TENTANG

PEDOMAN TEKNIS PELAKSANAAN REKLAMASI DAN PASCATAMBANG

PADA KEGIATAN USAHA PERTAMBANGAN MINERAL DAN BATUBARA

DECREE OF THE MINISTER OF ENERGY AND MINERAL RESOURCES OF THE REPUBLIC OF INDONESIA

CONCERNING

TECHNICAL GUIDELINES FOR IMPLEMENTING RECLAMATION AND POST-MINING IN MINERAL AND COAL MINING BUSINESS ACTIVITIES

MINISTER OF ENERGY AND MINERAL RESOURCES OF THE REPUBLIC OF INDONESIA

 

KELIMA FIFTH	:	Pada saat Keputusan Menteri ini mulai berlaku: When this Ministerial Decree comes into force:
		a.	permohonan penilaian keberhasilan atas Reklamasi atau Pascatambang yang telah dimohonkan pada saat ditetapkannya Keputusan Menteri ini, tetap dapat dilakukan peninjauan lapangan oleh Inspektur Tambang sampai dengan diterbitkannya daftar Izin Usaha Jasa Pertambangan sebagai pihak ketiga yang melakukan peninjauan lapangan kriteria keberhasilan Reklamasi atau Pascatambang; Applications for assessment of the success of Reclamation or Post-Mining which have been submitted at the time of the stipulation of this Ministerial Decree, can still be reviewed in the field by the Mining Inspector until the issuance of the list of Mining Services Business Permits as a third party conducting field reviews of the success criteria for Reclamation or Post-Mining;
		b.	Jaminan Reklamasi tahap kegiatan Operasi Produksi dalam bentuk selain deposito berjangka yang telah ditempatkan sebelum Keputusan Menteri ini ditetapkan, tetap berlaku sampai dengan masa berlaku jaminan berakhir; Reclamation guarantees for the Production Operation activity stage in the form of other than time deposits that have been placed before this Ministerial Decree is stipulated, remain valid until the guarantee validity period ends;
		c.	Jaminan Reklamasi tahap kegiatan Operasi Produksi sebagaimana dimaksud pada huruf b, wajib ditempatkan kembali dalam bentuk deposito berjangka dengan nilai sesuai dengan surat penetapan Jaminan Reklamasi tahap kegiatan Operasi Produksi untuk periode yang sama; dan The Reclamation Guarantee for the Production Operation activity stage as referred to in letter b, must be placed back in the form of a time deposit with a value in accordance with the Reclamation Guarantee determination letter for the Production Operation activity stage for the same period; and
		d.	dokumen rencana Reklamasi dan/atau dokumen rencana Pascatambang yang telah disetujui tetap berlaku selama tidak ada perubahan dan penilaian keberhasilan Reklamasi dan/atau Pascatambang didasarkan atas kriteria keberhasilan yang telah disetujui. The approved Reclamation plan document and/or Post-mining plan document remains valid as long as there are no changes and the assessment of the success of Reclamation and/or Post-mining is based on the approved success criteria.
