4. JAMINAN REKLAMASI (halaman 26)

a. Jaminan Reklamasi Tahap Kegiatan Eksplorasi (halaman 26)

1) Pemegang IUP tahap kegiatan Eksplorasi atau pemegang IUPK tahap kegiatan Eksplorasi wajib menempatkan Jaminan Reklamasi tahap kegiatan Eksplorasi sesuai dengan penetapan besaran Jaminan Reklamasi oleh Direktur Jenderal atau gubernur sesuai dengan kewenangannya.

2) Jaminan Reklamasi tahap kegiatan Eksplorasi ditempatkan seluruhnya di awal sesuai dengan penentuan biaya Reklamasi.

3) Penempatan Jaminan Reklamasi tahap kegiatan Eksplorasi dilakukan dalam jangka waktu paling lambat 20 (dua puluh) hari kerja sejak rencana Reklamasi disetujui oleh Direktur Jenderal atau gubernur sesuai dengan kewenangannya.

4) Jaminan Reklamasi tahap kegiatan Eksplorasi berupa deposito berjangka yang ditempatkan pada bank Pemerintah di Indonesia atas nama Direktur Jenderal atau gubernur qq pemegang IUP tahap kegiatan Eksplorasi atau pemegang IUPK tahap kegiatan Eksplorasi yang bersangkutan dengan jangka waktu penjaminan 12 (dua belas) bulan sejak tanggal penempatan dengan ketentuan perpanjangan otomatis (automatic roll over).

5) Jaminan Reklamasi tahap kegiatan Eksplorasi ditempatkan dalam bentuk mata uang Rp (rupiah) atau $ (dolar) Amerika Serikat.

6) Penempatan Jaminan Reklamasi tahap kegiatan Eksplorasi tidak menghilangkan kewajiban pemegang IUP tahap kegiatan Eksplorasi atau pemegang IUPK tahap kegiatan Eksplorasi untuk melaksanakan Reklamasi tahap kegiatan Eksplorasi.

7) Kekurangan biaya untuk menyelesaikan Reklamasi dari jaminan yang telah ditetapkan, tetap menjadi tanggung jawab pemegang IUP tahap kegiatan Eksplorasi atau pemegang IUPK tahap kegiatan Eksplorasi. (halaman 26)

4. RECLAMATION GUARANTEE (page 26)

a. Reclamation Guarantee for the Exploration Phase (page 26)

1) Holders of Mining Business Permits for the Exploration phase or holders of Special Mining Business Permits for the Exploration phase are required to deposit a Reclamation Guarantee for the Exploration phase in accordance with the amount determined by the Director General or the governor, in accordance with their authority.

2) The Reclamation Guarantee for the Exploration phase is deposited in full at the outset in accordance with the determination of Reclamation costs.

3) The Reclamation Guarantee for the Exploration phase must be deposited no later than 20 (twenty) working days after the Reclamation plan is approved by the Director General or the governor, in accordance with their authority.

4) The Reclamation Guarantee for the Exploration phase takes the form of a time deposit placed in a government bank in Indonesia in the name of the Director General or governor, qq the holder of the Mining Business Permit for the Exploration phase or the holder of the Special Mining Business Permit for the Exploration phase, with a guarantee term of 12 (twelve) months from the date of placement, with automatic rollover provisions.

5) The Reclamation Guarantee for the Exploration phase is placed in Rupiah (IDR) or US Dollars (USD).

6) The placement of the Reclamation Guarantee for the Exploration phase does not relieve the holder of the Mining Business Permit for the Exploration phase or the holder of the Special Mining Business Permit for the Exploration phase from the obligation to carry out Reclamation for the Exploration phase.

7) Any shortfall in funds to complete Reclamation from the stipulated guarantee remains the responsibility of the holder of the Mining Business Permit for the Exploration phase or the holder of the Special Mining Business Permit for the Exploration phase. (page 26)
