2. MEKANISME PENYAMPAIAN, EVALUASI, DAN PERSETUJUAN RENCANA REKLAMASI

a. Rencana Reklamasi Tahap Kegiatan Eksplorasi

6) Pemegang IUP tahap kegiatan Eksplorasi atau pemegang IUPK tahap kegiatan Eksplorasi wajib menyampaikan rencana Reklamasi tahap kegiatan Eksplorasi periode berikutnya kepada Direktur Jenderal atau gubernur sesuai dengan kewenangannya dalam jangka waktu paling lambat 45 (empat puluh lima) hari kerja sebelum berakhirnya periode rencana Reklamasi periode sebelumnya.

7) Terhadap pemegang IUP tahap kegiatan Eksplorasi dan pemegang IUPK tahap kegiatan Eksplorasi yang telah mendapatkan persetujuan rencana Reklamasi tahap kegiatan Eksplorasi sebelum beralihnya kewenangan dari Pemerintah Daerah Provinsi kepada Pemerintah Pusat dan belum menempatkan Jaminan Reklamasi tahap kegiatan Eksplorasi, pemegang IUP tahap kegiatan Eksplorasi atau pemegang IUPK tahap kegiatan Eksplorasi wajib menyampaikan permohonan perintah penempatan Jaminan Reklamasi tahap kegiatan Eksplorasi kepada Direktur Jenderal atau gubernur sesuai kewenangannya dengan dilengkapi:

a) dokumen rencana Reklamasi tahap kegiatan Eksplorasi yang telah disetujui;

b) persetujuan rencana Reklamasi tahap kegiatan Eksplorasi; dan

c) surat pernyataan kebenaran dokumen yang ditandatangani oleh direksi di atas meterai.

8) Direktur Jenderal atau gubernur sesuai dengan kewenangannya berdasarkan permohonan dari pemegang IUP tahap kegiatan Eksplorasi atau pemegang IUPK tahap kegiatan Eksplorasi memberikan perintah penempatan Jaminan Reklamasi tahap kegiatan Eksplorasi dalam jangka waktu paling lambat 20 (dua puluh) hari kerja.

9) Dalam hal permohonan perintah penempatan Jaminan Reklamasi tahap kegiatan Eksplorasi belum memenuhi ketentuan, Direktur Jenderal atau gubernur sesuai dengan kewenangannya menyampaikan kembali permohonan untuk dilakukan perbaikan oleh pemegang IUP tahap kegiatan Eksplorasi dan pemegang IUPK tahap kegiatan Eksplorasi.

10) Pemegang IUP tahap kegiatan Eksplorasi atau pemegang IUPK tahap kegiatan Eksplorasi wajib menyampaikan kembali permohonan perintah penempatan Jaminan Reklamasi tahap kegiatan Eksplorasi yang telah diperbaiki sebagaimana dimaksud pada angka 9) kepada Direktur Jenderal atau gubernur sesuai dengan kewenangannya dalam jangka waktu paling lambat 20 (dua puluh) hari kerja sejak tanggal pengembalian.

2. MECHANISM FOR SUBMISSION, EVALUATION, AND APPROVAL OF RECLAMATION PLANS

a. Reclamation Plan for the Exploration Phase

6) Holders of Mining Business Permits for the Exploration phase or holders of Special Mining Business Permits for the Exploration phase are required to submit a Reclamation plan for the subsequent Exploration phase to the Director General or the governor, in accordance with their authority, no later than 45 (forty-five) working days before the end of the previous Reclamation plan period.

7) Holders of Mining Business Permits for the Exploration stage and Special Mining Business Permits for the Exploration stage who have received approval for their Reclamation plan for the Exploration stage before the transfer of authority from the Provincial Government to the Central Government and have not yet placed a Reclamation Guarantee for the Exploration stage, the holder of the Mining Business Permit for the Exploration stage or the holder of the Special Mining Business Permit for the Exploration stage must submit a request for an order to place a Reclamation Guarantee for the Exploration stage to the Director General or the governor in accordance with their authority, accompanied by:

a) the approved Reclamation plan document for the Exploration stage;

b) approval of the Reclamation plan for the Exploration stage; and

c) a statement of the authenticity of the document signed by the board of directors on a stamped document.

8) The Director General or the governor in accordance with their authority, based on the request from the holder of the Mining Business Permit for the Exploration stage or the holder of the Special Mining Business Permit for the Exploration stage, shall issue an order to place the Reclamation Guarantee for the Exploration stage within a maximum of 20 (twenty) working days.

9) If the application for the order to place the Reclamation Guarantee for the Exploration stage does not meet the requirements, the Director General or the governor, in accordance with their authority, shall resubmit the application for correction by the holder of the Mining Business Permit for the Exploration stage and the holder of the Special Mining Business Permit for the Exploration stage.

10) The holder of the Mining Business Permit for the Exploration stage or the holder of the Special Mining Business Permit for the Exploration stage must resubmit the application for the order to place the Reclamation Guarantee for the Exploration stage that has been corrected as referred to in point 9) to the Director General or the governor, in accordance with their authority, within a maximum period of 20 (twenty) working days from the date of return.
