b. Jaminan Reklamasi tahap kegiatan Operasi Produksi (halaman 26)

5) Jaminan Reklamasi tahap kegiatan Operasi Produksi ditempatkan dalam bentuk mata uang Rp (rupiah) atau $ (dolar) Amerika Serikat.

6) Penempatan Jaminan Reklamasi tahap kegiatan Operasi Produksi tidak menghilangkan kewajiban pemegang IUP tahap kegiatan Operasi Produksi atau pemegang IUPK tahap kegiatan Operasi Produksi untuk melaksanakan Reklamasi.

7) Kekurangan biaya untuk menyelesaikan Reklamasi dari jaminan yang telah ditetapkan, tetap menjadi tanggung jawab pemegang IUP tahap kegiatan Operasi Produksi atau pemegang IUPK tahap kegiatan Operasi Produksi.

8) Besaran Jaminan Reklamasi tahap kegiatan Operasi Produksi paling sedikit sesuai dengan Standar Biaya Reklamasi sebagaimana tercantum dalam Lampiran II.

9) Jaminan Reklamasi yang telah ditempatkan namun tidak dilengkapi dengan data dukung berupa:

a) persetujuan rencana Reklamasi; dan/atau

b) dokumen rencana Reklamasi,

berdasarkan dokumen serah terima bukti asli Jaminan Reklamasi dan/atau Jaminan Pascatambang dari Pemerintah Daerah Provinsi kepada Pemerintah Pusat, tetap dapat digunakan untuk pelaksanaan Pascatambang pada lahan bekas eks WIUP atau WIUPK tahap kegiatan Operasi Produksi apabila terdapat permintaan dari Pemerintah Daerah Provinsi, DPRD, Aparat Penegak Hukum dan instansi yang membidangi lingkungan hidup, yang dituangkan dalam program Pascatambang sesuai dengan ketersediaan jaminan yang telah ditempatkan. 4. RECLAMATION GUARANTEE (page 26)

b. Reclamation Guarantee for the Production Operations phase (page 26)

5) The Reclamation Guarantee for the Production Operations phase is placed in Rupiah (IDR) or US Dollars (USD).

6) The placement of the Reclamation Guarantee for the Production Operations phase does not relieve the holder of the Mining Business Permit for the Production Operations phase or the holder of the Special Mining Business Permit for the Production Operations phase from the obligation to carry out Reclamation.

7) Any shortfall in funds to complete Reclamation beyond the stipulated guarantee remains the responsibility of the holder of the Mining Business Permit for the Production Operations phase or the holder of the Special Mining Business Permit for the Production Operations phase.

8) The amount of the Reclamation Guarantee for the Production Operations phase must at least comply with the Reclamation Cost Standards as set out in Attachment II.

9) Reclamation Guarantees that have been placed but are not accompanied by supporting data in the form of:

a) approval of the Reclamation plan; and/or

b) Reclamation plan documents,

based on the original handover document of the Reclamation Guarantee and/or Post-Mining Guarantee from the Provincial Government to the Central Government, may still be used for Post-Mining implementation on land formerly covered by Mining Business Permit Areas or Special Mining Business Permit Areas during the Production Operation phase if requested by the Provincial Government, the Regional People's Representative Council, Law Enforcement Officers, and environmental agencies, as outlined in the Post-Mining program, subject to the availability of the collateral.
