ATAS

UNDANG-UNDANG No. 11 TAHUN 1967

Tentang

KETENTUAN-KETENTUAN POKOK PERTAMBANGAN

ELUCIDATION

OF

ACT NUMBER 11 OF 1967

Regarding

BASIC PROVISIONS ON MINING

 

Pasal 33.

Ketentuan ini diperlukan agar pelanggaran terhadap keputusan Menteri dapat dihukum, karena keputusan Menteri yang terpisah sendiri tidak dapat memuat ancaman hukuman.

Article 33.

This provision is necessary so that violations of the Minister's decision can be punished, because a separate Minister's decision itself cannot contain the threat of punishment.

Pasal 35.

Maksud Undang-undang ini ialah untuk merubah seluruh per-aturan pertambangan dari masa penjajahan dan dari suatu zaman di mana di Indonesia pernah berkembang alam pikiran-pikiran pada para penguasa bahwa semua pertambangan harus dilakukan oleh Pemerintah, alam pikiran mana tidak sesuai dengan kepentingan Nasional. Selanjutnya untuk jangka waktu tertentu perlu diadakan suatu masa peralihan untuk penyesuaian.

Article 35.

The purpose of this Law is to overhaul all mining regulations dating from the colonial era and from a period when the prevailing mindset among those in power in Indonesia held that all mining operations had to be conducted by the Government—a mindset incompatible with the national interest. Furthermore, a transitional period is required to facilitate the necessary adjustments.
