3. PERUBAHAN RENCANA REKLAMASI (halaman 24)

a. Perubahan Rencana Reklamasi Tahap Kegiatan Eksplorasi (halaman 24)

1) Pemegang IUP tahap kegiatan Eksplorasi atau pemegang IUPK tahap kegiatan Eksplorasi wajib melakukan perubahan atas rencana Reklamasi tahap kegiatan Eksplorasi yang telah disetujui apabila terjadi perubahan rencana bukaan lahan, rencana Reklamasi tahap kegiatan Eksplorasi dan/atau Dokumen Lingkungan Hidup yang mempengaruhi kriteria keberhasilan Reklamasi tahap kegiatan Eksplorasi yang telah disetujui.

2) Perubahan rencana Reklamasi tahap kegiatan Eksplorasi sebagaimana dimaksud pada angka 1) disampaikan kepada Direktur Jenderal atau gubernur sesuai dengan kewenangannya dalam jangka waktu paling lambat tanggal 31 Juli pada tahun berjalan untuk mendapatkan persetujuan.

3) Direktur Jenderal atau gubernur sesuai dengan kewenangannya memberikan persetujuan terhadap perubahan rencana Reklamasi tahap kegiatan Eksplorasi yang disampaikan dalam jangka waktu paling lambat 45 (empat puluh lima) hari kerja.

4) Dalam hal perubahan rencana Reklamasi tahap kegiatan Eksplorasi belum memenuhi ketentuan, Direktur Jenderal atau gubernur sesuai dengan kewenangannya menyampaikan hasil evaluasi perubahan rencana Reklamasi tahap kegiatan Eksplorasi kepada pemegang IUP tahap kegiatan Eksplorasi atau pemegang IUPK tahap kegiatan Eksplorasi untuk diperbaiki.

5) Pemegang IUP tahap kegiatan Eksplorasi atau pemegang IUPK tahap kegiatan Eksplorasi wajib menyampaikan kembali perubahan rencana Reklamasi tahap kegiatan Eksplorasi yang telah diperbaiki kepada Direktur Jenderal atau gubernur sesuai dengan kewenangannya dalam jangka waktu paling lambat 20 (dua puluh) hari kerja sejak tanggal pengembalian.

3. CHANGES TO THE RECLAMATION PLAN (page 24)

a. Changes to the Reclamation Plan for the Exploration Phase (page 24)

1) Holders of Mining Business Permits for the Exploration phase or holders of Special Mining Business Permits for the Exploration phase are required to amend the approved Reclamation Plan for the Exploration phase if there are changes to the land clearing plan, the Reclamation Plan for the Exploration phase, and/or the Environmental Document that affect the approved Reclamation success criteria for the Exploration phase.

2) Changes to the Reclamation Plan for the Exploration phase as referred to in point 1) must be submitted to the Director General or the governor, in accordance with their authority, no later than July 31^st, of the current year for approval.

3) The Director General or the governor, in accordance with their authority, must approve the submitted changes to the Reclamation Plan for the Exploration phase within a maximum of 45 (forty-five) working days.

4) If the changes to the Reclamation plan for the Exploration stage do not meet the requirements, the Director General or the governor, in accordance with their authority, shall submit the results of the evaluation of the changes to the Reclamation plan for the Exploration stage to the holder of the Mining Business Permit for the Exploration stage or the holder of the Special Mining Business Permit for the Exploration stage for revision.

5) The holder of the Mining Business Permit for the Exploration stage or the holder of the Special Mining Business Permit for the Exploration stage must resubmit the revised changes to the Reclamation plan for the Exploration stage to the Director General or the governor, in accordance with their authority, within a maximum period of 20 (twenty) working days from the date of return.
