Exploration, or The Especially Mining Permit of Production Operations.
 
(2) Sanksi administratif sebagaimana dimaksud pada ayat (1) diberikan oleh direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya.
(2) Administrative sanctions as referred to in paragraph (1) shall be issued by the director general on behalf of the minister, governor or Regent/mayor in accordance with their authority.
 
Pasal 69
Article 69
 
Sanksi administratif berupa peringatan tertulis sebagaimana dimaksud dalam Pasal 68 ayat (1) huruf a diberikan paling banyak 3 (tiga) kali dengan jangka waktu peringatan masing-masing 30 (tiga puluh) hari kalender.
Administrative sanctions in the form of a written warning as referred to in Article 68 paragraph (1) letter a given at most three (3) times of the period of each warning is thirty (30) calendar days.

(1) Dalam hal pemegang IUP Eksplorasi, IUP Operasi Produksi, IUPK Eksplorasi, atau IUPK Operasi Produksi, yang mendapat sanksi peringatan tertulis setelah berakhirnya jangka waktu peringatan tertulis sebagaimana dimaksud dalam Pasal 69 belum melaksanakan kewajibannya, dikenai sanksi administratif berupa penghentian sementara sebagian atau seluruh kegiatan Pertambangan sebagaimana dimaksud dalam Pasal 68 ayat (1) huruf b.
(1) In the case of holders of The Mining Permit of Exploration, The Mining Permit of Production Operation, The Especially Mining Permit of Exploration, The Especially Mining Permit of Production Operations, who received a written warning sanction after the expiry of the written warning as referred to in Article 69 has not carried out its obligations, shall be subject to administrative sanctions in the form of temporary suspension of part or all of Mining activities referred to in Article 68 (1) b.
 
(2) Sanksi administratif berupa penghentian sementara sebagian atau seluruh kegiatan Pertambangan sebagaimana dimaksud pada ayat (1) dikenakan dalam jangka waktu paling lama 90 (sembilan puluh) hari kalender.
(2) The administrative sanction in the form of temporary suspension of part or all mining activities referred to in paragraph (1) shall be within a period of ninety (90) calendar days.
 
Pasal 71

Sanksi administratif berupa pencabutan IUP Eksplorasi, IUP Operasi Produksi, IUPK Eksplorasi, & IUPK Operasi Produksi, sebagaimana dimaksud dalam Pasal 68 ayat (1) huruf c dikenakan kepada pemegang IUP Eksplorasi, IUP Operasi Produksi, IUPK Eksplorasi, & IUPK Operasi Produksi yang tidak melaksanakan kewajiban sampai dengan berakhirnya jangka waktu pengenaan sanksi penghentian sementara sebagian atau seluruh kegiatan pertambangan sebagaimana dimaksud dalam Pasal 70.
Administrative sanctions such as revocation of The Mining Permit of Exploration, The Mining Permit of Production Operation, The Especially Mining Permit of Exploration & The Especially Mining Permit of Production Operations as referred to in Article 68 paragraph (1) letter c imposed on holders of The Mining Permit of Exploration, The Mining Permit of Production Operation, The Especially Mining Permit of Exploration & The Especially Mining Permit of Production Operations that do not implement obligations until the expiration of the imposition of temporary suspension of part or all of mining activities referred to in Article 70.

KETENTUAN PERALIHAN
CHAPTER XI
TRANSITIONAL PROVISIONS
 
Pasal 72
Article 72
 
(1) Rencana Reklamasi dan/atau rencana Pascatambang yang telah disetujui oleh menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya sebelum berlakunya Peraturan Menteri ini, dinyatakan tetap berlaku & pelaksanaannya wajib disesuaikan dengan Peraturan Menteri ini paling lambat 1 (satu) tahun sejak Peraturan Menteri ini diundangkan.
(1) Reclamation Plan and/or the Mine Closure plan which has been approved by the minister, governor or Regent/mayor in accordance with the authority before the entry into force of this Minister's Regulation, shall remain valid & and its implementation must be adjusted with this Minister's Regulation no later than 1 (one) year from the This Ministerial Decree promulgated.
 
(2) Rencana Reklamasi dan/atau rencana Pascatambang yang disampaikan oleh pemegang IUP Operasi Produksi, Kontrak Karya, & Perjanjian Karya Pengusahaan Pertambangan Batubara & belum mendapatkan persetujuan sebelum berlakunya Peraturan Menteri ini, wajib diproses sesuai dengan ketentuan dalam Peraturan Menteri ini.
(2) Reclamation Plan and/or the Mine Closure plan submitted by holders of The Mining Permit of Production Operation, COW (Contract of Work), and Coal Mining Agreement & has not been approved before the entry into force of this Minister's Regulation, shall be processed in accordance with the provisions of this Minister's Regulation.
 
Pasal 73
Article 73
 
Pemegang IUP Operasi Produksi, Kontrak Karya, & Perjanjian Karya Pengusahaan Pertambangan Batubara yang telah menempatkan Jaminan Reklamasi atau Jaminan Pascatambang sebelum berlakunya Peraturan Menteri ini, bentuk jaminannya wajib disesuaikan dengan ketentuan dalam Peraturan Menteri ini paling lambat 1 (satu) tahun sejak Peraturan Menteri ini diundangkan.
Holders of The  Production Operation, COW (Contract of Work), & Coal Mining Agreement which has been put Reclamation Guarantee or Post-Mining Reclamation Guarantee prior to the enactment of this Minister's Regulation, in the form of the guarantee shall be adjusted to the provisions of this Minister's Regulation no later than 1 (one) year from the promulgation of this Minister's Regulation.

KETENTUAN PENUTUP

CLOSING REGULATION

Pada saat Peraturan Menteri ini mulai berlaku, Peraturan Menteri Energi & Sumber Daya Mineral Nomor 18 Tahun 2008 tanggal 29 Mei 2008 tentang Reklamasi & Penutupan Tambang, dicabut & dinyatakan tidak berlaku.
At the time this Minister's Regulation comes into force, the Minister of Energy and Mineral Resources No. 18 of 2008 dated May 29th, 2008 on Reclamation & Mining Closure, revoked & declared no longer valid.
 
Pasal 75
Article 75
 
Peraturan Menteri ini mulai berlaku pada tanggal diundangkan.
This Minister's Regulation comes into force on the date of promulgation.
 
Agar setiap orang mengetahuinya, memerintahkan pengundangan Peraturan Menteri ini dengan penempatannya dalam Berita Negara Republik Indonesia.
For public cognizance, this Ministerial Regulation shall be promulgated in the State Gazette of the Republic of Indonesia.

a. Biaya mobilisasi & demobilisasi alat sebesar 2,5% (dua koma lima persen) dari biaya langsung atau berdasarkan perhitungan.
a. Mobilization & demobilization costs appliance of 2.5% (two point five percent) of direct costs or by calculation.
 
b. Biaya perencanaan Reklamasi sebesar 2% (dua persen) sampai dengan 10% (sepuluh persen) dari biaya langsung;
b. Reclamation planning fee of 2% (two percent) to 10% (ten percent) of direct costs;
 
c. Biaya administrasi & keuntungan pihak ketiga sebagai pelaksana Reklamasi tahap Eksplorasi sebesar 3% (tiga persen) sampai 14% (empat belas persen) dari biaya langsung;
c. Administrative costs & profit of third parties as executor of Reclamation of Exploration phase of 3% (three percent) to 14% (fourteen percent) of the direct cost;
 
d. Biaya supervisi sebesar 2% (dua persen) sampai dengan 7% (tujuh persen) dari biaya langsung.
d. Supervision fee of 2% (two percent) to 7% (seven percent) of direct costs.

a. Biaya mobilisasi & demobilisasi alat sebesar 2,5% (dua koma lima persen) dari biaya langsung atau berdasarkan perhitungan.

b. Biaya perencanaan Reklamasi sebesar 2% (dua persen) sampai dengan 10% (sepuluh persen) dari biaya langsung;

c. Biaya administrasi & keuntungan pihak ketiga sebagai pelaksana Reklamasi tahap Operasi Produksi sebesar 3% (tiga persen) sampai dengan 14% (empat belas persen) dari biaya langsung;

c. Administrative costs & profit of third parties as the executor of Reclamation of stage of Production Operation at 3% (three percent) to 14% (fourteen percent) of direct costs;

 

d. Biaya supervisi sebesar 2% (dua persen) sampai dengan 7% (tujuh persen) dari biaya langsung.

a. Biaya mobilisasi & demobilisasi alat sebesar 2,5% (dua koma lima persen) dari biaya langsung atau berdasarkan perhitungan;

a. Mobilization & demobilization costs in appliance of 2.5% (two point five percent) of direct costs or by calculation;

 

b. Biaya perencanaan Pascatambang sebesar 2% (dua persen) sampai 10% (sepuluh persen) dari biaya langsung;

b. Mine Closure planning costs of 2% (two percent) to 10% (ten percent) of direct costs;

 

c. Biaya administrasi & keuntungan pihak ketiga   sebagai pelaksana Pascatambang sebesar 3% sampai dengan 14% (empat belas persen) dari biaya langsung; dan

c. Cost of administrative & profit of third parties as executor of Mine Closure by 3% to 14% (fourteen percent) of direct costs; and

 

d. Biaya supervisi sebesar 2% (dua persen) sampai dengan 7% (tujuh persen) dari biaya langsung.
