1. PENYUSUNAN DOKUMEN RENCANA REKLAMASI

1. PREPARATION OF RECLAMATION PLAN DOCUMENTS

 

b. Penyusunan Dokumen Rencana Reklamasi Tahap Kegiatan Operasi Produksi

b. Preparation of Reclamation Plan Documents for the Production Operations Activity Stage

 

Untuk reklamasi yang berada di wilayah laut dilaksanakan dengan tahapan kegiatan sebagai berikut:

1) Pemegang IUP tahap kegiatan Operasi Produksi atau pemegang IUPK tahap kegiatan Operasi Produksi wajib menyusun rencana Reklamasi wilayah laut tahap kegiatan Operasi Produksi berdasarkan Studi Kelayakan dan Dokumen Lingkungan Hidup yang telah disetujui.

2) Kewajiban menyusun rencana Reklamasi wilayah laut tahap kegiatan Operasi Produksi berlaku bagi:

a) Pemegang IUP tahap kegiatan Eksplorasi atau pemegang IUPK tahap kegiatan Eksplorasi untuk rencana Reklamasi laut tahap kegiatan Operasi Produksi periode 5 (lima) tahun pertama sebagai persyaratan untuk mendapatkan IUP tahap kegiatan Operasi Produksi atau IUPK tahap kegiatan Operasi Produksi; dan

b) Pemegang IUP tahap kegiatan Operasi Produksi atau pemegang IUPK tahap kegiatan Operasi Produksi untuk rencana Reklamasi laut tahap kegiatan Operasi Produksi periode 5 (lima) tahun berikutnya.

3) Dalam hal jangka waktu IUP tahap kegiatan Operasi Produksi atau IUPK tahap kegiatan Operasi Produksi kurang dari 5 (lima) tahun atau sisa jangka waktu IUP tahap kegiatan Operasi Produksi atau IUPK tahap kegiatan Operasi Produksi kurang dari 5 (lima) tahun, penyusunan dokumen rencana Reklamasi laut tahap kegiatan Operasi Produksi sesuai dengan jangka waktu atau sisa jangka waktu IUP tahap kegiatan Operasi Produksi atau IUPK tahap kegiatan Operasi Produksi.

4) Rencana Reklamasi wilayah laut tahap kegiatan Operasi Produksi meliputi:

a) rencana area kerja untuk tahap kegiatan Operasi Produksi;

b) penentuan lokasi Reklamasi wilayah laut;

c) penentuan biaya Reklamasi wilayah laut;

d) program Reklamasi wilayah laut tahap kegiatan Operasi Produksi; dan

e) Kriteria keberhasilan Reklamasi wilayah laut berdasarkan kajian yang terintegrasi dalam dokumen rencana Reklamasi wilayah laut tahap kegiatan Operasi Produksi.

5) Format penyusunan rencana Reklamasi wilayah laut tahap kegiatan Operasi Produksi tercantum dalam format 7.

Reclamation in marine areas is carried out in the following stages:

1) Holders of Mining Business Permits during the Production Operations phase or holders of Special Mining Business Permits during the Production Operations phase are required to prepare a marine reclamation plan for the Production Operations phase based on a feasibility study and approved environmental documents.

2) The obligation to prepare a marine reclamation plan for the Production Operations phase applies to:

a) Holders of Mining Business Permits during the Exploration phase or holders of Special Mining Business Permits during the Exploration phase for marine reclamation plans during the Production Operations phase for the first 5 (five) years as a requirement for obtaining a Mining Business Permit for the Production Operations phase or a Special Mining Business Permit for the Production Operations phase; and

b) Holders of Mining Business Permits during the Production Operations phase or holders of Special Mining Business Permits during the Production Operations phase for marine reclamation plans during the subsequent 5 (five) years.

3) If the term of a Mining Business Permit for the Production Operations stage or a Special Mining Business Permit for the Production Operations stage is less than 5 (five) years, or the remaining term of a Mining Business Permit for the Production Operations stage or a Special Mining Business Permit for the Production Operations stage is less than 5 (five) years, the marine reclamation plan document for the Production Operations stage must be prepared in accordance with the term or remaining term of the Mining Business Permit for the Production Operations stage or the Special Mining Business Permit for the Production Operations stage.

4) The marine reclamation plan for the Production Operations stage includes:

a) work area plan for the Production Operations stage;

b) determination of the location for marine reclamation;

c) determination of marine reclamation costs;

d) marine reclamation program for the Production Operations stage; and

e) Criteria for the success of marine reclamation based on an integrated study within the marine reclamation plan document for the Production Operations stage.

5) The format for preparing a marine reclamation plan for the Production Operations stage is set out in Format 7.
