d. Penggunaan Perusahaan Jasa Pertambangan

Penggunaan Jasa Pertambangan sepenuhnya menjadi tanggung jawab pemegang IUP, IUPK, IUP Operasi Produksi khusus untuk pengolahan dan/atau pemurnian, meliputi pemenuhan kewajiban perusahaan jasa pertambangan dan penerapan kaidah teknik pertambangan yang baik.

2. Kewajiban perusahaan jasa pertambangan terdiri atas; (halaman 367)

a. melaksanakan ketentuan aspek teknis, konservasi, keselamatan, dan lindungan lingkungan pertambangan sesuai dengan bidang usaha dan ketentuan peraturan perundang-undangan;

b. mengangkat penanggung jawab operasional;

c. memiliki Tenaga Teknis Pertambangan yang Berkompeten sesuai dengan ketentuan peraturan perundang-undangan; dan

d. pemegang IUJP yang diterbitkan oleh Menteri melaporkan IUJP-nya kepada gubernur tempat kegiatan usahanya sebelum memulai kegiatan usahanya. (halaman 367)

d. Use of Mining Service Companies.

The use of Mining Services is entirely the responsibility of the holder of a Mining Business Permit, Special Mining Business Permit, or Production Operation Mining Business Permit specifically for processing and/or refining, including fulfilling the obligations of the mining service company and implementing good mining engineering principles.

2. The obligations of a mining service company consist of: (page 367)

a. implementing provisions regarding technical aspects, conservation, safety, and environmental protection of mining in accordance with the business sector and provisions of laws and regulations;

b. appointing an operational manager;

c. having competent mining technical personnel in accordance with statutory provisions; and

d. holders of Mining Services Business Permits issued by the Minister must report their Mining Services Business Permits to the governor of the location where they operate before commencing business activities. (page 367)
