2. MEKANISME PENYAMPAIAN, EVALUASI, DAN PERSETUJUAN RENCANA REKLAMASI

b. Rencana Reklamasi Tahap Kegiatan Operasi Produksi

1) Pemegang IUP tahap kegiatan Operasi Produksi atau pemegang IUPK tahap kegiatan Operasi Produksi menyampaikan rencana Reklamasi kepada Direktur Jenderal atau gubernur sesuai dengan kewenangannya untuk mendapatkan persetujuan dalam jangka waktu paling lambat 45 (empat puluh lima) hari kerja sejak mendapatkan IUP tahap kegiatan Operasi Produksi atau IUPK tahap kegiatan Operasi Produksi.

2) Direktur Jenderal atau gubernur sesuai dengan kewenangannya memberikan persetujuan rencana Reklamasi dalam jangka waktu paling lambat 45 (empat puluh lima) hari kerja setelah permohonan lengkap dan benar.

3) Dalam hal rencana Reklamasi tahap kegiatan Operasi Produksi belum memenuhi ketentuan, Direktur Jenderal atau gubernur sesuai dengan kewenangannya menyampaikan hasil evaluasi rencana Reklamasi kepada pemegang IUP tahap kegiatan Operasi Produksi atau pemegang IUPK tahap kegiatan Operasi Produksi untuk diperbaiki.

4) Pemegang IUP tahap kegiatan Operasi Produksi atau pemegang IUPK tahap kegiatan Operasi Produksi wajib menyampaikan kembali rencana Reklamasi tahap kegiatan Operasi Produksi yang telah diperbaiki kepada Direktur Jenderal atau gubernur sesuai dengan kewenangannya dalam jangka waktu paling lambat 20 (dua puluh) hari kerja sejak tanggal pengembalian.

5) Persetujuan rencana Reklamasi tahap kegiatan Operasi Produksi termasuk di dalamnya penetapan besaran Jaminan Reklamasi tahap kegiatan Operasi Produksi dengan rincian tahunan.

2. MECHANISM FOR SUBMISSION, EVALUATION, AND APPROVAL OF RECLAMATION PLANS

b. Reclamation Plan for the Production Operations Phase

1) Holders of Mining Business Permits for the Production Operations phase or holders of Special Mining Business Permits for the Production Operations phase shall submit a Reclamation plan to the Director General or the governor in accordance with their authority for approval within a maximum of 45 (forty-five) working days of obtaining a Mining Business Permit for the Production Operations phase or a Special Mining Business Permit for the Production Operations phase.

2) The Director General or the governor in accordance with their authority shall approve the Reclamation plan within a maximum of 45 (forty-five) working days after the application is complete and correct.

3) If the Reclamation plan for the Production Operations phase does not meet the requirements, the Director General or the governor in accordance with their authority shall submit the results of the Reclamation plan evaluation to the holders of Mining Business Permits for the Production Operations phase or holders of Special Mining Business Permits for the Production Operations phase for revision.

4) Holders of Mining Business Permits for the Production Operation stage or holders of Special Mining Business Permits for the Production Operation stage are required to resubmit the revised Reclamation plan for the Production Operation stage to the Director General or the governor in accordance with their authority within a maximum period of 20 (twenty) working days from the date of return.

5) Approval of the Reclamation plan for the Production Operation stage, including the determination of the amount of the Reclamation Guarantee for the Production Operation stage, with annual details.
