Pasal 6 dan 9.
Dengan pasal 6 dan pasal 9 ini ditegaskan pengusahaan
masing-masing bahan galian.
Bahan galian golongan a hanya dapat diusahakan oleh
Negara atau Negara bersama Daerah; golongan b boleh oleh pihak Swasta atau
dalam bentuk perusahaan yang modalnya adalah modal bersama, golongan c dan
bahan-bahan galian yang tidak disebut dalam Peraturan Pemerintah Pelaksana
Undang-undang ini diserahkan pengaturannya kepada Pemerintah Daerah Tingkat I.
Usaha yang dilakukan oleh Negara dapat berbentuk:
a. Pekerjaan kedinasan atau penugasan Negara kepada salah
satu Instansi Pemerintah terutama Instansi Pemerintah ini akan diberi tugas
dalam inventarisasi kekayaan alam Indonesia, penyelidikan geologi, penyelidikan
umum, eksplorasi dan pembukaan proyek baru.
b. Perusahaan Negara. Usaha yang dilakukan oleh Daerah
berbentuk Perusahaan Daerah, yaitu semacam Perusahaan yang dibentuk dan
diadakan oleh Pemerintah Daerah, baik Daerah Tingkat I atau Tingkat II.
Dalam
pada itu, Pemerintah Pusat dan Pemerintah Daerah dapat pula mendirikan suatu
Perusahaan dengan modal bersama.

establish the framework for the exploitation of specific categories of mineral
resources.
Category A
mineral resources may only be exploited by the State or by the State jointly
with a Regional Government; Category B resources may be exploited by the
private sector or through joint-capital enterprises; and the regulation of
Category C resources—as well as any mineral resources not explicitly listed in
the Government Regulation implementing this Law—is delegated to the First-Level
Regional Government.
Operations
undertaken by the State may take the following forms:
a. Official government
activities or State assignments to a specific government agency; such agencies
are primarily tasked with inventorying Indonesia's natural resources,
conducting geological surveys and general prospecting, and carrying out
exploration and the initiation of new projects.
b. State-owned
enterprises. Operations undertaken by a Region take the form of Regional
Enterprises—entities established and organized by the Regional Government,
whether at the First-Level or Second-Level.
Furthermore, the Central Government and
Regional Governments may also jointly establish an enterprise using shared
capital.
