BASIC PROVISIONS

BAB VII
BERAKHIRNYA KUASA
PERTAMBANGAN
CHAPTER VII
END OF MINING POWER
Pasal 24
Article 24
(1) Jika Kuasa pertambangan berakhir karena hal-hal termaksud
dalam pasal 21, 22 ayat (1) dan pasal 23, maka:
a. segala beban yang diberatkan kepada kuasa
pertambangan batal menurut hukum;
b. Wilayah kuasa pertambangan kembali kepada kekuasaan
Negara.
c. segala sesuatu yang diperlukan untuk pengamanan
bangunanbangunan tambang dan kelanjutan pengambilan bahan-bahan galian menjadi
hak Negara tanpa penggantian kerugian kepada pemegang kuasa pertambangan;
d. perusahaan atau perseorangan yang memegang kuasa
pertambangan itu diharuskan menyerahkan semua klise dan bahan-bahan peta,
gambar-gambar ukuran tanah dan sebagainya yang bersangkutan dengan usaha
pertambangan kepada Menteri dengan tidak menerima ganti kerugian.
(2) Menyimpang dari bunyi ayat (1) pasal ini, maka bilamana
kuasa pertambangan dibatalkan untuk kepentingan Negara, maka kepadanya diberi
ganti kerugian yang wajar.
(3) Menteri menetapkan waktu dalam mana pemegang kuasa
pertambangan terakhir diberi kesempatan untuk mengangkat segala sesuatu yang
menjadi hak miliknya. Segala sesuatu yang belum diangkat dalam waktu tersebut
menjadi milik Negara.
(1) If the mining
authorization ends due to the matters referred to in articles 21, 22 paragraph
(1) and article 23, then:
a. all burdens
imposed on the mining authority are void according to law;
b. The mining
jurisdiction returns to state control.
c. everything
necessary for the security of mining buildings and the continued extraction of
excavated materials becomes the right of the State without compensation to the holder
of the mining authority;
d. The company
or individual holding the mining authority is required to submit all maps and
map materials, land measurement drawings and so on related to the mining
business to the Minister without receiving compensation.
(2) Notwithstanding
paragraph (1) of this article, if a mining authorization is canceled in the
interests of the State, reasonable compensation shall be given to him.
(3) The Minister
determines the time within which the last mining authorization holder is given
the opportunity to appoint everything that is his or her right. Everything that
has not been removed within that time becomes the property of the State.
