CHAPTER III
FORM AND ORGANIZATION OF MINING COMPANIES
Pasal 12
Article 12
(1) Kuasa Pertambangan untuk pelaksanaan usaha pertambangan
bahan-bahan galian yang tersebut dalam pasal 3 ayat (1) huruf b dapat diberikan
kepada :
a. Badan Hukum Kopersi.
b. Badan Hukum Swasta yang didirikan sesuai dengan
peraturan-peraturan Republik Indonesia bertempat kedudukan di Indonesia dan
bertujuan berusaha dalam lapangan pertambangan dan pengurusnya mempunyai
kewarganegaraan Indonesia dan bertempat tinggal di Indonesia.
c. Perseorangan yang berkewarganegaraan Indonesia dan
bertempat tinggal di Indonesia.
(2) Khusus untuk usaha eksploitasi, sebelum diberikan kuasa
pertambangan kepada pihak termaksud dalam ayat (1) pasal ini, haruslah didengar
lebih dahulu pendapat dari suatu Dewan Pertambangan, yang pembentukan dan
penentuan susunannya akan diatur oleh Pemerintah.

Mining Authorization for conducting mining operations regarding the mineral
materials referred to in Article 3, paragraph (1), letter b, may be granted to:
a. A cooperative
legal entity.
b. A private legal entity
established in accordance with the regulations of the Republic of Indonesia,
domiciled in Indonesia, and having the objective of conducting business in the
mining sector, provided that its management personnel hold Indonesian
citizenship and reside in Indonesia.
c. An
individual holding Indonesian citizenship and residing in Indonesia.
(2)
Specifically regarding exploitation operations, prior to the granting of Mining
Authorization to the parties referred to in paragraph (1) of this Article, the
opinion of a Mining Council must first be obtained; the establishment and
composition of said Council shall be regulated by the Government.
