6) Penetapan pihak ketiga pelaksana Pascatambang
dilakukan dengan cara:
a) pemegang IUP Operasi Produksi dan IUPK Operasi
Produksi mengusulkan pihak ketiga yang memiliki Izin Usaha Jasa Pertambangan di
bidang Pascatambang dan Reklamasi kepada Menteri melalui Direktur Jenderal atau
gubernur sesuai dengan kewenangannya;
b) Direktur Jenderal atas nama Menteri atau gubernur
sesuai dengan kewenangannya melakukan evaluasi untuk menetapkan pihak ketiga;
dan
c) Dalam hal pemegang IUP Operasi Produksi dan IUPK
Operasi Produksi tidak mengusulkan pihak ketiga, maka Menteri melalui Direktur
Jenderal atau gubernur sesuai dengan kewenangannya menetapkan pihak ketiga
untuk melaksanakan Pascatambang. (halaman 254)
6) The
appointment of a third party to implement Postmining is carried out in the
following manner:
a) Holders of
a Mining Business Permit for Production Operations and a Special Mining
Business Permit for Production Operations shall propose a third party holding a
Mining Services Business Permit in the field of Postmining and Reclamation to
the Minister through the Director General or the governor, in accordance with
their authority;
b) The
Director General, on behalf of the Minister or the governor, in accordance with
their authority, shall conduct an evaluation to determine the third party; and
c) If the
holders of a Mining Business Permit for Production Operations and a Special
Mining Business Permit for Production Operations do not propose a third party,
the Minister, through the Director General or the governor, in accordance with
their authority, shall appoint a third party to implement Postmining. (page
