6. Untuk mencegah kekosongan dalam menghadapi pelaksanaan dari Undang-undang ini masih diperlukan ketentuan Peralihan menjelang dibuatnya peraturan lanjutan. Lagi pula beberapa peraturan pelaksanaan dalam bentuk Peraturan Pemerintah yang diharapkan dikeluarkan sesudah Undang-undang No. 37 Prp tahun 1960 diundangkan, ternyata sampai sekarang belum dikeluarkan dengan lengkap, baru beberapa Keputusan Menteri dan suatu Peraturan Pemerintah tentang Penggolongan Bahan Galian yang sudah dikeluarkan.

6. To prevent a legal vacuum during the implementation of this Law, transitional provisions are still required pending the issuance of implementing regulations. Moreover, several implementing regulations in the form of Government Regulations—which were expected to be issued following the enactment of Law Number 37 Prp of 1960—have not yet been fully issued; to date, only a few Ministerial Decrees and a single Government Regulation regarding the Classification of Mineral Materials have been promulgated.

 

Sehingga dengan mulai berlakunya Undang-undang ini mengingat belum lengkapnya peraturan-peraturan pelaksanaan, maka "Mijn Ordonnantie" dan beberapa verordeningen selama tidak bertentangan dengan Undang-undang ini dan selama belum diganti dengan peraturan-peraturan pelaksanaan baru, masih tetap berlaku disamping peraturan perundang-undangan yang dikeluarkan berdasarkan Undang-undang No. 37 Prp tahun 1960 itu. Dengan dikeluarkannya Undang-undang Pertambangan ini, Undang-undang No. 37 Prp tahun 1960 dan penjelasannya telah dicabut. Namun demikian hak-hak pertambangan serta kuasa pertambangan yang telah ada (yang berdasarkan Undang-undang No. 37 Prp tahun 1960) yang masih berlaku, akan tetap berlaku, dengan ketentuan bahwa para pemegang kuasa pertambangan tersebut dalam waktu yang sesingkat-singkatnya harus menyesuaikan diri dengan cara memenuhi syarat-syarat yang ditentukan dalam Undang-undang tentang Ketentuan-ketentuan Pokok Pertambangan ini.

Consequently, given that the implementing regulations are not yet complete upon the entry into force of this Law, the "Mijn Ordonnantie" and certain *verordeningen* (ordinances) shall remain in effect—provided they do not conflict with this Law and have not yet been replaced by new implementing regulations—alongside the legislation issued pursuant to Law Number 37 Prp of 1960. With the enactment of this Mining Law, Law Number 37 Prp of 1960 and its elucidation are repealed. Nevertheless, existing mining rights and mining authorizations (granted under Law Number 37 Prp of 1960) that remain valid shall continue in effect, subject to the requirement that the holders of such mining authorizations must, as soon as possible, bring themselves into compliance by satisfying the conditions stipulated in this Law concerning Basic Mining Provisions.
