Penjelasan pokok persoalan:

3. Dalam memanfaatkan kekayaan alam dapat diambil cara-cara penguasaannya seperti berikut:

a. Dikerjakan langsung oleh suatu Instansi Pemerintah, penguasaan oleh Instansi Pemerintah itu terutama ditujukan untuk penyelidikan umum dan eksplorasi sebagai usaha inventarisasi kekayaan alam Indonesia dan tidak dalam arti pengusahaan untuk mencari keuntungan, karena usaha pertambangan untuk mencari keuntungan tersebut seyogyanya diserahkan kepada Perusahaan-perusahaan Tambang Negara atau Swasta. Begitupun bahan radio aktif perlu diusahakan oleh Instansi Pemerintah dan dalam hal ini adalah Badan Tenaga Atom Nasional;

b. diusahakan oleh Perusahaan Negara;

c. diusahakan dengan perusahaan atas dasar modal bersama oleh pihak Negara dengan Daerah;

3. In the utilization of natural resources, the following methods of control and operation may be adopted:

a. Direct operation by a Government Agency; such control by a Government Agency is primarily intended for general surveys and exploration as part of the effort to inventory Indonesia's natural resources, rather than for profit-oriented commercial exploitation—as profit-oriented mining operations should ideally be entrusted to State-owned or private mining companies. Similarly, the development of radioactive materials must be undertaken by a Government Agency—specifically, in this instance, the National Atomic Energy Agency;

b. Operation by a State-owned enterprise;

c. Operation by a company based on joint capital investment between the State and regional authorities;
