b. Pelaksanaan Reklamasi
3) Pelaksanaan Reklamasi pada eks WIUP dan eks WIUPK yang
memenuhi kriteria untuk diusahakan kembali Dalam hal eks WIUP dan eks WIUPK
telah memenuhi kriteria untuk diusahakan kembali wilayahnya melalui mekanisme:
a) Lelang WIUP dan WIUPK Mineral Logam dan Batubara;
b) Pemberian prioritas WIUP dan WIUPK Mineral Logam dan
Batubara;
c) Permohonan WIUP Mineral Bukan Logam dan Batuan; atau
d) Perluasan WIUP atau WIUPK Mineral Logam dan Batubara,
Eks
pemegang WIUP atau pemegang WIUPK wajib melaksanakan kegiatan Reklamasi sesuai
dokumen rencana Reklamasi yang telah disetujui sampai dengan diterbitkannya
IUP, IUPK, atau penyesuaian perluasan WIUP atau WIUPK.
4) Pelaksanaan Reklamasi hingga mencapai tingkat keberhasilan
100% (seratus persen) pada eks WIUP dan eks WIUPK sebagaimana dimaksud pada
angka 3) menjadi kewajiban pihak yang mengusahakan kembali.
b.
Reclamation Implementation
3)
Reclamation implementation in former Mining Business Permit Areas and former
Special Mining Business Permit Areas that meet the criteria for
re-exploitation. In the case of former Mining Business Permit Areas and former
Special Mining Business Permit Areas that have met the criteria for
re-exploitation, the following mechanisms will be implemented:
a)
Auction of Mining Business Permit Areas and Special Mining Business Permit
Areas for Metallic Minerals and Coal;
b)
Prioritization of Mining Business Permit Areas and Special Mining Business
Permit Areas for Metallic Minerals and Coal;
c)
Application for Mining Business Permit Areas for Non-Metallic Minerals and
Rocks; or
d)
Expansion of Mining Business Permit Areas or Special Mining Business Permit
Areas for Metal Minerals and Coal.
Former holders of Mining
Business Permit Areas or Special Mining Business Permit Areas are required to
carry out Reclamation activities in accordance with the approved Reclamation
plan document until the Mining Business Permit, Special Mining Business Permit,
or adjustments to the expansion of the Mining Business Permit Area or Special
Mining Business Permit Area are issued.
4)
Implementation of Reclamation until a 100% (one hundred percent) success rate
is achieved in former Mining Business Permit Areas and former Special Mining
Business Permit Areas as referred to in point 3) is the responsibility of the
re-operating party.
