b. Pelaksanaan Reklamasi

1) Pelaksanaan Reklamasi Tahap kegiatan Eksplorasi

a) Pemegang IUP tahap kegiatan Eksplorasi atau pemegang IUPK tahap kegiatan Eksplorasi wajib melaksanakan Reklamasi yang telah disetujui pada lahan terganggu.

b) Lahan terganggu sebagaimana dimaksud pada huruf a) meliputi lahan bekas kegiatan Eksplorasi yang tidak digunakan lagi pada masa Operasi Produksi.

c) Lahan bekas kegiatan Eksplorasi terdiri atas: (1) lahan bekas Eksplorasi; dan (2) lahan bekas fasilitas penunjang Eksplorasi.

d) Pelaksanaan Reklamasi tahap kegiatan Eksplorasi dilakukan segera setelah kegiatan Eksplorasi berakhir.

e) Dalam hal terdapat realisasi bukaan lahan pada tahun tertentu yang melebihi rencana bukaan lahan yang telah disetujui dalam dokumen rencana Reklamasi tahap kegiatan Eksplorasi, kelebihan bukaan lahan tersebut wajib dijaminkan melalui mekanisme perubahan rencana Reklamasi tahap kegiatan Eksplorasi yang telah disetujui atau dalam penyusunan rencana Reklamasi tahap kegiatan Eksplorasi periode berikutnya.

b. Reclamation Implementation

1) Reclamation Implementation during the Exploration Phase

a) Holders of Mining Business Permits during the Exploration phase or holders of Special Mining Business Permits during the Exploration phase are required to implement approved reclamation on disturbed land.

b) Disturbed land as referred to in letter a) includes land previously used for exploration activities that is no longer used during the Production Operations period.

c) Land previously used for exploration activities consists of: (1) land previously used for exploration activities; and (2) land previously used for exploration support facilities.

d) Reclamation implementation during the Exploration phase is carried out immediately after the end of exploration activities.

e) If land clearance in a given year exceeds the land clearance plan approved in the Exploration phase Reclamation plan document, the excess land clearance must be secured through a mechanism to amend the approved Exploration phase Reclamation plan or in the preparation of the subsequent Exploration phase Reclamation plan.
