a. Pelaporan Reklamasi dan Pencairan Jaminan Reklamasi

A. Reclamation Reporting and Disbursement of Reclamation Guarantees

 

1) Pelaporan Reklamasi tahap kegiatan Eksplorasi dan Pencairan Jaminan Reklamasi tahap kegiatan Eksplorasi:

1) Reporting of Reclamation activities at the Exploration stage and Disbursement of Reclamation Guarantees at the Exploration stage:

 

d) Penyampaian laporan pelaksanaan Reklamasi sebagaimana dimaksud pada huruf a) di atas disampaikan melalui sistem informasi;

e) Direktur Jenderal atau gubernur sesuai kewenangannya sebelum memberikan persetujuan pencairan Jaminan Reklamasi tahap kegiatan Eksplorasi wajib melakukan peninjauan lapangan;

f) Direktur Jenderal atau gubernur sesuai dengan kewenangannya dapat melakukan peninjauan lapangan melalui pihak ketiga yang diusulkan oleh pemegang IUP atau pemegang IUPK tahap kegiatan Eksplorasi;

g) Direktur Jenderal menetapkan daftar pihak ketiga yang dapat melakukan peninjauan lapangan penilaian keberhasilan pelaksanaan kegiatan Reklamasi;

h) Biaya yang diperlukan dalam pelaksanaan peninjauan lapangan penilaian keberhasilan kegiatan Reklamasi oleh pihak ketiga dibebankan pada masing-masing pemegang IUP atau pemegang IUPK;

i) Kriteria dan persyaratan pihak ketiga sebagai pelaksana peninjauan lapangan dalam rangka penilaian keberhasilan Reklamasi sebagaimana tercantum dalam Lampiran IV;

j) Evaluasi terhadap laporan pelaksanaan Reklamasi tahap kegiatan Eksplorasi dilaksanakan dengan berpedoman pada Kriteria Keberhasilan Reklamasi Tahap kegiatan Eksplorasi tercantum dalam format 4;

k) Pencairan Jaminan Reklamasi tahap kegiatan Eksplorasi sesuai dengan tingkat keberhasilan dan dapat dilakukan setelah hasil penilaian mencapai nilai akhir keberhasilan minimal 60% (enam puluh persen) sesuai dengan format 15.

d) Submission of the Reclamation implementation report as referred to in letter a) above is submitted through the information system;

e) The Director General or the governor, in accordance with their authority, must conduct a field review before approving the disbursement of the Reclamation Guarantee for the Exploration phase;

f) The Director General or the governor, in accordance with their authority, may conduct a field review through a third party proposed by the Mining Business Permit holder or Special Mining Business Permit holder for the Exploration phase;

g) The Director General shall determine a list of third parties who may conduct field reviews to assess the success of Reclamation activities;

h) Costs required for conducting field reviews to assess the success of Reclamation activities by third parties shall be borne by each Mining Business Permit holder or Special Mining Business Permit holder;

i) The criteria and requirements for third parties to implement field reviews for assessing the success of Reclamation are as set out in Appendix IV;

j) Evaluation of the Reclamation implementation report for the Exploration phase shall be conducted based on the Reclamation Success Criteria for the Exploration Phase, as listed in format 4;

k) Disbursement of Reclamation Guarantees for the Exploration activity stage is in accordance with the level of success and can be carried out after the assessment results reach a final success value of at least 60% (sixty percent) in accordance with format 15.
