4. JAMINAN REKLAMASI (halaman 26)

b. Jaminan Reklamasi tahap kegiatan Operasi Produksi (halaman 26)

1) Pemegang IUP tahap kegiatan Operasi Produksi atau pemegang IUPK tahap kegiatan Operasi Produksi wajib menempatkan Jaminan Reklamasi tahap kegiatan Operasi Produksi sesuai dengan penetapan besaran Jaminan Reklamasi tahap kegiatan Operasi Produksi oleh Direktur Jenderal atau gubernur sesuai dengan kewenangannya.

2) Jaminan Reklamasi tahap kegiatan Operasi Produksi untuk periode 5 (lima) tahun pertama ditempatkan seluruhnya untuk jangka waktu 5 (lima) tahun paling lambat 20 (dua puluh) hari kerja sejak rencana Reklamasi tahap kegiatan Operasi Produksi disetujui oleh Direktur Jenderal atau gubernur sesuai dengan kewenangannya.

3) Jaminan Reklamasi tahap kegiatan Operasi Produksi untuk periode berikutnya dapat ditempatkan seluruhnya untuk jangka waktu 5 (lima) tahun atau setiap tahun paling lambat 20 (dua puluh) hari kerja sejak rencana Reklamasi tahap kegiatan Operasi Produksi disetujui oleh Direktur Jenderal atau gubernur sesuai dengan kewenangannya, atau sejak awal tahun berjalan untuk tahun-tahun setelahnya dalam periode tersebut.

4) Bentuk Jaminan Reklamasi tahap kegiatan Operasi Produksi berupa deposito berjangka ditempatkan pada bank Pemerintah di Indonesia atas nama Direktur Jenderal atau gubernur qq pemegang IUP tahap kegiatan Operasi Produksi atau pemegang IUPK tahap kegiatan Operasi Produksi yang bersangkutan dengan jangka waktu penjaminan sesuai dengan jadwal Reklamasi tahap kegiatan Operasi Produksi.

4. RECLAMATION GUARANTEE (page 26)

b. Reclamation Guarantee for the Production Operations Phase (page 26)

1) Holders of Mining Business Permits for the Production Operations Phase or holders of Special Mining Business Permits for the Production Operations Phase are required to deposit a Reclamation Guarantee for the Production Operations Phase in accordance with the amount of the Reclamation Guarantee for the Production Operations Phase determined by the Director General or the governor, in accordance with their authority.

2) The Reclamation Guarantee for the Production Operations Phase for the first 5 (five) years shall be deposited in full for a period of 5 (five) years, no later than 20 (twenty) working days after the Reclamation Plan for the Production Operations Phase is approved by the Director General or the governor, in accordance with their authority.

3) The Reclamation Guarantee for the Production Operations Phase for subsequent periods may be deposited in full for a period of 5 (five) years, or annually, no later than 20 (twenty) working days after the Reclamation Plan for the Production Operations Phase is approved by the Director General or the governor, in accordance with their authority, or from the beginning of the current year for subsequent years within that period.

4) The form of Reclamation Guarantee for the Production Operation activity stage is in the form of a time deposit placed in a Government bank in Indonesia in the name of the Director General or governor qq holder of a Mining Business Permit for the Production Operation activity stage or holder of a Special Mining Business Permit for the Production Operation activity stage concerned with the guarantee period in accordance with the Reclamation schedule for the Production Operation activity stage.
