6. MECHANISM FOR
SUBMISSION, EVALUATION AND APPROVAL OF POST-MINING PLANS (page 45)
d. Pemegang IUP tahap kegiatan Operasi Produksi atau pemegang
IUPK tahap kegiatan Operasi Produksi wajib menyampaikan kembali rencana
Pascatambang yang telah diperbaiki kepada Direktur Jenderal atau gubernur
sesuai dengan kewenangannya dalam jangka waktu paling lambat 20 (dua puluh)
hari kerja sejak tanggal pengembalian;
e. Persetujuan rencana Pascatambang termasuk di dalamnya
penetapan besaran Jaminan Pascatambang dan jadwal penempatannya;
f. Dalam hal pemegang IUP tahap kegiatan Operasi Produksi dan
pemegang IUPK tahap kegiatan Operasi Produksi telah mendapatkan persetujuan
rencana Pascatambang sebelum beralihnya kewenangan dari Pemerintah Daerah
Provinsi kepada Pemerintah Pusat dan belum menempatkan Jaminan Pascatambang,
pemegang IUP tahap kegiatan Operasi Produksi atau pemegang IUPK tahap kegiatan
Operasi Produksi wajib menyampaikan permohonan perintah penempatan Jaminan
Pascatambang kepada Direktur Jenderal atau gubernur sesuai kewenangannya dengan
dilengkapi:
1) dokumen rencana Pascatambang yang telah disetujui;
2) persetujuan rencana Pascatambang; dan
3) surat pernyataan kebenaran dokumen yang ditandatangani
oleh direksi di atas meterai.
d. Holders of Mining
Business Permits in the Production Operations phase or holders of Special
Mining Business Permits in the Production Operations phase must resubmit the
revised Post-Mining plan to the Director General or the governor in accordance
with their authority within a maximum of 20 (twenty) working days from the date
of return;
e. Approval of the
Post-Mining plan, including the determination of the amount of the Post-Mining
Guarantee and the schedule for its placement;
f. If holders of Mining
Business Permits in the Production Operations phase or holders of Special
Mining Business Permits in the Production Operations phase have received
approval for their Post-Mining plan before the transfer of authority from the
Provincial Government to the Central Government and have not yet placed the
Post-Mining Guarantee, the holders of Mining Business Permits in the Production
Operations phase or holders of Special Mining Business Permits in the
Production Operations phase must submit a request for an order to place the
Post-Mining Guarantee to the Director General or the governor in accordance
with their authority, accompanied by:
1) the approved
Post-Mining plan document;
2) approval of the
Post-Mining plan; and
3) a statement of the
document's authenticity signed by the board of directors on a stamped paper.
