9. IMPLEMENTATION OF
RECLAMATION AND POST-MINING (page 48)
c. Pelaksanaan Pascatambang
1) Pascatambang dimulai setelah akhir sebagian atau seluruh
kegiatan usaha Pertambangan dan tidak melebihi masa berlaku IUP tahap kegiatan
Operasi Produksi atau IUPK tahap kegiatan Operasi Produksi.
2) Penyelesaian Pascatambang paling lambat 5 (lima) tahun
setelah IUP tahap kegiatan Operasi Produksi atau IUPK tahap kegiatan Operasi
Produksi berakhir dan dapat diperpanjang 1 (satu) kali paling lambat 3 (tiga)
tahun.
3) Dalam hal pemantauan hasil pelaksanaan Pascatambang sesuai
dengan Dokumen Lingkungan Hidup lebih dari 8 (delapan) tahun, tetap menjadi
tanggung jawab eks pemegang IUP tahap kegiatan Operasi Produksi atau pemegang
IUPK tahap kegiatan Operasi Produksi kepada Instansi yang menerbitkan
persetujuan Dokumen Lingkungan Hidup.
4) Dalam hal eks WIUP dan eks WIUPK telah memenuhi kriteria
untuk diusahakan kembali wilayahnya melalui mekanisme:
a) Lelang WIUP dan WIUPK Mineral Logam dan Batubara;
b) Pemberian prioritas WIUP dan WIUPK Mineral Logam dan
Batubara;
c) Permohonan WIUP Mineral Bukan Logam dan Batuan; atau
d) Perluasan WIUP atau WIUPK Mineral Logam dan Batubara,
Eks
pemegang WIUP atau pemegang WIUPK wajib melaksanakan kegiatan Pascatambang
sesuai dokumen rencana Pascatambang yang telah disetujui sampai dengan
diterbitkannya IUP, IUPK, atau penyesuaian perluasan WIUP atau WIUPK.
5) Pelaksanaan Pascatambang hingga mencapai tingkat
keberhasilan 100% (seratus persen) pada eks WIUP dan eks WIUPK sebagaimana
dimaksud pada angka 4) menjadi kewajiban pihak yang mengusahakan kembali.
c. Post-Mining
Implementation
1) Post-mining begins
after the completion of some or all mining business activities and does not
exceed the validity period of the Mining Business Permit for the Production
Operations stage or the Special Mining Business Permit for the Production
Operations stage.
2) Post-mining must be
completed no later than 5 (five) years after the Mining Business Permit for the
Production Operations stage or the Special Mining Business Permit for the
Production Operations stage expires and may be extended once for a maximum of 3
(three) years.
3) If monitoring of
Post-mining implementation results in accordance with the Environmental
Document for more than 8 (eight) years remains the responsibility of the former
holder of the Mining Business Permit for the Production Operations stage or the
holder of the Special Mining Business Permit for the Production Operations
stage to the Agency that issued the Environmental Document approval.
4) If a former Mining
Business Permit Area and a former Special Mining Business Permit Area have met
the criteria for re-operation through the following mechanisms:
a) Auction of Mining
Business Permit Areas and Special Mining Business Permit Areas for Metallic
Minerals and Coal;
b) Prioritization of
Mining Business Permit Areas and Special Mining Business Permit Areas for
Metallic Minerals and Coal;
c) Application for a
Mining Business Permit Area for Non-Metallic Minerals and Rocks; or
d) Expansion of a
Mining Business Permit Area or Special Mining Business Permit Area for Metallic
Minerals and Coal,
The former holder of a Mining Business
Permit Area or holder of a Special Mining Business Permit Area is required to
carry out post-mining activities in accordance with the approved post-mining
plan document until the issuance of a Mining Business Permit, Special Mining
Business Permit, or adjustment to the expansion of the Mining Business Permit
Area or Special Mining Business Permit Area.
5) Implementation of
Post-Mining until a success rate of 100% (one hundred percent) is achieved in
former Mining Business Permit Areas and former Special Mining Business Permit
Areas as referred to in point 4) is the obligation of the party re-operating.
