6. MECHANISM FOR
SUBMISSION, EVALUATION AND APPROVAL OF POST-MINING PLANS (page 45)
g. Direktur Jenderal atau gubernur sesuai dengan
kewenangannya memberikan perintah penempatan Jaminan Pascatambang dalam jangka
waktu paling lambat 20 (dua puluh) hari kerja;
h. Dalam hal permohonan perintah penempatan Jaminan
Pascatambang belum memenuhi ketentuan, Direktur Jenderal atau gubernur sesuai
dengan kewenangannya menyampaikan hasil evaluasi perintah penempatan Jaminan
Pascatambang kepada pemegang IUP tahap kegiatan Operasi Produksi atau pemegang
IUPK tahap kegiatan Operasi Produksi untuk diperbaiki;
i. Pemegang IUP tahap kegiatan Operasi Produksi atau pemegang
IUPK tahap kegiatan Operasi Produksi wajib menyampaikan kembali permohonan
perintah penempatan Jaminan Pascatambang yang telah diperbaiki sebagaimana
dimaksud pada huruf h kepada Direktur Jenderal atau gubernur sesuai dengan
kewenangannya dalam jangka waktu paling lambat 20 (dua puluh) hari kerja sejak
tanggal pengembalian.
g. The Director General
or the governor, in accordance with their authority, shall issue an order for
the placement of the Post-Mining Guarantee within a maximum period of 20
(twenty) working days;
h. If the application
for the order for the placement of the Post-Mining Guarantee does not meet the
requirements, the Director General or the governor, in accordance with their
authority, shall submit the results of the evaluation of the order for the placement
of the Post-Mining Guarantee to the holder of a Mining Business Permit at the
Production Operation stage or the holder of a Special Mining Business Permit at
the Production Operation stage for correction;
i. The holder of a
Mining Business Permit at the Production Operation stage or the holder of a
Special Mining Business Permit at the Production Operation stage must resubmit
the revised application for the order for the placement of the Post-Mining
Guarantee as referred to in letter h to the Director General or the governor,
in accordance with their authority, within a maximum period of 20 (twenty)
working days from the date of return.
