b. Pemegang IUP Operasi Produksi dan IUPK Operasi
Produksi sebelum menyerahkan lahan harus mengajukan permohonan kepada Menteri
melalui Direktur Jenderal atau gubernur sesuai dengan kewenangannya untuk
mendapatkan persetujuan penyerahan lahan Reklamasi.
c. Penyerahan lahan reklamasi merupakan bagian dari
rencana Pascatambang atas WIUP Operasi Produksi dan WIUPK Operasi Produksi.
d. Dalam hal terdapat penyerahan lahan reklamasi yang
belum menjadi bagian dalam rencana Pascatambang maka pemegang IUP Operasi
Produksi dan IUPK Operasi Produksi wajib melakukan perubahan rencana
Pascatambang. (halaman 254)
b. Holders of
a Production Operation Mining Business Permit and a Special Production
Operation Mining Business Permit must submit an application to the Minister,
through the Director General or the governor, in accordance with their
authority, for approval to hand over the reclamation land.
c. The
handover of reclamation land is part of the post-mining plan for the Production
Operation Mining Business Permit Area and the Special Production Operation
Mining Business Permit Area.
d. In the
event of the handover of reclamation land that is not yet part of the
post-mining plan, the holders of the Production Operation Mining Business
Permit and the Special Production Operation Mining Business Permit are required
to amend the post-mining plan. (page 254)
