GOVERNMENT REGULATION IN LIEU OF LAW

BAB XI

KETENTUAN-KETENTUAN PIDANA

CHAPTER XI

PENAL PROVISIONS

 

Pasal 26

Article 26

 

(1) Dihukum dengan hukuman penjara selama-lamanya enam tahun dan/atau dengan denda setinggi-tingginya lima ratus ribu rupiah, barangsiapa yang tidak mempunyai kuasa pertambangan melakukan usaha pertambangan seperti dimaksud dalam pasal 10 dan 11.

(2) Dihukum dengan hukuman kurungan selama-lamanya satu tahun dan/atau dengan denda setinggi-tingginya lima puluh ribu rupiah, barangsiapa yang melakukan usaha pertambangan sebelum memenuhi kewajiban terhadap yang berhak atas tanah menurut Peraturan Pemerintah Pengganti Undang-undang ini.

(1) Any person who, without holding a mining authorization, conducts mining operations as referred to in Articles 10 and 11 shall be punished by imprisonment for a maximum term of six years and/or a fine not exceeding five hundred thousand rupiah.

(2) Any person who conducts mining operations prior to fulfilling obligations toward the party entitled to the land, in accordance with this Government Regulation in Lieu of Law, shall be punished by confinement for a maximum term of one year and/or a fine not exceeding fifty thousand rupiah.
