Regarding

BASIC PROVISIONS ON MINING

Penjelasan pokok persoalan:

Explanation of the main issue:

 

l. Mengenai semua bahan galian yang terkandung di dalam bumi dan wilayah hukum pertambangan Indonesia dinyatakan, bahwa bahan-bahan galian tersebut adalah karunia Tuhan Yang Maha Esa dan dikuasi oleh Negara.

l. Regarding all mineral resources contained within the earth and the mining jurisdiction of Indonesia, it is declared that such mineral resources are a gift from God Almighty and are controlled by the State.

 

Pernyataan ini adalah dasar, yang diletakkan dalam Undang- undang Pertambangan ini, sehingga dengan pernyataan ini Negara menguasai semua bahan-bahan galian dengan sepenuh- penuhnya untuk kepentingan Negara serta kemakmuran rakyat, karena bahan-bahan galian tersebut adalah merupakan kekayaan Nasional.

This statement serves as the foundation of this Mining Law, establishing that the State has full control over all mineral resources for the benefit of the State and the prosperity of the people, as these resources constitute national wealth.

 

Dengan pengertian baru yang disebut dataran Continental (Continental-Shelf), maka wilayah hukum pertambangan meliputi juga daerah di luar batas-batas perairan Indonesia. Pengertian perairan Indonesia inipun adalah pengertian sesudah disesuaikan dengan Undang-undang No. 4 Prp tahun 1960, tentang Perairan Indonesia (Lembaran-Negara tahun 1960 No. 22, Tambahan Lembaran-Negara No. 1942).

With the introduction of the concept of the continental shelf, the jurisdiction for mining activities extends to areas beyond the limits of Indonesian waters. This definition of Indonesian waters reflects the adjustments made pursuant to Government Regulation in Lieu of Law No. 4 Prp of 1960 concerning Indonesian Waters (State Gazette of 1960 No. 22, Supplement to the State Gazette No. 1942).
