THE REGULATION OF MINISTER OF ENERGY & MINERAL RESOURCES OF RECLAMATION & POST MINING ON ACTIVITIES OF MINERAL & COAL MINING

 

Pasal 30

Article 30

 

Direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya dapat memerintahkan pemegang IUP Eksplorasi & IUPK Eksplorasi untuk mengubah jumlah jaminan Reklamasi tahap Eksplorasi apabila :

Director General on behalf of the minister, governor or regent/mayor in accordance with its authority may order the holder of The Mining Permit of Exploration  & The Especially Mining Permit of Exploration to change the amount of collateral of The Reclamation of Exploration stage if :

 

a. Terjadi perubahan atas rencana Eksplorasi sebagaima dimaksud dalam Pasal 20; atau

a. There is a change on its Exploration plans referred to in Article 20; or

 

b. Biaya pelaksanaan Reklamasi tahap Eksplorasi tidak sesuai dengan rencana Reklamasi tahap Eksplorasi.

b. Cost of Reclamation implementation of Exploration phase are not in accordance with the plan of Reclamation on Exploration phase.

 

Pasal 31

Article 31

 

(1) Penempatan jaminan Reklamasi tahap Eksplorasi tidak menghilangkan kewajiban pemegang IUP Eksplorasi untuk melaksanakan Reklamasi.

(1) Placement of guarantees Reclamation on Exploration stage does not eliminate the obligation of the holder of The Mining Permit of Exploration to carry out reclamation.

 

(2) Kekurangan biaya untuk menyelesaikan Reklamasi tahap Eksplorasi dari jaminan yang telah ditetapkan, tetap menjadi tanggung jawab pemegang IUP Eksplorasi atau IUPK Eksplorasi.

(2) Lack of costs to complete the Reclamation on Exploration phase of the collateral that has been set, it remains the responsibility of the holder of The Mining Permit of Exploration or The Especially of Mining Permit of Exploration.

 

Paragraf 2

Jaminan Reklamasi Tahap Operasi Produksi

Paragraph 2

Guarantee of Reclamation of Production Operation Phase

 

Pasal 32

Article 32

 

(1) Pemegang IUP Operasi Produksi & IUPK Operasi Produksi wajib menyediakan Jaminan Reklamasi tahap Operasi Produksi sesuai dengan penetapan besaran Jaminan Reklamasi tahap Operasi Produksi oleh direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya sebagaimana dimaksud dalam Pasal 24.

(1) Holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation & shall provide a Reclamation Guarantee of stages of Production Operation in accordance with the determination of the amount of Reclamation Guarantee of Production Operation stage by The Director General on behalf of the minister, governor or regent/mayor in accordance with their authority as referred to in Article 24.

 

(2) Jaminan Reklamasi tahap Operasi Produksi untuk periode 5 (lima) tahun pertama wajib ditempatkan seluruhnya untuk jangka waktu 5 (lima) tahun.

(2) Reclamation Guarantee of stages of Production Operation for first a period of 5 (five) years shall be placed entirely for a period of 5 (five) years.

 

(3) Dalam hal umur tambang kurang dari 5 (lima) tahun, Jaminan Reklamasi tahap Operasi Produksi ditempatkan sesuai dengan umur tambang.

(3) In the event that a mine life of less than 5 (five) years, Reclamation Guarantee of stages of Production Operation are placed in accordance with a mine life.

 

(4) Jaminan Reklamasi tahap Operasi Produksi sebagaimana dimaksud pada ayat (2) untuk periode 5 (lima) tahun berikutnya dapat ditempatkan seluruhnya untuk jangka waktu 5 (lima) tahun atau setiap tahun.

(4) Reclamation Guarantee of stages of Production Operation as referred to in paragraph (2) for a period of 5 (five) years later can be placed entirely for a period of 5 (five) years, or every year.

 

(5) Penempatan Jaminan Reklamasi tahap Operasi Produksi setiap tahun sebagaimana dimaksud pada ayat (4) dimuat dalam rencana kerja & anggaran biaya Operasi Produksi tahunan.

(5) The Placement of Reclamation Guarantee of stages of Production Operation every year as referred to in paragraph (4) contained in the work plan & budget for annual production operation.

 

(6) Penempatan Jaminan Reklamasi tahap Operasi Produksi sebagaimana dimaksud pada ayat (2) dilakukan dalam jangka waktu paling lambat 30 (tiga puluh) hari kalender sejak rencana Reklamasi tahap Operasi Produksi disetujui oleh direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya.

(6) Placement of Reclamation Guarantee of stages of Production Operation as referred to in paragraph (2) shall be conducted at the latest within a period of thirty (30) calendar days after the reclamation plan of stages of production operation approved by the director general on behalf of the minister, governor or regent/mayor in accordance with authority.

 

(7) Penempatan Jaminan Reklamasi tahap Operasi Produksi untuk periode tahun berikutnya sebagaimana dimaksud pada ayat (4) dilakukan dalam jangka waktu paling lambat 14 (empat belas) hari kalender sejak dimulainya tahun berjalan.

(7) Placement of Reclamation Guarantee of stages of Production Operation for the next year period referred to in paragraph (4) shall be conducted within a period of at least 14 (fourteen) calendar days from the commencement of the current year.

 

Pasal 33

Article 33

 

(1) Pemegang IUP Operasi Produksi & IUPK Operasi Produksi wajib mengajukan bentuk Jaminan Reklamasi tahap Operasi Produksi kepada menteri melalui direktur jenderal, gubernur, atau Bupati/walikota sesuai dengan kewenangannya.

(1) Holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation required to submit forms The Reclamation Guarantee of stages of Production Operation to the minister through the director general, governor or regent/mayor in accordance with their authority.

 

(2) Bentuk Jaminan Reklamasi tahap Operasi Produksi sebagaimana dimaksud pada ayat (1) dapat berupa :

(2) Form of Reclamation Guarantee of stages of Production Operation as referred to in paragraph (1) can be :

 

a. Rekening bersama ditempatkan pada bank Pemerintah di Indonesia atas nama direktur jenderal, gubernur, atau Bupati/walikota & pemegang IUP Operasi Produksi atau IUPK Operasi Produksi.

a. Joint accounts are placed on a government bank in Indonesia on behalf of the director general, governor or regent/mayor & holders of The Mining Permit of Production Operation or The Especially Mining Permit of Production Operation.

 

b. Deposito berjangka ditempatkan pada bank pemerintah di Indonesia atas nama direktur jenderal, gubernur, atau Bupati/walikota qq pemegang IUP Operasi Produksi atau IUPK Operasi Produksi yang bersangkutan dengan jangka waktu penjaminan sesuai dengan Jadwal Reklamasi tahap Operasi Produksi.
b. Time deposits were placed in a government bank in Indonesia on behalf of the director general, governor or regent/mayor qq holders of The Mining Permit of Production Operation or The Especially Mining Permit of  Production Operation concerned with the period of the guarantee in accordance with the Schedule of Reclamation of phase of Production Operation Reclamation.

 

c. Bank Garansi yang diterbitkan oleh bank Pemerintah di Indonesia atau bank swasta Nasional di Indonesia dengan jangka waktu penjaminan sesuai dengan jadwal Reklamasi tahap Operasi Produksi; atau

c. The Bank of Guarantees issued by banks in the Indonesian Government or National private banks in Indonesia with a guarantee period according to the schedule of Reclamation of stage of Production Operation; or

 

d. Cadangan Akuntansi (Accounting Reserve), dapat ditempatkan apabila pemegang IUP Operasi Produksi atau IUPK Operasi Produksi tersebut memenuhi persyaratan sebagai berikut :

d. Accounting Reserve, can be placed if the holders of The Mining Permit of Production Operation or The Especially Mining Permit of Production Operation that  they meet the following requirements :

 

1. Terdaftar pada bursa efek di Indonesia & telah menempatkan sahamnya lebih dari 40% (empat puluh persen) dari total saham yang dimiliki; dan

1. Listed on the stock exchanges in Indonesia & has placed its shares more than 40% (forty percent) of the total shares held; and

 

2. Mempunyai jumlah modal disetor tidak kurang dari US$50.000.000,00 (lima puluh juta dolar Amerika Serikat) sebagaimana yang tercantum dalam akta pendirian perusahaan dan/atau perubahannya yang disyahkan oleh notaris.

2. Having paid up capital of not less than US $ 50,000,000.00 (fifty million US dollars) as stated in the certificate of incorporation and/or amendments are approved by a notary.

 

(3) Jaminan Reklamasi tahap Operasi Produksi sebagaimana dimaksud pada ayat (2) ditempatkan dalam mata uang Rupiah atau Dolar Amerika Serikat.   

(3) Reclamation Guarantee of stages of Production Operation as referred to in paragraph (2) is placed in Rupiah or US Dollar.

 

(4) Direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya menetapkan bentuk Jaminan Reklamasi tahap Operasi Produksi yang ditempatkan oleh pemegang IUP Operasi Produksi atau IUPK Operasi Produksi sebagaimana dimaksud pada ayat (2).

(4) The Director General on behalf of the minister, governor or Regent/mayor in accordance with the authority set shape of Reclamation Guarantee of stages of production operation which was placed by the holders of The Mining Permit of Production Operation or The Especially Mining Permit of Production Operation referred to in paragraph (2).

 

(5) Dalam hal Jaminan Reklamasi tahap Operasi Produksi dalam bentuk Bank Garansi sebagaimana dimaksud pada ayat 2 huruf c telah habis masa berlakunya, pemegang IUP Operasi Produksi atau IUPK Operasi Produksi wajib memperpanjang masa berlaku jaminan sebelum dinyatakan secara tertulis dapat dilepaskan oleh direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya.

(5) In the case of Reclamation Guarantee of stage of Production Operation in the form of Bank of Guarantee referred to in paragraph 2 letter c has expired, the holders of of The Mining Permit of Production Operation or The Especially Mining Permit of Production Operation shall extend the warranty period before it is declared in writing may be released by the director general on behalf of minister, governor or Regent/mayor in accordance with their authority.

 

(6) Tata cara penempatan Jaminan Reklamasi tahap Operasi Produksi sebagaimana dimaksud pada ayat (2) dilaksanakan sesuai dengan ketentuan perundang-undangan.

(6) The procedure for the placement of Reclamation Guarantee of stages of Production Operation as referred to in paragraph (2) shall be implemented in accordance with the statutory provisions.

 

Pasal 34

Article 34

 

(1) Pemegang IUP Operasi Produksi dan IUPK Operasi Produksi yang menempatkan Jaminan Reklamasi dalam bentuk Cadangan Akuntansi (Accounting Reserve) yang telah memenuhi persyaratan sebagaimana dimaksud dalam Pasal 33 ayat (2) huruf d, wajib menyampaikan surat pernyataan penempatan Jaminan Reklamasi yang disahkan oleh notaris kepada menteri melalui direktur jenderal, gubernur, atau Bupati/walikota sesuai dengan kewenangannya.

(1) Holders of The Mining Permit of Production Operation and The Especially Mining Permit of Production Operation which puts Reclamation Guarantee in the form of Accounting Reserve that have met the requirements referred to in Article 33 paragraph (2) letter d, shall submit a statement of Reclamation Guarantee placements are certified by a notary to the minister through the director general, governor or Regent/mayor in accordance with their authority.

 

(2) Surat pernyataan sebagaimana dimaksud pada ayat (1) harus disertai dengan laporan keuangan tahunan yang telah diaudit oleh akuntan publik.

(2) A statement referred to in paragraph (1) shall be accompanied by the annual financial statements audited by a public accountant.

 

Pasal 35

Article 35

 

(1) Direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya dapat memerintahkan pemegang IUP Operasi Produksi & IUPK Operasi Produksi untuk mengubah jumlah Jaminan Reklamasi tahap Operasi Produksi apabila :

(1) The Director General on behalf of the minister, governor or Regent/mayor in accordance with its authority may order the holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation to change the number of Reclamation Guarantee of stages of Production Operation if :

 

a. Terjadi perubahan atas rencana Reklamasi tahap Operasi Produksi sebagaimana dimaksud dalam Pasal 23; atau

a. There is a change on planned of Reclamation of stage of Production Operation as referred to in Article 23; or

 

b. Biaya pelaksanaan kegiatan Reklamasi tahap Operasi Produksi tidak sesuai dengan rencana Reklamasi tahap Operasi Produksi.

b. The cost of implementation of The Reclamation of phase of Production Operation is not in accordance with the plan of Reclamation of stage of Production Operation.

 

(2) Direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya dapat memerintahkan pemegang IUP Operasi Produksi atau IUPK Operasi Produksi untuk mengubah bentuk Jaminan Reklamasi tahap Operasi Produksi berdasarkan pertimbangan :

(2) The Director General on behalf of the minister, governor or Regent/mayor in accordance with its authority may order the holders of The Mining Permit of Production Operation or The Especially Mining Permit of Production Operation to change the shape of Reclamation Guarantee of stages of Production Operation is based on the following considerations :

 

a. Kinerja pemegang IUP Operasi Produksi & IUPK Operasi Produksi; dan/atau

a. Performance of holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation; and/or

 

b. Kemampuan keuangan pemegang IUP Operasi Produksi & IUPK Operasi Produksi.

b. The financial capacity of holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation.

 

Pasal 36

Article 36

 

(1) Pemegang IUP Operasi Produksi & IUPK Operasi Produksi dapat mengajukan perubahan bentuk Jaminan Reklamasi tahap Operasi Produksi sebagaimana dimaksud dalam Pasal 33 kepada menteri melalui direktur jenderal, gubernur, atau Bupati/walikota sesuai dengan kewenangannya.

(1) Holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation may propose changes of shape of Reclamation Guarantee of stages of Production Operation as referred to in Article 33 to the minister through the director general, governor or Regent/mayor in accordance with their authority.

 

(2) Direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya memberikan persetujuan perubahan bentuk Jaminan Reklamasi tahap Operasi Produksi sebagaimana dimaksud pada ayat (1) berdasarkan Pertimbangan sebagai berikut :

(2) The Director General on behalf of the minister, governor or Regent/mayor in accordance with the authority to approve changes in the form of Reclamation Guarantee of stages of Production Operation as referred to in paragraph (1) is based on the following considerations :

a. Kinerja pemegang IUP Operasi Produksi & IUPK Operasi Produksi; dan/atau

a. Performance holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation; and/or

 

b. Kemampuan keuangan pemegang IUP Operasi Produksi & IUPK Operasi Produksi.

b. The financial capacity of holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation.

 

Pasal 37

Article 37

 

(1) Penempatan Jaminan Reklamasi tahap Operasi Produksi tidak menghilangkan kewajiban pemegang IUP Operasi Produksi & IUPK Operasi Produksi untuk melaksanakan Reklamasi tahap Operasi Produksi.

(1) Placement of Reclamation Guarantee of stages of Production Operation does not eliminate the obligation of holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation to carry out Reclamation of stage of Production Operation.

 

(2) Kekurangan biaya untuk menyelesaikan Reklamasi tahap Operasi Produksi dari jaminan yang telah ditetapkan, tetap menjadi tanggung jawab Pemegang IUP Operasi Produksi & IUPK Operasi Produksi.

(2) Lack of cost to complete The Reclamation of phase of The Production Operation warranties specified, remain the responsibility of holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation.

 

Bagian Kedua

Jaminan Pascatambang

Part Two

Post Mining Guarantee

 

Pasal 38

Article 38

 

(1) Pemegang IUP Operasi Produksi & IUPK Operasi Produksi wajib menyediakan Jaminan Pascatambang sesuai dengan besaran jaminan Pascatambang yang telah ditetapkan oleh direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya sebagaimana dimaksud dalam Pasal 27.

(1) Holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation shall provide a Guarantee in Mine Closure accordance with the amount of collateral of Mine Closure set by the director general on behalf of the minister, governor or Regent/mayor in accordance with their authority as referred to in Article 27.

 

(2) Jaminan Pascatambang sebagaimana dimaksud pada ayat (1) ditempatkan setiap tahun & dimuat dalam rencana kerja & anggaran biaya Operasi Produksi Tahunan.

(2) Post-Mining Guarantee referred to in paragraph (1) are placed each year & included in the work plan & budget for the Annual Production Operations.

 

(3) Penempatan Jaminan Pascatambang sebagaimana dimaksud pada ayat (2) wajib dilakukan dalam jangka waktu paling lambat 30 (tiga puluh) hari kalender sesuai dengan jadwal penempatan Jaminan Pascatambang yang ditetapkan dalam persetujuan rencana Pascatambang.

(3) Placement of Post-Mining Guarantee referred to in paragraph (2) shall be made within a period not later than 30 (thirty) calendar days in accordance with the schedule set forth of placement of Mine Closure Guarantee in Mine Closure plan approval.

 

(4) Jaminan Pascatambang wajib terkumpul seluruhnya 2 (dua) tahun sebelum memasuki pelaksanaan Pascatambang.

(4) Post-Mining Guarantee in compulsory entirely collected two (2) years before entering the implementation of the Mine Closure.

 

(5) Tata cara penempatan Jaminan Pascatambang sebagaimana dimaksud pada ayat (3) dilaksanakan sesuai dengan ketentuan sebagaimana tercantum dalam Lampiran IV yang merupakan bagian tidak terpisahkan dari Peraturan Menteri ini.

(5) Procedures for placement of Post-Mining Guarantee referred to in paragraph (3) shall be implemented in accordance with the provisions contained in Annex IV which is an integral part of this regulation.

 

Pasal 39

Article 39

 

(1) Jaminan Pascatambang sebagaimana dimaksud dalam Pasal 38 berupa Deposito Berjangka ditempatkan pada bank Pemerintah di Indonesia atas nama direktur jenderal, gubernur, atau Bupati/walikota qq pemegang IUP Produksi atau IUPK Operasi Produksi yang bersangkutan dengan jangka waktu penjaminan sesuai dengan jadwal Pascatambang.

(1) Post-Mining Guarantee referred to in Article 38 in the form of Deposit placed on government bank in Indonesia on behalf of the director general, governor or Regent/mayor qq holder of The Mining Permit of Production or The Especially Mining Permit of Production Operation is concerned with the period of the guarantee in accordance with the schedule of Mine Closure.

 

(2) Jaminan Pascatambang sebagaimana dimaksud pada ayat (1) ditempatkan dalam bentuk mata uang Rupiah atau Dolar Amerika Serikat.

(2) Post-Mining Guarantee referred to in paragraph (1) is placed in Rupiah or US Dollar.

 

(3) Bentuk mata uang Jaminan Pascatambang sebagaimana dimaksud pada ayat (2) yang telah ditetapkan tidak dapat diubah.

(3) The currency of Mine Closure Guarantee referred to in paragraph (2) which has been set can not be changed.

 

(4) Bunga deposito berjangka sebagaimana dimaksud pada ayat (1) hanya dapat dicairkan pada saat pencairan Jaminan Pascatambang.

(4) Deposit Interests referred to in paragraph (1) may only be disbursed at the time of disbursement of Post-Mining Warranty.

Article 40

 

(1) Penempatan Jaminan Pascatambang tidak menghilangkan kewajiban pemegang IUP Operasi Produksi & IUPK Operasi Produksi untuk melaksanakan Pascatambang.

(1) Placement of Post-Mining Guarantee does not eliminate the obligation of holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation to implement the Mine Closure.

 

(2) Kekurangan biaya untuk menyelesaikan Pascatambang dari jaminan yang telah ditetapkan, tetap menjadi tanggung jawab pemegang IUP Operasi Produksi & IUPK Operasi Produksi.

(2) Lack of cost to complete the Mine Closure of guarantees that have been established, it remains the responsibility of the holder of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation.

 

BAB VI

PELAKSANAAN REKLAMASI & PASCATAMBANG

CHAPTER VI

OF RECLAMATION and Post-MINING

 

Bagian Kesatu

Umum

Part One

General

 

Pasal 41

Article 41

 

(1) Pemegang IUP Eksplorasi, IUP Operasi Produksi, IUPK Eksplorasi, & IUPK Operasi Produksi wajib melaksanakan Reklamasi sesuai dengan rencana Reklamasi yang telah disetujui sebagaimana dimaksud dalam Pasal 19, Pasal 20, Pasal 22, & Pasal 23.

(1) Holders of The Mining Permit of Exploration, The Mining Permit of Production Operation, The Especially Mining Permit of Exploration & The Especially Mining Permit of Production Operation shall implement Reclamation in accordance with the approved reclamation plan as referred to in Article 19, Article 20, Article 22, and Article 23.

 

(2) Pemegang IUP Operasi Produksi & IUPK Operasi Produksi wajib melaksanakan Pascatambang yang telah disetujui sebagaimana dimaksud dalam Pasal 25 & Pasal 26.

(2) Holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operations obliged to implement the Post-Mining agreed referred to in Article 25 & Article 26.

 

(3) Pelaksanaan Reklamasi & Pascatambang wajib dipimpin oleh Kepala Teknik Tambang yang dibantu oleh petugas yang kompeten di dalam pelaksanaan Reklamasi & Pascatambang.

(3) Implementation of Reclamation & Mine Closure must be led by the Head of Mining Engineering assisted by competent personnel in the implementation of Reclamation & Mine Closure.

Pelaksanaan Reklamasi

Implementation of Reclamation

 

Paragraf 1

Paragraph 1

 

Pelaksanaan Reklamasi Tahap Eksplorasi

Implementation of Reclamation of Stage of Exploration

 

Pasal 42

Article 42

 

(1) Pemegang IUP Eksplorasi & IUPK Eksplorasi wajib melaksanakan Reklamasi tahap Eksplorasi yang telah disetujui sebagaimana dimaksud dalam Pasal 19 & Pasal 20 pada lahan terganggu akibat kegiatan Eksplorasi.

(1) Holders of The Mining Permit of Exploration & The Especially Mining Permit of Exploration shall carry out Reclamation of phase of Exploration which has been approved as referred to in Article 19 & Article 20 on land disturbed due to Exploration activities.

 

(2) Lahan terganggu sebagaimana dimaksud pada ayat (1) meliputi lahan bekas kegiatan Eksplorasi yang tidak digunakan lagi.

(2) Land disrupted as described in paragraph (1) includes formerly land used for Exploration activities that are not used anymore.

 

(3) Lahan bekas kegiatan eksplorasi sebagaimana dimaksud pada ayat (2) antara lain :

(3) Former land of exploration activities referred to in paragraph (2), among others :

 

a. Lahan bekas eksplorasi; dan

a. Former land of exploration; and

 

b. Lahan bekas fasilitas penunjang eksplorasi.

b. Former land of exploration support facilities.

 

(4) Lahan bekas kegiatan Eksplorasi sebagaimana dimaksud pada ayat (3) huruf b antara lain meliputi lubang pengeboran, sumur uji, & parit uji.

(4) Former land of exploration activities referred to in paragraph (3) letter b, among others, include hole drilling, testing well, & test trenches.

 

(5) Lahan bekas fasilitas penunjang Eksplorasi sebagaimana dimaksud pada ayat (3) huruf b antara lain akses jalan Eksplorasi, base camp, helipad, dan/atau workshop yang tidak digunakan lagi.

(5) Former land of Exploration support facilities as referred to in paragraph (3) letter b, among others, road access of Exploration, base camp, croquet, and/or workshops that are not used anymore.

 

(6) Pelaksanaan Reklamasi tahap Eksplorasi wajib dilakukan dalam jangka waktu paling lambat 30 (tiga puluh) hari kalender setelah tidak ada kegiatan Eksplorasi pada lahan terganggu sebagaimana dimaksud pada ayat (2), ayat (3), ayat (4), & ayat (5).

(6) Implementation of Reclamation of Exploration stage shall be conducted within a period not later than 30 (thirty) calendar days after no activity of Exploration on disturbed land referred to in paragraph (2), paragraph (3), paragraph (4), and paragraph (5).

Pelaksanaan Reklamasi Tahap Operasi Produksi

Implementation of Reclamation of Phase of Production Operations

 

Pasal 43

Article 43

 

(1) Pemegang IUP Operasi Produksi & IUPK Operasi Produksi wajib melaksanakan Reklamasi tahap Operasi Produksi sebagaimana dimaksud dalam Pasal 22 pada lahan terganggu akibat kegiatan Operasi Produksi.

(1) Holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation obliged to carry out Reclamation of stage of Production Operation as referred to in Article 22 on land disturbed due to the activities of Production Operations.

 

(2) Lahan terganggu sebagaimana dimaksud pada ayat (1) meliputi lahan bekas tambang & lahan di luar bekas tambang yang tidak digunakan lagi.

(2) Land disrupted as described in paragraph (1) shall include mined land & land outside the former of mines that are not used anymore.

 

(3) Lahan bekas tambang sebagaimana dimaksud pada ayat (2) dengan sistem tambang bawah tanah antara lain shaft, raise, stope, adit, decline, pit, tunnel, dan/atau final void.

(3) Ex-mine land referred to in paragraph (2) with a system of underground mine among other things shafts, raise, stope, adit, decline, pits, tunnels, and/or final void.

 

(4) Lahan di luar bekas tambang sebagaimana dimaksud pada ayat (2) dengan sistem tambang terbuka antara lain :

(4) outside the former mine land referred to in paragraph (2) with a system of open-pit mining, among others :

 

a. Tempat penimbunan batuan samping dan/atau tanah/batuan penutup;

a. Side rock dumps and/or covers soil/rock;

 

b. Tempat penimbunan tanah zona pengakaran;

b. Landfill sites of rooting zone;

 

c. Tempat penimbunan komoditas tambang;

c. Landfill of mining commodities;

 

d. Jalan tambang dan/atau jalan angkut;

d. Mining roads and/or transport road;

 

e. Instalasi & fasilitas pengolahan dan/atau pemurnian;

e. Installation and facilities of processing and/or purification;

 

f. Fasilitas penunjang;

f. Supporting facilities;

 

g. Kantor & perumahan;

g. Offices & housing;

 

h. Pelabuhan khusus/dermaga; dan/atau

h. Special port/dock; and/or

 

i. Lahan penimbunan dan/atau pengendapan tailing.

i. Land of hoarding and/or deposition of tailings.

 

(5) Pelaksanaan Reklamasi tahap Operasi Produksi wajib dilakukan paling lambat 30 (tiga puluh) hari kalender setelah tidak ada kegiatan pada lahan terganggu sebagaimana dimaksud pada ayat (2), ayat (3), & ayat (4).

(5) Implementation of Reclamation of stage of Production Operation must be done no later than 30 (thirty) calendar days after no activity on disturbed land referred to in paragraph (2), paragraph (3), & paragraph (4).

 

(6) Dalam hal tidak ada kegiatan pada lahan terganggu sebagaimana dimaksud pada ayat (5) & pada wilayah tersebut direncanakan untuk dilanjutkan kegiatan penambangan kembali, pemegang IUP Operasi Produksi & IUPK Operasi Produksi wajib melakukan kegiatan Reklamasi tahap Operasi Produksi dalam rangka pengendalian kualitas air permukaan, erosi, & sedimentasi.

(6) In case there is no activity on disturbed land referred to in paragraph (5) & in the region planned to resume mining operations return, holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation required to conduct Reclamation activities of stage of Production Operation in order to control the quality of surface water, erosion, & sedimentation.

 

Pasal 44

Article 44

 

(1) Dalam hal area yang sudah direklamasi akan dibuka kembali untuk mendapat persetujuan dari direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya.

(1) In the case of reclaimed area will be reopened to the approval of the director general on behalf of the minister, governor or Regent/mayor in accordance with their authority.

 

(2) Rencana kegiatan Pertambangan sebagaimana dimaksud pada ayat (1) wajib memperhitungkan nilai keekonomian Reklamasi yang telah dilaksanakan.

(2) Plan for Mining activities referred to in paragraph (1) shall take into account the economic value of Reclamation that have been implemented.

 

Bagian Ketiga

Part Three

 

Pelaksanaan Pascatambang

Implementation of the Mine Closure

 

Pasal 45

Article 45

 

Pemegang IUP Operasi Produksi & IUPK Operasi Produksi wajib melaksanakan Pascatambang sebagaimana dimaksud dalam Pasal 25 & Pasal 26 paling lambat 30 (tiga puluh) hari kalender setelah kegiatan Penambangan, pengolahan, dan/atau pemurnian berakhir sesuai dengan rencana Pascatambang yang telah disetujui.

Holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operations shall implement Post-Mining as referred to in Article 25 & Article 26, no later than thirty (30) calendar days following activities of Mining, processing, and/or purification ended in accordance with the Mine Closure plan that has been approved.

Pelaporan Reklamasi Tahap Eksplorasi & Pencairan Jaminan Reklamasi Tahap Eksplorasi

Reporting Reclamation of Phase of Exploration & Liquefaction of Exploration Phase Reclamation Guarantee

 

Pasal 46

Article 46

 

(1) Pemegang IUP Eksplorasi & IUPK Eksplorasi wajib menyampaikan laporan pelaksanaan Reklamasi tahap Eksplorasi setiap 1 (satu) tahun kepada menteri melalui direktur jenderal, gubernur, atau Bupati/walikota sesuai dengan kewenangannya.

(1) Holders of The Mining Permit of Exploration & The Especially Mining Permit of Exploration shall submit reports on the implementation of Reclamation of Exploration stage every 1 (one) year to the minister through the director general, governor or Regent/mayor in accordance with their authority.

 

(2) Laporan pelaksanaan Reklamasi tahap Eksplorasi sebagaimana dimaksud pada ayat (1) disertai dengan permohonan pencairan Jaminan Reklamasi tahap Eksplorasi.

(2) The report on the implementation of Reclamation of Exploration phase referred to in paragraph (1) accompanied by a request for disbursement of Reclamation Guarantee of Exploration stage.

 

(3) Laporan sebagaimana dimaksud pada ayat (1) disusun sesuai dengan Pedoman Penyusunan Laporan Pelaksanaan Reklamasi Tahap Eksplorasi sebagaimana tercantum dalam Lampiran V yang merupakan bagian tidak terpisahkan dari Peraturan Menteri ini.

(3) The report referred to in paragraph (1) shall be prepared in accordance with Preparation Guidelines of Implementation Report of Reclamation of Phase of Exploration as listed in Annex V, which is an integral part of this regulation.

 

Pasal 47

Article 47

 

(1) Direktur jenderal atas nama Menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya memberikan persetujuan pencairan Jaminan Reklamasi tahap Eksplorasi dalam jangka waktu paling lama 30 (tiga puluh) hari kalender setelah diterimanya laporan sebagaimana dimaksud dalam Pasal 46.

(1) The Director General on behalf of the minister, governor or Regent/mayor in accordance with the authority to approve the disbursement of Reclamation Guarantee of Exploration stage in a period of 30 (thirty) calendar days after receipt of the report referred to in Article 46.

 

(2) Direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya sebelum memberikan persetujuan pencairan Jaminan Reklamasi tahap Eksplorasi sebagaimana dimaksud pada ayat (1) wajib melakukan evaluasi terhadap laporan pelaksanaan Reklamasi tahap Eksplorasi.

(2) The Director General on behalf of the minister, governor or Regent/mayor in accordance with the authority before approving disbursement of Reclamation Guarantee of Exploration phase referred to in paragraph (1) shall carry out an evaluation of the implementation reports of Reclamation of Exploration phase.

 

(3) Evaluasi sebagaimana dimaksud pada ayat (2) dilaksanakan dengan berpedoman pada Kriteria Keberhasilan Reklamasi Tahap Eksplorasi sebagaimana tercantum dalam Lampiran VI yang merupakan bagian tidak terpisahkan dari Peraturan Menteri ini.

(3) The evaluation referred to in paragraph (2) is guided by the Success Criteria of Reclamation of Phase of Exploration as listed in Annex VI which is an integral part of this Ministers Regulation.

 

Pasal 48

Article 48

 

(1) Direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya sebelum memberikan persetujuan pencairan Jaminan Reklamasi tahap Eksplorasi, selain melakukan evaluasi sebagaimana dimaksud dalam Pasal 47 ayat (2), melakukan penilaian untuk pencairan Jaminan Reklamasi tahap Eksplorasi.

(1) The Director General on behalf of the minister, governor or Regent/mayor in accordance with the authority before approving disbursement of Reclamation Guarantee of Exploration phase, in addition to the evaluation referred to in Article 47 paragraph (2), make an assessment to the disbursement of Reclamation Guarantee of Exploration phase.

 

(2) Pencairan Jaminan Reklamasi tahap Eksplorasi sebagaimana dimaksud ayat (1) hanya dapat dilakukan setelah hasil penilaian mencapai 100 % (seratus persen) sesuai dengan Pedoman Penilaian Reklamasi tahap Eksplorasi sebagaimana tercantum dalam Lampiran VII yang merupakan bagian tidak terpisahkan dari Peraturan Menteri ini.

(2) Disbursement of Reclamation Guarantee of Exploration phase referred to in paragraph (1) may only be made after an assessment of 100% (one hundred percent) in accordance with the Guidelines for Assessment of Reclamation of phase of Exploration as listed in Annex VII which is an integral part of this Ministers Regulation.

 

Pasal 49

Article 49

 

(1) Direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya dalam melakukan penilaian pencairan Jaminan Reklamasi tahap Eksplorasi sebagaimana dimaksud dalam Pasal 48 dapat melakukan peninjauan lapangan.

(1) The Director General on behalf of the minister, governor or Regent/mayor in accordance with its authority in assessing the disbursement of Reclamation Guarantee of Exploration stage as referred to in Article 48 can carry out a review of the field.

 

(2) Peninjauan lapangan sebagaimana dimaksud pada ayat (1) dilakukan setelah penyusunan dokumen Studi Kelayakan selesai.

(2) A review of the field referred to in paragraph (1) shall be done after the preparation of the Feasibility Study document completed.

 

(3) Hasil peninjauan lapangan sebagaimana dimaksud pada ayat (1) harus dibuat dalam Berita Acara yang memuat Penilaian Keberhasilan Reklamasi Tahap Eksplorasi sebagaimana tercantum dalam Lampiran VIII yang merupakan bagian tidak terpisahkan dari Peraturan Menteri ini.

(3) Results of field survey referred to in paragraph (1) shall be made in the Minutes that contains The Success Rate of Reclamation of Phase of Exploration as listed in Annex VIII which is an integral part of this Minister's Regulation.

 

Paragraf 2

Paragraph 2

 

Pelaporan Reklamasi Tahap Operasi Produksi & Pencairan Jaminan Reklamasi Tahap Operasi Produksi

Reporting Reclamation of Phase of Production Operations & Disbursement of Reclamation Guarantee of Phase of Production Operations

 

Pasal 50

Article 50

 

(1) Pemegang IUP Operasi Produksi & IUPK Operasi Produksi wajib menyampaikan laporan kegiatan pelaksanaan kegiatan Reklamasi tahap Operasi Produksi setiap 1 (satu) tahun kepada menteri melalui direktur jenderal, gubernur, atau Bupati/walikota sesuai dengan kewenangannya.

(1) Holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation shall submit report on activities of the implementation of reclamation of phase of Production Operations for every 1 (one) year to the minister through the director general, governor or Regent/mayor in accordance with their authority.

 

(2) Laporan kegiatan pelaksanaan kegiatan Reklamasi tahap Operasi Produksi sebagaimana dimaksud pada ayat (1) disertai dengan permohonan pencairan atau pelepasan Jaminan Reklamasi tahap Operasi Produksi.

(2) The report on the implementation of Reclamation activities of stage of Production Operation as referred to in paragraph (1) accompanied by a request for disbursement or release of Reclamation Guarantee of stages of Production Operation.

 

(3) Laporan sebagaimana dimaksud pada ayat (1) disusun sesuai dengan Pedoman Penyusunan Laporan Pelaksanaan Reklamasi Tahap Operasi Produksi sebagaimana tercantum dalam Lampiran IX yang merupakan bagian tidak terpisahkan dari Peraturan Menteri ini.

(3) The report referred to in paragraph (1) shall be prepared accorded with The Preparation Guidelines of Implementation Report of Reclamation of Phase of Production Operations as contained in Annex IX which is an integral part of this Ministers Regulation.

 

Pasal 51

Article 51

 

(1) Direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya memberikan persetujuan pencairan atau pelepasan Jaminan Reklamasi tahap Operasi Produksi dalam jangka waktu paling lama 30 (tiga puluh) hari kalender setelah diterimanya laporan sebagaimana dimaksud dalam Pasal 50.

(1) The Director General on behalf of the minister, governor or Regent/mayor in accordance with the authority to approve the disbursement or release of Reclamation Guarantee of stages of Production Operation within a maximum period of 30 (thirty) calendar days after receipt of the report referred to in Article 50.

 

(2) Direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya sebelum memberikan persetujuan pencairan atau pelepasan Jaminan Reklamasi tahap Operasi Produksi sebagaimana dimaksud pada ayat (1) wajib melakukan evaluasi terhadap laporan pelaksanaan Reklamasi tahap Operasi Produksi.

(2) The Director General on behalf of the minister, governor or Regent/mayor in accordance with the authority before granting approval of liquefaction or release of Reclamation Guarantee of stage of Production Operation as referred to in paragraph (1) shall carry out an evaluation of the report of implementation of Reclamation of stage of Production Operation.

 

(3) Evaluasi sebagaimana dimaksud pada ayat (2) dilaksanakan dengan berpedoman pada Kriteria Keberhasilan Reklamasi Tahap Operasi Produksi sebagaimana tercantum dalam Lampiran X yang merupakan bagian tidak terpisahkan dari Peraturan Menteri ini.

(3) The evaluation referred to in paragraph (2) is guided by the criteria for success of Reclamation of Phase of Production Operations as contained in Annex X which is an integral part of this Ministers Regulation.

 

Pasal 52

Article 52

 

(1) Permohonan pencairan jaminan Reklamasi tahap Operasi Produksi sebagaimana dimaksud dalam Pasal 50 dilakukan terhadap Jaminan Reklamasi tahap Operasi Produksi dalam bentuk Rekening Bersama & Deposito Bersama berikut bunganya.

(1) Application of disbursement of guarantee of reclamation of stage of Production Operation as referred to in Article 50 performed on The Reclamation Guarantee of stage of Production Operation in the form of Joint Account & Deposit Together with interest.

 

(2) Permohonan pelepasan jaminan Reklamasi tahap Operasi Produksi sebagaimana dimaksud dalam Pasal 50 dilakukan terhadap jaminan Reklamasi tahap Operasi Produksi dalam bentuk Bank Garansi & Cadangan Akuntansi (Accounting Reserve).

(2) Application for release of collateral of Reclamation of stage of Production Operation as referred to in Article 50 is done to guarantee of Reclamation of stage of Production Operation in the form of Guarantee Bank & Accounting Reserve.

 

Pasal 53

Article 53

 

(1) Direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya sebelum memberikan persetujuan pencairan atau pelepasan Jaminan Reklamasi tahap Operasi Produksi, selain melakukan evaluasi sebagaimana dimaksud dalam Pasal 51, melakukan penilaian untuk pencairan atau pelepasan Jaminan Reklamasi tahap Operasi Produksi.

(1) The Director General on behalf of the minister, governor or Regent/mayor in accordance with the authority before granting approval of liquefaction or release of Reclamation Guarantee of stage of Production Operation, in addition to the evaluation referred to in Article 51, take measures to the disbursement or release of Reclamation Guarantee of phase of Production Operations.

 

(2) Penilaian penentuan besaran pencairan atau pelepasan jaminan Reklamasi tahap Operasi Produksi sebagaimana dimaksud pada ayat (1) ditentukan :

(2) the determination of the amount of disbursement or release of collateral of Reclamation of stage of Production Operation as referred to in paragraph (1) is determined :

 

a. Paling banyak 60% (enam puluh persen) dari besaran Jaminan Reklamasi tahap Operasi Produksi apabila telah selesai melaksanakan penatagunaan lahan yang terdiri atas :

a. At most 60% (sixty percent) of the amount of Reclamation Guarantee of stages of Production Operation if it has completed consisting the land use of :

 

1. Penataan permukaan tanah & penimbunan kembali lahan bekas tambang;

1. Structuring the surface ground & backfilling of mined land;

 

2. Penyebaran tanah zona pengakaran;

2. Spread of the soil of rooting zone;

 

3. Pengendalian erosi & pengelolaan air,

sesuai dengan peruntukannya sebagaimana ditetapkan dalam rencana Reklamasi tahap Operasi Produksi yang telah disetujui.

3. Control of erosion & water management, according to its purpose as set out in the plan of Reclamation of stage of Production Operation which has been approved.

 

b. Paling banyak 80% (delapan puluh persen) dari besaran Jaminan Reklamasi tahap Operasi Produksi apabila telah selesai melaksanakan kegiatan sebagaimana dimaksud pada huruf a & pekerjaan revegetasi yang terdiri atas :

b. At most 80% (eighty percent) of the amount of Reclamation Guarantee of stages of Production Operation has been completed when carrying out the activities referred to in paragraphs a and revegetation work consisting of :

   

1. Penanaman tanaman penutup (cover crops);

1. Planting cover crops;

 

2. Penanaman tanaman cepat tumbuh;

2. Planting fast growing plants;

 

3. Penanaman tanaman jenis lokal; dan/atau

3. Planting plants of local species; and/or

 

4. Pengendalian air asam tambang,

4. Control of mine acid drainage,

 

sebagaimana ditetapkan dalam rencana Reklamasi tahap Operasi produksi yang disetujui.

as defined in the reclamation plan of stage of Production Operation approved.

 

c. 100% (seratus persen) dari besaran Jaminan Reklamasi tahap Operasi Produksi setelah kegiatan Reklamasi tahap Operasi Produksi memenuhi penyelesaian akhir,

c. 100% (one hundred percent) of the amount of Reclamation Guarantee of stage of Production Operation after stage of Reclamation activities of stage of Production Operation meet the final settlement,

Pasal 54

Article 54

 

(1) Direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya dalam melakukan penilaian pencairan atau pelepasan Jaminan Reklamasi tahap Operasi Produksi sebagaimana dimaksud dalam Pasal 53 wajib melakukan peninjauan lapangan.

(1) The Director General on behalf of the minister, governor or Regent/mayor in accordance with its authority in assessing the disbursement or release of Reclamation Guarantee of stages of Production Operation as referred to in Article 53 shall carry out a review of the field.

 

(2) Peninjauan lapangan sebagaimana dimaksud pada ayat (1) dilakukan paling lambat 15 (lima belas) hari kalender setelah diterimanya laporan pelaksanaan Reklamasi tahap Operasi Produksi.

(2) A review of the field referred to in paragraph (1) shall be done no later than 15 (fifteen) calendar days after receipt of the report of Reclamation of stage of Production Operation.

 

(3) Hasil peninjauan lapangan sebagaimana dimaksud pada ayat (1) harus dibuat dalam berita acara yang memuat penilaian keberhasilan Reklamasi tahap Operasi Produksi sebagaimana tercantum dalam Lampiran XII yang merupakan bagian tidak terpisahkan dari Peraturan Menteri ini.

(3) Results of field survey referred to in paragraph (1) shall be made in the official report which includes assessing the success of Reclamation of stage of Production Operation as specified in Annex XII which is an integral part of this Ministers Regulation.

 

Pasal 55

Article 55

 

(1) Dalam hal penilaian keberhasilan Reklamasi tahap Operasi Produksi sebagaimana dimaksud dalam Pasal 53 belum mencapai 100% (seratus persen), besaran nilai pencairan atau pelepasan Jaminan Reklamasi tahap Operasi Produksi disesuaikan dengan hasil penilaian di lapangan.

(1) In terms of assessing the success of Reclamation of stage of Production Operation as referred to in Article 53 has not reached 100% (one hundred percent), the amount of the value of the disbursement or release of Reclamation Guarantee of stages of Production Operation adjusted to the results of the assessment in the field.

 

(2) Besaran sisa Jaminan Reklamasi tahap Operasi Produksi yang belum dapat dicairkan atau dilepaskan wajib ditempatkan kembali sebagai Jaminan Reklamasi tahap Operasi Produksi.

(2) The amount of residual of Reclamation Guarantee of stages of Production Operation that can not be melted or removed must be placed back as Reclamation Guarantee stage Production Operation.

 

Bagian Kedua

Part Two

 

Pelaporan Pascatambang & Pencairan Jaminan Pascatambang

Reporting Mine Closure & Liquidation of Mine Closure Guarantee

 

Pasal 56

Article 56

 

(1) Pemegang IUP Operasi Produksi & IUPK Operasi Produksi wajib menyampaikan laporan pelaksanaan kegiatan Pascatambang setiap triwulan kepada menteri melalui direktur jenderal, gubernur, atau Bupati/walikota sesuai dengan kewenangannya.

(1) Holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation shall submit report on implementation of the Mine Closure every three months to the minister through the director general, governor or Regent/mayor in accordance with their authority.

 

(2) Laporan pelaksanaan kegiatan Pascatambang sebagaimana dimaksud pada ayat (1) disertai dengan permohonan pencairan Jaminan Pascatambang.

(2) The report on the implementation of the Post-Mining activities referred to in paragraph (1) accompanied by a request for disbursement of Post-Mining Warranty.

 

(3) Permohanan pencairan jaminan Pascatambang sebagaimana dimaksud pada ayat (2) beikut bunganya berisi rincian program & rencana biaya Pascatambang yang telah dilaksanakan & yang akan dilaksanakan pada triwulan berikutnya berdasarkan rencana Pascatambang yang telah disetujui.

(3) Request of the disbursement of Mine Closure guarantee referred to in paragraph (2) with the interest contains details of the program & the cost of Mine Closure plans have been implemented and to be implemented in the next quarter based on Mine Closure plan that has been approved.

 

(4) Laporan sebagaimana dimaksud pada ayat (1) disusun sesuai dengan Pedoman Penyusunan Laporan Triwulan Pelaksanaan Pascatambang sebagaimana tercantum dalam Lampiran XIII yang merupakan bagian tidak terpisahkan dari Peraturan Menteri ini.

(4) The report referred to in paragraph (1) shall be prepared in accordance with the Guidelines for Preparation of Quarterly Report of Implementation of Post-Mining as set out in Annex XIII, which is an integral part of this Ministers Regulation.

 

Pasal 57

Article 57

 

(1) Direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya memberikan persetujuan pencairan Jaminan Pascatambang dalam jangka waktu paling lama 30 (tiga puluh) hari kalender setelah diterimanya laporan sebagaimana dimaksud dalam Pasal 56.

(1) The Director General on behalf of the minister, governor or Regent/mayor in accordance with the authority to approve the disbursement of the Mine Closure guarantee in a maximum period of 30 (thirty) calendar days after receipt of the report referred to in Article 56.

 

(2) Direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya sebelum memberikan persetujuan pencairan Jaminan Pascatambang sebagaimana dimaksud pada ayat (1) wajib melakukan evaluasi terhadap laporan pelaksanaan Pascatambang.

(2) The Director General on behalf of the minister, governor or Regent/mayor in accordance with the authority before approving disbursement of Mine Closure Assurance referred to in paragraph (1) shall carry out an evaluation of the implementation of the Mine Closure report.

 

(3) Evaluasi sebagaimana dimaksud pada ayat (2) dilaksanakan dengan berpedoman pada Kriteria Keberhasilan Pascatambang sebagaimana tercantum dalam Lampiran XIV yang merupakan bagian tidak terpisahkan dari Peraturan Menteri ini.

(3) The evaluation referred to in paragraph (2) is guided by the Success Criteria of the Mine Closure Criteria as stated in Annex XIV which is an integral part of this Ministers Regulation.

 

Pasal 58

Article 58

 

(1) Direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya sebelum memberikan persetujuan pencairan Jaminan Pascatambang berikut bunganya, selain melakukan evaluasi sebagaimana dimaksud dalam Pasal 57, melakukan penilaian untuk pencairan Jaminan Pascatambang.

(1) The Director General on behalf of the minister, governor or Regent/mayor in accordance with the authority before approving disbursement of Post-Mining Security with interest, in addition to the evaluation referred to in Article 57, take measures to the disbursement of guarantee of Mine Closure.

 

(2) Direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya hanya dapat memberikan persetujuan pencairan Jaminan Pascatambang berikut bunganya sebagaimana dimaksud pada ayat (1) sesuai dengan Pedoman Penilaian Pascatambang sebagaimana tercantum dalam Lampiran XV yang merupakan bagian tidak terpisahkan dari Peraturan Menteri ini.

(2) The Director General on behalf of the minister, governor or Regent/mayor in accordance with their authority can only approve the disbursement of Post-Mining Security following interest referred to in paragraph (1) in accordance with the Assessment Guidelines of Mine Closureas set out in Annex XV which is an integral part of this Minister's Regulation.

 

Pasal 59

Article 59

 

(1) Direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya dalam melakukan penilaian Jaminan Pascatambang sebagaimana dimaksud dalam Pasal 58 wajib melakukan peninjauan lapangan.

(1) The Director General on behalf of the minister, governor or Regent/mayor in accordance with its authority in assessing the Mine Closure Security referred to in Article 58 shall carry out a review of the field.

 

(2) Peninjauan lapangan sebagaimana dimaksud pada ayat (1) dilakukan paling lambat 15 (lima belas) hari kalender setelah diterimanya laporan pelaksanaan Pascatambang.

(2) A review of the field referred to in paragraph (1) shall be done no later than 15 (fifteen) calendar days after receipt of the report the implementation of the Mine Closure.

 

(3) Hasil peninjauan lapangan sebagaimana dimaksud pada ayat (1) harus dibuat dalam berita acara yang memuat penilaian keberhasilan pelaksanaan Pascatambang sebagaimana tercantum dalam Lampiran XVI yang merupakan bagian tidak terpisahkan dari Peraturan Menteri ini.

(3) Results of field survey referred to in paragraph (1) shall be made in the official report containing the successful assessment of implementation of the Post-Mining as contained in Annex XVI which is an integral part of this Minister's Regulation.

 

Pasal 60

Article 60

 

(1) Dalam hal pemegang IUP Operasi Produksi & IUPK Operasi Produksi tidak memenuhi kriteria keberhasilan pelaksanaan Pascatambang berdasarkan evaluasi laporan & penilaian lapangan kurang dari 80% (delapan puluh persen) setelah berakhirnya jangka waktu kegiatan Pascatambang, pemegang IUP Operasi Produksi & IUPK Operasi Produksi dapat mengajukan permohonan perpanjangan waktu untuk menyelesaikan kegiatan Pascatambang kepada menteri melalui direktur jenderal, gubernur, atau Bupati/walikota sesuai dengan kewenangannya.

(1) In the case of holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation not meet the criteria for successful of implementation of the Mine Closure is based on evaluation reports & field assessments of less than 80% (eighty percent) after the expiry of the term of Post-Mining activities, holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation can apply for an extension of time to complete the Post-Mining activities to the minister through the director general, governor or Regent/mayor in accordance with their authority.

 

(2) Direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya memberikan persetujuan perpanjangan waktu sebagaimana dimaksud pada ayat (2) paling lama 2 (dua) tahun sejak berakhirnya kegiatan Pascatambang.

(2) The Director General on behalf of the minister, governor or Regent/mayor in accordance with the authority to approve an extension of time referred to in subsection (2) no later than 2 (two) years since the end of the Post-Mining activities.

 

(3) Pemegang IUP Operasi Produksi & IUPK Operasi Produksi tidak dapat diberikan sisa Jaminan Pascatambang selama jangka waktu perpanjangan sebagaimana dimaksud pada ayat (2).

(3) Holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation can not be given the rest of the Post-Mining Warranty during the extension period referred to in paragraph (2).

 

(4) Pemegang IUP Operasi Produksi & IUPK Operasi Produksi hanya dapat diberikan pencairan sisa Jaminan Pascatambang apabila telah mencapai penilaian keberhasilan 100% (seratus persen).

(4) Holders of The Mining Permit of Production Operation & The Especially Mining of Production Operation can only be granted of the disbursement of the rest of the Post-Mining Security has achieved ratings success of 100% (one hundred percent).

 

Bagian Ketiga

Part Three

 

Penetapan Pihak Ketiga

Determination of Third Party

 

Pasal 61

Article 61

 

(1) Dalam hal pemegang IUP Eksplorasi & IUPK Eksplorasi tidak memenuhi kriteria keberhasilan pelaksanaan Reklamasi tahap Eksplorasi berdasarkan evaluasi laporan & peninjauan lapangan sebagaimana dimaksud dalam Pasal 47 & Pasal 49, direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya menetapkan pihak ketiga untuk melaksanakan Reklamasi tahap Eksplorasi dengan menggunakan Jaminan Reklamasi tahap Eksplorasi.

(1) In the event the holder of The Mining Permit of Exploration & The Especially Mining Permit of Exploration not meet the criteria for successful of implementation of The Reclamation of phase of exploration based on the evaluation of report & review of the field as referred to in Article 47 and Article 49, the director general on behalf of the minister, governor or Regent/mayor in accordance with the authority set a third party to carry out The Reclamation of exploration phase using The Reclamation Guarantee of exploration stage.

 

(2) Dalam hal pemegang IUP Operasi Produksi & IUPK Operasi Produksi tidak memenuhi kriteria keberhasilan pelaksanaan Reklamasi tahap Operasi Produksi berdasarkan evaluasi laporan & peninjauan lapangan sebagaimana dimaksud dalam Pasal 51 & Pasal 54, direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya menetapkan pihak ketiga untuk melaksanakan Reklamasi tahap Operasi Produksi dengan menggunakan Jaminan Reklamasi tahap Operasi Produksi.

(2) In the event that holders of of The Mining Permit of Production Operation & The Mining Permit of Production Operation not meet the criteria for successful of implementation of The Reclamation of stage of Production Operation based on the evaluation report & review of the field as referred to in Article 51 & Article 54, the director general on behalf of the minister, governor or Regent/mayor in accordance with the authority set a third party to carry out The reclamation of stage of Production Operation using Reclamation Guarantee of stages of production operation.

 

(3) Penetapan pihak ketiga sebagaimana dimaksud pada ayat (1) & ayat (2) dilakukan apabila setelah 2 (dua) tahun periode penilaian berturut-turut, pelaksanaan Reklamasi belum mencapai keberhasilan 60% (enam puluh persen).

(3) The third party referred to in paragraph (1) & paragraph (2) done if the following two (2) year period of consecutive assessment, implementation of Reclamation has not reached the success of 60% (sixty percent).

 

(4) Penetapan pihak ketiga sebagaimana dimaksud pada ayat (1), ayat (2), & ayat (3) dilakukan dengan cara :

(4) Determination of third parties referred to in paragraph (1), paragraph (2), & paragraph (3) is done by :

 

a. Pemegang IUP Eksplorasi, IUP Operasi Produksi, IUPK Eksplorasi, & IUPK Operasi Produksi wajib mengusulkan pihak ketiga yang memiliki Izin Usaha Jasa Pertambangan di bidang Pascatambang & Reklamasi kepada menteri melalui direktur jenderal, gubernur, atau Bupati/walikota sesuai dengan kewenangannya; dan

a. Holders of The Mining Permit of Exploration, The Mining Permit of Production Operation, The Especially Mining Permit of Exploration & The Especially Mining Permit of Production Operations must propose a third party who has a Mining Service Permit in Mine Closure & Reclamation to the minister through the director general, governor or Regent/mayor in accordance with their authority; and

 

b. Direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya melakukan evaluasi untuk menetapkan pihak ketiga.

b. Director General on behalf of the minister, governor or Regent/mayor in accordance with the authority doing evaluation to establish a third-party.

 

Pasal 62

Article 62

 

(1) Dalam hal pemegang IUP Operasi Produksi & IUPK Operasi Produksi tidak memenuhi kriteria keberhasilan pelaksanaan Pascatambang berdasarkan evaluasi laporan & peninjauan lapangan sebagaimana dimaksud dalam Pasal 57 & Pasal 59 kurang dari 60% (enam puluh persen) sampai berakhirnya periode pelaksanaan Pascatambang, direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya menetapkan pihak ketiga untuk melaksanakan Pascatambang.

(1) In the case of holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation not meet the criteria for successful of implementation of the Post-Mining based on evaluation report & review of the field as referred to in Article 57 & Article 59 of less than 60% (sixty percent) until the expiration of the period of implementation of the Mine Closure, director general on behalf of the minister, governor or Regent/mayor in accordance with the authority set a third party to implement the Mine Closure.

 

(2) Penetapan pihak ketiga sebagaimana dimaksud pada ayat (1) dilakukan dengan cara :

(2) The third party referred to in subsection (1) is done by :

 

a. Pemegang IUP Operasi Produksi & IUPK Operasi Produksi sebagaimana wajib mengusulkan pihak ketiga yang memiliki Izin Usaha Jasa Pertambangan di bidang Pascatambang & Reklamasi kepada menteri melalui direktur jenderal, gubernur, atau Bupati/walikota sesuai dengan kewenangannya; dan

a. Holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation as must propose a third party who has a Mining Service Permit in Mine Closure & Reclamation to the minister through the director general, governor or Regent/mayor in accordance with their authority; and

 

b. Direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya melakukan evaluasi untuk menetapkan pihak ketiga.

b. Director General on behalf of the minister, governor or Regent/mayor in accordance with the authority doing evaluation to establish a third-party.

 

Pasal 63

Article 63

 

Pemegang IUP Operasi Produksi & IUPK Operasi Produksi dilarang melakukan kegiatan Penambangan sebelum Reklamasi yang dilakukan oleh pihak ketiga sebagaimana dimaksud dalam Pasal 61 dinyatakan mencapai penilaian keberhasilan Reklamasi paling sedikit 80% (delapan puluh persen) oleh direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya.

Holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation prohibited conduct Mining activities before Reclamation is done by a third party as referred to in Article 61 stated achieving success ratings of Reclamation at least 80% (eighty percent) by the director general on behalf of the minister, governor or Regent/mayor in accordance with their authority.

 

BAB VIII

PENYERAHAN LAHAN REKLAMASI

CHAPTER VIII

DELIVERY OF LAND RECLAMATION

 

Pasal 64

Article 64

 

(1) Pemegang IUP Operasi Produksi atau IUPK Operasi Produksi yang telah melakukan Reklamasi tahap Operasi Produksi wajib menyerahkan lahan yang telah direklamasi kepada pihak yang berhak sesuai dengan ketentuan peraturan perundang-undangan melalui direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya setelah memenuhi :

(1) Holders of The Mining Permit of Production Operation or The Especially Mining Permit of Production Operation  who has conducted Reclamation of stage of Production Operation shall give the land that has been reclaimed to the party entitled in accordance with the provisions of the legislation by the director general on behalf of the minister, governor or Regent/mayor in accordance with authority after the meet :

 

a. Prinsip-prinsip perlindungan & pengelolaan lingkungan hidup, keselamatan & kesehatan kerja, & konservasi mineral & batubara sebagaimana dimaksud dalam Pasal 2; dan

a. The principles of protection & management of the environment, safety & occupational health,  conservation of mineral & coal as defined in Article 2; and

 

b. Penilaian keberhasilan Reklamasi 100% (seratus persen) sebagaimana tercantum dalam Lampiran XI yang merupakan bagian tidak terpisahkan dari Peraturan Menteri ini.

b. Ratings success of Reclamation in 100% (one hundred percent) as listed in Annex XI which is an integral part of this Ministers Regulation.

 

(2) Pemegang IUP Operasi Produksi & IUPK Operasi Produksi sebelum menyerahkan lahan sebagaimana dimaksud pada ayat (1) harus mengajukan permohonan kepada menteri melalui direktur jenderal, gubernur, atau Bupati/walikota sesuai dengan kewenangannya untuk mendapatkan persetujuan penyerahan lahan reklamasi.

(2) Holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation before handing over the land referred to in paragraph (1) shall apply to the minister through the director general, governor or Regent/mayor in accordance with the authority for approval of reclaimed land handover.

 

(3) Penyerahan lahan sebagaimana dimaksud pada ayat (1) merupakan bagian dari rencana Pascatambang atas WIUP Operasi Produksi & WIUPK Operasi Produksi.

(3) Submission of land referred to in paragraph (1) is part of a plan on Post-Mining of The Area of Mining Permit of Production Operations & The Area of Especially Mining Permit of Production Operations.

 

(4) Direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya wajib melakukan peninjauan lapangan sebelum memberikan persetujuan penyerahan lahan yang telah direklamasi.

(4) The Director General on behalf of the minister, governor or Regent/mayor in accordance with the authority required to conduct a review of the field before giving consent to handing over land that has been reclaimed.

 

(5) Hasil peninjauan lapangan sebagaimana dimaksud pada ayat (4) wajib dituangkan dalam bentuk berita acara.

(5) Results of field survey referred to in paragraph (4) shall be set out in the form of minute.

 

(6) Direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya memberikan persetujuan penyerahan lahan reklamasi sebagaimana dimaksud pada ayat (1) dalam jangka waktu paling lama 60 (enam puluh) hari sejak diterimanya permohonan penyerahan lahan reklamasi.

(6) The Director General on behalf of the minister, governor or Regent/mayor in accordance with the authority to approve the delivery of reclaimed land as referred to in paragraph (1) within a maximum period of 60 (sixty) days of receipt of the request submission of reclaimed land.

 

(7) Tanggung jawab pemeliharaan & pemantauan lahan yang telah direklamasi oleh pemegang IUP Operasi Produksi & IUPK Operasi Produksi dinyatakan berakhir setelah direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya memberikan persetujuan penyerahan lahan yang telah direklamasi sebagaimana dimaksud pada ayat (6).
(7) The responsibility of maintenance & monitoring of land that has been reclaimed by the holders of The Mining Permit of Production Operation & The Mining Permit of Production Operation declared ended after the director-general on behalf of the minister, governor or Regent/mayor in accordance with the authority to approve the delivery of land that has been reclaimed as referred to in paragraph (6).

 

BAB IX

PENYERAHAN LAHAN PASCATAMBANG

CHAPTER IX

DELIVERY post-mining land

 

Pasal 65

Article 65

 

(1) Pemegang IUP Operasi Produksi & IUPK Operasi Produksi yang telah selesai melaksanakan Pascatambang wajib menyerahkan lahan Pascatambang kepada pihak yang berhak sesuai dengan ketentuan peraturan perundang-undangan melalui direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya setelah memenuhi :

(1) Holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation who have completed the Mine Closure shall submit land of Mine Closure to the parties entitled in accordance with the provisions of the legislation by the director general on behalf of the minister, governor or Regent/mayor in accordance with their authority after the meet :

a. Prinsip-prinsip perlindungan & pengelolaan lingkungan hidup, keselamatan & kesehatan kerja, & konservasi mineral & batubara sebagaimana dimaksud dalam Pasal 2;

a. The principles of protection and management of the environment, safety & occupational health, & conservation of mineral and coal as defined in Article 2;

 

b. Penilaian keberhasilan Pascatambang 100% (seratus persen) sebagaimana tercantum dalam Lampiran XIV yang merupakan bagian tidak terpisahkan dari Peraturan Menteri ini.

b. Ratings success of Mine Closure 100% (one hundred percent) as listed in Annex XIV which is an integral part of this Minister's Regulation.

 

(2) Pemegang IUP Operasi Produksi & IUPK Operasi Produksi sebelum menyerahkan lahan sebagaimana dimaksud pada ayat (1) harus mengajukan permohonan untuk mendapatkan persetujuan penyerahan lahan Pascatambang.

(2) Holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation before handing over the land referred to in subsection (1) must apply for approval of handover land of Mine Closure.

 

(3) Penyerahan lahan sebagaimana dimaksud pada ayat (1) merupakan keseluruhan dari Pascatambang di seluruh WIUP Operasi Produksi & WIUPK Operasi Produksi.

(3) Submission of land referred to in paragraph (1) is a whole of Post-Mining of all of The Area of Mining Permit of Operation Production & The Area of Mining Permit of Production Operation.

 

(4) Direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya memberikan persetujuan penyerahan lahan yang telah dilakukan Pascatambang.

(4) The Director General on behalf of the minister, governor or Regent/mayor in accordance with the authority to approve the delivery of land that has been done of Mine Closure.

 

(5) Hasil peninjauan lapangan sebagaimana dimaksud pada ayat (4) wajib dituangkan dalam bentuk berita acara.

(5) Results of field survey referred to in paragraph (4) shall be set out in the form of Minute.

 

(6) Direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya memberikan persetujuan penyerahan lahan Pascatambang sebagaimana dimaksud pada ayat (1) dalam jangka waktu paling lama 60 (enam puluh) hari sejak diterimanya permohonan penyerahan lahan Pascatambang.

(6) The Director General on behalf of the minister, governor or Regent/mayor in accordance with the authority to approve the delivery of Mine Closure land referred to in paragraph (1) within a maximum period of 60 (sixty) days from the receipt of the application of submission of Mine Closure land.

 

(7) Tanggung jawab pemeliharaan & pemantauan lahan yang telah direklamasi oleh pemegang IUP Operasi Produksi atau IUPK Operasi Produksi dinyatakan berakhir setelah direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya memberikan persetujuan penyerahan lahan yang telah direklamasi sebagaimana dimaksud pada ayat (6).

(7) The responsibility of maintenance & monitoring of land that has been reclaimed by the holders of The Mining Permit of Production Operation or The Especially Mining Permit of Production Operation declared ended after the director-general on behalf of the minister, governor or Regent/mayor in accordance with the authority to approve the delivery of land that has been reclaimed as referred to in paragraph (6).

 

Pasal 66

Article 66

 

(1) IUP Operasi Produksi & IUPK Operasi Produksi yang telah berakhir masa berlakunya, tidak menghilangkan kewajiban pemegang IUP Operasi Produksi & IUPK Operasi Produksi untuk melaksanakan Pascatambang.

(1) The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation which has expired, does not eliminate the obligation of holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation to implement the Mine Closure.

 

(2) Dalam rangka pelaksanaan Pascatambang sebagaimana dimaksud pada ayat (1), direktur jenderal atas nama menteri, gubernur, atau Bupati/walikota sesuai dengan kewenangannya menerbitkan surat mengenai pelaksanaan Pascatambang kepada pemegang IUP Operasi Produksi & IUPK Operasi Produksi.

(2) In the framework of the implementation of the Post-Mining referred to in paragraph (1), the director-general on behalf of the minister, governor or Regent/mayor in accordance with their authority issuing The Letter on the implementation of the Post-Mining to holders of The Mining Permit of Production Operation & The Especially Mining Permit of Production Operation.
