KETERANGAN TATA CARA PENYAMPAIAN, EVALUASI, DAN PERSETUJUAN RKAB UNTUK IUP TAHAP KEGIATAN EKSPLORASI ATAU IUPK TAHAP KEGIATAN EKSPLORASI

DESCRIPTION OF PROCEDURES FOR SUBMITTING, EVALUATING AND APPROVAL OF WORK PLANS AND BUDGET FOR MINING BUSINESS PERMITS IN THE EXPLORATION ACTIVITY STAGE OR SPECIAL MINING BUSINESS PERMITS IN THE EXPLORATION ACTIVITY STAGE

 

4.  Penolakan

a.  Menteri c.q. Direktur Jenderal atau Gubernur sesuai dengan kewenangannya menandatangani penolakan RKAB dan dilakukan penomoran serta penanggalan sesuai dengan tata naskah dinas.

b. Penolakan RKAB disampaikan kepada pemohon.

5.  Pengajuan Kembali Dokumen RKAB

a.  Pemohon diberikan jangka waktu 5 (lima) hari kalender sejak tanggal penolakan RKAB untuk memperbaiki dokumen RKAB, dan menyampaikan kembali kepada Menteri c.q. Direktur Jenderal atau Gubernur sesuai dengan kewenangannya melalui surat elektronik resmi Direktorat Jenderal Mineral dan Batubara atau Dinas yang membidangi energi dan sumber daya mineral sesuai dengan kewenangannya.

b.  tata cara evaluasi dan pemberian tanggapan/perbaikan terhadap permohonan RKAB yang telah mendapatkan penolakan, dilakukan secara mutatis mutandis sesuai dengan ketentuan pada angka 2 dan angka 3.

6.  Persetujuan

a.  Menteri c.q. Direktur Jenderal atau Gubernur sesuai dengan kewenangannya menandatangani persetujuan RKAB dan dilakukan penomoran serta penanggalan sesuai dengan tata naskah dinas.

b. Persetujuan RKAB disampaikan kepada pemohon.

4. Rejection

a. The Minister, c.q. the Director General, or the Governor, in accordance with their authority, will sign the rejection of the Work Plan and Budget and number and date it according to official document regulations.

b. The rejection of the Work Plan and Budget will be conveyed to the applicant.

5. Resubmission of the Work Plan and Budget Documents

a. The applicant will be given 5 (five) calendar days from the date of rejection of the Work Plan and Budget to revise the Work Plan and Budget documents and resubmit them to the Minister, c.q. the Director General, or the Governor, in accordance with their authority, via an official email from the Directorate General of Minerals and Coal or the Agency responsible for energy and mineral resources, in accordance with their authority.

b. The procedures for evaluating and providing responses/corrections to rejected Work Plan and Budget applications will be carried out mutatis mutandis in accordance with the provisions in points 2 and 3.

6. Approval

a. The Minister, c.q. The Director General or Governor, in accordance with their authority, signs the approval of the Work Plan and Budget, numbering and dating it in accordance with official document regulations.

b. Approval of the Work Plan and Budget is submitted to the applicant.

DESCRIPTION OF PROCEDURES FOR SUBMITTING, EVALUATING AND APPROVAL OF WORK PLANS AND BUDGET FOR MINING BUSINESS PERMITS IN THE EXPLORATION ACTIVITY STAGE OR SPECIAL MINING BUSINESS PERMITS IN THE EXPLORATION ACTIVITY STAGE

 

2.  Melakukan Evaluasi Berdasarkan dokumen yang disampaikan dalam permohonan, unit teknis melakukan evaluasi terhadap dokumen RKAB dengan memperhatikan aspek dan kriteria esensial untuk dituangkan dalam lembar kerja evaluasi.

2. Conducting an Evaluation Based on the documents submitted in the application, the technical unit conducts an evaluation of the Work Plan Budget document by paying attention to the essential aspects and criteria to be included in the evaluation worksheet.

 

3. Tanggapan/Perbaikan

a.  Tanggapan Berdasarkan hasil evaluasi yang dituangkan dalam lembar kerja evaluasi, apabila permohonan belum memadai unit teknis menyampaikan kembali tanggapan kepada pemohon dengan melampirkan lembar kerja evaluasi;

b.  Perbaikan Pemohon diberikan jangka waktu 5 (lima) hari kalender untuk memperbaiki dokumen RKAB, dan menyampaikan kembali kepada Menteri c.q. Direktur Jenderal atau Gubernur sesuai dengan kewenangannya melalui sistem informasi/aplikasi Rencana Kerja dan Anggaran Biaya (e-RKAB) dan/atau melalui surat elektronik resmi Direktorat Jenderal Mineral dan Batubara atau Dinas pada Pemerintah Daerah Provinsi yang membidangi energi dan sumber daya mineral sesuai dengan kewenangannya.

c.  Dalam hal berdasarkan hasil evaluasi perbaikan permohonan telah memadai, unit teknis menyiapkan konsep Persetujuan RKAB dengan dilampirkan lembar kerja evaluasi.

d. Pemohon diberikan kesempatan perbaikan paling banyak sebanyak 3 (tiga) kali.

e. Dalam hal berdasarkan hasil evaluasi, telah dilakukan 3 (tiga) kali perbaikan, dan permohonan RKAB masih belum memadai, unit teknis menyiapkan konsep Penolakan RKAB dengan melampirkan lembar kerja evaluasi.

3. Response/Revision

a. Response: Based on the evaluation results outlined in the evaluation worksheet, if the application is inadequate, the technical unit will resubmit a response to the applicant, attaching the evaluation worksheet.

b. Revision: The applicant is given 5 (five) calendar days to revise the Work Plan and Budget document and resubmit it to the Minister, c.q. the Director General or the Governor, in accordance with their authority, through the Work Plan and Budget information system/application (e-Work Plan and Budget) and/or via official email from the Directorate General of Minerals and Coal or the Provincial Government Agency responsible for energy and mineral resources, in accordance with their authority.

c. If, based on the evaluation results, the application revisions are adequate, the technical unit will prepare a draft Work Plan and Budget Approval, attaching the evaluation worksheet.

d. The applicant will be given a maximum of 3 (three) revisions.

e. If, based on the evaluation results, 3 (three) revisions have been made and the Work Plan and Budget application is still inadequate, the technical unit will prepare a draft Work Plan and Budget Rejection, attaching the evaluation worksheet.

DESCRIPTION OF PROCEDURES FOR SUBMITTING, EVALUATING AND APPROVAL OF WORK PLANS AND BUDGET FOR MINING BUSINESS PERMITS IN THE EXPLORATION ACTIVITY STAGE OR SPECIAL MINING BUSINESS PERMITS IN THE EXPLORATION ACTIVITY STAGE

 

1. Mengajukan Dokumen RKAB

1. Submitting the WORK PLAN AND BUDGET Documents

 

a.   Pemegang IUP tahap kegiatan Eksplorasi atau IUPK tahap kegiatan Eksplorasi mengajukan permohonan persetujuan RKAB kepada Menteri c.q. Direktur Jenderal atau Gubernur sesuai dengan kewenangannya dengan melampirkan data dan dokumen pendukung:

a.  Holders of Mining Business Permits for the Exploration activity stage or Special Mining Business Permits for the Exploration activity stage submit an application for approval of the Work Plan and Budget to the Minister c.q. Director General or Governor in accordance with their authority by attaching the following supporting data and documents:

 

1)  surat pengantar yang ditandatangani oleh direksi pemegang IUP Tahap Kegiatan Eksplorasi atau IUPK Tahap Kegiatan Eksplorasi yang terdaftar di Minerba One Data Indonesia (MODI);

2) bukti pembayaran ke kas Negara dalam rangka penyelesaian tagihan piutang penerimaan negara bukan pajak;

3) surat pengesahan Kepala Teknik Tambang (KTT)/KTT Sementara/Penjabat Sementara KTT; dan

4) surat pernyataan tertulis di atas materai yang ditandatangani oleh direksi pemegang IUP tahap kegiatan Eksplorasi atau IUPK tahap kegiatan Eksplorasi yang terdaftar di MODI dan diberikan stempel basah yang menyatakan bahwa seluruh data dan dokumen yang dilampirkan dalam permohonan adalah benar sesuai dengan format dalam Lampiran I Kepmen ESDM 373.K/ MB.01/MEM.B/2023.

1) a cover letter signed by the board of directors holding a Mining Business Permit for the Exploration Phase or a Special Mining Business Permit for the Exploration Phase registered with Minerba One Data Indonesia (MODI);

2) proof of payment to the State Treasury for the settlement of non-tax state revenue receivables;

3) a letter of approval from the Head of Mining Engineering/Temporary Head of Mining Engineering/Temporary Acting Head of Mining Engineering; and

4) a written statement on stamped paper signed by the board of directors holding a Mining Business Permit for the Exploration Phase or Special Mining Business Permit for the Exploration Phase registered with MODI and affixed with a wet stamp, stating that all data and documents attached to the application are true and in accordance with the format in Attachment I to Decree of the Minister of Energy and Mineral Resources 373.K/MB.01/MEM.B/2023.

 

b.  Permohonan disampaikan melalui sistem informasi/aplikasi Rencana Kerja dan Anggaran Biaya (e-RKAB) dan/atau melalui surat elektronik resmi Direktorat Jenderal Mineral dan Batubara atau Dinas pada Pemerintah Daerah Provinsi yang membidangi energi dan sumber daya mineral sesuai dengan kewenangannya.

b. Applications are submitted through the Work Plan and Budget information system/application (e-Work Plan and Budget) and/or through the official electronic mail of the Directorate General of Minerals and Coal or the Office in the Provincial Government that handles energy and mineral resources in accordance with its authority.

4.	Penolakan Rejection				5 hari 5 days	Penolakan RKAB Rejection of Work Plan and Budget	Dalam hal berdasarkan hasil evaluasi setelah 3 (tiga) kali perbaikan, Penolakan RKAB disampaikan kepada pemohon dengan dilampirkan Lembar Kerja Evaluasi In the case of evaluation results after 3 (three) revisions, the Rejection of the Work Plan and Budget is submitted to the applicant with the Evaluation Worksheet attached.
5.	Pengajuan Kembali Dokumen RKAB Resubmission of Work Plan Budget Documents				5 hari 5 days	Hasil Evaluasi Evaluation Results	Pemohon diberikan jangka waktu 5 (lima) hari kalender sejak tanggal penolakan RKAB untuk memperbaiki dokumen RKAB, dan menyampaikan kembali melalui alamat surat elektronik The applicant is given a period of 5 (five) calendar days from the date of rejection of the Work Plan and Budget to correct the Work Plan and Budget documents and resubmit them via email address.
6.	Persetujuan Agreement				4 hari 4 days	Persetujuan RKAB Approval of Work Plan and Budget	Penandatangan persetujuan RKAB penyampaian persetujuan kepada Pemohon melalui sistem informasi Signing of the Work Plan and Budget approval and delivery of approval to the Applicant via the information system   dan/atau melalui surat elektronik and/or via electronic mail
