5) Pemegang IUP Operasi Produksi dan IUPK Operasi
Produksi wajib melakukan perubahan atas rencana Pascatambang yang telah
disetujui apabila terjadi perubahan atas:
a) Tata guna lahan;
b) Dokumen studi kelayakan; dan/atau
c) Dokumen Lingkungan Hidup yang telah disetujui oleh
instansi yang berwenang sesuai dengan ketentuan peraturan perundang-undangan di
bidang perlindungan dan pengelolaan lingkungan hidup.
6) Perubahan rencana Pascatambang disampaikan kepada
Menteri melalui Direktur Jenderal atau gubernur sesuai dengan kewenangannya
dalam jangka waktu paling lambat 2 (dua) tahun sebelum akhir kegiatan
Penambangan.
7) Direktur Jenderal atas nama Menteri atau gubernur
sesuai dengan kewenangannya memberikan penilaian dan persetujuan atas perubahan
rencana Pascatambang dalam jangka waktu paling lama 90 (sembilan puluh) hari
kalender sejak diterimanya perubahan rencana Pascatambang, tidak termasuk
jumlah hari yang diperlukan untuk penyempurnaan perubahan rencana Pascatambang.

5) Holders of
Production Operation Mining Business Permits and Special Production Operation
Mining Business Permits are required to amend the approved Post-Mining plan if
there are changes to:
a) Land use;
b)
Feasibility study documents; and/or
c)
Environmental Documents approved by the authorized agency in accordance with
the provisions of laws and regulations on environmental protection and
management.
6) Amendments
to the Post-Mining plan must be submitted to the Minister through the Director
General or the governor in accordance with their authority no later than 2
(two) years before the end of mining activities.
7) The
Director General, on behalf of the Minister or governor in accordance with
their authority, shall assess and approve the amendments to the Post-Mining
plan within a maximum of 90 (ninety) calendar days from the date of receipt of
the amendments to the Post-Mining plan, excluding the number of days required
to finalize the amendments to the Post-Mining plan. (page 236)
