9. IMPLEMENTATION OF
RECLAMATION AND POST-MINING (page 48)
a. Ketentuan
1) Pemegang IUP tahap kegiatan Eksplorasi, pemegang IUP tahap
kegiatan Operasi Produksi, pemegang IUPK tahap kegiatan Eksplorasi, dan
pemegang IUPK tahap kegiatan Operasi Produksi wajib melaksanakan Reklamasi
sesuai dengan rencana Reklamasi yang telah disetujui.
2) Pemegang IUP tahap kegiatan Operasi Produksi dan pemegang
IUPK tahap kegiatan Operasi Produksi wajib melaksanakan Pascatambang sesuai
dengan rencana Pascatambang yang telah disetujui.
3) Pelaksanaan Reklamasi dan Pascatambang dipimpin oleh
Kepala Teknik Tambang, khusus untuk penyelesaian Pascatambang setelah IUP atau
IUPK berakhir dipimpin oleh orang yang ditunjuk oleh direksi eks pemegang IUP
atau pemegang IUPK.
4) Dalam hal pelaksanaan Reklamasi dan/atau Pascatambang
dilaksanakan oleh pihak ketiga, pelaksanaan dipimpin oleh orang yang ditunjuk
oleh direksi pihak ketiga.
a. Provisions
1) Holders of Mining
Business Permits during the Exploration phase, holders of Mining Business
Permits during the Production Operation phase, holders of Special Mining
Business Permits during the Exploration phase, and holders of Special Mining
Business Permits during the Production Operation phase are required to carry
out Reclamation in accordance with the approved Reclamation plan.
2) Holders of Mining
Business Permits during the Production Operation phase and holders of Special
Mining Business Permits during the Production Operation phase are required to
carry out Post-Mining in accordance with the approved Post-Mining plan.
3) Reclamation and
Post-Mining implementation is led by the Head of Mining Engineering.
Post-Mining completion after the Mining Business Permit or Special Mining
Business Permit expires is led by a person appointed by the board of directors
of the former Mining Business Permit or Special Mining Business Permit holder.
4) If Reclamation
and/or Post-Mining implementation is carried out by a third party, the
implementation is led by a person appointed by the board of directors of the
third party.
