BAB I
KETENTUAN UMUM
CHAPTER I
GENERAL
PROVISIONS
Pasal 5
(1) Penyelenggaraan PB sebagaimana dimaksud dalam Pasal 2
ayat (2) huruf b dan/atau PB UMKU sebagaimana dimaksud dalam Pasal 2 ayat (2)
huruf c meliputi sektor:
d. energi dan sumber daya mineral;

Pasal 143
(1) PB sektor energi dan sumber daya mineral meliputi
subsektor:
c. mineral dan batubara; dan
(2) PB UMKU sektor energi dan sumber daya mineral meliputi
penunjang operasional dan/atau komersial kegiatan usaha yang terdiri atas
subsektor:
c. mineral dan batubara;
(3) Kewajiban pemenuhan persyaratan dasar berupa KKPR
sebagaimana dimaksud dalam Pasal 12 ayat (1) huruf a dikecualikan untuk PB
dalam tahap survei dan tahap eksplorasi subsektor energi baru, terbarukan, dan
konservasi energi, serta tahap kegiatan eksplorasi pada subsektor mineral dan
batubara.

(1)
Business Licensing in the energy and mineral resources sector includes the
following subsectors:
c. minerals and coal; and
(2)
Business Licensing to Support Business Activities in the energy and mineral
resources sector includes operational and/or commercial support for business
activities, consisting of the following subsectors:
c. minerals and coal;
(3) The
obligation to fulfill basic requirements in the form of Approval of Conformity
for Spatial Utilization Activities as referred to in Article 12 paragraph (1)
letter a is exempted for Business Licensing in the survey and exploration stages
of the new, renewable energy, and energy conservation subsectors, as well as
the exploration activity stage in the minerals and coal subsector.

Energy and
Mineral Resources Sector
Pasal 270
(1) Pengawasan terhadap PB dan/atau PB UMKU pada sektor
energi dan sumber daya mineral dilakukan oleh:
a. menteri yang menyelenggarakan urusan pemerintahan di
bidang energi dan sumber daya mineral;
(2) Kewenangan Pengawasan sebagaimana dimaksud pada ayat (1)
dilakukan oleh aparatur sipil negara bidang energi dan sumber daya mineral
sesuai dengan ketentuan peraturan perundang-undangan.

(1)
Supervision of Business Licensing and/or Business Permits to Support Business
Activities in the energy and mineral resources sector is carried out by:
a. the
minister who oversees government affairs in the energy and mineral resources
sector;
(2)
Supervisory authority as referred to in paragraph (1) is carried out by state
civil servants in the energy and mineral resources sector in accordance with
the provisions of laws and regulations.
Pasal 271
Dalam melaksanakan Pengawasan sebagaimana dimaksud
dalam Pasal 270, menteri yang menyelenggarakan urusan pemerintahan di bidang
energi dan sumber daya mineral dapat mendelegasikan dan/atau melimpahkan kepada
Pemerintah Daerah untuk melaksanakan Pengawasan sesuai dengan ketentuan
peraturan perundang-undangan.

In
implementing Supervision as referred to in Article 270, the minister in charge
of government affairs in the energy and mineral resources sector may delegate
and/or delegate to Regional Governments the responsibility for Supervision in
accordance with statutory provisions.
Pasal 272
Ketentuan mengenai tata cara pelaksanaan Pengawasan
terhadap PB dan/atau PB UMKU sebagaimana dimaksud dalam Pasal 270, kompetensi,
dan peningkatan kapasitas pengawas pada sektor energi dan sumber daya mineral
diatur dalam peraturan menteri yang menyelenggarakan urusan pemerintahan di
bidang energi dan sumber daya mineral.
Article 272
Provisions
regarding the procedures for implementing supervision of business permits
and/or permits to support business activities as referred to in Article 270,
the competence, and capacity building of supervisors in the energy and mineral
resources sector are regulated in the regulations of the minister responsible
for government affairs in the energy and mineral resources sector.

Pasal 372
(1) Dalam hal ketidaksesuaian atau pelanggaran sebagaimana
dimaksud dalam Pasal 371 mengakibatkan timbulnya korban dan/atau kerusakan
terhadap:
menteri yang menyelenggarakan urusan pemerintahan di
bidang energi dan sumber daya mineral atau gubernur sesuai dengan wilayah
kerjanya mengenakan sanksi administratif berupa pembekuan kegiatan sementara
atau pencabutan PB dan/atau PB UMKU.

(1) In
the event that non-compliance or violation as referred to in Article 371
results in victims and/or damage to:
the
minister who carries out government affairs in the field of energy and mineral
resources or the governor in accordance with their work area shall impose
administrative sanctions in the form of temporary suspension of activities or
revocation of Business Permits and/or Business Permits to Support Business
Activities.
Pasal 374
(1) Setiap Pelaku Usaha yang berdasarkan hasil Pengawasan
ditemukan ketidaksesuaian atau pelanggaran terhadap PB dan/atau PB UMKU pada
subsektor mineral dan batubara, dikenai sanksi administratif berupa:

Every Business Actor who, based on the results of Supervision, is found to have
non-compliance or violations of PB and/or Business Permits to Support Business
Activities in the mineral and coal sub-sector, shall be subject to
administrative sanctions in the form of:
Pasal 382
(1) Pengenaan sanksi administratif sebagaimana dimaksud dalam
Pasal 369 ayat (1), Pasal 370, Pasal37I, Pasal 374 ayat (1), Pasal 376 ayat
(3), Pasal 377 ayat (2), Pasal 378, dan Pasal 380 dilaksanakan oleh menteri
yang menyelenggarakan urusan pemerintahan di bidang energi dan sumber daya
mineral, gubernur, bupati/wali kota, kepala Administrator KEK, atau kepala
Badan Pengusahaan KPBPB sesuai dengan kewenangan masing-masing berdasarkan
ketentuan peraturan perundang-undangan.
(2) Ketentuan mengenai tata cara pengenaan sanksi
administratif, mekanisme, jangka waktu, upaya administratif, dan pejabat yang
berwenang diatur dengan peraturan menteri yang menyelenggarakan urusan
pemerintahan di bidang energi dan sumber daya mineral.

382
(1) The
imposition of administrative sanctions as referred to in Article 369 paragraph
(1), Article 370, Article 37I, Article 374 paragraph (1), Article 376 paragraph
(3), Article 377 paragraph (2), Article 378, and Article 380 shall be
implemented by the minister who administers government affairs in the energy
and mineral resources sector, the governor, regent/mayor, head of the Special
Economic Zone Administrator, or head of the Free Trade Zone and Free Port Authority
in accordance with their respective authorities based on provisions of laws and
regulations.
(2)
Provisions regarding the procedures for imposing administrative sanctions,
mechanisms, timeframes, administrative measures, and authorized officials are regulated
by regulations of the minister who administers government affairs in the energy
and mineral resources sector.

dimaksud dengan "Lampiran II" adalah Lampiran II PB UMKU sektor
energi dan sumber daya mineral yang mengatur mengenai lzin pengusahaan air
tanah.

means Attachment II to Business Licensing to Support Business Activities in the
energy and mineral resources sector, which regulates groundwater business
permits.
